The Council sends notice of their 0 opposition to any further gun control laws which would restrict members' rights to awn and ~ ~ ~ enjoy or use firearms. They also go on record as commending the California Legislature for requiring mandatory prison sentence for use of firearm during the commission of a crime. Information. Mr. Rackerby was present to answer questions of the Board members. Salory to be paid to the Civil Disaster Officer discussed. Mr. Rackerby said the recommended salary was a valid recommendation. It was stated that 50% of Mr. Struthers time will be spent on these matters. Other positions covered in this ordinance discussed. it was moved by Supervisor Madigan, and seconded by Supervisor Cameron that the salary ordinance amendment be approved and that the first reading of the salary ordinance amendment was waived. AYES: Supervisors Cameron, Madigan, McKillop and Chairman Ladd NOES: Supervisor Richter ~?tlOn failed as it takes a unanimous vote of the Board to waive the reading of an ordinance. This corrects budget transfer 1975-2. When reconciling the fair premiums payable figures with those of the Auditor's Office, there was a need to adjust the amount of funds transferred on the previous transfer by this amount to brim the figures into balance. Transfer approved by Auditor and has been cleared with Department of Fairs and Expositions in Sacramento. On motion of Supervisor Richter, sewnded by Supervisor Cameron and unanimously carried, Golden Feather Fair budget transfer number 1975-3 was approved and the Chairman authorized to sign. 75-1590 APPROVE CIVIL DISASTER 'PROPOSAL T e propose as iscusse at t e rvil Disaster Council meeting needs Board approval so that it can be implemented and budget adjustments made. Mr. Struthers was present to discuss the proposal. Mr. Struthers feels that this is the minimum effort that should be expended. page 225. September 23, 1975 !"~ ~ On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, the civil disaster proposal was approved and authorizati on granted for reorganization and budget adjustment to implement it. 75-1591 AUTHORIZE ORDINANCE CHANGE TRANSITIONING CETA CLERICAL POSITION IN BLDG. & SUBDIVISION DEPARTMENT T Bw ing an rv~s on nspection Department is funded through self generated revenues. A clerical position currently funded through CETA in this Department should more properly be funded through the Building and Subdivision Inspection fund. Position discussed. Chairman Ladd said he was not in favor of the transferring of these people. He, could not support this action as it will be putting another position on the payroll. On motion of Supervisor Madigan, seconded by Supervisor Cameron and carried, an ordinance change iransitioning the clerical CETA position assigned to Building and Subdivision M a regular position was authorized to be prepared. AYl=S: Supervisors Cameron, M:ird'rgan and Mc~llop NOESz SupervisonRtchter and Ghainnan Ladd RECESS: IO;15 RECONVENED: 10:30 CHAIRMAN LADD WELCOMED THE AMERICAN GOVERNMENT CLASS FROM GRIDLEY HIGH SCHOOL AT THIS TIME. 75-1592 DISCUSSION: HOUSING AND COMMUNITY DEVELOPMENT GRANT Mr. Mic a son exp ained t at t ere are many areas re t sta needs to have policy decisiarsmade as they get into the implementation of the HCD grant. Any actions should also involve the City of Orovtlle and the Housing Authority. Chairman Ladd stated that the government cannot buy property as cheap as private enterprise except in the instance of eminent domain. He feels there should be an area drawn for the property involved. It was his opinion that private parties should purchase land, build units and lease them. He dcesn't feel government should own the land. Scott Tandy, administrative analyst, explained that the grant is approved with terms. This grant was approved with the term that the money would be used for land acquisition. late doesn't feel that this money can be used for other projects but that other protects could apply for funds in the future. Supervisor Richter explained that he feels it makes very little sense to buy property and then turn around and sell it to i-~divtduals. Supervisor Cameron feels that the Beard should appoint a site selection committee to study the matter. rle also wants the Board and the committee to look at the property that will be auctioned off for tax purposes. He feels it is possible that some of this land will meet the apecific~ations and can be acquired at a comparatively low price. Supervisor Richter feels it is wrong to buy land, tear down the existing buildings and build new ones. Chairman Ladd stated that this would be more appropriate in a city where they might have condemned buildings and very little clear land. Page 22b. September 23, 1975 r ~, ________________~~~~'~~=1Q7~=- ---- He feels that Butte County somehow got swept into this with other areas, Mr, Nickelson explained that they recommend that the committee be composed of Board members, someone from the City of OroviHe and someone from the Housing authority. Discussion of reallocating this money to another project. Supervisor Cameron felt this would put o cloud on future requests for funds. Mr. Tandy stated that two men from HUD will be in Oroville on October 1 or 2. Chairman Ladd felt that something should be done before these men came to Oroville in the way of plans. Chairman Ladd and Supervisor McKillop will serve on the committee. Mr, Tandy is to schedule a meeting, to include representatives of the City of Oroville and the housing Authority, for next Monday. 