The City of Chico has requested authorization to do building inspection
work and collect fees on the following AP Nos. located in the Bidwell Drive and
Sacramento Avenue areas: 43-253-05; 43-253-04; 43-290-67; 43-290-37 (this
property is in the process of being annexed to the City of Chico). Request
discussed. Ctay Castleberry, Director of Public Works, suggested that ar,
stipulation be attached to the approval stating that the developer be required
to do improvement work [o take care of the traffic problems in that area.
Tt was felt that the County should be more definite as to what they will require.
Mr. Castleberry requested that he be given an hoar to-work up the stipulatior_.

Clay Castleberry,Director of Public Works, reported on the assessment
district for the Junior College improvementso He said this project will involve
the 1913 Bond Act procedures. In Lhe past, the Publi.: Works director has been
named the engineer of work for 1913 Act procedures. Discussed whether Mr. Castleberry
should be appointed engineer of work at this time. The~College is doing the
preliminary work and they want to know if Mr. Castleberry will be named engineer
of work. I"c was stated that if the assessment district were not approved, then
there would be no need for an engineer of work. It was felt there was not need
to take action at this time. Tt was said that Mr. Castleberry would be appointed
if the District is to be formed,

C'iay Castleber'x~y, Director' of Public Works, reported on the hearing
held by the Reclamation Board last Friday in the Board of Supervisors-Room.
He reported that the Reclamation Board would establish those levels as requested
by "she Board of Supervisors. They acknowledged the County's concern but went
ahead ar_d established the floodway.
7`he 5acx'amento River floodway was also discussed. Lowering of the levees
along this river also discussed. Supervisor Gilman explained the levee situation.

.Brian W. Freeman, representing Del kiyde, reported on. the 1972 Headstart
program and requested that the package be approved and the Chairman authorized
to sign. Total funding set out and discussed, He stated that this program has
provided many advantages to the underpriveleged. Mr. Freeman stated that the
day care center provides services that the other day care centers do not provide.

Brian Freeman. reported on the 197273 Versatile funded pragr.am. lie stated
t~tat this program includes administration, neighborhood service centers, family
planning, youth development and economic development. Mr. Freeman explained the
.purpose of the program. Services pro~~~ided by this program set out and discussed.
Funding for this program explained. 'Fhe word "political~.y" set out in .5a of the
summary of the program was eliminated at the request of the Board members. The
activities of the Economic Deve"lopmen,t portion of this program explained and
discussed.

The new EOC Personnel Manual has bean reviewed by the County Personnel
Department and approved by the EOC. Mr, Rackerby said this could be approved by
the Board at this time as it has been cleared by Personnel Office, 'There is no
conflicth the format of the manual has not been changed. Time spent discussing
the manual.

Mr. Freeman reported that 'there would be a press conference on October
21st, and the Board members were invited. He explained the purpose of the
conference. He explained the firewood cutting program; he said this program
has taken 30 men off the Welfare rolls and they are now earning their own .living.
71•-1900 APgF,ARANCE° ED KIM~I,SHJE DIIJRHAM-BANK EROSION ON-SACRAMENTO RIVER
Q Mr. Ed Kimmelshue, Rt. 1, Box 936, Durham, stated he farms on the
Sacramento River. There is a great deal of bank erosion along this river.
He said the farmers have been trying to get some action from•khe Corpsof
Engineers to keep the bank the same as it is now. The river has eaten
under the levee. The Corpsof Engineers has come up with the solution that they
will move back the levee 400'. They will not do anything in sustaining the levee,
The.Corpsof Engineers has informed the landowners that if they will put up
$18,900 they will move the levee. Mr. Kimmelshue said he was present today
to ask the Board to help them financially. Request explained time spent
discussing the request. It was felt that there was a conflict between the
opinion of the Corpsof Engineers and the Reclamation Board. The Reclamation
Board has discussed the lowering of the levees; the Corp of Engineers are
talking about the moving of ,the levees. The landow,#?ers feel they need more
protection from the water. `The Corps of Engineers-will not put in a cent of
money for rock revetment work.
It was stated that the Board would take this request under advisement.
It was suggested that a meeting be set up with the representatives from the Corp
of Engineers and Mr. Castleberry and the Supervisors. Maybe through this meeting
a solution can be reached. Mr. Castleberry will attempt to set up this
meeting for Thursday; he will advise Mr. Kimmelshue of the meeting date and time.

