71-1679 APPROVAL dF MINUTES
On motion of Supervisor Gilman, seconded by Supervisor Maxon
and unanimously carried, the minutes of August 24, 1971 were approved as mailed.
71-1680 COMMUNICATIONS
.]oho Jaekel, Chico. Mr. 3aekel writes on several matters including use of Counsel
Q ~•~~ in certain matters, attendance at P.G< & $. orientation meetings, and
thQ levee in the Butte Basin Project. Information.
Gridley Medical Group, Inc. The four doctors who comprise the group write that the
~ OO Macey Ambulance Service in Gridley has done a fine job and they request
S ~ the Board consider renewal of their contract on a four.~year basis. They
ask that they be given.an opportunity to review the bids prior to award,
Information. Will be discussed later in the meeting.
Mrs. Shirley M. Heffernan, Orinda. Mrs. Heffernan writes to protest the taxes on her
property in Butte County and lists amounts of taxes from 1961 thru 1971
'•~ and requests reply to her letter. Referred to Assessor.
Goldstein, Barceloux and Goldstein, The Attorneys request information regarding
insurance carriers, compensation and auto liability for the Butte County
` Z ~, OO Economic Opportunity Council, Inc. Referred to Administrative Officer
and County Counsel.
Paradise Chamber of Commerce. The Chamber requests an ordinance be enacted to prohibit
sale of used cars and other items qn the county property in front of the
0 3 r d Paradise Recreation Center on the Skyway. Letter discussed; no action
.taken at this time. Letter to be answered by County•Counsel.
L. H. Casagrande, executive officer, Region III, CCCJ. Mr. Casagrande forwards copy
of his letter to California Council on Criminal Justice, Juvenile
Q Delinquency Task Force, stating that conditions required to be met on the
I ?i ~• "Earadise for Youth" project have been met and stating that Region C
is recommending the proposal be refunded for the second year.

Superior California Water Association. The Association sends notice of meeting to be

California Taxpayers' Association. The Association forwards copy of the recently

71-1681 MATTERS D:CSCUSSED BY BOARD MEMBERS
Supervisor Maxon requested that the Administrative Officex obtain the
tax increases from other Counties throughout the State> Mr. Nickelson
stated that he: would obtain their tax increase schedules and present to the Board
for the Board`s considerations
Supervisor Madigan commented on a letter to a newspaper editor from a
person in Paradise that concerns people takiang garbage to the Neal•Road disposal site.
1t was stated rhat County Counsel was working on an ordinance regulating this matter.
People should be made aware that they cannot haul garbage and allow the debris to fly off .
their cars or trucks. Dan•-BTackstock, County Counsel, cited various sections of the
Government Code that would apply to this matter. Mr. Blackstock was requested to•write
a letter to the Sheriff explaining action that should be taken,
Supervisor Gilman stated he had a letter from James L, Fox concerning
Stewart Avenue, Chico, inspection work, Letter referred to the Public Works Directox.
Chairman Reynolds stated that he had received a letter last week
from people in the Gridley area setting forth their appreciation for the Gridley pool.
They express their thanks for the opportunity of being able to use this pool and
expressing their pleasure in having such a nice pool to use, Discussed; no action

Clay-Castleberry, Director of. Public Works, reported on the Neal Road
disposal bids for equipment rental and fill material as follows<

