Pledge of Allegiance to the Flag of the United States of America Invocation by Supervisors Moseley 1403 PRESENTATION OF CADET CAPTAIN THOMAS E. DOYLE OF OROVILLE Supervisor Moseley introduced Cadet Captain Thomas E. Doyle of roville at this time. ,Supervisor Moseley stated Cadet Doyle is 16 years old and has won many awards through the Civil Air Patrol in California. his is the first time in northern California an individual has received this award. Cadet Captain Doyle thanked the Board. Hopefully in July he will e going to one of the military academy's. The Board will help Cadet Captain Doyle in any wa'y to achieve this oat. 1404 PPROVAL OF MLNUTES On motion of Supervisor Wheeler, seconded by Supervisor Dolan and nanimously carried, the minutes of August 26, 1980 were approved as mailed. On motion of Supervisor Wheeler, seconded by Supervisor Moseley nd unanimously carried, the minutes of July 16, 1980 and August 1, 1980 ere approved as mailed. On motion of Supervisor Moseley, seconded by Supervisor Wheeler and nanimously carried, the minutes of August 26, 1980 were corrected as follows: Minute order 80-1387, CSA 4, Sierra Del Oro (drainage) to reflect 2.16 and to correct CSA 10 to reflect CSA 12. The service charges for SA 53 to be deleted. 1405 PPROVED CETA ITEMS On motion of Supervisor Wheeler, seconded by Supervisor Dolan the ollowing CETA items were approved: 1. Approved staff response of CETA FY 81 plan to state CETA Office nd authorize distribution. YES: Supervisors Dolan, Moseley, Wheeler, Winston and Chairman Lemke Motion carried, 2. .Approved leases for CETA training center facility in Oroville and hico to permit skills training classes in the local communities and the Personne' Director authorized to sign. .YES: Supervisors Dolan, Moseley, Wheeler, Winston and Chairman Lemke Motion carried. 3. Approved the upgrading of prime CETA computer system because of hanges in federal regulations and increases in information needs and the ersonnel Director authorized to acquire necessary equipment at 100% federal cost. Approved the affirmative action plan for fiscal year 81 and instructed the Personnel Director to implement the plan. AYES: Supervisors Dolan, Moseley, Wheeler, Winston and Chairman Lemke APPROVE PERSONNEL ITEMS: ADOPT RESOLUTION 80-187 On motion of Supervisor Winston, seconded by Supervisor Wheeler and unanimously carried, the following Personnel items were approved: 1. Approved Public employees` retirement acturial study for local miscellaneous and safety members by adding one year, The cost of adding the benefits provided under section 20024.2 of the California Government Code providing for one year of final compensation calculation for local and safety members has been determined by actuarial study conducted by the Public Employees' Retirement System. The cost for local miscellaneous members is 0.924% of subject payroll. This will change the current contribution rate from 13.159% to 14.083%. The cost for this benefit based on most current payroll figures for the next 12 months is $139,579. The 0.924% increase will apply to all local miscellaneous members covered by this benefit until the year 2000. The total percentage of contribution is subject to change in the future with any change in actuarial data. The costs .for local safety member: is 1.161% of subject payroll. This will change the current contribution rate from 14.527% to 15.588%. The cost for this benefit based on most current payroll figures for the next 12 months is $25,032. -The 1.161% increase will apply to all local safety members covered by this benefit until the year 2000. The total percentage of contribution is subject to change in the future with any change in actuarial data."; Resolution 80-187 of intention to approve an amendment to contract between the Board of Administration of the Public Employees' Retirement System and the Board of Supervisors was adopted and the Chairman authorized to sign. 2, Approved the work experience agreement with Chico State University to permit placement of student interns in various county offices, interns will receive college credit but will not be paid workers, and the Personnel Director was authorized to sign. AUTHORIZE PURCHASING OFFICER TO DISPOSE OF ITEMS DECLARED SURPLUS On motion of Supervisor Winston, seconded by Supervisor Wheeler and unanimously carried, a list of county equipment and Sheriff's unclaimed