They request that the County take over the overlook road, Mr. Castleberry will report on this later, No action at this time. 73-1495 APPOINTMENT TO RECLAMATION_DISTRICT N0, 833 On motion of Supervisor Ladd, seconded by Supervisor Madigan and unanimously carried, the Board concurred with the recommendation of the District, and reappointed Mr, Sherman 5, Hinaman, Jr. as a Trustee of the Reclamation District No. 833, for a term of four years. 73-1496 D_I_SCU55ION: DUMPING OF PEACHES ON COX LANE BY CANNERY Dan Blaclcstocic, County Counsel, reported on the matter of the dumping of peaches bar the Cannery on Cox Lane. He had requested Lvnn Van Bart, County San:itari.an, to look into this matter. Mr. Van Hart filed a report, stating that Mathews, in i:he future, cvi.ll not use the Cox Lane site. The property fins been re-disced and the problem is no longer substantial. He explained hoer problem had been created. Situation discussed; no action taken at t1iS~s time. 73-1497 ADOPT ORDINANCE 1402, A SALARY ORDINANCE AMEDTDMENT Bob Crisan, represAnting the [Telfare Department and Mrs. Rutherford was present to discuss the employees set up for the Homemakers Program. Mr. Nickelson explained the situation. Tt was suggested that the proposed ordinance could be adopted as proposed but place a restriction on the filling of the homemakers and Supervisors positions. Mr. Crison explained the request. This is a follow up on the resolution adopted by the Board on March 20th going to the home care program. There is a deadline of December lst on this program, The program must be a going program by December 1st. Mr. Nickelson said he would recommend that the Board designate a committee to sit doton and go over all of this. 1Ie said the thing that concerns him the most is the possibility of expanding the County staff. He explained the costs and problems involved. Mrs. Rutherford said she felt that the concept of the Homemaker Aid program was a good one. It would help the recipients to acquire job skills. Mr. Harris, Director of E.O.C., presented his position of the program. Tt would help the aged, elderly and blind, There are many aspects of the program that would be beneficial to the recipients and also to the County. On motion of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, Ordinance 1402, amending the salary ordinance, was adopted,and the Chairman authorized to sign, with the understanding that the Homemaker positions will be frozen at this time. 73-1498 ADOPT RESOLUTION 73-159. APPROVING COOPERATIVE PERSONNEL SERVICES TEST CONTRACT James Rackerby, Personnel Director, stated that the State Personnel Board has requested renewal of the test security contract with the County, Personnel uses Cooperative Personnel Services' test materials. Contract discussed. On motion of Supervisor Gilman, seconded by Supervisor Cameron and unanimously carried, Resolution 73-159 approving cooperative Personnel Services Test Contract was adopted and Personnel Director was authorized to execute on behalf of the County of Butte. 73-1499 MANPOWER REPORT Mr. Rackerby reported on the status of the county manpower programs. He said the County is involved in three programs with the Department of Labor. The first program he explained was Operation Mainstream, There were 12 positions allocated to Butte County and 9 of them have been filled. The program requires that there be a 50% American Indian participation. The second program he explained roes the DTeighborhood Youth program. They positions are filled by high school aged children that have dropped out of school. They are attemr~ting to get these youngsters into work. The second program under_ this particular program is for high school children that are still attending school. They are trying to develop worTc experience slots, Mr, Rackerby explained the PEP program, This program is being phased out. It must be phased out by June 30, 1974. He said that most of this County's positionwould be phased out by March. Some of the positions might be able to be kept on longer, Some of the positions are in the transition of being phased into county taork. Federal funds would be utilized before the positions are phased into County employment. Under Section 6, the County was allocated 21 slots. Down to 7 vacant positions Wows. These positions could be filled-with labor positions. Mr, Rackerby requested that the Board consider filing the seven labor positions in Public 5dorks Department so that the County could use the non-skilled employees at the Hospital that have been laid off. These positions could be kept on until next May. They could be filled under Section 6. Request discussed. On motion of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, Personnel Director was authorized to fill the PEP slots from those people that are available, for labor positions at Public Works Department. 