Mr. Castleberry said that Norman Francis of Gridley was the. lowest
bidder for Cat rental, Mr. Castleberry said he would not ask for approval of this
hid at this time, Chairman Reynolds felt the County could buy or lease a cat
for 3 years cheaper than "they could going along with these bids. Chairman
Reynolds explained his thinking in this matter, He felt the costs would be too
high at tine figure quoted in the bid. Supervisor McKillop stated that unless the
County purchased used equipment, the County could not do the work cheaper than
set out in the bids.
Bids discussed; no action taken at this time.
71-1684 DISCUSSIONo PARKING PLANS FOR LIME SADDLE RECREATION AREA
Clay Castleberry, Director of Public Works, stated that the State had
approved the County proceeding with the parking plans for Lime Saddle. Mr. Castleberry
said his department would have the plans and contract for the Board at the next
Board meeting.
71,1685 DISCUSSIONs TRAVEL BY LOGGING TRUCKS ON OLIVE & OLD QUINCY ROAD
Supervisor McKillop stated that he has had complaints that the logging
trucks are exceeding the speed limits on Olive Highway and Old Quincy Road. Many
of the truck drivers are going too fast. He suggested that Public Works write a
letter to the logging companies and explain the situation. Mr. Castleberry stated
that there are many more lumber trucks hauling lumber and logs down Old-Quincy
Road and Olive Highway than ever before. A letter will be written to the logging
companies .explaining the complaints being received and the dangers involved.

Del Hyde, Executive Director, presented the prepared CAP forms and
eligibility documents covering the Community Action Agency plans and priorities
for the 1973 year. Mr. Hyde requested Board approval of said documents.
On motion of Supervisor McKi.llop, seconded by Supexvisor)Madigan and
carried, the plans and priorities for the 1973 year for the Community Action
envy were approved and the Chairman was authorized to sign CAP forms 81 and 3.

71-1687 PROGRkSS REPORT BY AIR POLLUTION CONSROL OFFICER
Don Black, Air Pollution Control Officer, gave an oral progress report
to the Board concerning the Agricultural burning rules and regulations, He reported
that the Committee that had been appointed by this Board met yesterday and studied
the proposed rules and regulations. Copies of the rules and regulations were
presented to the Board members for study and discussiono Rules and regulations
set out and discussed., Mr. Black explained the change in the rules. Supervisor
Gilman asked Mr, Black if he discussed these regulations with Jerry Letson, Division•
of Forestry, Mr. Black stated that the Division of Forestry could issue the air
pollution control permits if the County would adopt an ordinance regulating the
matter. Prior to this time; the public did nat need a permit to burn during the
winter months. Supervisor Gilman questioned Mr. Black about the burn~no burn days.
Time spent discussing the rules and regulations. It was stated that
the way the rules and regulations are written, the farmers can only burn 10~ of the
ruble per day, per property ownero

~~ Dr. Hazeltine, manager of the Butte County:Mosquito Abatement District,
' spoke on the encephalitis problem. He said there was a confirmed horse case in the
Chico area, He presented the bulletin fram the California State Department of
Public Health concerning the encephalitis surveillance. Dx~. Hazeltine explained
the problem involved in this matter. Discussed, no action taken.
71-1689 CLERK DIRECTED TO CORRECT 'IHE TAX RATE RESOLUTION FOR CHICL UNIFIED SCHOOL DISTRICT
Wm. Lawrence, assistant Auditor, reported that he had been contacted by
the Chico Unified School District concerning a budget error in the district budget.
Mr ..Lawrence explained how the matter should be handled. It was recommended that the
resolution be changed to show a tax rate of $4.674 for the Chico Unified School
District, rather than the $4.395 set out originally in the resolution. County
Counsel stated that the clerk could be instructed to make the correction to the
adopted resolution,
On motion of Supervisor Gilman, seconded by Supervisor Maxon and
unanimously carried, the Clerk was directed to correct the clerical error in Resolution
71-189 to set the tax rate for the Chico Unified School District at ,54.674.
71-1690 APPROVE ISSUANCE OF PERMIT FOR SEPTIC 'TANK & TRAILERo FLOYD HOWARD CHTCO
Howard '1oussaint, Health Department, appeared to discuss the access
problem in issuing permit for a septic tank and trailer to Floyd Howard, Ghicoo
Mr,. Toussaint explained the problems He stated that Mr. Howard's father had
died and the property had been split four ways among the heirs, There was no
recorded access to the property. Mr, Howard would like to place a mobile home on
parcel 1k4; Mr, Toussaint said that if the Board would approve the access, then the

