Invocation by Supervisor Lemke 77-1865 APPROVAL OF MINUTES Oa motion of Supervisor Moseley, seconded by Supervisor Madigan and carried, the minutes of Septe:ber 20, 1977 were approved as mailed with the correction to 77-1859 that $10 million was allotted to the Corp o£ Engineers for work and that the State so far has maneuvered to prohibit the Corp from carrying out the work. They should have completed this as of this date; with correction to the August 30, 1977 minutes 77-1725 as follows: Award of Bid for lime treatment of various County roads - Project No. LT-77-1 was awarded to Butte C=eek..Rock~Company and award of Bid for Skyway Bridge across Butte Creek - Project No. 51261-76-2 waseaarded to C. See motion following communications. 77-1867 DISC[~SSION: ORDINANCE INCREASING SPEED LIt~ffT ON ORD FERRY ROAD IN DAYTON FROM 25 ML'S TO 45 MPH. Discussion of the ordinance increasing the•spped limit oa Ord Ferry Road in Dayton from 25 mph to 45 mph was held at this time. Clay Castleberry, Public 'Works Director, stated that the County had received a request from the Highway Patrol that action be postponed oa changing of the speed limit. The present speed limit is not enforceable in court because of the present traffics and speed of the vehicles. It would be best to postpone action until staff and the Highway Patrol can tali a public meeting to discuss the matter. A petition and two letters were presented to the Board is opposition to the changing of the speed limit. 77-1868 REJECT CLAIM On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the claim of Zoila Malekos itn•t1ne:~amourit of $200,000 plus medical and doctor bills and actual injuries when determined, as a result of ;injuries sustained on June 19, 1977 was rejected on the basis that the Board cannot determine in what manner the County of Butte brought about the alleged iajuries~aad the Board cannot determine is what meaner or where thin person was assaulted and battered; referred to County Counsel and insurance carrier. 77-1869 REJECT CLAIM On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the claim of Rodrick De Leoa, in the amount of $200,000 plus medical and doctor bills and actual injuries when determined, ae a result of injuries sustained on Juae 16, 1977 was rejected oa the basis that the Board cannot determine is what manner the County of Butts brought about the alleged injuries and the Board cannot deternzine is what manner or where this person waa assaulted and battered; referred to County Counsel and insurance carrier. 77-1870 ENDORSE GRANT APPLICATION OF SENIOR CITTZENS OROVTLLE FOR ROOFING On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, the Board endorses the grant application of the Senior Citizens, Oroville for their roofing project, no money allocated. 77-1871 ADDITIONAL MATTERS PRESENTED BY BOARD MEMBERS Supervisor Madigan stated that the sales tax should be checked when the funds are received. This is regarding the problem with the City of Chice on the sales tax matter. Supervisor Madigan stated that he would like to have a memo from the Auditor. It was felt that the City of Chico would have representatives at the meeting ao the County need not send anyone. Supervisor Winston stated that he had read the minutes of the Butte County Development Commission. The City of Oroville guarantee that wffthin a 60-day period the EIRs w111 be approved. Earl Nelson, Environmental Review Director, to contact the City as to their method of processing EIRs. 77-1872 AWARD BID On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, the bid for reroofing of the Agricultural Building and the Food Stamp/Mentai Health Building in Oroville was awarded to Permatite Roofing Company of Yuba City is the amount of $8,692. 77-1873 APPROVE CONTRACT - CH:ICO MEALS'?ON WHEELS PROGRAM On motion of Supervisor Winston, seconded by Supervisor 2?adigan and unanimously carried, the contract with Chico•Meals on Wheel~tn the amount of $7,500 was approved and the Chairman authorized to sign. 77-1874 ADOPT DISTRICT ALLOCATION PROGRAM - REVENITE SHARING FUNDS AS SET OUT IN MEMO OF SEPTEMBER 22 1977 FROM ADMCNISSTRATIVE OFFICE Clif Nickelson, Administrative Officer, set out the background of the proposed district allocation program for revenue sharing funds. Discussion of public facilities development had at this time: Mr. Nickelson stated that there should be three things considered: 1. These funds should net go for an-going operations. 