Jack Merelman, general counsel and manager, writes to urge the Board of Supervisors to name a member and alternate immediately in the event that the constitutional revision to be voted on by all county supervisors at the Monterey meeting October 20 thru 22 is adopted. The Association writes regarding tax reform negotiations and emphasizes the Association's strong opposition to expenditure controls. RECESS: 10:20 RECONVENED: 10:30 71~-1848 APPEARANCE OF DR, SCHULTZ, CHICO, REQUEST TO HAVE BOARD Ii.ESCIND TIiEIR ACTION REQARDING ANNEXATION OF .HIS PROPERTY TO THE CITY, AS A REQUIREMENT OF THE ISSUANCE OF USE PERMIT FOR HIM Dr. Schultz, Chico, explained the purpose of his appearance before the Board. He said they have tried to comply with the requirement of the use permit concern~~.g.annexation to the City of Chico. He said the City has disapproved the annexation. "': He is~ requesting the Board to rescind their action and give them the same consideration they granted to Vistec. Time spent disc sing the request. Chairman Reynolds said he ~ uld not vote for this type ~hing until a-buffer area was designated around the City of Chico. It was moved by Supervisor Maxon, seconded by Supervisor Madigan and carried, that the stipulation for annexation to the City of Chico be removed from the requirements placed on the Use Permit for Dr, Schultz, and that he be instructed to comply with. the Health and Safety requirements and that he follow the recommendations of the Planning Commission; that he hook his units to a community sewer system. Chico, requested the Board t.o explain their views on s Community. Sewer System< He was told that there was only one system in Chico and any other system that might be used would have to be app roved by the Health Department. The Board intended that the Dr< Sehultz's development be connected to the Chico sewer facility. GOVER~VI~IENT CLASS OF GRIDLEY UNION. HIGH: SCHOOL E~TELCOMEA TO THR MEETING 71-1851 MAYOR WINSTON: PROPERTIES WITHIN THE CITY THAT HAVE BEEN ,PLACED FOR `FAX DEEDED SALES Mayo r:Ti7inston of Oroville spoke to the Board regarding properties within the city that have been placed for tax deeded sales, He said he would like to reiterate the City9s position in this matter. He explained why *_he City of Oroville desired to acquire this property. He said the bond exemption payments have to be met on these parcels of land. Earl Lucas, Supervisor-Tax Heeded Land, State Controller's Office, Sacramento, was present, said that Mr, Winston°''s concern was for the bonds, and the concern is logical. The bonds are not covered by the delinquency factor. Mr, Winston stated that the City Counsel, at their regular meeting held last evening, had objected to the sale of all five parcels, He felt a.cammittee should be appointed that could meet and investigate the policy for sale of these tax deeded properties. Mr. Winston filed a copy of the resolution adopted by the City Cour~rcrlconcerniag the sale of these properties. Mr. Swinney stated that the Board had granted permission for the sale of the property. He said that the City of Oroville did not have a built-in delinquency factor, In the parking district there is over $5,000 owing on delinquent taxes, Mr, Swinney said he felt that the suggestion of Mr. Winston to have a committee comprised o was unty people and representatives of the City of Oroville to study this matter/ a goad suggestion. Supervisor McKillop and Chairman Reynolds could represent the County, County Counsel, the cammittee members,. Mr. Swinney and the representatives from the City of Orovilie could meet and attempt to come up with a solution. A date for the meeting will be set; it was suggested. that a day during the last week of the month would be a good time to meet. Chairman Reynolds requested a member of Mr.,;LucasP office be present ar_d for him to set the time, Mrs. Dorothy ParadisE,, Oroville, said she was part owner of one of the parcels to be sold, They have been trying to secure a loan to pay the back taxes on this property. She felt the City should not be allowed to purchase this property for $50,00. Mr•. Swinney stated that Mr, Winston had not requested this sale; it was requested by another person interested in the property, 71-1852APPEARANCE: REPRESENTATIVES OF NORTHERN DISTRICT CHILDREN'S HOME SOCIETY: ADOPTION. SERVICES IN BUTTE COUNTY Mr. Bill Retzer, Chairman of the Northern-District Children°s Home Society, was present to discuss adoption services in Butte County. He said that many .members of the Society were present today. He said the Children's Home Society was a statewide organization;. he explained the purpose of the organization, He said they were financially sound, He introduced