Pledge of allegiance to the Flag ofthe United States of America Invocation by Supervisor'Moseley. 78-188 APPROVAL OF MINUTES On motion of Supervisor Madigan, seconded by Supervisor Moseley and carried, the minutes of September 26th and 27th, 1978 were approved with the correction on Page 335, seventh paragraph, to set out the amount of the budget in the amount of $48,220,521.00. 78-1889 APPROVE W~#IVING OF FIRST READING OF SALARY ORDINANCE AMENDMENT A salary ordinance amendment has een prepared to. imp ement t e personae changes approved in the 197879 budget. On motion of Supervisor Richter, seconded by Supervisor Moseley and carried,--the first reading of the salary ordinance amendment was waived. 7$-1890 CONCUR WITH SUPERIOR COURT'S APPOINTMENT OF CHIEF PROBATION OFFICER The Superior Court has, upon recommendation of the Juvenile Justice Commission, appointed Wally Herring to the position of Chief Probation Officer. On motion of Supervisor Moseley, seconded by Supervisor Madigan and carried, the Board concurred with the Court's appointment of Wally Herring as Chief Probation Officer. 78-1891 APPROVE REQUEST FOR EQUIPMENT FROM ACCOUNTABILITY The Administrative Office requests relief from accountability of three pieces of equipment missing from the inventory list. On motion of Supervisor Richter, seconded by Supervisor Moseley and carried, request for relief from accountability was concurred with by the Board, as requested by the Administrative Office. 7$-1892 APPROVE CLAIM AGAINST LIVESTOCK INDEMNITY FUND - _ __ A claim has been received by Doris Martin in the amount of 140 for sheep killed b.y dogs. Supervisor Richter questioned Administrative Officer about the funds in the fund to cover this payment. Mr. Mickelson stbted that the County was obligated to pay for damages caused by dogs. Claim discussed. Page 336. October 3, 1978 ' October3~ 1978__________________ On motion of Supervisor Madigan, seconded by Supervisor Richter and carried, claim in amount of $100 from the Livestock Indemnity Fund was approved and reimbursement for alleged damage to mother esve denied. -1893 ADOPT RESOLUTIONS 78-IB5<~ 78=166 APPROVING ANNEXATION TO COUNTY SERVICE AREA #26 and to THERMALITO IRRIGATION DISTRICT LAFCO has approved the annexation of approximately one acre to TID and CSA#26. This Board has been designated the conduttirig authority. On motion f Supervisor Richter, seconded by Supervisor Madigan and carried, Resolutions 78-Ib~nd 78-166. approving annexations to County Service Area #26 and to Thermalito Irrigation District were adopted and the Chairman authorized to sign. -1894 APPROVE CHANGE ORDER #p~ ADMINISTRATION BUILDfNG A change order has en prepared in the amount of 735 to accommodate the consolidation:of the Clerk and Recorder offices. On motion of Supervisor Moseley, seconded by Supervisor Richter and carried, change order #14, in the amount of $735 fo come from Administration Building project contingencies was approved and the Chairman authorized to sign. -1895 DISCUSSION: VETERANS SERVICE OFFICER Mr. Penn spoke to thee. Board concerning the problems of servicing Glenn County. He stated that he had about six new cases last week from Glenn County; he is working in the dark because he does not have the folders on these people. Administrative Officer has weirh~en a letter to Glenn County requesting a meeting with their representatives and representatives of Butte County. Supervisor Richter stated he was certain that Glenn County would be willing to help pay-for this service to their residents. Mr. Penn stated that he had heard that Glenn County intended to destroy the veterans' records; they feel they are out of the Veteran Service business. Administrative Officer requested to toll Glenn County and arrange for a meeting with the' Chairmen of the two Boards of Supervisors, with Mr. Mickelson and Mr. Penn. Ne will also request Glenn County not to destroy their records regarding the ve#erans. -1896 DISCUSSION: BUTTE -GLENN COUNTIES VETERANS EMPLOYMENT COMMITTEE Letter from the Committee requesting an alternate be appointed to the position on CETAC held by Gene Barkley. Mro Barkley is in the Veterans' Hospital, It was felt that with all his other troubles, Mr. Barkley should not be replaced on the Council at this time. It was suggested that the Veteran organizations have a representative attend the CETAC meetings and give them in-put, but not take part in any action taken by CETAC. 