2. The funds should go et least to public facilities, property owned or utilited by local government. 3. Whether or not the funds should be used for social purposes. Oa motion of Supervisor'Winstoa, seconded by Supervisor Lemke and unanimously carried, the district allocation program as set out in Administrative Office memo of September 22, 1977 for Revenue Sharing funds was adopted. 77-1875 PUBLIC HEARING: JOHN C. STANHOPE - PETITION FOR VARIANCE TO PROVISIONS OF SECTIONS 19-10 AND/OR 19-12 OF TgE BUTTB COUNTY CODE FOR•PLACEMENT OF A MOBII.E_HOME ON AP 27-07-08. 6801 UPPER PALERMO ROAD. OROVILLE The public hearing on the John C, Stanhope petition for variance to the provisions of Sections 19-10 and/or 19-12 of the Butte County Code for placement of a mobile home oa AP 27-07-08, 6801 Upper 'Palermo Road, Oroville was held as advertised. Howard Toussaint, Sanitarian, net out the background of the petition. Hearing open to the public. Appearing: No one. Hearing closed to the public and egnfined to the Board. Clay Castleberry, Public Works Director, set out the background of the appeal. This is in the urban area of Paradise. Rearing open to the public. Appearing: .Phil Mace, Attorney at Law, representing Mr. Kopsa. Mr. Mace stated that the appeal was for condition No. 1. This cells for 40-foot face to face road with 30 feet of paving. Thin is the only undeveloped parcel in the area. There are ao sidewalks in the area. Diecusalon of curbs, gutters and sidewalks on the Pearson Road Project just completed had at this time. Mr. Mace stated there is a drainage swale on the property. Mr. Kopsa would be happy to grant a drainage easement to the County. Mx. Mane stated that the riew section of Pearson Road is 33 feet wide and Mr. Kopsa is being required to place 36 feet of road. NOES: Supervisor Moseley. 77-1877 PUBLIC HEARING: CARL YOUNGDAHL - APPEAL CONDITIONS OF TENTATIVE PARCEL MAP, AP 53-272-8, THREE LOTS, LOCATED ON THE WEST~SIDE OF PENTZ- MAGALIA HIGAWAY OPPOSITE LURA LANE. PARADISE. The public hearing on the Carl Youngdahl appeal of conditions of tentative parcel map, AP 53-272-9, three lots, located oa the west side of Pentz-Magalia Highway opposite Lura Lane, Paradise was held at this time. Clay Castleberry, Public Works Director, set out the background of the appeal. Hearing open to the public. Appearing: 1. Carl Youngdahl. Mr. Youngdahl stated that he objected to the Curbs, gutters and sidewalks.. Paradise does not want sidewalks like Chico has. Mr. Youngdahl stated that he would be happy to put in sidewalks when everyone else does. 2. Anna Gasaie, Chico. Ms. Gassie stated that she hoped that the Board would continue to require sidewalks for the safety of the public. 3. Judy DeMorris, Chico. Ms. DeMorri~stated that she would like to see the Board continue to require 83dewalka for the safety of the public. On motion of Superrrieor Winston, seconded by Supervisor Lemke and carried, the matter is continued for 30 days to October 25, 1977 at 10:00 a.m. AYES: Supervisora'Lemke, Moseley and Winatoa. ONE MILE SOUTHEAST OF TOWNSITE OF NORD The public hearing on the Ralph Coil negative declaration and appeal of Advisory Agency's denial of tentative parcel map, AP 47-15-48, two lots, intersection of Carmen Ieiae •and Nord Highway, approximately one mile southeast of townaite of Nord was held as advertised. Hearing on the negative declaration open to the public. Appearing: John Jarvis. Mr. Jarvis atated that he did not feel an EIR was justified. Hearing closed to the public and confined to the Board. On motion of Supervisor Winston, seconded by 6upervisor Moseley and unanimously carried, the proposed project could not have a significant effect on the environment, and a negative declaration was accepted. Hearing on the parcel map open~to the public. Appearing: John Jarvis. Mr. Jarvis stated that he was representing his father-in-law Mr. Coil on the appeal. Mr. Coil bought the property with the understanding that the property could be parceled. Mr. Jarvis atated that he and his father-in-law were going to both build a house on the property and this was the reason for the requested parcel split. Mr. Jarvis was told that Chia wen orchard and field crop designation on the General Plan and at the present the Board could not approve the map. On motion of Supervisor Lemke, seconded by Supervisor Winston and unanimously carried, the appeal was upheld and the boundary line modification was approved. 