He suggested that all the employees of this department be given a polyogram test. The City Police Deportment is checking inro this matter; investigation of the theft was turned over to Lt. Spinals. Supervisor Madigan asked how the shortage was handled; there has been no request for a replenishment to tEie cash fund. We suggested that the Auditor report on how this is being handled. Glif Mickelson, Administrative OTficer, reporte on t e request y Supergr California Senior Services, Inc. for use 6F the Palermo Community Center. The Palermo Community Center held a meeting lost night and they support the use of the center for this purpose. The meals will be prepared at tha Center. Request discussed. They will only be able to serve 25 people at Each meal. The Board asked Mr. Nickelson if there were any other buildings that could be used for this purpose. Mr. Nickelson will look around and determine if there is any other site. that could be used. Mr. Castleberry explained the request for these improvements. Mr. Geddis requested that the property owner be relieved from this condition. The owner would agree to place the improvements on the property when they become necessary in that location. Drainage problem in area discussed. Waiving of the condition discussed. On motion of Supervisor McKillop, seconded by Supervisor Cameron and carried, the Board relieved the property owner of complying with Condition No. 2 of the following map, with the guarantee by the property owner that they will be placed on the property when the improvements are required for the other property owners in that area, and #hat such guarantee be placed on the map: Page 165. On motion of Supervisor Richter, seconded by Supervisor Cameron and unanimously carried, the fnllowing resolutions were adopted and the Chairman was authorized to sign: Resolution 75-132 making application to LAFCO for annexing territory to County Service Area No. 24 - __ ,~,_:.'r.;; ~p page 169. September 3, 1975 ~ ~'` -_--_----____=====September 3, 1975_________________ __ Resolution 75-133 making application to LAFCO for detaching territory affecting County Service Area No. 24. 75-1489 AUTHORIZE REMODELING OF OLD KITCHEN AT HOSPITAL COMPLEX, FOR CENTRAL SER~YICES PRINT SHOP, PURSUANT TO PROV1SiO?3SJOF GOVT. CODE SECTION 2545$ ' -~' e~ncy move of the Print Shop to the old kitchen at the hospital complex is estimated to cost $11,462 and would normally require bids and specifications to be prepared and to be let by contract because of provisions in Govemment Code Section 25457. The emergency need for storage space is such that this remodeling could come under provisions of Govemment Code Section 2545$ which allows the county to do the emergency remodeling with its own labor and contract only those items which must be provided by outside suppliers. This would include the HVAC and floor covering portions of the work. Mr. Mickelsonsexplained the real storage problem. On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, remodeling of old kitchen at the hospital complex pursuant to provisions of Govemment Code Section 25458 was authorized. 75-1490 APPROVE JOINT POWERS AGREEMENT FOR OPERATION OF GRIDLEY FIRE STATION is agreement was previous y out rize and execute y t is Board an paragrap of this agreement calls for a separate automatic aid agreement and an operational letter of understanding. These have been prepared by Butte County Fire Department and have been approved as; to form and for fiscal and budgetary control. Also, the County Fire Warden suggests the following actions to implement the joint powers agreement: (1) reduce the Biggs Volunteer Fire Company from 30 to 20 members; ~2) establish the Gridley Volunteer Fire Company with an authorized strength of 20 members; (3) authorize funds to provide alert/monitors, protective clothing and workman's compensation for the 10 additional volunteers (approximately $500). Mr. Nickelson stated that everyone is in agreement with this action. On motion of Supervisor Cameron, seconded by Supervisor McKillop and unanimously carried, the agreement for automatic aid with the City of Gridley was approved and the Chairman authorized to sign; (b) authorized actions as described above for implementing the joint powers agreement. 75-1491 APPROVE COOPERATIVE AGREEMENT FORDEER HABITAT IMPROVEMENT On motion o Supervisor i op, secon e y Supervisor Cameron and unanimously carried, the Cooperative Agreement for beer Habitat Improvement with the Forest Service was approved (Plumas National Forest} and the Chairman authorized to sign. 75-1492 APPROVED COOK ASSOCIATES PROPOSAL FOR INSPECTION AN) CONSTRUCTION STAKING-PARADISE LIBRARY,_ADOPTORDINANCE NO. 1602 & CONTRACT FOR SIGN, no inspectors available. Cast proposal is less than county full time inspection on like buildings. The contract with Cook Associates did not provide for inspection. A felt time inspector will be used for this building. Mr. Castleberry set out the alternate proposals for the crossing. He spoke to safety, convenience and cost. Supervisor Richter requested that a committee of two Board members be appointed to hold n hearing in Durham and to present the proposals to the people. In that way the Board would determine public support of the proposals. Chairman Ladd appointed Supervisors Madigan and Richter as the two members on this committee. Mr. Castleberry will work with the Committee on this matter. Date for hearing will be announced later in this meeting. This is a State owned access rood. Clay