Currlin, Manager, writes regarding the formation of the "Association of State Water Project Agencies," Thirteen contracting.agencies-whose annual entitlements equal 87.95 percent of the total project's entitlement have-formed this .association. They .solicit membership from other contractors. Referred to George-Stamm. Department of General Services - Buildings and Grot~ads Division. Dale Matzke, building ,manager of the State Capitol Building asks that the county provide his office with the names of firms or individuals who are authorized to woxk on-the county's display case in the Capitol Building. Warrens di.stri.ct engineer, writes regarding Butte County's Resolution Na. 70-227, which requested approval of .five new public Q road connections to Route 32 east of Chico. The Department forwards supply of DWR Forms 2328 to cover Butte County's request for monthly delivery quantities during the five years, 1972 through 1976, as required by our water supply contract. The Board forwards a copy of the proposed general policy on granting extensions- to city and county open burning dumps. Supervisor Maxon said he had heard that this matter would affect Butte Creek area and Butte Meadows. County Coun~eylwill make a report on the matter next week. Jerome D. Peters. Request for continuance of his public hearing to be held on Tuesday, September 21, 1971 at 11:00 a.m. Letter read and discussed. / ~ ~• d ~ Hearing will be opened next Tuesday and continued to January 11, 1972, Paradise Chamber of Commerce. Protest the charging of fees to drive through Lime ~ Saddle, They feel that the residentsr,of Paradise should be allowed 0 7.7 ~ free entrance to this area. Letter discussed, Mr. Castleberry requested to aaswer letter and explain the situation. Helen Robinson. Supervisor Madigan stated he had received this letter concerning the transfer station in the Gridley area. All Board members received a similar letter. 71-1725 DISCUSSION: CLEAN UP DAY ON NEAL ROAD - Supervisor Maxon reported that the Cub ~couts and the Boyr,Scouts had cleaned up Neal Road on Saturday.' Supervisor Maxon said he hoped that the ordinance regulating littering on the highways will be enforced. It was suggested Chat the Administrative Officer notify the Sheriff's Department and the Highway Patrol requesting that they make an effective control of the ordinance regulating the blowing of debris from uncovered trucks, The press was requested to have a news item stating that people would be cited if they have debris blowing from their vehicles. Matter discussed. Mr. Castleberry said he felt the Sheriff would do a good job of handling this matter; he felt the dump operators should not be 'deputized to cite people at the disposal areas. Public Works was requested to install signs leading to the disposal areas setting out the ordinance regulating the matter of blowing debris- and stating that the violaters would be cited. 71-1726 APPROyE REQUEST OE PAR6DISE CHAMBER OF COMMERCE TO GL05E PEARS ON ROAD FOR APP BOX DERBY: OCTOBER 3 On,motion of Supervisor Maxon, seconded by Supervisor Madigan and unanimously carried, the Paradise Chamber of Commerce was granted permission to close Pearson Road between College Hill Drive and Chap$1 Drive on Sunday, October 3, between 6:00 a.m. and 2:DO.p,m, for an Apple Box Derby held in connection with the annual Johnny Appleseed Days Celebration, subject to the agproval of the Sheriff and. the Highway Patrol. 71-1727 LETTER CONCERNING AGRICULTURAL BURNING Supervisor Gilman stated he had a letter on burning in the Chico urban .area, He asked what constituted a family. Some of the people are renting houses to groups of college students. It was suggested that the matter be discussed with the Planning Department> Letter to be seat to the Health Dept. and the Sheriff's Department-for their study and recommendation. 71-1728 DISCUSSION: CHANGES ON ROADWAY. ORO°GRIDLEY HIGHWAY Red Me.ltnn, manager of the Butte County Housing Authority, appeared to speak to the Board concerning a request for certain changes on Oro-Gridley Highway road frontage as,it relates to the Housing Authority's installation. Mr. Melton stated that they were nearly completed with the construction work at the center, There will be about 800 to 1,000 people living at the center when it is finished. He said there were 3 suggestions to be considered: 1. Speed limit in front of the center; the request is to lower the speed limit to at least 35 or 25 miles per hour. Tt is presently set at 45 MPH. 2. A harrier on the corner left of the center should be erected, He-said this was a dangerous place and a barrier would :help. 3< Requested that a holding. lane be installed because the traffic will be heavy at the center and there should be a turning lane installed. It was felt that this request-should have priority. Suggestions discussed. Director of Public Works will go over the suggestions with. Mr, Melton. ~, 7.1-1729 