77-1881 ADOPT RESOLUTION 77-155: RESOLUTION AUTHORIZING THE ADMINISTRATIVE OFFICER TO APPLY FOR FUNDS FOR HOME MANAGEMENT TRAINING GRANT - HCD PROJECTS Larry Brooks, Administrative Aaalyat, set out the background of the home management training grant. This is to educate the people in the rehabilitation homes on how to maintain a home. The funds will be to pay contractors to talk to the people. On motion of Supervisor Lemke, seconded by Chairman Richter and carried, Resolution 77-155 authorizing the Administrative Officer to apply for funds for the home management training grant was adopted and the Chairman authorized to sign. NOES: Supervisor Winston. 77-1883 ADOPT RESOLUTION 77-156: RESOLUTION AUTHORIZING GRANT APPLICATION SUBMISSION FOR SEPTAGE STUDY GRANT On motion of Supervisor 'Lemke, seconded by Supervisor Madigan and unanimously carried, Resolution 77-156 authorizing the Health Department to submit a grant application under the Federal•WaterPk~llutioa Control Act for a septage study grant for the Chico sewer plant was adopted and the Chairman authorized to sign; subject to approval by Counsel as to legal form aad approval of the Auditor as to budgetary aad fiscal control; with the funds to coma from the Public 'Works revolving fund. 77-1884 DENY; L B STACK PETITION FOR PENALTY RELIEF On motion of Supervisor Winston, seconded by Supervisor Madigan aad unanimously carried, the petition for penalty relief of L. B. Stsck was denied, 77-1885 APPROVE PUBLIC WORKS ITEMS O[t motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, the following Public Works~iteme were approved: 1. Issued oactditional Certificate of Complianthc provided owner signs raad~maintenance agreement for 'Lawrence Tomovick for AP 62-54-04 and AP 62-07-356, ad,~acent to Bloomer Mountain Look Out Road. 2. Authorized work outside the city limits of Gridley on Oregon Street to be done by City of Gridley and that $6,800 be deposited with the City of Gridley. 3. Approved Hagenridge Country Subdivision final map. 77-1886 AUTHORIZE RETURN OF $400 DEPOSIT, PLUS INTEREST, JOHN LUNSFORD - CRBIGr',RECREATION ROAD ASSESSMENT DISTRICT On motion of Supervisor Winston, seconded 6y Supervisor Moseley and unanimously carried, refund of $400 deposit, plus interest, for John Lansford for Craig Recreation Road Assessment District was authorized. 77-1887 AUTHORIZE AUDITOR TO INCREASE APPROPRIATION FOR BAGGETT MARXSVILLE RDAD PROJECT REVENUE FROM 3TATE AND RAILROAD FUNDS On motion of Supervisor Moseley, seconded by Supervisor Madigan and carried, the Hoard reconfirmed their action of last week and authorized the auditor to increase appropriation for the project from revenue from State and Railroad funds. AYLS: 3upervisora Madigan, Moseley, Winston and Chairman Richter. ABSTAINING: Supervisor Lemke. 77-1888 APPROVE SKYWAY FENCING AGREEMENT WITH THE U. S. FOREST SERVICE On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, an agreement with the U. S. Forest Service for chain lick fencing on the Skyway was approved and the Chairman authorized to sign; with $2,900 coming from the County Road Fund with the fencing done by the County with reimbursement by the Forest Service of $3575. 