71-1901 APPEARANCES DAVE LANTIS, OAK PARK AVE., CHICOs GRANTING OF VISTEC:USE._PERMIT
Dave Zantis, Oak Park Ave°, Chico, read an article that appeared in the
Chico Enterprise concerning the granting of the Vistec use permit. He asked
the Board what they meant by a community sewer system. The Board informed him
that they had meant that this development would hook up to the City's sewer
system or build a sewer treatment plant themselves. Matter discussed; no
action r~zcessary.

resume of the communications proposal for Butte County. He said the objectives
of the proposal eras

Mr, Garner said it is felt that the solution to the whole problem is
the Centrex telephone system. He showed slides on the advantages of Centrex.
He ,explained how the system would work. Ca1'ls can be placed without the
assistance of an operator, He set out the cost comparison between the present
system and the conversion to Centrex.

It is felt there would be more control under Centrex. Mr. Nickelson
said the County would have better control than at present. He said that if
the County did not go to this system, they will have to upgrade the present
system.

71-1903 PUBLIC HEARINGo CARL DIETZ, USE PERMIT TO ESTABLISH A RETAIL LUMBER 'YARD,
\ WEST SIDE OF ESPLANADE. CHICO
~" The public hearing on the application of Carl Dietz for a use permit to
~,~` establish a retail lumber yard, including possible pre-cutting and pre-fabrication
on property zoned o'A-2o' (general) located on the west side of Esplanade opposite
Eaton Road, identified as the;sautherly approximate 11.82 acres of AP 44-03 44,
Chico, was held as advertised, Jim Lawson, Planning Director, summarized the
actions of the Planning Commission in this matter. The Planning Commission
recoamlended denial of the use permit. Mr. Lawson stated that the full Commission
was not present at the meeting when this matter was heard. The applicant
appealed the decision of the Planning Commission.
Hearing opened to the public. Letters received in opposition to the
Use Permit: Carl Rottschalk; Jean Souders, Wallin J. Carlson and City of
Chico Planning Commission. Chairman Reynolds also received a letter in
opposition from Glenn Kendall.

Appearing in favors Mr. Carl Dietz, applicant. Mr. Dietz said there
was a misconception of the proposed use. They do not pre-fabricate anything.
They have outgrown the area that they now operate from. They have never had
a complaint from any of the neighborsl. There will be no burning on these
premises. He said a limitation could' be placed on the use permit stating that
there will. be no pre_fabricating or burning on this site. He explained
the present operation. He said they merely wanted Lo operate a retail and
wholesale. lumber lot. He said they do some pre cutting now, Neil Dietz, so~~
of the applicant, said that the County could eliminate the pre-fab part of the
use permit but they would need the pre-cut part.
Proposed use discussed. Clay Castleberry, Director of Public Works,
said. it was their recommendation that the County should preserve a right-of~~aay
for future use by the County. A condition of the use permit world be to
reserve the 80' right of way. The applicant could use the right-of-way but
it would be reserved for future use by the County. Discussed the dedication
of the 80' right of way. The applicant said he would agreed to the dedication
of half the right-of-way.
2. Mr. Olson, Camille Drive, Chico, also appeared in favor of the
use permit. He said he owned the property,at this time; he would not dedicate
any right of way to the County. He said he..does_not oppose the use permit.