property was declared surplus and the Purchasing Officer is authorized to dispose of the items by public auction on September 27, 1980, APPROVE.. CONTRACT AND AWARD BID FOR COUNTY SERVICE AREA 37 AND ACKNOWLEDGE 1980 CALIFORNIA PUBLIC LIBRARY REPORT On motion of Supervisor Moseley, seconded by Supervisor Aolan and unanimously carried, the following items were approved: 1. Award of the low bid for furnishing a subsidized ambulance service for the Gridley, Biggs and Richvale area funded through County Service Area 37 to Scott Ambulance, Inc, with a low bid of $3,821.63 per month far the next two years with a new fee schedule increasing the base rate from $60 to $85 was accepted; approved the ambulance service contract with the Chairman authorized to sign and authorize the new rate schedule for CSA 37. 2. .Acknowledged the 1980 California Public Library Report submitted by the County Librarian pursuant to Education Code Section 19168 to the Board and to the State Librarian. ADOPT RESOLUTION 80-187A RE: COURT RECORD MANAGEMENT SYSTEM GRANT MOAIFICATION FOR CLERK-RECORDER'S OFFICE On motion of Supervisor Dolan, seconded by Supervisor Moseley and carried, Resolution 80-187A for the Clerk-Recorder's court record management system grant modification at no._inerease in cost was adopted and the Chairman authorized to sign. BOARD, .- REGION C, AND APPROVE BUDGET TRANSFERS On motion of Supervisor Moseley, seconded by Supervisox Wheeler and unanimously carried, the following items were approved: 1. Resolution 80-190 the 1980-81 fire protection cooperative agreement with the State of California covering Schedule A contract for the period July 1, 1980 through June 30, 1981 in the amount of $1,754,7b7 was adopted and the Chairman authorized to sign. 20 Resolution 80-191 giving notice of withdrawal from the joint powers agreement for the Regional Criminal Justice Planning Board - Region C was adopted and the Chairman authorized torsign. 3. .Approved the following budget transferee 1413 B-9 - Gridle Justice Court. Transfers $310 from office expense to special department expense in order to cover the increased cost of law books provided under a CCCJ grant. 8-10 - Communit Action Pro ram. Transfers $200 from salaries and wages to travel and $31b from fringe benefits to consumable supplies within the Community Action Agency Beautification Project 1980 grant year pursuant to budget modification ~~2 as approved by CETA Administration on September 3, 1980. ADOPT RESOLUTION 80-192 APPROVING SALE OF PROPERTY AT 3337 COLUMBIA AVENUE, OROVILLE AND AUTHORIZING ADMINISTRATIVE OFFICER TO ENTER INTO AGREEMENT FOR SALE On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the sale of property at 3337 Columbia Avenue, Oroville agreement was approved pursuant to conditions and Resolution 80-192 autharizing the County Administrative Officer to enter into an agreement for sale was adopted and the Chairman authorized to sign. Clif Mickelson, administrative officer, pointed out many times the completed jobs are not of quality workmanship. They do try to enlist the help when possible. On motion of Supervisor Moseley, seconded by Supervisor Dolan and carried, Resolution 80-193 authorizing the County Administrative Officer and Community Action Agency Director to enter into an agreement for minor home repairs in the 1980-81 Community Development Block Grant target area with $33,075 to qualified low income residents implementation was adopted and the Chairman authorized to sign. AYES: Supervisors Dolan, Moseley, Wheeler and Chairman Lemke NOES: Supervisor Winston On motion of Supervisor Wheeler, seconded by Supervisor Dolan and carried, the Community Action Agency Title VI modification treatherization grant was approved; and authorize the funding of the top ten projects (81-2 through 81-41 as set out in the memo of August 15, 1980) with the esistiz~g CETA money. AYES: Supervisors Dolan, Moseley, Wheeler and Chairman Lemke NOES: Supervisor Winston APPROVE COMMUNITY ACTION...GRANT MODIFICATION AND CETAC TITLE VI PROJECTS CONTINUE TO SEPTEMBER 23, 1980 DISCUSSION ON HOUSING AND COMMUNITY DEVELOP- MENT CONSULTANT CONTRACT On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, continued to September 23, 1980 discussion of the Housing and Community Development consultant contract with Connerly and Associates> AUTHORIZE COMMUNITY ACTION AGENCY SUBMISSION OF BUILDING RENOVATION AND