The Board of Supervisors met at 9:00 a.m. pursuant to adjournment. Present:
Supervisors Cameron, Madigan, McKillop, Richter and Chairman Ladd. Clif

75-1672 APPROVAL OF MINUTES
On motion of Supervisor McKillop, seconded by Supervisor Cameron and
unanimously carried, the minutes of September 30, 1975 were approved as mailed,
with the insertion on Page 262, Item 75-1667 of the remarks of Supervisor Madigan
regarding the grade separation in Durham, attaching a copy of the transcript as part
of the minutes.
75-1673 COMMUNICATIONS

Butte-Glenn Medical Society. The Society sends notice that at its September 25th

group obstetrical care in the Chico area. " Information only.
Assemblyman Charles Warren. Mr. Warren sends -notice oqf hearing re Assembly Bill 2353-
The Litter Abatement and Resource Recovery Act of,1975; October 23, 1975,

with the notice. Mr. Warren also sends notice of hearing re State Lord Use and
Resources Management Planning -Assembly Bill 2422, October 9 and 10,
1975 in San Francisco. Mr. Castleberry explained the levy that will be charged
to the contributors of the litter scene. Discussed; nQ action taken.
Department of Transportation. Department sends notice•that Butte County is assigned
$66,763 to continue the implementation of the Pavement Marking Demonstration

of the amount of allocation that we intend to obl igote. Mr. Castleberry reported
on this matter; no action taken.
Department of Transportation. Department sends notice of intention to relinquish
highway rightrof-way between 0.7 of a mile northwest of I?oute 70 and 0.3 of a
c,/ ~ ~• O O mile northwest of Shippee Road. Mr. Castleberry explained the matter of the
relinquishment of this rightrof-way; he does not feel there will be a maintenance cost
for about 7 or 8 years. Discussed; no action taken.

Senator Randolph Collier. Notice is filed of Senate Transportation Committee hearings
concerning present financial difficulties of the Department of Transportation with
~o v.e p meetings set in Fresno, Redding, San Diego, San Francisco, Los Angeles, and
Sacramento on the various dates. Mr. Castleberry will speak on the County's
behalf at the meeting. in Redding on November 4th.
Federal Communications Commission. The Commission sends Memorandum Opinion and
Order re Televents of Paradise granting Certificate of Compliance to Televents
/ p 0.~3 of Paradise. Supervisor Cameron stated he has had calls on this matter.
Mr. Mickelson stated that this opinion was a wiping out of the way some of the
roadblocks that were before this company. The final word has hot been received.
No action needed at this time.
James H. Moore. He writes concerning his letter of complaint. This concerns a variance
// 3,0 d permit approved by the Planning Commission. Copies given to the Board members.
No action taken at this time.
James W. Lenhoff. Removo! of old courthouse and jail. He suggests consideration be
given to build the needed space at present Administration Building site. Copies
of letter to be made for Board members.
Petition for variance for mobile home. Petition of Reginald Stevens for placement of

on October 21, 1975 at 1:30 p.m.

75-1674 PRESENTATION OF BI CENTENNIAL FLAG ~ CERTIFICATE TO BUTTE COUNTY

Mr. Wa gen ac , C airman, Butte County BiCentennia Committee, an
~ ?,''~ Mrs. Jack Minasian, Mrs.. Louis Olker, and Mrs. Harry Meade, members of the committe,
presented the Chairman a Bicentennial Flag and Certificate, being the official notice that
Oroville is a Bicentennial Town. Chairman Ladd said it was his pleasure to receive the
flag for the County.
Mr. Walgenbach suggested that maybe the Board could authorize the purchase
of bicentennial flags to fly aver the new courthouse and the other county buildings.
Suggestion discussed. Mr, Mickeison will study the request and bring back a recommendation
to the Board.