75-1593 DISCUSSION: LEGAL ADVISOR TO LAW ENFORCEMENT GRANT; AppROVE BUDGET TRANSF'ER5 ~~Mr. ttoward Casagrande, CCC.?, explained that the problem on the budget transfer for the Legal advisor is a mechanics! problem on the county's side. This has nothing to da with their office. Supervisor Richter questioned Mr. Casagranda regarding the county's portion of the funding far this program. Mr, Casagrande explained that on multi-year programs, the funding is 90%-10% for the first year (state paying 90%), 700% the second year and $0°10-50°/a the third year. IiYith the program, the county is now required ro match funds for 47%. Mr. Casagrande explained that this was a de eisian of the plannir~q board. Supervisor Richter feels that there are other programs that should have priority and doesn't feel he can support this program. Supervisor McKillap stated that the Board has already voted to support the program when they approved the budget for it. Mr, Nickelson explained that 47~% was budgeted for this, Chairman Ladd stated that these programs should be evaluated and not carried on through when they do not fit the need ~df the people. Discussion of the program, Supervisor McKiliop stated that if the Board objects to this match, they should Approve only one-year programs. Mr, Casogrande explained that some programs started under this have become permanent, such as the narcotics resources center. Each program should be evaluated to see if it is worth spending the money on,. Supervisor Richter stated that this is not the time to be evaluating the program. Chairman Ladd stated that he will no*. vote for these types of programs in the future unless he feels that it is a worthwhile program. On motion of Supervisor Richter, seconded by Supervisor.Camecon and unanimously tarried, the following budget, transfers were approved: B-023 District Attorney -Legal Advisory to Law Enforcement, This corrects and increases appropriations on this grant which st rted June 14, 1975 and was brought forward into the current year. Transfer reflects grant comditions as applied for by the Board under Resolutim No. 75-40 passed on March 11, 1975 and approved by OCJP on July 31, 1975. Amounts set up in the budget reflect unanticipated revenue federal aid -other in the amount of $3,882.50, state Page'227. September Z3, 1975 /"+ aid -other $1,007, and $1,975.50 from the reserve £or contingencies. Total appropriation set up $9,267. B-028 Superintendent of Schools -Juvenile Delinquency Prevention Grant. This establishes a budget for the Juvenile Delinquency Prevention Grant for the period September 1, 1975 to August 31, 1976 per County Resolutian~75-95 adopted on June 24, 1975 and approved by OCJF on August 25, 1975. Total amount of _ grant $31,870 with $19,758 coming from federal aid-other, $1.098 from state aid-other and $11,014 from local aid-other. Na county funds involved, B-031 Supplemental Manpower Pros ram CETA Title I. This transfers $354.99 from Compensation Insurance to extra help in the Youth Program, and $18,647.57 from Compensation Insurance to extra help in the Adult Program. 8-032 Auditor. $4,000 is transferred from salaries and wages regular to extra halp~within the Auditor's budget to cover cost of extra help accountants hired to #ill extended vacancies in auditing and accounting sections caused by prolonged illness and retirement and resignations. 75-1594 APPEARANCE; BUD CONKLIN PARADISE CALIFORNIA HORSEMEN`S ASSOCIATION Mr. Con in present t e a wit a certi icate o appreciation r t etr involvement in the Bicentennial celebration. Supervisor McKilllop praised Cho Pageant Riders and everyone involved in the parade for the excellent job they did. 75-1595 APPEARANCE: DAVE MAC KEY SIGNAL REAL ESTATE COMPANY Mr. Mac ey exp nine t at t ey are in t e process of deve oping a to caide of Butte County, Mr. Mackey explained what they are doing on this and the purpose. This will give the exact locationot` any piece of property within the county. He feels it will not only benefit the real estate business but will also help the fire department and the police department. lie feels that the company involved could have helped on the street naming study and saved the county some money. Mr. Mackey requested that the Board send a letter to the departments requesting that they give Mr. Mackey any help he needs. Supervisor Cameron stated that the records ara public and that he is sure the departments ara already very willing to work with Mr. Mackey on this in any way they can. 75-1596 APPEARANCE; PATRICIA RELLAFORD PARADISE Mrs. Re aford exp sine t at s e app led for and been granted welfare assistance. She then received a job as a social worker but has now been fired from that job and she has had to reapply for welfare. Mrs. ReUaforcl stated that she has been in touch with her attorney and that she will bring suit against the welfare department. She has a list of ten pages of reasons far her firing. 