DISCUSSION OF THE EMERGENCY EMPLOYMENT ACT AS IT RELATES TO HOUSING AUTHORITY The letter from Mr. Melton concerning the request of the Housing Authority discussed, Mr. Melton stated he had received a call from Washington .and had received a letter from HUD urging them to enter into this program if psssible, The Housing Authority works with the unemployed, He said it was felt that the Housing Authority should be one of the main referral agencies, Jim Rackerby, Personnel Director, spoke on .the request of Mr. Melton. He said he has discussed the situation with Mr, Melton. He said that one of the criteria: established by the Committee was that the agency requesting the positions would be deriving their salaries from local tax sources. The Housing Authority does not have taxing powers, and would not fit this criteria. Mr. Melton had been denied. his application by the committee. Mr, Rackerby said he would use the Housing Authority for referrals and will provide Mr. Melton with job announcements concerning the type jobs that will be available, No action taken on request at this time, Page 83. September. l4, 1971. _ _ _ _ _ _ _ _ _ _ _ _ _ r = _ _ - =September=14,=1971 = _ _ _ _ _ _ - - - - W - _ - _ 71-7.730 REPORT BY WELFARE DIRECTOR ON THE WELFARE REFORM LEGISLATION Ed Robinson, Welfare Director, reported on the Welfare Reform legislation. He said he had. presented the Board members copies o~ his report but. he did not kngw if the Board members had had time to read the report. Report discussed, He said there would be a saving of about $40,000 due to this reform, He outlined the areas where there will be additional savings. He said that if the reform goes .forward now, there will be a reapportionment of the administrative casts next year. He said the memo was self explanatory. Clif Mickelson, Administrative Officer, said that in line with this report, he would like to take this time to report on the. meetings that he had attended, with Ed Robinson and Ev Bosworth, last Thursday and Friday. The meetings .were held in Sacramento. They discussed Medical and Media=Care. Mr: Mickelson explained the matter of the County's share of participation in these prDgrams. He explained-how the matter of the medically indigent would be dandled-. Adjustments would be made: The program.does not go into effect until October 1st„ •The bounty would ~•be~ required to send .$1~,wyc30€3 to Sacramento a~s :.the--County's contribution ..for the 1971-72 fiscal yedr. Mr. Nickelson said he would suggest that the Board authorize County Counsel and 'the Administrative Office to work on a cgmmunication to the State concerning-this matter, Suggestion discussed, On.motion of Supervisor Maxon, seconded by Supervisor Madigan and unanimously carried, County Counsel and the Administrative Officer were authorized to prepare a letter setting out the position of the County concerning the costs of Medi-Cal and Medi-Gare, and state Chat the County protests these,~osts. :.a Time spent .discussing the social workers screening the applications for Medi-Care and Medi-Cal. Social Service unit costs explained and discussed, Tt.Was~Eelt.that the, e.ligility should be determined-at-the Welfare. Depa-rtment, Supervisor McKillop said, that if there wel5egoing to~be a social service unit at the hospital,there'~Should'not beoaseligibility unit at the Welfare Department to provide Chese services. It was felt that the County was going to have to-laok at this matter and make some kind of determination. Time spent discussing the matter. 71-1731 WELFARE DIRECTOR AUTHORIZED TO CONTACT SACRAMEN'li1COUNTY WELFARE DT RECTOR .CONCERNING ADOPTION SERVICES Supervisor Gilman requested that the Welfare'Director speak on the matter of adoption services, Mr, Robinson stated that an adoption unit was established but the unit was:not set up. In the past year the number of children .for adoption has dropped, .This. has caused a fiscal problem for the Children!s Aid Society, Mr, Robinson said it is more economical to the County if theycca.n 'contract for this service from another agency. If 2 counties .are close, and one County has an adoption unit, the second county could contract with them. - Mr. Robinson said that Sacramento County. has an adoption unit established. He said it would be well for the County to contract--with Sacramento County. fox these adoption .services, If there was ,a .legal problem involved, Chen the County Counsel-could handle this problem, The County would be responsible for the legal action.