CONVERSION FUNDS PROPOSAL On motion of Supervisor Moseley, seconded by Supervisor Dolan and unanimously carried, submission of a proposal for building renovation and conversion funds to Community Services. Administration in the amount of $16,015 to assist in relocation of Oroville Community Center and repair to present Gridley Center was approved. ADOPT RESOLUTION 80-194 RE: IMPLEMENTING NEW PESTICIDE USE REGULATIONS BY AGRICULTURAL COMMISSIONER Joe Bandy, agricultural commissioner, stated he had sent the Board a memo regarding the new pesticide use regulationso The Department of Food and Agriculture are to fund part of the additional costs-from these new regulations. They will have to consider certain documents where in the past they reviewed them. It will cost $29,516 to implement the new pesticide use. They will hire one man, purchase a vehicle with two way radio and a telephone recorder. Individuals wishing a permit can abtain them in Gridley, Chico and Oroville. The Pesticide Control Officer will control only those that possess the material. Give a notice of intent of 24 hours and an inspection. They-have,.to certify to safety conditions. On motion of Supervisor Winston, seconded by Supervisor Dolan and unanimously carried, Resolution 80-194 implementing new pesticide use regulations contract with State Department of Food and Agriculture in the amount of $29,516 was adopted and the Chairman authorized to sign; and purchase of the vehicle was approved. Page 214. .September 16, 1980 September 16, 1980 80- 1419 1420 1421 142 2 1423 DISCUSSION OF NEW AGRICULTURAL BURNING RULES .Toe Bandy, agricultural comissioner, set out the background on the new agricultural burning rules at this time. This year there will be a ten pound state visibility standard. They will take the reading in Sacramento and with what we are doing and will impact that standard. Mr. Sandy stated Mr. Teie is willing to work and gather information and provide to the growers, even though his prime •3responsibility is for protection of life and property. The burning period is from October 1 to November 1. Chairman Lemke stated when Mr. Bandy had any further information and needed action the Soard will be ready to go to bat for him. Mr. Bandy is to furnish the Board with the new regulations when they axe received. APPROVE MENTAL HEALTH PSYCHIATRIC SERVICES CONTRACT WITH CSU-CHICO On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the psychiatric services contract with California State University Chico to provide services to students from September 1, 1980 through June 30, 1981 at $1,360 per month was approved and the Chairman authorized to sign. SET PUBLIC HEARING DATES The following public hearing_dates•were set for October 7, 1980 at 10:00 a.m.: 1. Joseph L. Burrell petition for variance to Sections 19-10 and/or 19-12 of the Butte County Code for placement of a mobile: home on AP 42-05-39, Nord Avenue, Route 1, Box 483A, Chico, zoning "A-5". 2. James Roberson petition for variance to Sections 19-10 and/or 19-12 of the Butte County Code for placement of a mobile home on AP 72-42-004, Wayman Zane, Oroville area, zoning "M-R". APPROVE RENEWAL OF VARIANCES On motion of Supervisor Winston, seconded by Supervisor Wheeler and unanimously carried, the following were approved: 1. Approved William J. Parks renewal of variance to Sections 19-10 and/or 19-12 of the Butte County Code for placement of a mobile home on AF 27-66-24, 6975 Citrus Avenue, Oroville area, zoning: "A-5". 3. Approved Richard W. Reese renewal of variance to Sections 19-10 and/or 19-I2 of the Butte County Code for placement of a mobile home on AP 63-04-1O1,.Star Route, Forest Ranch area, zoning: "TM-5". APPROVE PUBLIC WORKS ITEMS: ADOPT RESOLUTION 80-195 ANA WAIVE FIRST READING OF ORDINANCE On motion of Supervisor Moseley, seconded by Supervisor Wheeler and unanimously carried, the following Public Works items were approved: 1. .Approved the litter control agreement 58-171-200LG, amendment No. 1 extending the agreement from October 31, 1980 to June 30, 1981, and the Public Works Director authorized to sign. 2. Resolution 80-195 of intention rename county roads in Paradise address area setting public hearing for November 4, 1980 at 10:00 a.m. was adopted and the Chairman authorized to sign. Waived the first reading of an ordinance establishing speed limits on Evans-Reimer Road and Thresher Avenue in the southeast Gridley area,-recommended for 35 mph zoning. 