Health Department could issue the proper permits. Action desired discussed.
On motion of Supervisor Maxon, seconded by Supervisor Gilman and
unanimously cazcied, an exception was approved for Floyd Howardy Chico ,to place
a mobile home on his property and for accessro sand property; and the Health
Department was authorized to issues the proper permit.
711691 DISCJSSl:ON o BILLING 'TO O~J`.TSIDE CON'TRAC'TORS. FOR DADA PROCESSING SERVICES
1t was reported that final billings for data processing services to
outside users for 1970m71 fiscal year have eaused some problems as contract
maximums have 'been exceeded in certain instances. A separate memorandum was
mailed to the B®ard members with their agenda, giving further details. Clif
Nickelson, Administrative Officer, explained the problem. 'There was a turmoil
that developed when the outside users were billed, these people had no money
budgeted for the services. ~t was stated that if the Board agrees, and the
undistributed costs are absorbed, then it should be made clear that these outside
users will not be billed for these services. O~~tside users itemized and
discussed. Rates that are charged should be computed properly so that the County
will not overcharge these users. T.t was stated that the basic thing was to get the
proper rare so that these agencies would know the exact charges that would be
made,
Mr. Nickelson explained the problem stating that this is an enterprise
program. Bi11 lawrence, assistant Auditor, stated "that he had gone back to the
eontrac"tons and it was clearly stated that the costs would be billed at the
estimated rates, It was said that computer services were being discussed at
this time. System costs are unpredictable. Mr. Lawrence explained how the costs
were computed. Mr, Lawrence stated that the principal of accounting was followed
to the letter. 'The question remains~•~who is going to pay the bill,
Dan Blackstock, County Counsel, explained the claims in this matter.
Mr, Blackstock said this was-going to have to be spe1~-ed ou~,.to the Board;_cpnt~~ct.by
contract ,so the Board would have a good idea of what has happened:: Mro Blackstock
said that in order for the Board co understand what has happened, the Board
should be presented with a run-down on each contracfa contract by contract.
Mr. Blackstock suggested that this matter be put over until he can give a summary of each
contract and explain the situation z:o the Board,
Hank Hindery, Data.Processing Ilirector, stated that Data Processing
had not had any advance knowledge of this matter, IC was also nok known to hi,s
customers.
Mr. Nickelson said "the basic issue at this rime was that it should
never happen again.

71m1692 PUBLIG HEARING CONTINUATION PARADISE PINES UNITS 10 11 and 15
Bob Brunsell, attorney for the district; appeared to hold the
continuation of the hearing for Paradise Pines Units 10, 11 and 15, IL was
stated that this area is just beyond the village and the golf course area.
'The hearing was continued from the last Board meeting and is still open to the
public. No one appeared in opposition or in. favor of the district.
Hearing closed to the public and confined to the Board for action.
It was stated that harwin Company would like to make a side arrangement with the
contractor to go ahead with the work of clearing the land, Previously the Board
had allowed Larwin to have this agreement with the contractor for the other
units. `There would be ao obligation to the County and no contract payment until

was held at this time. The assistant Director of :F fanning explained the matter.
He stated that the Planning Commission had considered the names and approved the

.Phe continuation ofr_he public hearing for the cancellation of the
land conservation agreement for ArmtP~ Speckert was held at this time. The hearing
had been. continued to give the Board members an opportunity to view the property
in. question.
Dan. Blackstock, County Counsel, explained the authority of the Board
in this matter. He submitted that the aloard could find 'chat this is in the
public interest. He exp"rained ttow the hoard could arr°ive at the findings in
this mattero Mr. Blackstock read the code sections chat applied in this matter.
`Ihe Board may approve the cancellation. i.f they find the cancellation is n.ot
inconsistent to this contract and that it is in the public's interest, He said
that the Zaw does give a specific power' to the. Board to terminate these contracts.
The penalty is computed by going out. and reappraising the land, She penalty
fee would be one-half of the valuation of the re-appraisals
In-this case, the Assessor appraised the land at $700 per acre.
Mr. Blacksrock explained how the penalty fee is arrived at from this valuation,