73-1500 DISCUSSION PAYROLL DEDUCTION AUTHORIZATIONS FOR CHARITABLE ORGANIZATIONS Mr, Rackerby explained tfi,~agettE~'~of payroll deductions for charitable September 25, 1973 September_25,_1973 organizations. It is suggested that the employees could be solicited for a one shot contribution to all the agencies. They have worked out a program and have presented it to the employees. Since the program wss worked out, the Oroville United Way and the Chico United Way have been separated. This would present a problem, Mr. Rackerby explained how this could be handled, CHAD has also now requested permission for employee payroll. deductions for them. Personnel did not feel this should be recommended. Supervisor Cameron explained that the Health Agencies are combined in CHAD. The employee could state trhich of the agencies he would like to donate to. Time spent discussing the organizations and how the deductions should be handled. Supervisor Ladd said he does not feel that this should be expanded. Action on this matter held over at this time. 73-1501 SURPLUS PROPERTY DECLARED: PARADISE JUSTICE COURT DISCHARGED FROM ACCOUNTABILITY AND FIRE DEPARTMENT E UTPMENT AUTHORIZED TO BE PURCHASED On motion of Supervisor Ladd, seconded by Supervisor Gilman and unanimously carried, the following action toss taken; 1. Declared two items surplus property and authorized the cannibalization for spare parts as both items are entirely worn out:- (a) Craftsman Riding Mower ~~536-81354, and (b) Ferguson Roller ~~p0869. 2. Granted Paradise Justice Court discharge from accountability for six accounts as listed totaling $728, 3, Authorized the purchase of two pickup trucks rather than station wagons and transfer of pickup ~p271 to DeSable Volunteer Fire Company, for the Division of forestry. RECESS: 7.0:30 RECONVENED; 10;45 73-1502 REPORT: DAVE UASCO, COUNTY ASSESSOR, SPOKE TO THE BOARD CONCERNING HIS APPEARANCE AND REMARKS TO BE MADE ON TIMBER ASSESSMENT PRACTICES 0 ~ Dave Vasco, County Assessor, stated that Senator Collier had requested I~1' that he testify this Thursday at Redding to put his thoughts into record on the assessment of timbex. His office has changed the method o£ assessing timber. They have based their thoughts en the taJ.k made by Mr, Roseberry, Mr, Vasco explained how they base the appraisals of the timber properties. He explained the background of timber appraising and hots it has been changed in recent years. He stated that he would explain at the meeting why they are appraising this property in their present manner; he feels that the timber companies can afford to pay a tax. He feels that the County will be tter off with this present method of appraising timber lands. Supervisor Madigan questioned Mr, Uasco about Carpenter's Bill regaxding gun clubs. Bill set out and discussed. Mr. Uasco said he would inves~igate the bill and will report back to the Board, Supervisor Cameron said he hoped that a better method could be employed to shot~r losses to the roll; it should show where the losses are given back on the roll. Mr. Vasco said this was being studied. Page 500, September 25, 1973 Septembar_25,_1973 73-1503 APPEARANCE OF MRS. C, L. HARRIS: SPEAKING ON WEST PARADISE ACCESS Mrs. C. L. Harris, Paradise, spoke to the Board concerning West ~ pp,~~ Paradise access. She feels that there is lack of compliance with the injuction suit settlement agreement. Access should be provided to the area. The residents were lucky during the last fire; they might not be if there is another fire. Mrs. Harris said she was not opposed to development in the area but she was opposed to the lack of access in the area. She read a prepared statement concerning her thinking regarding the access and lack of compliance with the terms of the injunction suit settment agreement. She said she felt that County Counsel was not living up to the agreement. Mr. Blackstock explained his feelings in this matter. He said there has been no development in that area and the County will have to wait and approve the individual improvements as proposed. __ ___ ____ __-'__-~°•- Matter discussed; no action taken, 73-150+ APPEARANCE OF MR. ED FAT,KENSTEIN: REQUEST TO HAVE M. DEAN WORCESTER APPOINTED AS DIRECTOR TO PARADISE IRRIGATION DISTRICT Mr. Ed Falkenstein, Paradise, referred to the petitions that were filed this morning requesting the appointment of M. Dean Worcester as a Director of Paradise Irrigation District. He set out Mr. Worcester's qualifications and requested that the Board give consideration to his appointment. • 73-1505 Al?PEAIt~NCE: NIR, SHAW MC HUGH~.P~RAAISE. Mr. 5ha~•~ McHugh, Paradise, fa.lecl another petition in favor of the appointment of N!r. Roy Smith as Director of Paradise Irrigation District. He explained his qualifications, and requested that theBoard give consideration to his appointment. 73-1506 APPEARANCE: RAY CUDNEY, MANAGER OF BUTTE COUNTY EMPLOYEES ASSOCIATION Ray Cudney, Manager of Butte County Employees Association, spoke concerning rules change. The rLele change would affect all employees in the County. He said that after an employee resigns, and a period of time elapses, if the employees desires to return to work for the County, they could pick up their oid status, under the nerr rule change. Presently they cannot return to the Covnty employ withrnit starting all over again. He set out the benefits that they would be able to regain. This change would help the hospital employees that are being laid off; they could come back and retain their old seniority. He requested that the Board consider this rule change. Mr. Nickelson will discuss this change with Personnel and bring back the matter to the Board next week for their consideration. 