4. Approved the transportation services agreement with City of Oroville through the period ending June 30, 1982 which reflects cost sharing of county 38% and city 62% and the Chairman authorized to sign. APPROVE.':- PUBLiC'WORKS ITEMS: DRAINAGE DEPOSIT REFUNDS AND ACCEPT IMPROVEMENTS ON SOUTHGATE SUBDIVISION UNIT N0. 1 On motion of Supervisor Winston, seconded by,Supervisor Wheeler and unanimously carried, the following Public Works items were approved: 1. Authorized John N. Owens drainage deposit refund in the amount of $4,158 which was required as a condition of filing a parcel map for AP 46-31-42, 51, 52 and 53, property located near Centennial Avenue, east of Chico. Deposit was paid by John N. Owens, Noel Z. Owens and Mary Helen Owens. 20 Authorized James Johnson drainage deposit refund in the amount of $5,400 which was required as a condition of filing a parcel map for AP 47-37-01, property located on the south side of Keefer.-Road, 1,100 feet west of Hicks Lane, Chico. 3. ,Authorized Public Works to release drainage deposits in sub- divisions and land divisions upon request when no drainage<'plan exists. 4. Accepted ~.mp~oveiaept8',,on Southgate-:subdivision Unit Na.,l; authorized the release of performance and labor and materials bond and commenced the one year maintenance period. On motion of Supervisor Wheeler, seconded by Supervisor Winston and unanimously carried, the following Public Works items were approved: 1. Authorized proceeding with Concow Road project in conjunction with minor projects previously approved on Big Bend Road curve. 2, Authorized to design Bruce Road extension project, process the environmental assessment and acquire necessary right-of-way in preparation for budgeting in FY 1981-82 rather than 1980-81. 3. Approved Haven Lane, Chico into the maintained mileage system; and authorized repairs in the amount of $4,000. 4. Approved Contract Change Order No. 1 for Table Mountain Bridge at Feather River, Project No. 28491-76-1.xo provide for modffying fabrication methods for the restrainer units between piers and the superstructure and the Chairman authorized to sign. 5. Approved Contract Change Order No. 1 for Foothill Boulevard, Project No. 21574-78-1 in the increasing amount of $489.28 which provides far placing perforated pipe and permeable backfill material around a spring encountered dux3ng construction and the Chairman authorized to signo 6. Accepted work of Robinson Construction Company, Inc. on Foot- hill Blvd., Project No. 21574-78-1; authorized the Chairman to sign the Notice of Completion and instruct the Clerk to record said notice with the Recorder. 7. Accepted work of S. N. Phillips, Inc. on Sacramento Avenue, Project No. 54123-79-1; authorized.ahe Chairman to sign the Notice of Completion and instruct the Glerk to record said notice with the Recorder. Authorized the Public Works Department to sign and record notices of completion on road and bridge construction projects on behalf- of the Board after acceptance of projects. 9. Accepted improvements of Mountain .Park No. 4 Subdivision; in Iieu of performance and labor and materials bonds the developer placed a savings passbook and two savings withdrawal orders in the amounts of $28,808 and $48,578 on deposit with the county. WORKS TO WORK WITH COUNTY COUNSEL RE: ACCEPTANCE AND RELEASE OF Discussion was held at this time regarding PuT"lic Works being authorized to perform the acceptance and release of sureties on subdivision and land division improvements. Clay Castleberry, public works director, stated he will work with County Counsel in performing the acceptance and release of sureties on subdivision and land division improvements. ADOPT ORDINANCE 2136: CLOSED HEARING_ON NORTH CHICO REZONE The closed hearing on north Chico rezone consideration of "C-1" zoning on AP 44-21-39 rather than the proposed "R-4" and also the property belonging to Albert and Glenn Williams for "R-3" zoning rather than "S-R" as proposed was held at this time. Bettye Blair, planning director, stated the Planning Commission modified the report. It agrees with the Williams property but not the additional property. Supervisor Wheeler stated the seven acres of Mr. Wax and Williams in that area is so chopped and she felt placing the "SR" zone was a bit redundant and felt they should allow the "R-3" designation. On motion of Supervisor Wheeler, seconded by Supervisor Winston and unanimously carried, the adoption of the north Chico rezone including "C-1" zoning on AP 44-21-39; allow Mr. Wax and Mr. Williams to be zoned "R-3" zoning rather than "S-R" as proposed by the Planning Commission; the rezone is consistent with the General Plan; Ordinance 2136 was adopted and the Chairman authorized to sign. APPROVE RECOMMENDATION OF PLANNING COMMISSION IN REGARDS TO FREEWAY ROUTE NORTH OF CHICO BE FORWARDED BY LETTER TO CALTRANS The Planning Commission's request for direction on freeway route north of Chico was held at this time. On motion of. Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the recommendation of the Planning Commission in regards to the freeway route north of Chico be transmitted by letter to Caltrans. Bettye Blair, planning director, stated the Commission was asking the Board's direction as to an extension of time, short of that she will let the Board know their feelings. Chairman Lemke stated the proper action to take was asking for ',extension and the Planning Commission to hold a public hearing as was presented Eby the memo. A public hearing date of October 7, 1980 at 10:45 a.m. was set for consideration of Jay D. Plummer proposed negative declaration regarding environmental impact and rezone from "SR-3" (suburban residential - 3 acre parcels) to "M-1" {light industrial), property located approximately 300 feet east of Cohasset Road, approximately 1z miles north of Eaton Road, identified as AP 48-01-09, north of Chico. 2, A public hearing. date of October 7, 1980 at 11:15 a.m. was set for consideration of Louisiana Pacific Corporation rezone (item 'not subject to California Environmental Quality Act) from "TM-40" (timber mountain - 40 acre parcels) to "TPZ -.160" (timber preserve), property located approx- imately z mile west of Lumpkin LaPorte Road and Lumpkin Road intersection, approximately i mile north of Feather Falls, identified as AP 71-04-19, east of Oxoville. 3. Mr. Crisan, welfare director, last year began a pilot program and has it accomplished, but because of recent legislation they must change the program. Leo Battle, deputy county counsel, set out the background on the Court. The court would be under the supervision of Superior Court. The county would back up the court over and above what is received from the income of the Court. The pilot program of Mr. Crisan has been a great success in keeping these problems from tying up the Superior Court calendar. He had been generally of the oginion that the county has gotten nothing and now that the council is waking up to the fact that the county is pulling out of the council they are going to give the county some equipment. Supervisor Winston stated that the county has had transistors on the tog of mountains for years. The ambulances have had radios from the council for years. Clif Nickelson, administrative officer, stated that all the cost of the equipment probably does not add up to what the county has paid in dues. The state and federal governments added funds to the council. The council is saying this is the first year the county will get their fair share. DATA.PROCESSING BUDGET;"'PAGE 270 ° Mr. Nickelson asked that the Board add $100,000 to the Data Processing budget for the renegotiation of the contract. The county is -going into a new configuration of trying to go on-line. There are not enough manhours available zo allow the county to implement the major effort needed to go on-line. If the Board wants to stay like the county is, it will not be necessary. The Board has already approved the upgrade of the equipment. DISCUSSION OF APPROPRIATION FOR CONTINGENCIES Discussion of the appropriation for contingencies held at this time. Supervisor Winston stated that in the memo from the Auditor it show the appropriation for contingencies as $3,192,000 in the General Fund. Jim Johansen, auditor, stated that basically there is $2,250,000 reserve that the Board approved plus the $500,000 for the Sheriff's Office and the $442,000 for the jail reserve. DISCUSSION FIRE DEPARTMENT BUDGET, PAGE 159 William Teie, fire warden, stated that if the Board has any extra money he would like to have $18,000 for the Richvale Volunteer Fire Department. The Board has made the allocation for priority ~h. He asked that the Board consider the allocation for priority #3 which is the building at the Richvale Volunteer Fire