The letter from the Feather River Hospital read at this time.
Supervisor Cameron presented copies of the statement to the Board members
concerning a meeting paid last night by the Comprehensive Health planning Committee,
He said he was in favor of doing something regarding OB problems but he felt it should
be something that would be favorable to all cancemed. Medi-Cal payments for OB
are too low; malpractice insurance premiums are too high. He stated that if this
clinic is started it might well lead to the shut down of the other OB units in other
hospitals in the County. Supervisor Cameron suggested that the committee of interested
citizens meet and prepare a proposal regarding obstetrical care for Butte County.
Supervisor Richter set out his views regarding Supervisor Cameron's statement
and the letter from the Feather River Hospital. He feels, however, that the County
should go ahead with the proposal for the Chico area.
Chairman Ladd opened the discussion to the public.
Appearing: Mr. Leonard Coy, Feather River Hospital. ye agreed that there
is a crisis in the OB-Materni#y care area. There will be similar crisis in the other
areas of medicine. At this time, they oppose the present proposal for the clinic in
Chico. The suggestions was made that the State Health Department~hould increase the
payment for Medi-Cal patients regarding OB matters.
Discussion held conceming OB care in the County.
Mardi Worley spoke and presented copies of fhe Comprehensive Health
Planning analysis to the Board :arembers.
Mrs. Jan Terrino. She spoke concerning MCH funding through the Health
Department. The County is eligible for funding for birth control planning. She felt
the County should investigate funding for OB care.
Supervisor Cameron presented letters from Dr. James Wood, Mrs. Lytle, Mrs.
George Hackle and other nurses which expressed their approval or disapproval of the
plan .
Dr. Enloe stated that he had contacted '13r. Cunningham in Sacramento regarding
funding for OB problems. Dr. Cunningham will investigate the matter and will report
back to the County. Dr. Enloe set out his views concerning the obstetrical problems
and the pro pasals that have been made.
Violet Blem, Director of Nurses, Feather River Hospital, stated that she hoped
that in any proposal considered by the Board, that i# will include the standard of care
for the expectant mothers.
Action on this matter put over one week.
75-1676 APPROVE CONTRACT WITH FAMILY SERVICE ASSOCIATION.

On motion of Supervisor Cameron, seconded by Supervisor Richter and unanimously
carried, the contract with Family Service Association was approved and the Chairman
was authorized to sign.
75-Ib77 APPROVE CONTRACT AMENDMENT WITH FIRST UNITED METHODIST CHURCH OF
O ROVILLE
is contract provides funding for the Church which operates as the Head Start
Delegate Agency in Oroville and the amendment increases funds from $37,048 to $34,452.
TF~is funding change was previously approved by the CAA.
On motion of Supervisor Richter, seconded by Supervisor Cameron and unanimously
carried, the contract amendment with First United Methodist Church of Oroville was
approved and the Chairman was authorized to sign.
75-1678 APPROVE PROGRAM AND BUDGET SUBMISSION FOR CALENDAR YEAR 1976

spoke concerning the documents. FCe' Stated that he considered the Board of Supervisors
his employers but he works with the administering board. The administering board
decision is in conflict with his own recommendation. He does not agree with their
recommendation concerning the Day Care Center. Use of funds for the day care facility
is not a realistic use of funds was his feeling. Establishment of priorities explained by
Mr. Barry. He explained hosx~ he felt the funds should be used.
Funding for the Day Care facility discussed.
Chairman of the Administering Board, Mr. McLane present and he explained
their recommendation .
Mrs. Marjorie Wndsow, member of the administering board, stated she felt
the Day Care Center should 6e supported. There has bean a lot of funds invested in
the program.
Mr. Dan Irnmel, Church Council, urged the Board to include funds for the
Chico Community Day Care Cen#er.
Mr. Carlos Mottos, a worker at the Chico Day Care Center, said the center
was almost at the state where they can receive funding From the State for the Censer.
Fie urged the Board to support the funding of this center at this time.
Funding of the pay Care Center discussed. Supervisor Richter said he would
abstain from voting on this matter as he does not have enough information to make a
decision.
It was moved by Supervisor Cameron and seconded by Supervisor McKillop
that the program and budget for Calendar Year 197b as recommended by the administering
board be approved, with the understanding that the Board will look at this more
closely with the help of the administering board next year and be sure that the dollars
are spent as equitably as possible.