1897 DISCUSSION: BIGGS COMMUNITY CLUB, INC. The Club writes in opposition to the closure of the Biggs C(eterans Memorial Hpll. The Board is trying to work:sboi~ething out in this matter. They are trying to have the Biggs City Council take over the Nall. No action taken at this time. Page 337. October 3, 1978 ___________==~~.t2ber3~.1.9Z~==.________________ 78-189'~BUDGET TRANSFERAPPROVED On motion of Supervisor Richte r, seconded by Supervisor Moseley and carried, the following budget transfer was approved; B-014 Purchasing.. Provides payment of the auctioneer at the annual Butte County Auction held on September 16 and 17, 1978. The transfer represents the auctioneer's fee at 10% of gross sales, $5,336.30. 78-1899 APPROVE LEASE AGREEMENTS On motion of Supervisor Moseley, seconded by Supervisor Richter and carried, the following lease agreements were approved and the Chairman authorized to sign: 1. Agreement with the First Christian Church of Chico for use by the Butte County Head Start Program. 2. Agreement with the First United Methodist Church of Oroville far use by the Butte County Head Start Program. 78-1900 DISCUSSION: REPORT BY AUDITOR-CO NTROLLERON PARADISE IRRIGATION DISTRICT'S REQUEST TO PROVfDE ASSESSMENT TAX COLLECTION SERVICES Report by the Auditor~ontraller on the Paradise Irrigation District's request of Butte County to provide assessment and tax collection services disCUSSed. Mr. Lawrence, County Auditor,. stated thct ;there would be a meeting tomorrow to determine the cost of transferring this service to the County. He stated he would have a resolution for Board action next weef<. 78-190(Y DISCUSSION: MEMO RE "BAIL-OUT" MONEY FOR SPECIAL DISTRICTS Mr. Lawrence presented Board members with a copy of a memo dated October 2, 1978 regarding 'bail-out"money for special districtso The special districts that are eligible for the funds should be notified. Hearing set for October 10; 1978 at 10:30 a.m. and October 17, 1978 at 10:30 a.m. to discuss the priority list to handle the district costs and to determine the allocations to be made. 78-1901 DISCUSSION: CHANGE IN DATES FOR TAX BILLS Mr. Lawrence presented the Board members with a meo~rcaa:o~cerning the change in dates for mailing of tax bills. He set out Section 34 of Chapter 332, Statutes 1978 (SB 2212). He stated that there are many errors in the assessment roll . He stated he was delaying the date for delivery of the roll and bills to the Tax Colleator until November 16tho Mro Lawrence stated Board action was not necessary at this time. 78-1903 MEMO REGARDING RESERVE FOREQUALIZATION REDUCTION ALSO LETTER FROM ATTORNEY GENERALS OFFICE Discussed Auditor's memo fof September 25d;h regarding the matter of assessing and a letter from the Attomey ,Generals office relating to the same thing. The Attorney General feels that the manner of assessing is-wrong as being done. by Butte County Assessar. The difference is those assessments That are brought up to current values. He stated that the controversy appears to revolve essentially around the difference in wording between the phrase "All real property not already assessed up to the 1975-76 tax levels may be reassessed to reflect that va8uation: in the Page 338. October 3, 1978 ________________ October3~ 1978 Proposition 13 amendment. Those parcels that are no# assessed 25°l0 of market value should be brought up to that assessed value. Problem of assessment procedures discussed. Chairman Winston stated that Mr. Lawrence is urging caution in the manner of spending under the new budget. A memo has gone out to the department heads and there will be an administrative review on alt purchases and acquisitions, along with salary savings. There is going to be a slowing down of the whole movement of County government machinery. Mr. Lawrence will have the final summerization to the budget changes by next week. Supervisor Richter questioned Ed Brown about the manner in which the State does their samplization of County's assessed values. It is based on a statistical analysis of the roll. 78-1(3'.34 HEARING SET: LARRY MAY, PETITION FOR VARIANCE, MOBILE HOME Public hearing set for October 17, 1978 at 10:15 on the Larry May petition for variance to Sec#ions I9-10 and~or 19-12 of the Butte County Code for placement of a mobile home on the parcel known as AP 28-11-02 on the Lo Porte Star Route, Zoning: A-5. 