75-1597 APPEARANCE; CHARLES E. NELSON BIGGS Mr. Nelson explained that ise fa trying to deed five acres of his land to his brother. Mr. Castleberyy is to look at the property later this week and will discuss the matter with Mr. Nelson. 75-598 AUTHORIZE LETTER TO BE SENT TO AEPARTMENT OF WATER RESOURCES RE LIME SADDLE L'fl1~II~illNITY SERVICES DISTRICT Ehe Department of Water Resources wrote to the Board of Supervisors as Board of Directors of the Lime Saddle Community Services District regarding Che possibility of the Paradise Irrigation District transporting Lime Saddle Community Services District water through their system. Carl Fischer of the Lime saddle district, stated that the advisory committee met Last sight sad drafted a response to the letter. They request approval of this response. Supervisor Cameron stated that he has talked with Mr. Kellq of PID and they do sot agree that PID can handle any additional terrikory. Supervisor Cameron read a note that reaffirmed the district's intention not to annex any other land. Supervisor Came ran feels nothing should be done until the election in November fox fear of causing a problem with it. Discussion of the Lime Saddle District. Mr. Fischer explained that there are approximately 15 to 20 residents with many people in mobile homes is parka. Mr. Fischer explained that alI they would like to do is participate in a study of the feasibility of transporting the caster. Hendricks Canal discussed. It was explained that the PIA hoe applied for Davie-Grunsky fund e. Dave Miaasian, attorney for PID, explained that they would not like this matter to get involved at this time. He feels this request would compound any problems that they now have. Mr. Minasian discussed the district and its problems. He stated that the letter from D.W.R is not correct and explained why. Details of the district discussed. Mr. Fischer again stated that they only want to be included in the study, nothing more. Supervisor Cameron again explained that he feels it could jeopardize the election and that the Board should do nothing until after the election. Supervisor McKiilop agreed with SSnpervisor Cameron that this should be held off until after the election and fee la that this is premature. Discussion of reapondiag to the D4'W.R. letter. Mr. Nickelson suggested that the Board direct a letter to Mr. Dalcini that dicussion of this will be held oft for 60 days but that this is not an indication that they have lost interest in the Davis Grunsky funds, and that Chey back the pro3ect in Paradise. On motion of Supervisor Richter, seconded by Supervisor Cameron and unanimously carried, the Board authorized a letter to Mr. Dolcini of the Department of Water Resources as outlined by Mr. Nickelson, with the draft to come to the Board next week and that Mr. Minasiaa ie to receive a copy of this letter. FOREST LANDS The public hearing on the Butte County Planning Commission initiated- Northeast Butte County rezone from S-H, A-2, TM-5, TM-20, and TM-40 ro C-f, alt Diamond International Corp. forest lands, and from A-2 io TM-40 all forest land with permanent timber rights held by Diamond international Corp. , aH located in northeastern Butte County. Jim Lawson, Planning Director, aet out the background of this matter. A map was displayed setting put the arks to be rezoned. Chairman Ladd presented a letter to the Clerk that had been filed with him. The Clerk read the letter from Katherine Bolles at this time, requesting that her property not be rezoned as requested by the Planning Commission. Hearing opened to the public. Appearing; I. Waiter Bolles. He asked for the reading of the TM-40 ordinance. He was told that residences could be built on the property. He stated that he was opposed to any rezoning of the property; he would prefer that it be left os an A-2 district. 