77-18$9 ADDITIONAL MATTER PRESENTID HY PUBLIC WORKS Clay Castleberry, Public Works Director, stated that he will be bringing a report and suggested recommendations on the Neal Road Landfill regarding Solid Waste back to the Board. The Gianella fridge will be completed in three years. Chairman Richter stated that he would like the Board to authorize Supervisor Madigan and himself to hold hearings to invite the State Park and Recreation Department and the CHP to coordinate their efforts for access and parking facilities along the Sacramento Raver en the River Road, On motion of Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, Supervisor Madigan and Chairman Richter were •authorized to hold hearings asking the State Park and Recreation end the CHP to coordinate access to the Sacramento River and make parking facilities on the OLd roadway for vehicles. 77-1891 AUTHORIZE ESTABLISAMENT OF CITIZENS ADVISORY TASK FORCE COMMITTEE On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the establishment of a Citizens Aditieory Taek Force Committee for Butte County General Housing Element update waa authorized . 77-1892 CONTINUE APPOINTMENTS TO OCTOBER 4. 1977 " .. Jordan was appointed as an alternate member to the Board of Zaaing Adjustment. 77-1895 DISCUSSION: COST FEASIBILITY STUDY FOR CHICO LIBRARY SITE - MOTION OF INTENT: EAST FIRST AVENUE AND SHERMAN AVENUE SITE DESIGNATED AS LIBRARY SITE Discussion of a coat feasibility study for the Chico Library site had at this time. The feasibility study would be for the total complex an the block in dowaCown Chico. On motion of Supervisor Madigan, seconded by Supervisor Winston and unanimously carried, a motion of intent to accept the East First Avenue and Sherman Avenue Bite for the Chico-County Library was adopted. Page 489 September 27, 1977 ~ ~, September 27, 1977 ----~~- -• •• ••. _ m m s~~ v a c x. o o c a o s z m m a=_ m s d- 77-1896 ADOPT POLICY AND PROCEDURE MANUAL SECTION 16.0 On motion of Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, Policy and Procedure Manual Section 16.0 was adopted as presented. 77-1897 APPEARANCE: LESLIE ROBERTSON, FEATAER RIVER SENIOR CITIZENS AS50CIATION Mr. Robertson stated that he would~Zike to express his thanks to the Board for their endorsement of a letter of support for the Senior Citizens Center grant application. 77-1898 PROCLAIM SUPPORT OF UNITED WAY CAMPAIGN Bill Brown, Chairman of the United Way Campaign in Butte County, was present to ask that the Board endorse the campaign this year. On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, the Board proclalma their support of the United Way for the geople and employees of Butte County. 77-1899 ADDITIONAL MATTER PRESENTED BY SUPERVISOR MOSELEY Supervisor Moseley reported on a meeting of the Air Pollution Board that she attended. Supervisor Moseley stated that Dave Stratton and Joe Bandy were very well informed on the Air Pollution matters. The passible vse of synthetic fuel was also discussed at the meeting. EXECUTIVE SESSION: The Board recessed at 11:10 a.m. for an Executive Session to discuss litigation and a personnel matter. RECONVENE: The Board reconvened at 11:35 a.m. following an Executive Session to discuss litigation and a personnel matter. Nothing to report oa the personnel matter, 77-1900 AUTSORIZED TELEGRAM TO BE SENT TO RONALD ROBIE, DEPARTMENT OF WATER RESOURCES RE: LAKE MADRONE CAUSEWAY LITIGATION Dan Blacketock, County Counsel, stated that the County has been in litigation with the State over the Lake Madrone Causeway. Tha State maintains the Causeway does sot have sufficient spillway. The County tried to resolve the problem with the establishment of a district. The District has received an EDA loan grant which would rectify the problem. On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried,~a telegram to Ronald Roble, Degartment of Water Resources was authorized with the hope that some means of compromise could be reached so the grant can be accepted on Friday; that the litigation can be resolved; that an addition to the spillway capabilities of the Lake Madrone structures can be accomplished; end that the EDA Grant will involve employment and will be beneficial to the unemployment situation that is present in Butte County. 77-1901 ADDTTTONAL MATTERS PRESENTED BY SUPERVTSOR MADIGAN ' Supervisor Madigan stated that someone from the Public Defender's Office should respond to the material presented to the Board by Dick Bjork. Supervisor Madigan steted that the Board should get a copy of the minutes from the Yolo County hearing regarding the exportation of water.