75-1679 DISCUSSION: ASSEMBLY BILL 2326 -PUBLIC ASSISTANCE, AID TO NEEDY CHILDREN:
AUTHORIZE IMPLEMENTATION OF PROGRAM
Ken Leac , D strict Attorney, was present to discuss Assembly Bill 2326-
Public Assistance, Aid to Needy Ghiidren. This bill implements federal legislation
(PL 93-647) which mandates many changes in the AFDC Program containing both
the eligibility and family support. Effective data of this bill is October I, 1975 and
implementation must be started immediately. Mr. Leach stated that a meeting was
held last week to discuss this bill. He had been advised to write a memo to administration
to have this matter placed on the agenda for discussion and possible implementation.
Staffing to implement this bill outlined by Mr. Leach. The increases to the staff will
be paid for by the Federal Government. All collections made the first year will give
the County a refund of 25%of all said collections. The percentage will go down after
the second year.
Mr. Leach stated that the immediate question is this: This bill should have bean
acted upon prior to last Wednesday. It is a mandated federal program. This will make
a lot of additional work for the Welfare collections department. Bill and its requirements
set out and discussed.
Under this new bill, the applicant must cooperate. If they do not cooperate,
then they will receive no Welfare assistance. There wit) be some when: between
2200 and 2300 files to handle. Matter of recipient case load explained. The case
load will be wbject to scrutiny by the Federal offices. The files will have to be
worked every 60 days. Mr. Leach explained how the files will be handled. If
the absent fathers do not pay, then they are sent notices. The purpose of this '
Legislotian is to enable the local people to be able to staff at the expense of the
Federal Government.
Staffing requirements requested are; One Family Welfare Investigator;
one full time attorney and three staff clerks.
The Family Support Unit staff would be paid for by this program. There will
be a great deal of clerical work to do under this program. All the fathers will have
b be contacted and have them make their payments directly through the District
Attorneys Office.
Mr. Mickelson explained his thinking concerning the staffing for this
program. He stated that a year ago the Board authorized the hiring of an additional
deputy District Attorney to work in this department. Mr. Leach explained how he
has been nvrking this deputy.
Mr. Larry Harrison, State Department of Benefit Payments, spoke concerning
the work load which will be crdated by this Bill. As a condition of eligibility for
AFDC, the recipient is mandated to assign the entire child support payments to the
Welfare Department. The mother will receive her full, Welfare payment. The absent
father will owe the County the child support pay~,nt, the County will receive 75 "Bb

Mr. Crisan stated that the staffing decision should be made at the local levy
at this time. Mr. Crisan said at this time he was not making any request for the
additional stoffing; pistrict Attorneys request discussed. Welfare might, in the
future, require additional personnel.
It was moved by Supervisor McKillop, seconded by Supervisor Richter and
unanimously carried that the County implement this programas suggested by the
District Attorney and Mr. Harrison, that the Administrator pay some attention to the
administering of the program, and that the staffing request of the District Attorney be
approved .
75-1680 APPEARANCE: MRS, PENNY HANSON CETA WORKER DOING CENSUS WORK
Mrs. Penny Hanson stated t at 1s is a CETA emp oyes oing census wor
at this time. She stated ~,tlrat she was told to work on the CETA program, she would
have to work on the census study. She went down to the testing center and spoke
to other participants. Some of the employees have to leave their presen# positions b
do this census study. She did not feel that she was considered as an individual under
this program. She urged the Board to investigate the policy of using the CETA
employees for this census study. Matter dtscussed; no action taken at this time.