1. Mr. Glenn Kendall, Bay Ave., Chico. He said he was opposed
to the-use permit. He said it does not conform to the General Plann for Butte
caunty. He said Chicops General Plan is almost identical to the County`s plan.
He .said this would be a major violation to the GountyBs General Plan.
2. Mr. Dave Lanais, Oak Park Ave., Chico. He said the fringe
growth of Chico is critical; the whole area,is critical at this time.

discussed. Supervisor Gilman said he has mixed emotions on this matter. He
said he was for good planning. Supervisor McKillop said these people in the
general zoned areas should do some re-zoning for the area9 he felt the farming
areas .should be reserved for farming. Chairman Reynolds set forth his views on
the matter. He said the County policy has been to wait until people have
requested the rezoning before hearings are held for rezoning. He feels that
there should be some pre_planning before the fact. He felt the Count y, has
to look to the future and see these problems. Supervisor Faxon said he
felt this enterprise would benefit the taxpayer and would permit someone
tvho owns land to use it to his advantage.
,7im Lawson, Planning :Director, explained the feelings of the County
Planning Commission and the Chico Planning Commission. They feel that this
use would not be consistent to either general plan.

Time spent discussing the use permit and how the operation would
effect the area involved, Supervisor McKillop read Dr. Keadall's letter.
Dr. Kendall stated ire the letter that in the event that the Board cannot
deny the appeal, then maybe the Board could grant the use permit with the
understanding that the pre-fab and the pre-cut part of the use permit be
eliminated. I~c was also felt that the developer should construct the
Eatan Road access up to County standards. A deed for the 40' right of way
should also be given to the County. The applicant requested than the
condition that he construct a 6' high storage wood fence be taken off the
use permit as he intends to erect a chain link fence, rather than a wood
fence.
On motion of Supervisor Oilman, seconded by Supervisor Maxon and
carried, the use permit for Carl Dietz to establish a retail lumber yard,
pn property zoned "Ad2" (general) located on the west side of Esplanade
opposite Eaeon'Road, identified as the southerly approximate 11,82 acres
of AP 44°•03°'44, Chico, was approved, subject to the conditions set out by
the Planning Commission, and with the exclusion of the pre-'fab operation, and
ghat a 80' right of way on the subject property be deeded to "she County;
and that a chain link fence 'be constructed around the subject property.
Part of the conditions of the approval was that the access from the property
onto Eaton Road be constructed to County standards,

Clay Castleberry, Director of Public Works, reported on his telephone
conversation with Col. McCullomo He said there was no problem between the
Corg of Engineers. and the Reclamation Board concerning the levees, The $19,800
the Corp is requesting for the moving of the levees is in keeping with their
policy. Mr, Castleberry explained the policy. The owners of the property would
contribute to this amount of money that would-be required.. Mr. Castleberry stated
that Col: McCullom did not feel that a meeting was necessary. Matter discussed;
Mr. Castleberry will draft a letter requesting that a meeting.be held to discuss
this matter. '

Mr. Castleberry reported on the request of the City of Chico to do
building inspec*_ion work and col7e ct fees. He presented a proposal concerning
this request. He proposes that the City of Chico annex ,the through streets,
or as a condition of the developer going into the City, that the developer
be asked to improve the streets up to the city's standards, Discussed the
proposal of Public Works.
On motion of Supervisor Reynolds, seconded by Supervisor McKillop and
carried, the request by Gity of ..Chico to do building inspection work and
collect fees on property, located in the Bidwelh Drive and Sacramento Avenue
areas on AP T>Tos< 43-253-05; 43-253-04s 43-290-67; and 43-290-37 was authorized,
subject to the property being. annexed to the City n~-that the streets
leading up to the development and the roadways be brought up to the standards
of the City of Chico.

Dan Blackstock, County Counsel, asked the Isoard if they wanted to
take action on the question of zoning enforcement, ®r did they want to wait
until the whole Board was present, He said these would be different type
cases "than the way they. are being handled at present. He has discussed this
with the Dis*•x'ict Attorney and they would like to see the County give this
proposal a trial. The man~ser of handling these situations at present has
not been very effective and this new proposal might prove more effective,
Supervisor Maxon said he was in favor of this proposals a zoning violation
should not be a criminal matter.. Time spent discussing the proposal and
how it should be handled.

Mr. Macleessy, Agriculture Dept., representing Mr. Black, Air Pollution
Officer, appeared to answer questions concerning meteorological information
and agricultural burning which` obscures highways, He explained the situation
of the wind blowing the smoke do burn days across the highways. The Air
Resources Board had stated that they.would have aerial reports on burn ,days.