2. Bob Barrett, Diamond international Corp. representative. He stated they were in favor of the rezoning. All the property being rezoned belongs to Diamond Enternational Corp, and they are dedicated to commercial forestry. Stirling City and Lovelock are excluded from this rezoning, 3. Bill Cornpbell. He owns 320 acres at Flea Valley. His property is within this rezoning. He said he had not been notified of the rezoning and he would like to study the ordinance and what would be allowed in this zoned area. 4. Mr. Frank Stewart, Land Manager for Diamond International Corp. He explained the practice of this tympany regarding the cutting of timber. Dan $lackstock, County Counsel, explained the effect this zoning would have on the taxes in this area. This type of zoning will limit the use of the land. The Assessor will be unable to use any comparable sales for assessment purposes. He explained how the property would be assessed. Hearing closed to the public and confined to the Board. On motion of Supervisor Cameron, seconded by Supervisor Madigan and carried, the following ordinances were adopted and the Chairman authorized to sign: I. Supervisor Madigan stated that Dr, Horning had called him and stated he hoped the matter could be continued. Robert Stan ley appeared on behalf of Mr. Johnson and the others involved in this hearing. They have been working constantly on this matter and they are confident that they will be able to comply very shortly. they will probably have satisfactory evidence before the Board within 30 days. Phil Macs was present and stated that they had delivered the road wnstruction agreement to the Road Department today. They were unable to deliver the bonds at this time. He requested that the Board consider some type action at this time, subject to delivery of the bonds. It was moved by Supervisor McKillop and seconded by Supervisor Cameron that certificates of compliance be issued, subject to 'the delivery of the bonds, and subject to County Counsel's approval and that all conditions be met. Bettye Blair stated that they would have to issue conditional certificates of compliance. A record of survey has to be filed. Mr. Mace stated he was not requesting conditional certificates. He does not want to saddle his clients with conditional certiFicates. Chairman Ladd said the best course of action vwuld be to continue this hearing for a week so public Works could study the matter. Motion withdrawn at this time. It was stated that there is available space over the Central Bank on the second floor. These offices are vacant at this time. Rent for this space discussed. It was moved by Supervisor Richter and seconded by SupervisorMadigan that the Board direct the staff to retain an architect (Lawrence Thompson) to submit three alternate proposals to provide the needed County office space at the Thermalito County Center and later that a final Architectural proposal for the seclected alternate be submitted for final consideration by the Board. It is further suggested that a landscaping plan be considered for the County Center that could be 'implemented by stages. Motion discussed. Supervisor McKillop felt that at this point the motion is out of order. Supervisor Cameron stated he would not wpport naming an architect at this time. Supervisor Richter said he would withdraw the name of the architect from his motion. Name of architect deleted from the motion. Waived first reading of ordinance establishing 35 MPH speed limit on Keefer Road, north Chico. 3. Adopted R3solution 75-144 authorizing execution and acceptance of easements from Southern Pacific Company covering Evans-Reimer Road crossing C-155.8 and Megan Lane crossing C-182.) and authorized the Chairman to sign. 4. Approved CCO ~I roofing contract for Administration Building and Shop Building with Parma-Tits Roofing Company, which reflects reduction of $802.04 because of the condemnation of the Old Courthouse and adjoining'Shop Building. It increases the contract in the amount of $1,475 for the reroofing of the Courthouse Annex with asphalt shingles. Net increase $672.96. 5. Approved Change Order Na. 1, Skyway C Magalia Dam project (51261-74-I, in the increasing amount of $3,518.60 which provides for lowering footing block in the concrete retaining wall and bridge abutments. 75-Ibll INFORMATION AND DISCUSSION ITEMS a Requirement or County Engineer to verify that homes are or are not subject to flooding for lending agency purposes. Cloy Castleberry, Director of Public Works, reported on this new rule. He said they were not ready to do this on every house. They have a problem in this area. There is a house in Chapman Town that is in the process of being sold. Supervisor Mad?can explained the problem. This is not in an area that has been flood plane zoned. Supervisor Madigan said this matter should be pin-pointed. He did not think it was a law; it might be a regulation. It was felt that County Cou-hsel should look into this matter and alert the Board about how it should be handled. Mr. Castleberry will write a letter for this one case only, making this a stipulation that it was for this case only and that it is not the County's intention to do this in the future. Mr. Castleberry will work with County Counsel on this problem. 75-1612 TWO CBlCO SUPERVISORS TO ATTEND BEARING IN DURHAM: NOT TO BE AN ADJOURNED MEETING. Supervisor Cameron suggested the name of Mildred Force for appointment to Mental Health Advisory Board. Appointment to ~Merita! Health ,Advisory `Board" ~ •.: put over at this time. - On motion of Supervisor Cameron, seconded by Supervisor MoKillop and unanimously carried, Dr. Richnrd Campion was appointed as a member of the Alcohol Advisory Board, and as a member of the Technical Advisory Committee. 