Castleberry, Director of Public VWrks, explained the area in question. Hearing opened to the public. Appearances; Mr. Bill Geddis, representing Mr. Crowley. He set out the background of this appeal. The property owner had given the right,of-way to the State Department of Water Resources for the purpose of access to the Craig recreation area. Mr. Crowley is confused as to why he has been denied a building permit. Power pole and septic tank permits have been issued to him. Et was suggested that maybe the ,formation of the,Assessment District on Craig Road will make this a good access road. The Board could then declare it legal access for building permits. Use of the road discussed. Oid Oregon Gulch Woad set out, This road use to go through and run into the present Craig Access Road. Preliminary work on the assessment district is being done at this time. Supervisor McKillop felt that if the Board allows one permit or exception for building permits, then the road will never be built. Mr. Crowley should be a part of the assessment district. Supervisor McKillop said that at this point, he would rather wait fie grant his request. Mr. Geddis stated that Mr. Crowley has no objections to being a part of the assessment district. Mr. Castleberry said that if the formation of the assessment district papers were presented right away, then he would go along with the issuance of the building permit. Supervi sor McKillop stated that if Mr. Crowley would guarantee that he will loin the assessment district when formed, he would go along with his request. Karen L. Sharpe spoke to the problem, stating she prefers the Brea to remain agricultuzal. Rea sad Nancy Farrar stated that they definitely do not want the interim S-2 zoning or any change until the property owners in the area are notified. Sidney and Madeline Hopkins stated that they oppose the interim S-2 zoning and preferred the A-2 and A-3 zoning. Hearing opened to the public. Appearing: Everd McCaia stated that he opposes the interim zoning and requests the Board to honor the existing zoning. Keith Humpherys. Mr. Humpherya gave the Board members maps of the proposed S-2 area which ie bounded by Alamo, Beil, Cusaick and Renshaw. They are dropping their request to rezone the other area as delineated Last week. Mr. Humpherys stated that out of 42 parcels, they have the support of 35 for the interim zoning. Gary Hart presented a letter from Frank $ridgeman opposing the interim zoning, which was read by the clerk. Mr. Hart stated that he has talked to several people in the area that are not clear on exactly what ie happening. He would like this thing studied carefully before enq decision ie made. Mr. Hart explained that he has already been issued four building pewits for hie property. He explained the petition he has which has 41 signatures. Some people he talked to had signed Mr. Humpherys'~,~petition and now would like their names removed from it, one of which was a Mr. Norris. He stated that some who signed are now outside of the area due to the change presented this morning. Mr. BlackaCOCk stated ChaC unless construction has been started, the permits will be revoked. Supervisors McRillop, Cameras and Madigan atated that they would not have supported the interim zoning if they had known that the permits Mr. Hart had already received were going to be withdrawn. Mr. Hart explafned that he hoe invested much money into this. He has started surveying sad has started construction on a fence around the property. He hoe also built a gravel road into the property. Supervisor Cameron moved to table the above motion. Motion died for lack of second, Discussion of Mr. Hart's property and whether he has commenced construction as outlined by the 1a w, Mr. Blackstock stated that neither the purchase of materials nor the beginning of surveying have been upheld in the California courts. However, he feels that the fencing can be aonaidered the beginning of construction. Oa motion of Supervisor Cameron, seconded by Supervisor Madigan and unanimously carried, the determination was made that construction has been commenced by Mr. Hart and that the four building permits he has already been issued b~ honored. DISCUSSION: CONTRACT BETWEEN COUNTY AND GRIDLEY TRANSMISSION FOR ABANDONED VEHECLE ABATEMENT PROGRAM Neil MoCabe, attorney for Gridley Tranemiseion and Auto Wrecking, explained to the Board the proplems they have encountered since entering into this contract. There hoe been difficulty over determining what is to be considered a vehicle, whether only whole cars era to be aonaidered or whether a fender is being considered a vehicle. They were also told they would be required to removed 3,000 vehicles. 5o far they have oalq been notified to remove 78. Yublic Works reported on a memo that they have removed several more, approximately 96. Mr. McCabe stated khat they have been notified of some vehicles but were told they could wait a short time, as some are under water. Tt was explained that several vehicles are self-abated, which means that the owners have either hauled off, stored or fenced in the vehicle. Mr. McCabe stated that he underbtood this. Mr. McCabe presented photographs o£ some of the vehicles they have been required to pick up and explained each. Mr. McCabe stated that the notice to bidders portion of the contract is not being enforced. Mr. Castleberry answered the items mentioned by Mr. McCabe. They feel the program has done very well. His department stetted working in the southern part of the county and moved