Mr.-Mackessy said the Air Resources Board wex•e attempting to contract with Redding
or Red Bluff for the aerial reports; they hope to have_a contx'aet completed-soon.

Time spent discussing the report, The farmers need co burn now; they
cannot wait until the Air Resources Board gets a plane info the air. l:t was
stated that there are only certain airports that can make these weather reports.
Mr._Mackessy said the Board was also working with the Chico airport on a
contract,
It was stated that there has been a lot of controversy about the burn
or no burn days. There is different criteria set up for. burn days. A criteria
has been set up for burning the rice hulls, It was stated that if smoke gets
on the highway, the person banning the ri.ee hult.s would be cited, The
Highway Patrol issues the encroachment. permits to enable the growers to have
a f3.agman present on burn days. Mr, Black was requested to check with the
D;i.vision-of Highways and the Highway Patrol to determine what the problem was
and how i.t could be hax±dled.
'1'he Board members felt there should be a p:iane in the Chico area
to report on the weather conditions. The Board members felt that the Air
Resources Board should have been x•eady to go on this matter by the first of
September.
On motion of SupervisorR.eynolds9 seconded by Supervisor Gilman and
carried,.the Administrative Officer was requested to write a letter along
the lines as set out by Supervisor Gilman to be addressed to the Air Resources
Board, requesting That they have a contract for the plane in the Chico area
at the earliest possible date and that a copy of this letter be sent to Shan
Patterson.
71-1912 DISGUSSIDNe CONSTRUCTION OF PONDS AND AtTTF_FO1kIZATION:'TO CLOSE CI~1RK ROAD
DUMP SITE
Howard Toussaint, Sanitarian for the Butte County Health Department, was
gresent to discuss the proposal for sewage sludge ponds at the Neal Road dump
site for Paradise septic Tank pumpers. When the City of Chico gets their
new sewage plant built in Chico, they will take the waste in the Chico area.
Mr, `Toussaint said it was estimated that it would cost about $6,000 to
build sewage sludge ponds at the N'ea1 Road site. He said the pond should be
fenced at a cost of about $1,200. He said he would like some indication
from the Board whether they would like to make this expenditure. He said there
was a waste disposal problem in the Paradise area, Mr. Castleberry indicated
that his depax•tment would construct the ponds.
Time spent discussing the request, The county would receive about
$100 a week from the pumpers to dispose of their waste at this site. Mr.
Castleberry and Mr. Toussaint will work. out the details of the plans for these
ponds.
Mr. Castleberry said they were going co open bids for the Gridley
transfer' station This Thursday, He will report on the bids at a later date,

Considerable comment has been raised recently concerning county employees
usurping-the parking. spots around the Courthouse to the detriment of the public
who. wish to do business in the Courthouse. Because of-the adverse public
xelations that are developing over this subject the Administrative Officer
proposes that a policy position be adopted in this instance. Mr. M3.chelson
suggested that the Board take a position in this matter. Mr. Nickelson read
the statement that he had prepared on this matter. Matter discussed; it
was felt the Board did not have to take action at this time. It. was the
unanimous feeling of the Board members that the Administrative Officer should
proceed with the matter as set out in his statement.

The purchasing office has reviewed the offer made by Televents of
Paradise. Action rec{ues.ted; award franchise with certain contions. Information

requested that the company file a monthly progress report, to be received by

Discussed the indication of people that they would only be able to
receive three channels through this service. Representative £ram Televent,
Mr. Ray Davis, Martinez, California, said that under the present rule they can
carry 8 channels. They must have the cable into 50 homes prior to March of
1972 to be able to maintain the franchise,
On motion of Supervisor Maxon, seconded by Supervisor Gilman-and
carried, the award of franchise to Televents was approved, the Chairman was
authorized to sign the contract, subject to the conditions set forth by the
Administrative Officer.