75-1616 DISCUSSION: PLUMAS COUNTY PILOT PROGRAM FOR RESTRUCTURE OF EXISTING WELFARE AND SERVICE5 SYSTEMS IN RURAL AND SEMhRURAL COUNTIES Discussion was a concerning P umas County s pi of program r restructure of existing Welfare and services systems in rural and semi-rural counties. Supervisors Cameron and McKillop will attend a meeting in Plumas County wncerning this matter. It was stated that at a meeting in San Francisco of CSAC, time was spent discussing a regional meeting with Secretary Butts and representatives from 23 other States fn be held in Louisiana to listen to the demands on the initial program and the food stamp program. Plumas County`s program will be discussed at that meeting and Welfare reform will be discussed. 75-1617 DISCUSSION: STATEWIDE TAX REFORM COMMISSION Statewi a Tax Re orm Commission iscusse Board members received copies of this matter. Property tax changes ore being considered. Commission discussed. Supervisor Madigan will bring this topic up at the Government Operation Committee of the Nine Northern Counties Supervisors Association meeting. 75-1618 DISCUSSION OF AND ADOPTION OF FINDMGS OF FACT AND DECISION RELATIVE TO THE NOTECES OF VIOLATION ON PROPERTIES IDENTIFIED AS AP 61-07 various, AP 62-52 vario various and AP 62-53woriaus Fin ings presented by Dan Blackstock, County Counsel. Changes to the findings suggested. Supervisor Madigan felt that 60 days was too long a period of time to allow the violators. The County is requesting that they agree with the road agreements. Supervisor Richter said he would like to go back up on Bloomer Mt. and look at the area with some of the staff people. It was moved by Supervisor Cameron, seconded by Supervisor Richter and unanimously corried, to deny the appeal from the Subdivision Committee `s determination to file Notice of Violation for the area set out inF.xhibits 1 through 5, excluding ail recorded final maps and parcel maps and the small parcel for the water tank of Feather Ridge Estates Wager Association, Inc; finding that the division of land violated the Subdivision Map Act and Chapter 20 of the Butte County Code. Finding is based upon the following facts; 1) That Feather Ridge Estates (ne. created more than five parcels of land by Page 240. September 23, 1975 ~'` ~ -_____ __~_~~___=~~5_egt~rnber23 J47~_~~_ dividing a single parcel; of which not all resulting parcels were parcels in ,excess of 40 acres. 2) That Feather Ridge Estates retained financial control of a majority of more than 100 parcels through blanket deeds of trust and partial release clauses. 3) Testimony by ultimate purchasers that they continue to pay Feather Ridge Estates Inc., installments for the purchase of their land. 4} That no institutional lenders were involved. 5} That 106 parcels were created in approximately 3 months through q single title company and notary. 6) Business relationships. 7} Formation of a mutual water company to serve the subdivision. 8) Testimony of numerous Witnesses to the effect that the property was advertised by, the property was shown to them by, down payments were madt to, individuals who had no apparent record title to the parcel of land in question, however, had been responsible For prior splitting of land. Further move to direct the Department of Public Works and the Health Department to issue building and septic tank permits pursuant to the Uniform Building Code and Chapter 19 of the Butte County Code when applied for the innocent purchasers in this particular area. however, such permits shall be reviewed by the Board prior to issuance so that conditions may be placed upon thos permih that will protect the health, safety and genera (welfare of the county. Furtiter move that counsel be directed to file suit pursuant to Government Code Section b6499.33. Counsel shall not be required to file suit in this matter if he is able to reach a negotiated settlement prior to filing suit but in no event later than 60 days from the date of this motion. Any negotiated settlement shall be approved by this Board. Supervisor Richter said that by looking at the area twice, he feels that based on the hearing, and what he saw, the Board should ask the Grand Jury to investigate the whole area and especially Mr. Mann as he sold property without a license. The Grand Jury should be asked to look at the whole situation on Bloomer Mt. Supervisor Madigan suggested issuing subpoenas and find out what they care to tell the Board under oath. This might be beneficial to the State and ro the District At3oraey's-afffce. On motion of Supervisor Madigan, seconded by Supervisor Richter and unanimously carried, subpoenas were authorized to be issued and served on; Bill Sumner Don Mann Jayne Seeman ' Officer Eastham of OPD to appear before the Board on October 21st, 1975 at 1:30 p.m. in answer questions about what They know of these transactions.