78-1905 APPROVE MEAL CONTRACT WETH CHIQOMMUNITY HOSPITAL An agreement as en prepared to provide prepared mea s -for t e acute care unit at the mental health facility in Chico. Contract is with Chico Community Hospital through June 30, 1979 at a cost of $3.10 per meal with a maximum annual cost of $45,570. Walt Atkins explained the contract stating that the costs per meal are higher than the price for the '4neals-on-wheels ". Supervisor Richter stated he had made a study of the meals for students, etc. and these prices are twice as high as other companies furnishing meals. He fell the costs should be looked into. Mr. Mickelson will have a study made of these costs of these meals. On motion of Supervisor Richter, seconded by Supervisor Madigan and carried, agreement with Chico Community Hospital approved, Chairman authorized to sign, with the cancellation clause included fora 30-day cancellation period, and that a thorough investigation be made of the costs and a report prepared for the Board within the next 30-days. 78-1906 APPROVE AGREEMENT FOR THERAPEUTIC RECREATION SERVICES An agreement has been prepared with Do-it-Leisure Inc, for the providing of therapeutic recreation services for the Mental Health programo The agreement would commence upon Board approval and continue through June COQ 1979. The maximum annual cost under the agreement is $24,208. On motion of Supervisor Richter, seconded by Supervisor Moseley and carried, agreement with Do-it-Leisure Inc. to provide therapeutic recreation services for the Mental Health program was approved and the Chairman authorized to sign. October 3, 1978 78-1907 APPROVE LEASE AGREEMENT, MENTAL HEALTH FACILITIES, CHICO An omendment tlp the lease agreement for the building at 592 Rio Lindo Avenue, Chico has been prepared to authorize payment of rent from August 25, 1978 to October 1st. This was in occupancy prior to the issuance of a certificate of occupancy by the City of Chico as required in the existing lease agreement. On motion of Supervisor Richter, seconded by Supervisor Madigan and carried, lease agreement varFfendment for the building at 592 Rio Lindo Avenue, Chico was approved and the Chairman was authorized to sign the amendment. 78-1908 ADOPT RESOLUTIONS 78-167 & 78--168 FOR SALE OF TAX DEEDED PROPERTY On motion of Supervisor Moseley, seconded by Supervisor Richter and carried, the following resolutions were adopted and the Chairman authorized to sign: Resolution 78-167 giving notice of intention to sell a single parcel of land at at the minimum price of $1,000, AP 30-19-5-012-0 was adopted. Resolution 78-168 of intention to sell tax deeded property at a minimum price of $300, AP 051-14-4-032. 78-1909 APPROVE FEDERAL SAFETY PROGRAM CONTRACT FOR PLACEMENT OF THERMOPLASTIC PAVEMENT MARKINGS. Clay Castleberry,'.. Director of Public Works, reported an the bids received for a contract for placement of thermoplastic pavement markings in the Gridley, Oroville and Biggs areas. Low Bidder was Rough and Ready Construction Company at a bid of $221, 2000 On motion of Supervisor Richter, seconded by Supervisor Madigan and carried, contract for. placement of thermoplastic pavement markings was awarded to Rough &Ready Construction Company at a cost of $221P200 and the Chairman was authorized to sign. 78-1910 APPROVE AGREEMENT FOR RIGHTrof-WAY ACQUISITION:BULL HILL RD. BRIDGE An agreement for sale has been prepared with Pear! V, Pickens for .166 acres. in the amount of $2,500. f~greement discussed. On motion of Supervisor Moseley, seconded by Supervisor Richter and carried, culvert modifrica#ion plan was accepted as presented. Page 340. On motion of Supervisor Richter, seconded by Supervisor Moseley and carried, repair work at the Jordan Hill Road slipout was authorized, utilizing force account labor. 78-1913 DISCUSSION: CLIPPER TICKET INFORMATION, PRICE.INCREASE Mr. Caste erry reported on t e C ipper Tic et information, stating this was presented for information. Business is still good and they are getting a tremendous use of this service. Letter from Cynthia A. Flint, Adu~tt Center Supervisor, acknowledged. Her recommendations and suggestions will be considered in the future. Letter from Paradise Chamfer of Commerce will be responded to by Administrative Officer. 