upward, working in other areas if there was a complaint. They have been trying to be easy on the people instead of enforcing. the OrdinanCE completely and totally. Even so, he feels some appeals will be received in the future. Supervisor Cameron questioned about a problem in Che Jewell Road area. Mr. John Howard of the Public Works Department stated that this matter had been resolved. Supervisor Richter feels the county should cooperate and try to work with the contractor is order to clear the county of these vehicles. He feels that they should mark several cars in one area so the contrackar doesn't have to make several trips. He.queationed about the equipment of the company. They can heal four vehic~ea at once. Discussion of the B & M Auto~Wrecking yard. Tt was explained by Butch Pritchard that some confusion had re wlted because this property was sold and repossessed. There were vehicles an the property, they were marked and it was indicated ko the contractor that he would be moving them. However, the property exchanged panda and the owner removed them himself. Mr. Pritchard explained that nothing should be done until a list has been sent to the company. He stated khat vehicles are sometimes marked that are never listed for the contractor. Chairman Ladd stated that it was the feeling of the Board that the Public Works Department should work closely with the company oa this matter sad kry to coordinake the pick-ups and areas. He also feels that a part such as a fender should not be considered a vehicle. She passed out a pamphlet that autiines the highl~iglit~s~ of this law. Bill Elliott, Director of Superior California Comprehensive Health Planning Association, outlined the highlights of the law. It was signed in on January, 1975. Purpose of the Act set out. The 10 National Health priorities which relate to improving health facilifes explained. The Health Service Areas outlined; Butcte~County is in the northern most health service area, which includes 14 counties. The next step is to establish the Health Systems Agency. Functions of the Health Systems Agency set out. Some of the functions are; data management, planning of health systems and implementation of the law. Composition of the governing board for health planning explained. At least 51% {but not more than 60%) are to be consumers. The rest of the Board are to be providers; at least one-third of those are to be providers of direct services. Local public elected officials are to be included as either providers or consumers. Art Gilman, member of the steering committee, spoke concerning the concept of how the agency is being organized and how to involve all the people that should be involved. He stated that one of the most important thing is the necessity to involve each elected official. They ore the people that are the most responsible for health care. The steering committee is only exploring andffiguring out how to come up with a concept that will work out. He explained what the stieering committee has been doing. He explained how the Board could bemme involved in this matter. Supervisor Cameron set out his views of the meetings that have been held. Mr. Anderson said that he suspects that the Board members will be receiving telephone calls when the Assessor's appraisers start making their reappraisals of the properties. He explained the procedure that they will fallow. Some of the appraisals are 4, 5 and 6 years old. When making the reappraisals , some of tha¢i will be higher. It could be that even with the earthquake damage, the reappraisals might be higher than the present appraisals. It is a problem relating to those properties in the areas where sanitary sewers are being put in but are not in yet. He set forth the situation to the Board. He said he w~auld like to prepare a contract far these people to sign and would like to bring it back to the Board for approval. It wil! be a special contract that would protect the County ro insure that LvFaere something goes wrong with the sanitary system, the County will not have to take care of it. It will state that when the sewer lines goes in, the owner wi II connect up to it. The developer went to the City of Oroville and requested permission to hook up to the city sewers. The city denied this request and he has now rold the County that he has complied with the County ordinance. He would like b obtain septic tank permits. Stuation set out and discussed. Supervisor Mc~llop stated that if this property is adjacent to sewers, then they should hook up to the sewers. Mr. Blackstock stated that if that is the Board's concensus, he will go back to the City of Oroville and explain the problem from the County's standpoint. It was their determination that at the hearing there was no indication that there was 40 acres involved. Mr. Strauss did not appear at the meeting. Mrs. Blair had given this report to the Chairman today. It was felt there was lack of information in this matter. The matter is now going to be referred to the Corps of Engineer for their action. 75-15 20 REPORT ON SERIOUS PROBLEM WITH LOCATION OF COUNTY TREASURERS OFFICE : :c a son, Administrative Officer, reported on the serious problem concerning the location of the County Treasurer's office. The time is close upon us when people will be coming into the Treasurer's Office to handle their tax bills. This will create a lot of traffic. Ne said they ware proposing that the Treasurer be moved into County Counsel's office and move County Counsel's operations b some other location.