Time spent discussing the land and the area involved. Mr. Blackstock
advised the Board that no grounds were presented to justify waiving any portion
of the penalty fee. He said the agreement could be cancelled, subject to the
paying of the penalty fee.
Mr. Linhard, attorney for the applicant, spoke on the matter. He
said it was their position that this land was misclassified. He said he does not
feel that it would be in the public interest not to let this man out of the
agreement; he said the Board should not take advantage of this man.
Mr. Blackstock again stated that this Board was still bound by the
Government Code section, Mr. Blackstock again explained the law in this matter.
The Board was not presented with grounds to waive the cancellation penalty.
He said the Board could question the Assessor concerning his valuation of this land,
Ghairman Reynolds stated that in the future when any Williamson Act
applications are presented to theBoard, the applicant will be present and all
the conditions will be read to him. Chairman Reynolds said he would like to have
the Assessor present so that he could ask him and his appraisers some questions
prior to making a decision in this matter. The Administrative Officer was
requested to have the Assessor appear before this meeting at 1:30 this afternoon.

71-1698 DISCUSSION: INTERIM ZONING NORTH OF CHICO RIVER ROAD
Jerry Scott, Assistant Planning Director, explained the request for interim
zoning north of Chico River Road, Chico. The Planning Commission has considered
this matter. He set up a map of the area, showing the parcels that would be deleted.
Proposed zoning discussed.
Time spent discussing the zoning for this area. Chairman Reynolds
asked if there was anyone present that would like to speak on the matter of
interim zoning for this area.
Appearing: Bill Priel, Chico City Councilman, stated that this
zoning would cut his property in half. Mr. Scott said this problem could be
corrected. He said the permanent zoning would not incl~xde the Priel property.
Time spent discussing the request for exclusion. The description
will be changed to exclude the Priel property. Mr. Priel stated he hated to
see good. farm land taken up with something other than farming activities.
Also appearing: Mr. Roy Uhl. Be explained the matter of the zoning
for this area, He said there were over 111 people who wanted out of this proposed
zoning. He requested that he be left out of this zoning.
Hearing continued until after the lunch recess.

71-1698 CONTINUATION OF CANCELIATION OF LAND CONSERVATTON AGREEMENT HEARING
Dave Vasco, County Assessor, explained how the Assessor's office
had arrived at the $700 figure for the valuation of this land, Sales in the
area set out. Frank Donati, timber appraiser, set out the sales and how they were

handled. Mr. Vasco stated that all that area was scheduled to be re-assessed,
Time spent discussing the assessed value of subject property and
the surrounding properties. Mr. Vasco said he felt this was really the proper
value for this property.
Matter presented to the Board for decision. Board members set out
their feaiings in the matter, Supervisor McKillop said the Board would have to
have justification for letting this land out of the preserve; this land is
marginale He said he could not justify lasseaing the penalty on the property,
Supervisor Maxon said that because of the land's inability to produce timber it
should not have been in the preserve in the first place. '
It was moved by Supervisor Maxon that the land conservation agreement
be terminated and the assessed penalty be placed at $2000, which would take the
form of a lien until the penalty is paid, Motion died because of a lack of a
second.
Supervisor McKillop said it was against the law to make such a motion.
On motion of Supervisor McKillop, seconded by Supervisor Reynolds and
unanimously carried, the land conservation agreement between the County of Butte
and Speckert was cancelled for the Z80 in the Forest Ranch area and the maximum
penalty was authorized to be assessed on said property and that the penalty was
to be paid before the cancellation of the agreement,

this matter. He explained his reasons for wanting to be exempted from this

AS AN "Sml" MEDIUM DENSITY SUBURBAN RESIDENTIAL DISTRICT
On motion of Supervisor Gilman, seconded by Supervisor Madigan and
unanimously carried, Ordinance No. 1194 as interim ordinance zoning a portion of
the County an.°S4I11 (medium density suburban residential) district for the area
north of Chico River Road was adopted and- the Chairman was authorized to sign.