78-1914 DfSCUSSION: PLACEMENT OF SIGNS ON ROADWAYS & UTILITY POLES Supervisor Richter stated that they have a crisis 1~ the Chico area that concerns the County Code section that prohibits the placing of signs on the County rightrof-way. There is an epidemic of signs in the right~-of-ways. He stated that most of the candidates obey the law. He requester{ that the Board re-affirm that they wanfi the law obeyed. It was moved by'Supervisor Richter, seconded by Supervisor Madigan and carried that the Covnty Ordinance be recognized and enforced and that Public Works workers remove the signs from the poles when in that area. Mr. Blackstock will check the law relating to this matter. Supervisor Richter stated he did not want confrontations between the candidates placing the signs and those people removing the signs. He has checked with Fred Davis, City of Chico, and he stated that it is unlawful in Chico to place the signs on trees, poles or public entitieso City Council of Chico will take action at their meeting tonightL 78-1915 WOODS VS. BOARD OF SUPERVISORS FOR CENTEX AGGREGATE: srf RESCIND ACTION OF OCTOBER25, 1977 APPROVING EIR, SET MATTER FOR HEARING OF REPORT ON OCTOBER 17th and HEARING ON USE PERMIT SET FOR OCTOBER 24, )978 Dan B ackstock, County Counsel, reported on the Woods vs Board of Supervisors for Centex Aggregate. The approved EIR adopted by the Board on October 25, 1977 did not have the list of people appearing at the public hearing. Court action explained 6y Mr. Blackstock. It was moved by Supervisor Richter, seconded by Supervisor Madigan and approved that the Board accepted the recommendation of County Counsel to rescind Board action of October 25, 1977,vh+erc~s the Board of Supervisors approved the EIR and that this report be referred back to Earl Nelson for completion pursuant to the Court's action, and that a hearing be set for October 17, 1978 at 10:45 for re-certification of the report and that a further hearing be set for October 24, 1978 at 10:45 a.m. for the hearing of the use permit for said CenP~x~ggregate. October 3, 1978 ___________ October3,_I978_ -------------------- 78-1416 ORDINANCE ESTABLISHING ENVIRONMENTAL HEALTH PERMIT PROCEDURES & RESOLUTION ESTABLISH FEES: PUT OVER ONE WEEK Ordinance establishing Environmental Health permit procedures and resolution establishing fees put over one week at request of county counsel. 78-1917 APPOINTMENT TO COUNTY EMPLOYMENT TRAINING ADVISORY YOUTH COUNCIL: PUT OVERONE WEEK Chairman Winston requested that the appointment to the County Employment Training Advisory Youth Cauncil be put over one week; he will have his appointment ready by'',that time. 78-1918 DISCUSSION ON FORMATION NATIONAL GUARD COMMISSION FO R BUTTE COUNTY Formation of National Guard Commission for Butte County discussed. Chairman Winston stated that the person to represent the Board wi II be the Chairman each year, ', This minute order is the Board's intent for said representation. 78-1919 COMMUNICATIONS Holidaze on Parade, Chico. The Organization is planning its third annual parade on December 9, 1978 in Chico and requests assistance in the barricading of certain streets in Chico. Clay Castleberry reported that an extensive closing of the road requested here could cause a problem. The Baard should be made aware of this problem. SupervisorRichter felt the County shou~kl meet with these people and coordinate the matter. This street handles a fantastic amount of traffic, Chairman Winston appointed Supervisors Madigan and Richterto meet with the officials of City of Chico and representatives of Holidaze on Paraade. Mr. Castleberry will arrange the meeting rand contact parties involved. 78-1920 SELECTION OF ARCHITECT FOR CHICO LIBRARY Appointment of architect for Chico library discussed. It was felt that it would be appropriate to have representatives of the Board meet with representatives from Chico and then jointly select an architect. Chairman Winston appointed Supervisors Madigan and Richter to meet with representatives from Chico. Mr. Mickelson will coordinate the meeting. for tomorrow morning or for next Monday, ', 78-1921 CONTINUATION OF COMMUNICATIONS Lois Suite, Paradise. ,Lois Suite files a claim against the County of Butte for property and personal injury in the amount of $22.50. See motion following communications. Butte-Glenn Counties Veterans Employment Committee. The Committee writes requesting an alternate be appointed to the position on CETAC held by Gene .Barkley, Discussed earlier in meeting; no action taken. Paradise Municipal Advisory Council. Paradise MAC has reviewed proposed development