Department. They have been able to purchase afire engine for Stirling City Volunteer Fire Department for $1. The volunteers will do as much of the work as possible. DISCUSSION COUNTY COUNSEL'S BUDGET PAGE 25 Ban Blackstock, county counsel, asked that the Board transfer the $6,000 from professional services in his budget to equipment rents Page 228. September 16, 1980 September 16, 1980 80- and leases in oxder to lease a word processor for one year. He felt there v would be a number of othex departments that would be able to utilize the machine. By doing this, it will throw his budget into the red and he will be coming to the Board for a transfer from the reserve. Supervisor Winston stated that he has had occasion to use the services of public stenographers. He has been in a hurry and things have had to be redone. These have been done on a word processor. He felt the word processor was particularly adaptable for attorneys offices. By the use of this equipment and the increasing load on the County Counsel's Office, he would see very easily where they could save at least one position with the word processor. He felt it would create tremendous efficiency. He urged that the Board consider the transfer at this time. DISCUSSION OF COURT WORK REFERRAL PROGRAM BUDGET UNTT 247 Discussion of the Court Work Referral Program held at this time. Mr. .7ohansen stated that $14,303 was necessary for this program. SHERIFF'S BUDGET, PAGES 104 TO 118 Discussion of the Sheriff's budget held at this time. Supervisor Winston stated that the Board had a letter from Mr. Hecker. Mr. Hecker hasvisited with Supervisor Winston about what happened. Supervisor Winston could not help but wonder if the Sheriff can afford to send three units to a home where someone complained about a dog on the backporch. He wondered whether throwing money at the Sheriff's Office is the answer. It is frightening to him when he considered the amount of money budgeted by Board action last week for the Sheriff's Office. As far as he was concerned until a drastic change in the administration and a massive injection of common sense happens in the Sheriff's Department that the Board sbni~ld noh ba authoxizing the sums of money they are. He did not bring any of the newspaper clippings where the Sheriff promised no reduction in the Sheriff's Department in the Paradise area even though there was a reduction of 30,000 people from their jurisdiction. He submitted that removing 30,000 people in quite a tremendous area including the urban area from the responsibility to maintain the same number of deputies in that particular part of this county does not make very good sense. He knew that all over the county people were calling for deputies. The main interest is from people in the hills asking for resident deputies. Mr. Stenberg is saying yes they can hire resident deputies and the Sheriff is saying he will patrol those areas with deputies out of Oroville. Supervisor Winston stated there were one or two people on the committee ti*ho~~:have told him that they want the resident deputies back. The Sheriff made a presentation and this was the answer to his request. He felt the Board had gone overboard on these particular allocations. He expressed a deep concern that the' matter wi7.1 non stop here. He knew that Chairman Lemke had expressed a concern that if the Board did not give something to the Sheriff's Department the initiative would pass in November. If the people of Butte County vote for the Sheriff's initiative in November, God help them. He did not thinle that any action the Board might make would have a great deal of influence on the correct population of the law enforcement people. In the countries where hands are cut off, there is still crime. He did not think that throwing bodies at the problem was the answer. He did not`"think that by adopting a budget providing that percentage of money to the Sheriff's Department was in the best interests of the people of the County of Butte. DISCUSSION OF THE BUDGET AS PRESENTED AND AMENDPD Supervisor Winston questioned tfie Auditor as to whether he felt the budget was a good budget. Page 224. September lb, 1980 September 16, 1980 g0_ Mr. Johansen expressed serious concern about the budget. No ~ one can predict what the economy will do. From that standpoint he would be conservative and would like to retain the fiscal flexibility for next fiscal year. If