73-1507 APPEARANCE: NR. FISHER: LIME SADDLE COMMUNITY DISTRICT Mr. Fisher, Lime Saddle Community District, stated that the Department pfl of Water Resources have sent a contract to them and they have stated that ~, they will not advance any money until the contract is signed, Contract ~~ discussed. On motion of Supervisor Madigan seconded by Supervisor Gilman and Page 50~. September 25, 1973 September 25, 1973 unanimously carried, the contract with the State Department of Water Resources and Lime Saddle Community District was approved, subject to County Counsel's and County Auditor's approval. Mr. Ringels letter concerning payment of his fees for work for Lime Saddle Community District discussed. They will be willing to set up this conference, and will bring back a recommendation after the conference. Mr. Mickelson will attempt to set up a conference with Mr. Ringel at 11:00 a.m, on Thursday; he will also try to set up a meeting with County Counsel to discuss the State contract at 10;00 a.m, the same day, RECESS: 12:00 RECONVENED: 1:30 73-1508 APPROVE AGREEMENT WITH BRIDGE, AUTHORIZE AUDITOR TO PAY TODAY AND APPROVr WATVER OF MR, STUBBLEBINE'S SIGNATURE ~~.OO pn motion of Supervisor Cameron, seconded by Supervisor Madigan 3 and unanimously carried, the Board approved the agreement with "The Bridge", authorized the Auditor to make payment on the agreement today, and approved the waiver of Mr. Stubblebine's signature on this agreement, and continue making said payments until sur_h time as Mr. Stubblebine signs the agreement. RECONVENED: The Board reconvened at 3;00 following an executive session. 73-1509 REPORT ON INTERVIEW OF APPLICANTS FOR DIRECTOR OF PARADISE IRRIGATION DISTRICT Chairman McKillop reported that the Board had interviewed the applicants for appointment of Director of Paradise Irrigation District. He said the $oaxd would consider the appointment for a week or two and that the matter would then be placed back on the agenda. Chairman McKillop thanked the applicants for appearing for the interviews. 73-1510 PUBLIC HEARING: JAMES B, LINN, PETITION FOR VARIANCE TO PLACE MOBILE HOME-ON PROPERTY LOCATED EAST OF 12th STREET ON GRAND AVEA?UE, OROVILLE _ _ The public hearing of the James B. L?_nn petition for variance to provisions of Sections 19-10 and/or 7.9-12 of the Butte County Code to place a mobile home on the property located east of 12th Street on Grand Avenue, Oroville, also identified as a portion of AP 31-25-03-45, was held as advertised. Petition explained. Hearing opened to the public. Applicant present and explained his request. Health Department reported that there was no problem with. this variance. Hearing closed to the public and confined to the Board. The Head Start Grant package has been approved by the Butte County Head Start Policy Council. Mr. Bosworth explained this item. The Board members received copies of the grant package, evaluation and summary. Mr. Harris explained the grant. The Board could decide that they want to eliminate the program later. Approved Change Order ~~2, traffic signal installation, TOPICS Project EPS-T-305(1) and EPS-T3053(1), in the decreasing amount of $330 which provides far modification of the contract specifications regarding the pedestrian signals to conform to the latest state specifications, and the Chairman was authorized to sign, 2. Accepted the work of Robinson Construction Co, for traffic signal installations at intersections of Skyway @ Pearson Road and Clark Road @ Pearson Road and Oroville Dam Boulevard @ 5th Avenue, authorized the Chairman to sign the Notice of completion and instructed the Clerk to record said Notice with the County Recorder. 3. Adopted Ordinance No. 1403 establishing speed limit on Eaton Road and authorized the Chairman to sign. 4. Approved Change Order No. 9, Paradise Pines Units 12, 13, 14 Assessment District, in the increasing amount of $4,350 which covers labor, equipment and materials to install three additional pressure reducing stations and replace base and pavement as required and the Chairman was authorized to "sign. 5, Approved right of way acquisition, amended agreement for sale on the following, authorized Chairman to sign and authorized Auditor to issue warrant upon demand of County's escrot•7 agent: V. Approved schedule of fees for documents to be charged by Public Works. 73-1518 AUTHORIZE PUBLIC WORKS TO CONTRACT WITH CHICO STATE COLLEGE ENGINEERING STAFF TO AO STUDY OF PALERMO SEWER SERVICE AREA Clay Costleberry, Director of Public Works, said he and Supervisor Ladd had met with the people in Palermo to discuss the Palermo sewer service area, The Chico Engineering staff said that they could do the study if the Board would approve costs for printing, information gathering and travel. Supervisor Ladd said that tha.s was something that is needed in the area, The charges could be against the service area, Page 504. WORK WITH ARCHITECT AND DIRECTOR OF PUBLIC WORKS ON PLANNING OFFICE ADDITION ~~ Clay Castleberry, Director of Public Works, reported on the possible addition of space to the Planning Department. He said it would be feasible to add a 40' addition to the end of the building. It was suggested that space also be provided within this office for the sanitation service sa that they could approve building permits when they are presented. Mr. Castleberry said Gene McFerrin was contar•ted to prepare an architects agreement. Building space discussed.