of a shopping center on the south eastern corner of the intersection of Bille Road and the Skyway, and comments favorably for the development. This has been discussed and is being handled. Biggs Unified School District. William F. Schreck, superintendent, writes in opposition to closure of the Biggs Veterans Memorial Building. This has been discussed earlier in the meeting; action is being considered. James„D. Driscoll, Califomia Legislature. In accordance with Assembly Concurrent Resolution No. 61, Mr.'Driscoll requests that cities and counties consider the establishment of a rental housing mediation program. Discussed; it was assumed that the County would have to pay for such a program. Mr. Mickelsan suggested that this be referred to the Housing and Community Development representative, Larry Brooks. Referred to Larry Brooks for comments. City of Chico. Mayor Thom writes requesting a letter of support for the CACTRANS report on the 'feasibilityaf rerouting AMTRAK'S Coast Starlight, Chico-Marysville-Sacramento" be sent to CALTRANS. 'Mr. Mickelson to prepare letter for Chairman Winston's signature approving said rerouting. 922 REJECT CLAIM OF LOIS SUITE, PARADISE On motion of Supervisor. Madigan, seconded by Supervisor Mose-ley and .carried, the claim of Lois Suite, Paradise, in the amount of $242.50 was denied and referred to Risk Management Coordinator. 923 SUPPORT POSITION OF WELFARE DIRECTOR RE SOCIAL SERVICE PROGRAMS Memo of September 27, 1978 from Administrative Officer regarding Socia! Service programs ancf recommending that the County not support the State take-over, discussed. On motion of Supervisor Richter, seconded by Supervisor Moseley and. carried, the Board supported the position of the Welfare Director regarding State administration of Welfare be upheld. 1924 CO NFIRMATIO N OF SALARY ADJUSTME NT I-.'"lB` R RZAZIA KAHN It was moved by Supervisor Moseley, seconded by Supervisor Richter and carried that confirmation be given that Razia Kahn receive the salary adjustment the same as the other E.O.C. employees. 1925 i,NEQ3l~A-T I O NA L ITEMS Letter-from James Lenhoff regarding water ffomCherokee area acknowledged. Memo from County of Shasta regarding the draft received of Califomia Water law Page 343. October 3, 1978 October 3l 1978 discussed. It was felt that this Board should take some kind of position in this matter. Supervisor Madigan stated he was going to meet with Paul Minasian and he will make public his position paper. Supervisor Madigan will have a report on this meeting. This Water Law will be discussed at the Alturus meeting. Leteer from Paradise Chamber of Commerce regarding a tree ordinance discussed. They have presented the County with a proposed ordinance. They request the Board to give consideration to this ordinance which has been proposed by MAC and endorsed by the Chamber of Commerce. Discussed MAC's proposed meeting on a intersection in the Paradise area; Chairman Winston is going to meet with them tomorrow and wilt relate the Board's concern about the hearing process. Supervisor Madigan said he would like to go back and discuss the fetter from James Lenhoff about water for Cherokee. He felt that if that ones wanted water, s to they should start the procedures for formation of a water district, The people in that area feel the County should get the water up to them. Suggested that LAFCO review this situation. Chairman Winston stated he had attended a meeting in Monterey last Thursday. He had been requested to attend this meeting by Lou Chrysfer to listen to Frances Murray. Mr. Murrpy's address involved the use of coal-fossil fuel-in the United States. He emphasized the importance of people of divergent interests getting together and sitting down to make strides in compromising the issueso He said the first effort that must be made is to establish priorities and the first priority should be indegrity. RECESS: The Board recessed at 10:30 for an executive session to discuss litigation. RECONVENED: The Board reconvened at II:00 p.m. following morning recess and Executive Session in which litigation had been discussed. Nothing to report at this time. 1926 APPEARANCE: RON GRAVES RE PARCEL MAPS & REZONING OF A-2 AREAS Ron Graves reported that he was representing several clients that have been caught in this recent ordinance that states that you cannot divide parcels of land if zoned A-2 without having area rezoned. He feels this