the economy responds, if the sales tax exceeds the anticipated amount perhaps the county will not be in a bad way next year. Supervisor Winston stated the Soard had received a memo from the Administrative Office on the North Valley Plaza and the effect of annexation would have a catastrophe effect on the sales tax. The likelihood of the annexation is pretty fair. Supervisor Dolan stated that the City of Chico has been holding the sewer capacity for the mall until they make a decision on annexation. The people in the area are putting pressure on the city to release the capacity and the city is putting pressure on the mall. Mr. Nickelson stated that if the mall did not go to the city and an assessment district were formed, there would be a heavy amount of fees charged. If the city annexed just the mall it could happen in 45 days and be ratified by the Secretary of State on January 1. The big issue 3s the rest of the built up area. There would be the problem in how would the county fund the fire department if the sales tax were reduced. Supervisor Dolan stated this was a argument for keeping the reserve with the original recommendation from the Auditor of $3.5 million. Dan Blackstock, county counsel, stated the Board had a legal problem if they thought the mall was going to be annexed into the city. There is a problem with regard to the funding for the fire department. The county has not taxed for fire services. There is a provision in the. Government Code that the county cannot use funds except for taxes collected from the unincorporated area to pay for the fire department. That is why the county is using the sales tax for funding the department. The question is what tax funds are going to be used to substitute in the event the mall is annexed. Mr. Johansen stated they were faced with that this year to a degree. They were able to use the franchise taxes this year. The revenues available for funding the department are relatively few. They could face a problem. DISCUSSION SHERIFF'S BUDGET,_PAGES_ 104 TO 118,. Chadrman Lemke did not see any reason to change the figures as presented by the Auditor at this time. As far as the Sheriff is concerned to consider the fact that they are ._nnfi reducing officers from the Paradise Substation is that now that Paradise is incorporated they are finally up to staff. Prior to the incorporation they operated on 12 men. It takes five men per shift. The area patrm3led was from Butte College to Inskip. Now that Paradise is incorporated two men can well traverse the geography of the upper ridge:. and below the upper- ridge and they have finally realized there is sufficient staff for the area. The estimate for the initiative is going to be about $2 million to implement. He would not worry about the reserve for contingencies because it would be totally used for the initiative. He has received calls regarding the action that was taken by the Board. There is still some doubt but the people are satisif~d with what is taking place. The Board has tied into this action a study of the Sheriff's Department and that is what is going to provide whether there are the management skills or the sufficient personnel to carry out the job of law enforcement in Butte County. September I6, 1980 S~tember 16, 1980 80- Supervisor Wheeler felt it was important to recogna.ze the :act that the funds impounded for the upgrade of the Sheriff's Department ras placed into the reserve so that the expenditures need to came before :he Board and it takes four votes to release the funds. Supervisor Winston stated Sheriff Gillick has been before the ioard making the same comments about every other part of the county as ;hairman Lemke had stated about Paradise. As a city taxpayer he refused and would continue to refuse to pay fox his urban protection and urban ?olice protectioni~i the county. If someone does not bring suit, he as a private citizen will. Chairman Lemke stated he was a city taxpayer paying taxes for the city as well as the Sheriff's Department. He reminded the Board that the $1.5 million that could possibly be lost from the North Valley Plaza represents a considerable amount of money paid by the City of Paradise and the unincorporated area. He doutted whether there could be equity for everyone. He submitted a letter from Joseph B. Tokarski relative to a cabin 3n Butte Meadows asking if the Butte County taxpayers were entitled to regular