Mr. Clay McGowan, a long time resident of Chico, and very active in the Society, Mr, McGowan stated that the many children on the County's Welfare rolls were a problem. Mre McGowan stated that the Society felt they were the proper organization for the .County to contract with for the adoption services. It has been stated that this County plans to contract with Sacramento County for these services. He Page 124. October 5,.1971 October 5, 1971 explained how the matter should be handled, Child welfare serwices explained. This service gets !.he child ready for adoption. He felt their office in Chico could handle this far, more efficiently than the Sacramento County Welfare Dept. He said this matter will continue to cause a problem. The unwed mothers are more and more keeping their children. These children.-will be on Welfare. Mr. McGowan said the Society recommended that the County consider the request for the Home Society to handle these services. They are recommending that the Home Society hire one Social Worker. He explained the costs for this worker. The County could buy a share in this operation. They recommended that the County try the contract with them for on.e year at a cost of X9,000. He said that most other countie-s feel that the Home Society is the way to go. Supervisor McKillop said he felt there has been poor communications in this mailer. He had a letter from Raymond $, Cher•oske, Director-I3orther.n District Children`s Home Society addressed to Mr. Robinson. The clerk was instructed to read the letter. Mr. McGowan said that at the time this letter was written, they :had a referr.•a1 of 20 children.that were not eligible for adoption.. These referrals involved older children9 these ch5.ldr.•en are harder to handle. He said that several years ago he conferred with one of the 5uperior• Court Judges. At that time, the law changed, County Counsel was requested co represent County Welfare Department in these adoption matters. Dan Bl.ac:kstock, County Counsel, explained how his office handled these cases. He said the child must be free for adoption, Ed Robi.nson,•Welfare Director, was present and explained the Welfare Department's position in this matter, He clarified the costs involved. He said that i.f Butte County utilized the services of Sacramento County., the costs will. be entirely subverted. He said Sacramento County has a long history of placing children in good homes. Supervisor MclZillop questioned the representatives of the Home Society concerning their "DTo cost"'statement. Supervisor McKillop said he would like to see the Chairman of the Oh;il.dr;en's Home Society, Mr. Robinson and County•Counsel sit down and discuss the matter. Kent, Chico, spoke on the request for. establishment of a county service area. Mr. Kent said he had sent letters to the Board members outlining the problem involved, This concerns a bridge that will be constructed on Floral Avenue. Tt is felt that there should be curbs and gutters on this street. He said he has not been sur~c~ssful in getting a petition signed by the residents, He said he was requesting That the County inisiate whatever requirement that is necessary to have curbs and gutters installed under a service area. The street is being widened to 40"; there will be no place for the children to walk without the sidewalks. Mr. Castleberry explained the construction of the bridge, lIe said there was a high pedestrian count on this street. He said that Floral Avenue to the north is partly in. the City and partly in the County. Mr. Castleberry said he felt it would be ideal to have curbs and gutters on Floral Avenue. Dan Blackstock, County Counsel, explained how the matter could be handled, Two Supervisors could sign for a service area. There are 32 residents that would be involved. Costs set out. Chairman Reynolds said it would take the leadership of Supervisor Madigan. PORTION OF FEATHER RIVER Mr. Paul Flannigan of the State Reclamation. Board was present to speak to the Board regarding the proposed designated floodway lines for a portion of the Feather Diver. 'Phis information presentation is preliminary to the public hearing to he held October 8, 1971 in the Board room, Mr. :Flannigan just hit the high lights of the matter. lie said this concerns the adop"lion of the floodway lines with•the upper limits being the Fish Hatchery and the lower limit would be the Honcut Creek. Tie explained the project. The purpose of the designated floodway would be to secux•e permits fax`any construction in the area. lie displayed photographs that set out the areas that would be effected by the flow of water. He said their main concern was the construction of levees and homes that would be effected by the flow of the river, If a project does not impede the free flow of the water, it would be allowed, They would define the points where a permit would be needed. He said the Reclamation Board hoped to work with the County in this matter. They are considering a blanket permit for existing operations. He said that where it is known that there has been floodi_*!g by water, they would be hesitant in issuing permits. Time spent discussing the designated floodway and its effect on the County. I.