Board to enforce the law as pertaining to proper use pee~mits, namely, in opposition
to the permit issued to Jerry Holcomb, Rt. 1, Box 178 L, Oroville, on Lower Clark ibaad.
She has just purchased a house near this man and his opera#ion. Complaints concerning
the operation of Mr. Holcomb set out and discussed. Supervisor Cameron stated that
this matter had been inves#igated about two years ago. He feels that the Board should
again request an investigation of the operation. Referred to the zoning investigator
for study and investigation; referred also to the Welfare Department for evaluation of
1W'. Holwmb's disability.
Gordon Mentz stated he Ilves just above the property and he set out examples
of this man's mistreatment of the children living on the property.
75-Ib82 APPEARANCE: GARY HARTE, CHICO, BUILDING PERMITS
BOARD RE-AFFIRMS ACTION REGARDING BUILDING PERMITS
Gary Harr, C ico, stated was appearing concerning is Bell Road project that
he is building. bile feels that he is being discriminated against and he would like to get
started on this project. The 'bank is holding up his financing due to comments that have
beeri,,lOUdished in the paper. Mr. Harts explained what he has done to the property in
preparation to the building of his units. Mr. Harts stated he would Like a decision
in the matter of his permits. Financing will be held up until he secures the permits.
Supervisor Madigan questioned Mr. Norte concerning the payment to McCain and
Associates.
Statements of Mr. Harts discussed.
On motion of Supervisor McKillop, seconded by Supervisor Cameron and corned,
the Board re-affirmed that previous action stating that the permits for Mr. Harts are still
valid.

75-1683 APPEARANCE: ROGER FARRAR
Roger Farrar questioned the Board about a letter he had written to them concerning
AP 47-10-80. This letter was referred to the District Attorney. He did not feel that this
was a criminal action. The Board informed him that it was referred to the District Attorney
for secure a clearance on the matterr and #o answer the letter. Supervisor Madigan
stated that while the D:-~ R is still on the property, he could not see how this Board
could help him.
RECESS: The Board recessed at 12:40 for Iuneh and for on executive session.

Chairman Ladd stated that a telegram hsa been typed as discussed

75-16$5 DISCU5SION• PROPDSAL FROM FOX MCFARREN & TARMAN ARCHITECTS
Gene McFarren, architect, stated that the Board has already
received a memo from them outlining their presentation. That' £eel that
there needs to be a definite scope set out before anything can proceed on
building the offices for Che county. They would like to get with the Building
Committee and disease the matter more fully before anything is done,
He gave the background of the matter. There wes a study done in
1970 and he feels this could be updated. Supervisor McKillop agreed with
Mr. McFarren that the scope of the pr8ject should be decided upon first.
The Building Committee is already working on the problem and will probably
report back next weak. Chairman Ladd agreed that Che scope should be
specific regarding the number of departments, employees, etc. Mr. Nickelson
stated that they are in the process of updating the 1970 study.
Mr. McFarren stated that they are avAilable to work with the county
on this matter. Supervisor McKillop suggested that Mr. Nickelson do the
ground work on this and that a meeting be set next week for the committee
meeting. This is to be done.
75-1686 PUBLIC HEARING: GARY RAY, VARIANCE TO ALLOW 10-ACRE PARCEL ON
PROPERTY ZONED TM-20. PARADISE
The public hearing for Gary Ray - variance to allow a 10-acre parcel
on property zoned TM-20 (Timber-Mountain, 20-acre minimum), located on the
north side of Hupp-Coutelenc Road, approximately 1~ miles east of Skyway,
., west of Friendly Forest Subdivision, identified ea AP 64-03-04, north of
Paradise, was held as advertised.
Hearing opened to the public. Appearing:
Gary Ray. Mr. Bay gave the background of the matter. This Was

Supervisor Cameron moved that the variance be approved with the
findings that there is a special hardship case because use would be denied
as the parcel daae sot conform to the legal requirement under the zoning
ordinance.
Supervisor Madigan stated that the Planning Commission had been
told by County Counsel that a eondltion of no further splitting is not
enforceable. Chairman Ladd felt it was until the Board of Supervisors
voted to Hllow a further reduction in parcel size.