patrol and some kind of protection. Sheriff Gillick had the figures when he made the presentation and he had the experts advising what they felt were necessary to enforce the law. He assumed that everyone on the committee were speaking for the citizens. The committee was not able to disprove any of the figures. Chairman Lemke stated that there were four or five meetings of the committee on this matter. The initial meeting was spent with the Auditor talking to the committee about ixow the funding came down and slat problems the Board was faced with during the budget hearings. The Auditor answered questions for people who had other interests as well as police protection. If the Board neglects to heed a portion of what the Sheriff has recommended, the Board is giving away the initiative election and are looking at $2 million instead of $500,000 presently being requested. Mr. Nickelson stated the. Board had allocated money for additional jailers and some construction in the new jail in addition to the $500,000 for the Sheriff's Department. For this year, without 12 months, the cost is around $200,000. Supervisor Dolan felt the point was that it is just not the $1/2 million added to the Sheriff's Department, it was at least $650,000 counting the jail. It is a lot of money. Mr. Johansen stated the $500,000 figure is somewhat misleading. The cost for next fiscal year might be twice that amount. Supervisor Dolan did not vote for the budget just because she wanted to go on vacation, It still remains her..^..concern. The Board needs the results of the study and thorough information before anyone is added. She did not feel that just by adding $500,000 to the Sheriff's budget would answer the initiative. She felt the proper thing was asking for the study. DATA PROCESSING BUDGET, PAGE 270 Supervisor Wheeler felt that $100,000 was a very small amount of money for data processing considering the cost increase in the worload in the three major work areas, Auditor, Assessor and Treasurer-Tax Collector. Page 231. September 16, 1980 September 16, 1980 80- Mr. Johansen stated he had made a rough.' comparison for 1977. The average increase in the three major users was about 50 percent over the three previous years. From 1978 to 1980-81 the increase was about 38 percent. They would be looking at another $L00,000 roughly. Mr. Nickelson set out what the $100,000 would be used for. They would be renogi$ting a new contract and this would help get the transition done. The cost of data processing would not be reduced after a year. -Inflation would be a factor. There will be additions to data processing such as jury utilitization and CJIS programs. They are paying for Bart of the startup on these programs. Nothing being done in government will get any cheaper next year. There is an increase in the population and an increase in the Consumer Price Index. The Systems 80 will cost less in rental payments than the county is paying at the present time. BY CITY OF OROVILLE REPRESENTATIVES CONCERNING THE PROPOSED OROVILLE GENERAL PLAN REVISION Dave Jenkins, city administrator, representing the Oroville City Counetl, advised the Board that the city in cooperation with departments in the county are proceeding with the Oroville urban General Plan. The Oroville City limits contain 11 square miles and the urban area contains 40 square miles with a population of 25,000 to 30,000 in the urban area. In addition to the various elements, they are adding the Economic Development Element and the Leisure Services Element. They are addressing serious problems in the urban area. The unemployment rate at times is seven percent higher than the county rate, or about 18 percent. The reason for the unemployement is the seasonal work in the area. They would~.ike to support industr}r and the need for fulltime year-round employment for people in the area. The City Council and Planning Commission are setting up hearings throughoutithe city and the urban area. In the spirit of cooperation they need input from the Board and the county Planning Commission. There will be a series of hearings in the Thermalito, and south side areas. He extended an invitation to the Board and the county Planning Commission to attend the meetings and take part in the process. They were able to develop a master plan for the industrial area because of money from the county. He thanked the county for their cooperation.