could create spot zoning of the worst kind. The feeling of the people is that the County should initiate zoning on an area basis. At the present time, it; takes a long time to carry through the procedures involved. He set out the example of one of his clients who had purchased a 40 acre parcel and wanted to divide it into4-~0 acre parcels. This new ordinance has this client in a bind. Mr. Graves felt that the rezone should be a condition of the map. The rezone should run with the parcel map conditions. Supervisor Richter stated he could support this suggestion to have the two matters run concurrently. Spot zoning takes place with the present situation of A-2 zoning. Zoning should run concurrently with the division of the parcels. Suggested that the County. could go in and interim zone some of the A-2 areas and Page 344. ', October 3, 1978 ________________October3~1978_ provide that permanent zoning should be effective at the end of the two year time period. This method would take care',of a whole area rather than zoning just specific parcels that are being divided. It was requested that'the Planning Director appear before the Board to discuss this proposal.. This whole request should be aired. Planning Director will be requested to appear next week to discuss this matter. It was moved by Supervisor Richter, seconded by Supervisor Madigan and carried that rather than having zoning for specific Land divisions, that land divisions and zoning for the area run concurrently, with zoning being approved before the map is finally approved. Administrative Officer reported that Planning Director will be present to discuss this matter two weeks- from this date. •1927 APPEARANCE: DR. STUTZMAN, CHICO RE MONITORING OF DRIFT Dr. Stutzman, Ord Ferry Road, Chico, reported on the problem he is having with his orchard. The orchard has almonds and pistachios and they have sustained damage to the trees. Over the last six year period that have lost about three years growth of the trees. He stated that a report should be forthcoming regarding the monitoring of the drifts requested by the County. He asked when the report would be received and discussed. He was told that the County is very much concerned about this problem and hoped that the problem would be resolved. Chairman Winston stated he was incapable of making an investigation of this matter and he understands that a study is being made and the drift is being monitored . Administrative Officer to call and get a report on this monitoring of the drift Dr.S tut>man statedithat MCPA, the herbicide alle~lgedly being used, is a'highly toxic and deadly substance and has caused a great deal of damage. There has been much documentation on the damages caused by this substance. He stated that the Board had said that the monitoring would handle the drift, but damages are still being sustained from driftsa He €~lt that the Board's report on the monitoring would be inconclusive. Mr, Mickelson stated that Joe Bandy had advised him that Mr. Hutfless, Chico, had been in Sacramento yesterday and had talked to Ricf< Dinkell and that the monitoring report had been discussed. Supervisor Richter commented on the comments made by Dr. Stutzman about the damage to his property and about the dangers of this herbicide being extremely toxic. It is difficult for him to believe that if this chemical is as dangerous as it is stated to be, that the State allows it to be used. He said he did not want to take a position in this matter until he knows all the facts. They hlad'trouble analysing the residue from the drifts. The plants died duel to a lack of water. Mr. Hutfless stated they would get the report in soon. 78-1928 MATTERS PRESENTED BY BOARD MEMBERS Supervisor Madigan', reported that according to an article in the Sacramento papers, Senator Byrd was trying to override the Public Works Bill. Supervisor Madigan suggested that the Board send a night letter to both of our Senators in Washington, D.C. supporting the Public Works Bill. It was moved by Supervisor Madigan and seconded by Supervisor Moseley that a night letter be sent to our two U. S. Senators supporting the Public Works Bill and requesting their veto on the over-riding of the Bill. AYES: Supervisors Madigan and Moseley NOES: Supervisor Richter and Chairman Winston ABSENT: Supervisor Lemke Motion fails. Chairman Winston stated he did not know enou h about the bill to vote on the matter.
