The cost would be the same for those receiving less benefits as for those receiving more benefit. He wondered if the Board could use two different formulas for charges. Dan Blackstock, county counsel, stated there was a provision in the Government Code that allows for certain charges. They are to be based on the benefit to the particular parcel. In computing these staff determined the benefit to the parcels. If these charges were not made, there would not be money to properly maintain the Mud Creek diversion and they would be looking at the eye of possible flooding that would effect everyone within any of the zones of benefit. Mr. Hockett felt the Board was taxiing two different ways. He lives on East Avenue and he gets no benefit from Mud Creek district. Supervisor Dolan stated that another way to look at the service charge was for the administration of the district. Hearing closed to the public and confined to the Board. Jim Johansen, auditor, stated that in response to the Board's action on September 16, 1980 he had presented a revised budget resolution and detailed changes. He set out the changes at this time. The $24,000 membership for Northern California Emergency Medical Care Council was placed in the Board of Supervisors' budget. The rents and leases in the amount of $6,000 was added to Counsel's budget. The additional amount for data grocessing was added ~n-page 4. Tie.Work;~Refaxra~-s~~ogram~was added. The amount for Richvale Volunteer Fire Department was added on page 8. Page 13 is a summary of the changes to the appropriation for contingency. Hearing open to the public. Appearing: No one. The net result has been the reduction to the reserve for contingencies. He is supportative of certain changes. Mr. Johansen stated the appropriation?.'for contingencies is $3,028,424, which includes $942,000 set aside for the Sheriff and the jail, leaving a net resulted appropriation of $2,086,000, Fote on motion: AYES: Supervisors Dolan, Moseley, Wheeler and Chairman Lemke NOES: Supervisor Winston Motion carried. ** On motion of Supervisor Wheeler, seconded by Supervisor Dolan and carried, Resolution 80-202 adopting the budget for the fiscal year 1980-81 with a total budget of $58,063,579 was adopted and the Chairman authorized to sign. YUCRSS: 10:40 a.m. RECONVENE: 10:54 a.m. CONSIDERATION OF ORDINANCE AMENDTNG CHAPTERS 20 & 24 OF THE BUTTE COUNTY CODE REGARDING REGULATTONS AND CONTROL OF SUBDIVISIONS AND TO ZONING REQUIREMENTS Consideration of waiving the second reading and ordinance amending Chapters 20 and 24 of the Butte County Code regarding regulations and control of subdivisions and to zoning requirements held at this time. 1471 Del Siemsen, deputy county counsel, set out the background of the ordinance. This is amending Chapter 20 the subdivision ordinance. This probably could not go into effect until around November 1, 1980. There are some changes that will: be coming down in the State Map`°Act that could have an effect on this ordinance. He did not know what the changes would be. He suggested that the Board go through and consider the ordinance and hold off adoption of the ordinance until the changes are made in the State Map Act. John Mendonsa, public works, stated that the committee on land development processes could come up with recommendations that could also change the ordinance. Mr. Siemsen stated that if the Agricultural initiative passes there could be some ramifications to the changes. With that in mind, he suggested that the Board proceed with the review. Some of the changes made reflect a change in Board policy. One of the changes refers to the allowing of lot splits with 20-foot wide access. SUPERVISOR WTNSTON ABSENT AT THIS TIME AUTHORIZE COUNSEL TO ENTER INTO LETTER AGREEMENT WITH RICHARD SHIPLEY FOR PURCHASE OF WATER FROM 'LAKE OROVILLE Dan Blackstock, county counsel, asked that the Board authorize him to enter into a letter agreement with Richard Shipley for the purchase of water from Lake Oroville with a minimum chagge of $50 and for Mr. Shipley to hold the county harmless. He will be taking 40,000 gallons of water. 1472 On motion of Supervisor Moseley seconded by Supervisor Lemke and carried, County Counsel was authorized to enter into a letter agreement with Richard Shipley far purchase of water from Lake Oroville at a coat of $50 and providing that Mr. Shipley will hold the county harmless.