71-1.702 REPORT ON SB 1633-and 1414° AB 644. and 2.G
Dan Blackstock, County Counsel, reported to the Board on SB 1633 and 1414,
AB 644 and 26. He said that AB 26 was a._bill that was introduced by Senator Davis,
which sets forth a formula of five cents tax on the maximum tax rate. The State could
then pick up the excess, These bills concern-Superior. Court trials,
AB 644 ~- this should be considered apart from these bi1ls.Mr. Blackstock
said. This bill deals with cases of escape or conspiracy.
AB 1414 is similar to AB 26. The State would pay costs for homicide
cases when cases exceedo05 on the tax bill.
5B 1633. This is Senar,or Mailer's bill, This bill would require that
the State pay the costs on homicide cases, this would include bring the case to
trial and the costs of the actual trial.
Mr. Blackstock said he would recommend that the Board support SB,1633
and AB 6440 He said that SB 1b33 is the best bill. The brief summary of the
four bills explained by Mr. Blackstock.
71-1703 ADOPT RESOLUTION 71-206 IN SUPPORT OF SRNATE BILL, 1633
On motion of Supervisor Maxon, seconded by Supervisor Madigan and
unanimously carried, Resolution 71-206 in Support of Senate Bi11 1633 was adopted
and the Chairman was authorized r_o sign. Copies of said resolution to be sent
to CSAC, Assemblyman Johnson, Senator Fred.Mar.ler and the Honorable Ronald Reagan,
Governor of the State of California.
71-1704 REPORT TO TH& BOARD ON AB 1301 and 1303
Phil Mace, Assistant County Counsel, explained AB 1301 and 1303. He
said the bills were difficult to analyse. The Bills concern the Subdivision
Ac t. and the Map Act. Mr. Mace explained the details of said bills. He said the

bill would require land division maps for all parcel splits. ?Jnder these bills
the County would be required to making a finding in approving subdivision maps,
Time spent discussing these bills and the effects of the bills.
71°1705 ADOPT RESOLUTION 71W207 TN OPPOSTTTON:TO ASSEMBLY BILLS 1301 and 1303
On motion of Supervisor Reynolds, seconded by Supervisor Maxon
and unanimously carried, Resolution 714207 in opposition Lo Assembly Bills
1301 and 1303 was adopted and the Chairman was authorized to sign.
71°1706 R$POR'T ON THE LARS OROVZL;i~E REGRFATTON: COMl4TITTEE MEETING
Supervisor Maxon stated that there has been two meetings of the-Lake
Oroville Recreation-Committee. The attendance has been almost 100%. They_are now
working towardf 'ithe next fisca]. year budget. They have approximately 6Q days to work
with the5tate in formulating a plan to the mutual satisfaction of the S-fate and
the County. They are making progress. Clif,Nfick2lson~, Administrative Officer, said
that one of the things discussed was that the Committee would like to have all
the thoughts from the general public on the development around Lake Oroville.
It was requested that the press carry a story to this bffect.
There have been several problems with the State Department of
Recreation concerning. why certain areas should be developed. The State has made
it clear that they want to work with the .County.

71-1707 REPOR"C TO THE BOARA ON NATIONAL FLOOD INSURANCE ACT OF 1968 AS PER BOARD
RESUEST•OF AUGUST 17. 1971
Dan Blackstock, County Counsel, reported on the National Flood Insurance
.Act of 1968 as per the Board°s request of August 179 1971. On August 17th, the Board :.
had received from the Office of Emergency.Services.
Mr. Blackstock said that at the present time, this County has not been
determined eligible. He said the County has to make itself available to the criteria.
Mr. Blackstock said he would suggest that-the'County have someone from the State
appear before the Board and explain the criteria in this matter. He-said the
County does have an area of floods. The insurance would only cover single family
homes and businesses. County Counsel was requested to have someone from the-State
come up and speak to the Board on the matter. He will request that someone appear
at the Board meeting of September 21, 1971.
71m1708 APPROVE AGREEMENT WITH DEL IRO WATER COMQANY & TARWTN, FOR USE OF COUNTRY CLUB
UNITS 1 throu h 4 TO SUPPLY ADDITIONAL WATER.
Dan Blackstock, County Counsel, reported on-the agreement with Del Oro
Water Company and Larwin which is backed by $50,000 bond to supply additiora I water
for use of Country Club Units l through 4 in accordance with the requirements of
the Health Department. He explained the purpose of the agreement and requested that
the Board approve the agreement, subject.to his approval. The agreement needs to
be amended.
On motion of Supervisor McKillop, seconded by 5uperyisor Reynolds and
carried, the agreement with Del Oro Water Company and Larwin which is backed by
$50,000 bond to supply additional water for use of County Club Units 1 through 4