>of securing the approval by the parents. The-legal release s. could be obtained by Butte County Counsel. Time spent discussing the agreement. with Sacramento County, County Counsel has looked at the agreement and.. has approved it as to form. Page 84. September 14, 1971 September 14, 1971 Mr. Robinson said that before the agreement could be considered, he would have to contact Sacramento County's Welfare Director. He .has to have theBoard's intent in this matter before he can contact.the Welfare Director. County Counsel stated that what the County's Welfare Director was requesting was the authority to.. contact Sacramento's G~elfare Director. On-motion of Supervisor Maxon, seconded .by Supervisor McKillop and unanimously carried, Ed Robinson, Welfare Director, was authorized to contact Sacramento County's Welfare Director concerning adoption services. RECESS: 10020 RECONVENED, 10x30 71-1732 APPEARANCEa DON EASLEY -PARADISEo COMPLAINT CONCERNING HOSPITAL CARE Mr, Don-Easley, Sterns Road, Paradise, stated that three days ago he entered the County Hospital. He said he waited for the doctor so he could be relieved of pain, bui~~he was told that there was only one doctor on duty. He explained what transpired at the hospital; he was in pain all the time and could not see a doctor, He said that during the day an elderly man had to use oxygen to keep from suffocating, The man left the mask on top of the machine with the oxygen still going. There was a man smoking in the next bed. Mr. Easley said he yelled for a nurse to turn the oxygen off so that they would not all be blown up. - The nurses had been told to ignore his light. He-checked out of the hospital yesterday. He explain the matter of his billing at the hospital. Supervisor McKillop said he would check this matter out with the hospital and will r-eport back on-the. matter. 71-1733 PRESENTATION OF FT$ST PRIZE IN THE B DISPLAY AT THE STATE FAIR Clif Micke'lson, Administrative Officer, presented the first prize in the ,B Type display, which was gxanted to the County for their display at the Sacra mento State Fair, 71-1734 APPROVE THE S ~'~,EMENTING OF PRINTING COSTS OF "LAWS. FOR YOUTH" Gordon Casamajor, Chico, appeared to answer questions concerning the -project "Laws for Youth". He said what was needed from the County. was the issuance hf a.purehase order to the,griater in Orange County for the printing of 50,000 copies of this bookleto He said they.have received confirmation from Orange County that they could use their plates and data'for this booklet. Mr. Mi.ckelson explained what was needed at this time. The group needs allocation of funds to come up~with the total bill of $2926,00 for the printing of the booklet. The booklet will be distributed to the schools in the County, They.-have contribution pledge s.. in the amount of $2100. The booklet is a concise digest of laws involving young:people, Orange County has found this a very successful way of getting these laws into the homes, Mr. Nickelson-said he would .like written confirmation from the County Department that is encouraging the printing of this book. Publication costs discussed, On, motion of Supervisor Maxon, seconded by Supervisor Madigan .and _ unanimously carried, approval was granted for the supplementing of the printing costs of "Laws for Youth",subject to concurrence by.the Superior Court, Probation Department and Sheriff's Department, nat.to exceed the amount of $900, said funds to be transferred from.-Reserve..for.Canti,ngenc.y,-and~placed,in the ,Board's budget. There were no written protests; no one appeared in protest. He gave Mr. Mace an affidavit signed by his father. Affidavit read and filed with theClerk. On motion of Supervisor Gilman, seconded by Supervisor McKillop and unanimously carried., the Order f/Y~eeing adult child from responsibility for support of parent (Fulton) was approved as requested, 71-1738 REPORT OF BIDS AND SALE OF TAX ANTICIPATION NOTES D, C. Swinney, Treasurer and Tax tCollector, reported on the opening of bids for sale of tax anticipation notes. Bids were opened in the Treasurer's office from: Name of Bidder Net Interest Cost - United California Bank 3.04 We11s Fargo Bank 3,0858 Bank of America. 3.10 Crocker National Bank 3.51 Mr. Swinney recommended that the bid of United California Bank be accepted as the best bid. . September 14, 1971 September 14, 1971 On motion of Supervisor McKillop and seconded by Supervisor Reynolds the bid of United California Bank was accepted, Resolution No.. 71-229 selling $1,000,000 County of Butte Temporary Notes for the Fiscal Year 1971-72 was moved to be adopted. Motion discussed.. It was asked when the money would be needed. Mr. Mickelson explained the problem involved in this matter. lle said the Auditor Baas working on this, matter at this time. Vote on this motion held until the afternoon session. 