Chairman Ladd stated that it was now time for the Board to
consider the Environmental Impact Report received for the Feather Fella
area. Mr. Lawson read the requirements of consideration of the EIR. It
was stated that the Board had read the report.

75-1689 PUBLIC HEARING: PLANNING COMMI6SION - REZONING FROM A-~ (GENERAL)
TO TM-5, TM 1O, TM-160 (TII4BER-MOUNTAIl7) AND C-F (COMMERCIAL FORESTRY) FOR
PROPERTY LOCATED NEAR FEATHER FALLS: CONTINUED ONE WEEK ^~ ~~
The public hearing oa the Butte County Planning Commission - con-
sideration of environmental impact report and rezoning from A-2 (General)
to TM-5, TM-10, TM-160 (Timber-Mountain) end C-F (Commercial-Forestry)
for property located east of the Community of Feather Falls, north of the
South Fork of the Feather River, south and east of the Middle Fork of the
Feather River and west of the Butte County boundary was held ae advertised.
Chairman Ladd questioned Mr. Lawson about private ownership of
land within the C-F area. Mr. Lawson stated that moat of the land is owned
by commercial logging companies but that there is some private ownership,
Mr. Lawson outlined the area proposed for the rezoning.
Chairman Ladd stated that the hearing would be opened to the
public and that speakers could discuss the EIR along with the zoning if
desired.
Hearing opened to the public. Appearing:
Ray Donald, private owner of land in the C-F area. Mr. Donald
stated that he object^ to the C-F caning. Fie doesn't feel the area will
support co~ercisl lagging ageratioas. He also stated that the EIR is
incorrect is several instances. He doesn't feel it is representative of the
area ae it ie today. '
Royal Mannion, District Ranger for the U.S. Forest Service. The
Forest Service owns one third of the land in the area and they are in agreement
with Che county zoning and support the proposal as presented by the Planning
Commission. Mr. Mannioa diacueaed the timber producing capability of the
land. He stated that they have some spots which have not been logged and where
the tan oak has been cut dawn that produces some excellent timber.
Chairman Ladd questioned Mr. Mannioa as to whether this would
interfere with their multiple use program. Mr. Mannion didn't feel it would
except posaiblg in the case of mining claims. Ia this instance, it would
be a question of whether the county can legally zone U.S. Forest Service lands.
Supervisor Richter questioned Mr. Mannioa regarding the tan oak.
Mr. Mannion explained that this timber is good fire wood and was used for
chips far a while. However, as the trees are cut, the stumps are sprayed
to atop nay future growth.
Ben Pruden owns acreage is the area and stated he ie opposed to
the zoning. Letters were previously received from the Prudet~ protesting the
zoning.
Supervisor McKillop questioned Mr. Lawson regarding input from the
timber companies at the hearing. A letter was received from Louisiana-Pacific
who stated that they had plans for only timber oriented uses. No one else
appeared.
John Louses, attorney representing Landowners of Feather Falls,
spoke regarding the zoning. He stated that his remarks will apply to both
zoning proposals. Mr. Luvaas read a list of people present that he was
representing. These people were in favox of the zoning.
Mr. Luvaas outlined the backgxouad of thin matter and actions

there is a rater problem in the area. There is also presently a problem
with sewage disposal and xith srosioa. Se is afraid that the ~eombination
of these could effect the quality of Lake Oroville.
Mr. Luvaas read several paragraphs of the Generai Plan that support
the zoning of the area. He also made comments supporting the EIR. Mr. Luvaas
stated that hie clients would be willing to agree to a change in the zoning
of Mr. Donald's praperty to TM-160.
Mre. Ray Donald objected to some comments made regarding the sewage
and water in the Feather Falls area. She feels there ie no problem. She
also informed the Board that they have legal acceasto their property and
have driven a passenger car into the land.
Bny Alston, Feather Falls, spoke in favor of the zoning.