- was suggested that the matter of elevation be established at the time the zane is formed. This matter will be further discussed at the meeting to be held Friday, Mr. Castleberry and George Stamm were requested to be present at k'riday"s meeting. Slocomb for a variance to reduce required "lot area, 2 lots for property zoned.°1A~3B8, southwest of Chico River Road, Chico, was held as advertised. Jim-Lawson, Planning Director, summarized the actions of the Planning vommission. `The Planning.Gommission recommended denial of the variance. The Board members asked if they had the right to grant a variance. Neal McCabe, deputy county counsel, said he would have to look into the matter of whether the Board could grant a variance. _Request set out and discussed. and Aisthorpe, Tom Kelly, from the law firm of McPherson &.Mu1ky,/sald he was representing Mr, Slocamb. This is an appeal from the decision of the Planning.Conmtission. Mr. Kelly set out the purpose of this request. The variance is for size only. The owner desires to sell 5 acres, retaining 4.83 acres in his own name for his use, He said there would be a hardship if the owner were not allowed to divide the proper.•ty. Page 126. Attorney, to be reimbux•sed as part of the Regional Polygraph Center project by the CCCJ. This equipment is available from only one source and the CGGJ grant specified the equipment by brand name. Cost of the equipment from the SAC Electronics, Inc. is $4,392.15. Request for the purchase discussed. Supervisor Maxon said he would like to see the Planxeing.~ommission.initiate proceedings for scenic highway on Pentz Road. A more suitable :Location. is now available. ?: he new location is on the Feather Rd.ver Blvd, It has a concrete parking lot; it has all t7e facilities that are needed for this operation, They care x•eceive additional funds fox'"this building, This is a commecial building in a commercial zone, If the Board approved this request, the lease would be fox' a years time. Altex•ations would have to be done before they can use the building. Mr. Robinson said he would present the lease agreement to County Counsel for his wording. '.They-have written approval from the Government for the additional x•ental fee. Time spent discussing the request for the rental of this new site. It was felt that there was no daubs that the building was needed, On motion of Supex•visar Reynolds, seconded by Supervisor Gilman and caz•ried, the Board said it was their intent to appr.°ove the rental of the Moseley building on Feather River Blvd., Oroviile, subject to County Counsel preparing the lease agreement for use as a commodity distribution center. 71n,1868 APPROVE RE UEST FOR. Stewart and West Sacramento Avenues. The California Highway:Patrol recommended that ±•he county not prohibit parking i.n. thi.a area. They feel that widening of the streets would be better. Mr. Castleberry stated that. P•ubli.c Works planned on cutting out the brush and cleari.ng.along the road first before prohibiting the parking. He said the County does not have the money to widen the streak. Supervisor Gilman said that the Highway Patrol should inspect this street an Friday afternoon, Matter discussed. He said There are b,000 cars a day trying to get through this interse~tior.. He explained the traffic prob3.em at this intersection. He felt the County should go to a. four°way stop at this intersection. This will be a lift"le inconvenient but .t will help. Mr. Castleberry said he plan:aeci to bx'ing in an ordinance in the near future that would make this a four-way stop. He explained what would be involved. He said that instead of reper'r~ ng these matters to the District Attorney, they would be brought before t:he Board and then the Board would decide whether the matter should be brought to tx•ial. This procedure has a number of advantages; he set out these advantages. Mr. Blac'kstock. explained the cases that might be ~ff.ected by this procedure. He said that County Counsel's office could advise the Board on these matters a.nd it will be up to the Board to decide the action that should be taken. Chairman R.eyr.olds stated that it was a foregone conclusion that any change would be better than what the County is doing at present.