71-1739 DISCUSSION: PURCHASE OF TAX DEEDED LAND BY CITY OF OROVILLE D, C. Swinney, Tax Collector, reported on the request of the City of Oroville for the purchase of the five parcels of tax deeded. land set out in their communication. Mr. Swinne ex lained the re uest• all the lots are in the ~' y P q parking __. ... .. _. districts. The City of Oroville has paid the bonds against the lots, There are back taxes due the County which will have to be paid by the City, County Counsel was requested to report back to the Board on this matter. Mr, Swinney was requested to secure the assessed values on these parcels. No action taken at this time, 71-1740 PUBLIC HEARING: VISTEC-USE PERMIT FOR MULTIPLE FAMILY RESTDENCES IN CHICO The public hearing on the use permit for multiple family residences in Chico, as requested by Vistec, was held as advertised, Ji.m Lawson, Planning Director, summarized the action of the Planning Commission in this matter. The Planning Commission recommended approval of this use permit, subject to ten .conditions. Hearing opened to the public. Appearing in opposition: 1. Mr. Brit.tan, Chico. He-read a prepared statement on the matter, He explained his opposition to the use permit. 2. Mr. William Ganow. He owns the property adjacent to this property. He said that he was sure that if this building is allowed, he will be Forced to sell. 3. John Stutz, Morgan Avenue, Chico, Appearing.in favor; 1. Mr. Dan.Pellicotti, Oroville. He said that Chico State College has taken a great deal of property off the tax rolls, These people are going to sgend a considerable amount of money building this complex and it will bring,in many tax dollars. September 14,-1971 September 14, 1971 On,motion of Supervisor McKillop, seconded by Supervisor Reynolds and carried, the Board concurred with the Planning Commission and approved the use permit for multiple family residences in Chico (Vistec), subject to the ten conditions of the Planning Commission, with-the stipulation that the property be annexed to the City of Chico. Mr. Winston said the City did not intend to auction the property, off; they desire to recapture as much of the.. money on the parking district bonds as possible. The property will be listed-and placed on the market. Mr. Swinnay, Treasurer, stated that there was $20,393.22 due on these parcels. This would mean that the City of Oroville would have to pay the difference in.the amounts owed to the County, over those owed to the City. Mr. Winston .stated that it-was not his understanding. He said he would s uggest that this matter be held in abeyance until next week. The City Council did not know that there-would be additional charges. Matter held over to Tuesday, September 21, 1971. 71-1751 PUBLIC HEARING: PROPOSED ORDINANCE ON AGRICIfLTURAL RULES AND REGUL4TIONS FOR THE BUTTE COUNTY AIR. POLLUTION CONTROL DISTRICT xhe public hearing on the proposed ordinance on Agricultural Rules and Regulations for the Butte County Air Pollution Control pistrict was held as advertised. Rules and regulations set out and discussed. °l~eil McCabe, deputy County Counsel, gave a:brief run down.on what the proposed ordinance would do. Extra copies of the proposed ordinance presented to the public. - ~'S.~• O~ Mr. McCabe stated that t_he first part of the proposed ordinance was a series of definitions. Agr-icultural burning guidelines is the main purpose of the proposed ordinance. Amendments set out and discussed, Mr McCabe stated .that this proposed ordinance would have an emerg+e~cy claase. Don Black, Air Pollution Control Officer, stated that all counties,-have to get the rules and regulations.to the State by the-21st of this month. The Conrdting Council that has been appointed to look at these rules could be given"copies of the~ordina~nce and they might act to.make them more stringent., Chairman Reynolds stated that the point that Supervisor ,Gilman had made was.that the 1,5,-County Coordinating Council was ` '~-, Page 90'. He said he was a rice farmer and he has been requested to represent Butte County Rice Industry. He.is a member of the Butte County Rice Growers. He said he felt this was a problem that should be of mutual concern to a17. the residents in the County. He said that air pollution was a primary problem to the Cali$~rni:a fara[e-r „ He said the rice farmer produces a great deal of waste. He said they have no alternative but to burn this waste. He pointed out that the displeasure of the smoke is as great to the rice growers as to those in the cities. &ice Research Board has allocated funds for the study of the disposal of these wastes. Rice-is a water plant and even though incorporated - into the soil, the plant w.il1 not completely dissolve. He said the re .is a-real problem in Butte County raith the desease that was discovered-in Ttaly years ago; called stem rot. For some reason, this disease. has increased. The only known control for stem rot. is burning. M~a High briefly..mentioned the economic problems of the farmers. He said that agricultural farmers cannot control the price of their products. He said that maybe burning can be reduced so that.it will not be so offensive in the future. He-said that in-the past there have been several incidents of severe accidents because of smoke drifting across the roads. He said that maybe an encroachment permit shnald: be required. He .hoped that the County will help .farmers re8arding the d~ri.fting of smoke onto roadways ana how the drivers can be protected. 