Supervisor McKillop stated that he would like this matter held over
one week until the timber companies can be contacted. He wants to make
acre they know the restrictions of the C-F zoning. Supervisor Richter objected
to that being done as he feels it would be preferential treatment. Mr.
Lawson read the letter received from Sherman Rirschmeier of Louisiana-Pacific.
Discussion. Supervisor McR.illop requested it be put over one week to check
with the companies. He also feels that the Donald and Pruden property should
be considered for a different zoning. Supervisor Madigan felt the companies
know the restrictions of the zone. Mr. Lawson clarified one point: buildings,
other than residential, are permitted with a use permit in the C-F zone.
Supervisor McKi.llop was concerned that all building was prohibited and that
perhaps the timber companies were not aware of that.
Matter continued one week. This is a Closed hearing. However, if
information is received that the proponents might wish to speak to, they
rill be notified and allowed to discuss the matter.

Phil Wood, owner of property in the area, supported the rezoning

The public hearing on the formation of the Lake Madrone Water
District was held at this time.
Hearing opened to the public; Appearing:
Raymond A. Leonard, attorney. Mr. Leonard read the list of
people ha represents that have requested exclusion from the district.
A petition was filed on November 14, 1975 requesting exclusion. Mr.
Leonard filed as additional request, marked Exhibit A-1, far Mr. & Mrs.
Myron M. Nelson. Mr. Leonard stated that he has discussed the exclusion
of these properties with Paul Minasian, attorney for the proposed district,
and have come to an agreement subject to the Board's approval.
The agreement explained by Mr. Leonard stated that tIIe property
owners would give up rights of use of ~.ake Madrone and alas give up any claim
to any eater service by the proposed district. These are the main benefits.
Mr. Leonard stated that one of the~publia utilities thaC exists is
- ~• on the property of one of his'clients~ I.infoota. They agree to provide
acceseto the district..The new district would purchase or acquire the right of
the present utility district. No attempt would be made to enlarge the district.
Mr. Leonard also discussed the road. His clients would be required to contribute
to the maintenance of the roads in the area if the forest service should discontinue
this service.
Mr. Minasian stated that Che agreement was basically as presented
by Mr. Leonard. They agree to the exclusion sad have reached an agreement.

Phil Mace, attorney, stated that the performance, maintenance
and labor bonds have been delivered to Public Works and all other items
have been done ae required. The only thing to be solved concerns the
dedication of the roads. Mr. Mace also stated he is willing to cooperate
with the Board regarding the annexation to CSA #4, however this must be
initiated by the Board of Supervisors.
Mr. Castleberry stated that it is is order tc proceed with this
matter. They have the option of accepting the roads or not. He feel's they
have complied. He recommeada that the roads be accepted afterwards and they
would be broughtup to full county standards. It was also noted that the
record of •survey is ready to be recorded. Discuesionaf crossing one-foot
strip. It was stated that the road was being built to county standards
so it would be proper to allow the coossing of this strip. Mrs. Blair
and Mr. Castleberry discussed this.
Discussion of action to be taken. Mrs. Blair stated that the
Board could approve the recording of the notices of compliance. Chairman
Ladd felt this Gould be done.
On motion of Supervisor Cameron, seconded by Supervisor McKillop
and unanimously carried, Public Works or the Subdivision Committee were
authorized to record the certificates of compliance upon receipt and approval
by Public Works of the Road Maintenance agreement ar the deeds.
Mr. Mace stated that there night be a problem with the title
companies. He would like to have a subsequent document recorded stating