The salary ordinance amendment to establish the positions approved in the
Drug Abuse Program was taken off the agenda at this time at the request of the

71°1719 BID REPORT °' GRIDLEY AMBULAI~TCE SERVICE
Bids for continuation of the Gridley ambulance service were opened on
Friday, August 27, 1971. Tom Struthers, Purchasing. Agent, reported on the
bids. Bids were received from Chico Ambulance Service, YubamSutter Ambulance
Service and the Gridley Ambulance Service. Time spent discussing the bids.
Specifications of the bids set out. The present operator was high bidder.
Chairman Reynolds suggested that the people in ehe service area
should go over the..bids.and..study...the-specifications. -They could-then_.make their
recommendation to the Board of Supervisors on Tuesday, September 14th, 1971. Gridley
City Councilman Ed Hughes, City Councilman from Biggs, Roy Pritchard, Mrs. Hovlid,
manager of the Biggs-Gridley Hospital, Dr, Sears and Chief Cook of Gridley were
appointed to study the bids anal make their recommendation to the Board on Tuesday,
September 14, 1971.
Chairman Reynolds stated that he has received no criticism of the
local ambulance operator, Mr. Macy. Supervisor Gilman said that shortly. all the
ambulance operators were going to be requested to attend a meeting to discuss
ambulance service in the County. The County should get a more uniform service,
fol"lowing these meetings and discussions,

71-1721 DISCUSSION: DEVELOPMENT OF BOOK CALLED-.°jTHE LAWS OF YOUTH°
C1if Nickelson reported that a Mr, Gordon Casamajor had visited him
yesterday and stated that he has been working with CCCJ in the development of a
book cal"red "The Laws of Youth". This book-would be distributed through the
schools, Police Department, Juvenile Hall, etc. The application for the printing
of the book was turned down by CCCJ.

Bida have been obtained for the printing of these books at a cost of
$2,926, plus $48 for each additional thousand° The original printing would be for
50,000 boaks, Mr, Casamajor has contacted service organizations and he has a
firm contribution from them in the amount of $2100. He is requesting that the
Board par.tici.pate in the amount of 5900~maximum. This booklet contains the laws
pertaining to youth-in the areas that young people get into trouble. The book
is targeted ~t youth, CGCJ said they had no .money that could be used for the
printing of such a book.
Request discussed. The Administrative Officer was requested to
call Howard Casagrande, CCCJ, and discuss the request with him. No action talon
at this time. Matter held up until September 14, 1971.
71-.1722 MATTERS PRESENTED BY BOARD MEMBERS
Chairman Reynolds said that yesterday Supervisor McKillop, C1if
Nickelson, Jim Rackerby and he had a briefing on the Emergency,Employment E~ct.
A committee was appointed for this area. The committee will attempt to establish
a criteria for the priority of the man power that would be hired. The committee
will meet on Wednesday, September 1, 1971 tb study the matter. Representatives
from each district will be represented. ,
' Chairman Reynolds asked Supervisor McKillop about the County policy
in picking up dogs in the rural area, He asked if the dogs could be picked up if
they are running along the road. The policy is that the dogs could be pick up,
even though they might be licensed, Aiscussed the matter of picking up of dogs;
no action taken°