2, Mr. Basil Mohammed, Yuba City and Chico. He .gave .his background. He-said that-the farmers were not the only ones that made this air pollution .problem. Cars running 24 hours a day contributed to it; industry, makes a big ,problem. He said the rice stubble must be burned. He said he does not feel this burning of the rice stubble pollutes the air any more than the cars polluted the air. He said the rice problem is a different problem than the other pollution problems. Ric e: is a big industry. He appealed to the Board to help the rice industry; he urged them not to curb this industry too strongly. It was asked. if there could be a provision in the regulations than would allow the rice farmers to burn .more acreage in-the event that there is a forecast. of a heavy skorm. Mr. Black stated that that could be handled. He said that October, November and' February are the heavy, burning months. The State Air Resources Board has assured the County that there would, be at least 45 burn days. Mr. Black said he did not see where the County would run~into any problem. Mr. High requested that Section 3-15 be .interpreted for him,This section .concerns special permits. It designates certain days as "No burn days". Mr. Black said that growers could have permits to burn .on special days and with the insect problem, and stem rot, that a permit could be issued right away. for permission to burn. Mr. Black said he could not interpret the section to-mean that if there-was a.storm front moving through, that they. would be able to burn prior to that day. Mx. BLackstock recommended that on line_4 of .this section after thef-word "days", that the words "and restricted burning days" be added. It was - Page 91. The flexibility. will have to come from the air control .officer, There should be ~€lexibility when the forecast is that a.,air front is ,passing through the area-~ -Mr. Black agreed that those would be the best burning days. 3. Mr. Tom Martin, Cohasset Stage. He explained his feelings concerning this ordinance and stated that there was a difference.in ag burning and forest management. The elevation .for both activities is difference. He said he could tell from his home what kind of day it was going to be-in tihe valley. He said that in the forest areas, the burning was done during the night. The air is calm a~ that time and they can spot fires that might get away during the period of burning. Mr, Black told him that forest management did not come under these agricultural rules. He said the forest problems would be coming up at a.later date. He said that nothing that is placed in this ordinance would pre-empt the fire prevention laws. Supervisor Madigan handed a copy of this draft letter to the Chairman, and the clerk was re- quested to read the letter. In answer to Supervisor Gilman's question about reestablishing some of the present boundary lines for Chico, Dan .Mollenberndt outlined two possible solutions, Mr. Mollenberndt also outlined a possibility which would add the Forest Ranch and Cohasset areas to Supervisor Page 92. Theodolite, a surveying instrument, at a price of $2344.230' 71-1771 REPORT AND RECOMMENDATION ON BIDS FOR GRIDLEY-BTGGS AMBULANCE SERVIGE - COUNTY SERVICE AREA NOo 37 C1if£-Mickelson repotted that the Citizen's Committee from County Service Area No. 37 unanimously recommended the Macey Ambulance Service from Gridley to provide ambulance service for the Gridley-Biggs urea. The high bid was $32,400 per year for a four-year period from Macey Ambulance Service; the low bid was $24,000,.per year. It was decided to authorize the Administrative Officer to contact Mr. Macey and discuss his bid with him. `The Administrative Officer will report back to the Board next week with a final recommendation. Chairman Reynolds requested the Administrative Officer to write a letter to the individuals who have served on the Citizen's Committee and thank them for th~~ r findings. 71-1772 APPROVE TRAVBI: REQUEST' . RE ORCHARD-BURNING A communication from Bill Cottingham, General Manager of North State Hulling Coop., Inca regarding orchard burning was received and ordered entered into the reco~do 71-1-775 _DISC~'SSIONo LIMTT ON FROGGING, Chairman Reynolds expressed the intention of introducing to legisla- tion a limit on the amount of frogs allowed in one's possession at a given time, stating that one dozen frogs is a realistic limit, County Counsel will contact Senator Fred Marley about the possibility of attaching this to one of his bills before the legislature. 71-1776 DISCUSSTONa PARADE ON THE SKYWAY Cliff Mickelson stated that the "Youth for Christ" group was consid- ering having a parade on the Skyway on Satitl~lay, September 18, 1971. Sheriff Gillick had stated that he could not approve the closing of the Skyway for this purpose because of the inadequate time allow~ed:so accomplish the required pro= cedures.