CHANGE ORDER
On motion of Supervisor McKillop, seconded by Supervisor Richter and
unanimously carried, Change Order No. I, previously approved by the Board for
Gridley Fire Station was rescinded and tha following change order was approved and
Chairman au#horized to sign: (a)on overhead fil! stand, turn valve upward so water
will drain from bonnet eliminating freezing (no charge}. Relocated as requested by
Forestry deleting small concrete pad; (b) extend curb from return northerly along
Fcirway Drive ro the redwood header of driveway-$649; (c) install a wnduit to front
of building for 'day and night"doorbell-if possible-$50; and (d) underground telephone
conduit, pull wire and term, board-$270 with a total of $969 for said change order.
75-1701 NEAL ROAD LANDFILL COVER MATERIAL PURCHASE ORDER: B. C. RICHTER
RELIEVED OF PURCHASE QRDER FOR PROVIDING COVER MATERIAL
.8. C. Richter requests to 6e re ieve of s pure ass or er or providing
rover material for Neal Road Ipndfiil operation. Clay Castleberry, Dixeeror of
Public Works, explained the action that could be taken. The County could negotiate
with the second bidder for the work.
Time spent discussing the action that should be staken. Mr. Castleberry
said hFS first choice would be to allow Purchasing and Public Works to negotiate with
the second low bidder.
On motion of Supervisor Cameron, seconded by Supervisor Richter and
unanimously carried, B. C. Richter was relieved of his purchase order for providing
cover materia! at Nea! Road landfill operation, auditor was authorized to pay Mr. Richter

for the materials he was able to provide and authorized Public Works to negotiate
with the second bidder and bring his results back to the Board next week.
75-1702 INFORMATION AND DISCUSSION ITEMS

slightly revised FAS system, He set out the changes to the system. The Skyway has
become a primary road and Secondary funds will no longer be available For it.
Mr. Castleberry stared that the map setting out the changes will be out at his office
for viewing by the Board members. He will have a resolution next week requesting
the Board to approve the change.
(b) Driveway with locked ga to to old Quincy Road From M & T Market site.
Mr. Castlebe_nfy.said the owner has applied for a driveway permit and he states he
will keep the driveway gated and locked. The County is concerned about through
traffic. The owner will be required to put up steel barriers. The use permit will
be approved for one year. Matter discussed; no action taken.
75-1703 APPROVE DRILLING OF TEST HOLES FOR FEATHER RIVER iO.PPO"Rfi~llTY CENTS

unanimously carried, drilling of test holes for Feather River Opportunity Center site
was approved so payment can be made by the Auditor .
75-1704 PUBLIC WORKS DIRECTOR TO WRITE LETTER TO ALL PARTIES CONCERNED
INFORMING THEM TO SETTLE THEIR PROPERTY RIGHTS BETWEEN THEMSELVES

of neighbors fighting over an access problem. A letter should be written to the parties
involved to tell them to settle the property rights between themselves and that they
try to get along as good neighbors. It should be suggested that they secure a final
determination of prescriptive rights, probably through the Courts.
On motion of Supervisor Richter, seconded by Supervisor McKillop and
unanimously carried, Director of Public Works was authorized to write a letter to
all parties concerned in the Forbestown property problem, setting out the facts
as outlined above.
75-1705 BOARD MEETING DATE CWANGED FROM OCTOBER 28th to OCTOBER 27th,
HEARINGS RESET FOR NOVEMBER 4th, 1:30 .m.

On motion of Supervisor Madigan, seconded by Supervisor Richter and
unanimously carried, the Board meeting date for October 28, 1975 was changed
to October 27th and the hearings scheduled for that dote were rescheduled for
Tuesday, November 4th, at (:34 p.m.

75-1710 ; DlSC4iSS10N: PUBLIC SERVICE EMPLOYMENT JOB VACANCIES
A po icy decision is neede to determine procedures or re i ing permanent
public service employment jobs in County offices. Federal Funding after June 30, 1976
is questionable. Mr. Clif Nickelson, Administrative Officer, explained this item.
He presented a list prepared by Mr. Rackerby. The Board should look at the list and
make a decision regarding how positions should be filled when a vacancy occurs.
Mr. Rackerby asked if the Board was ready to take a position concerning this matter.
At the present time: these positions c•,are not regular positions. Mr. Rackerby stated
that if the federal program is extended, then he will wntinue these positions under
the federal program. He explained the action that should be taken.
It was staked that these positions would be a part of the department budgets
proposed next year. Chairman Ladd said he did not think that these positions will be
transitioned. The Board should not be asked to consider the positions at this time.
Time spent discussing the positions that will be open when the Manpower program
ends. Mr. Nickelson will set up a list with Mr. Rackerby and will bring back a
recommendation to the Board. No action taken at this time,
75-1711 SURPLUS PROPERTY APPROVE!)
On motion o Supervisor Cameron, seconded by Supervisor Madigan and
unanimously carried, three bookkeeping machines in fhe Auditor's Office were
declared surplus property and the Purchasing Officer was authorized to dispose
of the machines.
75-1712 AUTHORIZE TRANSFER OF FUNDS, OVERTIME FOR CENSUS
Mr. Mac a son exp ained t at excuse o certpin startup staffing problems
in the Chico area, it is requested that 55;~t>;10 be transferred from the reserve to the
census project for overtime. Transfer is needed because CETA funds are not designed
to pay overtime costs. Problem explained. Chieo was delayed in getting started,
and these people will need to be worl~a9ev~~ime. It tias felt they would need about

from $3000 to $5000 for the overtime estimated.
Matter discussed. Supervisor Madigan asked why the County had not been
alerted to this when the contract was approved. Mr. Nickelson stded that about
$1,500 was needed at this time.
On motion of Supervisor McKillop, sewnded by Supervisor Cameron and
unanimously carried, transfer of $1,500 was authorized, from the reserve, to 6e
used for overtime pay for the census takers in the Chico area.
75-1713 BUDGET TRANSFERS APPROVED
n motion o pervisor ameron, seconded by Supervisor Richter and
unanimously parried, the following budget transfers were approved:
B-039 Health Services Agency - Administrption. Contributions to other agencies
is reduced by $2,007 and this amount is reverted to the reserve for wntingencies-
general Fund. The reduction in contributions to Comprehensive Health Planning
was not incorporated in the final budget and this adjusts the budget and reverts
the appropriation to the amount allowed by the Board of $2,000.
B-040 Paradise Constable. $143 is transferred from office expense to extra
help within the Paradise Constable's budget. This extra help charge was incurred
due to a misunderstanding by the Paradise Constable regarding the employment of
CETA I employees. Thts situation has now been corrected but the person who wodced
68 hours and was not eligible as a CETA I employee, must be paid.
75-1714 ADOPT ORDINANCE 1630, ESTABLISHING NEW SUPERVISORIAL BOUNDARIES
On motion a Supervisor Cameron, secondedE y Supervisor Rie ter an
unanimously carried, second reading of ordinance establishing new supervisorial
boundaries was waived, Ordinance 1630 establishing new supervisorial boundaries
was adopted and the Chairman was authorized to sign.
75-1,715 APPROVE NEW CONTRACT WITH FEATHER RIVER OPPORTUNITY CENTER
On motion o Supervisor McKi op, sewn e y Supervisor Rie ter a
unanimously carried, the new wntract with Feather River OpportunityCenter to
replace one previously approved was approved and the Chairman was authorized
to sign.
75-1716 REPORTS BY JIM GRIFFITH, DEPUTY COUNTY COUNSEL: RESIGNATION OF
MEMBEROF OWID AND OREGON CITY SCHOOLHOUSE

requested comments on the resignation of Daryi Weston from the Oroville Wyandotte
Irrigation District. The Board could make an appointment at this time, 6vt the
appointee could not file for the election. He felt that with the election coming up,
it would be ro the disadvantage of the Board for an appointment to be made at this time.

Mr. Griffith reported that regarding the Oregon/$choolhause, it was beyond the
point whexre the Board could prevent the sale of this property. Retention of the schoolhouse
discussed. Mr. Nickelson will answer Mr. Lenhoff's letter explaining the situa#ion.