The annual Butte County Golden Feather Fair Budget for 1971w72 has
been approved by the State and the Caunty Auditor. The basic budget totals
$153,418.

carried, the Butte County Golden Feather Fair Budget for 1971-72 was approved

Clif Nickelson, Administrative Officer, said that in view of the Board's
recent actions regarding the services of the State Welfare Department's
Community Services Division, Dr. Maguire and the Mental Health-Advisory Board
recLuest the following actions cancel designation of the Community Services
Division as the pre-petition screening agency for mentally disordered persons
in•Butte County and designate the Butte County. Mental Health. Services as the
agency to provide this service pursuant to Section .5202 of the Welfare and
Institutions Code. Action to be taken discussed.
On .motion of Supervisor Reynolds, seconded by Supervisor Maxon and
carried, the Board cancelled the designation .of the Community: Services Division

Flamm of the Highway Patrol should be present when the ordinance is discussed.

.Time spent discussing the appointment'of a member and alternate to
CSAC Board of Directors for voting on Constitutional amendment. Supervisor-Maxon
explained his objectionro the amendment to the Constitution.
On,motion of Supervisor Maxon, seconded by Supervisor Gilman and
carxied,::Supervisor McKillop was appointed as a member and Supervisor Reynolds
as the alternate to CSAC Board of Directors fox voting on the Constitutional
amendment.
Supervisor McKillop requested that the Board-set out their feelings
concerning the amendment. Chairman•R:eynolds~felt the amendment-would give
better balance to the counties. Supervisor-Maxon felt that each matter should be
ratified by each county. Supervisor Gilman said that John Perez had spoken
to,him about supporting some individual to be on the executive committee. It
was stated that the executive committee was very impox•tant. It was suggested
that Supervisor McKillop support Mr. Wagerman.

Clay Castleberry,Director of Public Works, reported on the assessment
district for the Junior College improvements. He said this project will involve
the 1913 Bond Act procedures. In the past, the Public Works director has been
named the engineer of work for 1913 Act procedures. Discussed whether Mr. Castleberry
should be appointed engineer of work at this time. The College is doing the
preliminary work and they want to know if Mr. Castleberry will be named engineer
of work. It was stated that if the assessment district were not approved, then
there would be no need for an engineer of work. It was felt there was noPneed
to take acaion at this time, It was said that Mr. Castleberry would be appointed
if the District is to be formed.

Clay Castleberry, Director of Public Works, reported on the hearing
held by the Reclamation Board last-Friday in the Board of Supervisors Room.
He reported that the Reclamation Board would establish those levels as requested
by ==he Board of Supervisors, Whey acknowledged the County`s concern but. went
ahead and established the floodway.
~`he Sacr.•amento River floadway was also discussed. Lowering of the levees
along this river also discussed. Supervisor Gilman explained the levee situation.

Mr, E'reeman reported that there would be a press conference on October
21st, and the Board members were invited. He explained the purpose of the
conference. He explained the firewood cutting program; he said this program
has taken 30 men off the Welfare rolls and they are now earning their own .living.

Q Mr. Ed Kimmelshue, Rt. 1, Box 936, Durham, stated he farms on the
Sacramento River. There is a great deal of bank erosion along this river.
He said the farmers have been trying to get some action from khe Corpsof
Engineers to keep the bank the same as it is now. The river has eaten
under the 3evee. The Corpsof Engineers has come up with the solution that they
will move back the levee 400'. They will not do anything in sustaining the levee,
The Corpsof Engineers has informed the landowners that if they will put up
$18,900 they will move the levee, Mr. Kimmelshue said he was present today
to ask the Board to help them financially. Request explained; time spent
discussir..g the request. It was felt that there was a conflict between the
opinion of the Corpsof Engineers. and the Reclamation Board. The Reclamation
Board has discussed the lowering of the levees; the Corp of Engineers are
talking about the moving. of-the levees. The landow,hers feel they need more
protection from the water. The Corpsof Engineers will not put in a cent of
money for rock revetment work.
It was stated that the Board would take this request under advisement,
It was suggested that a meeting be set up with the representatives from the Corp
of Engineers and Mr. Castleberry-and the Supervisors, Maybe through this meeting
a solution can be reached. Mr. Castleberry will attempt to set up this
meeting for Thursdays he will advise Mr. Kimmelshue of the meeting date and time.

the Board what they meant by a community sewer system. The Board informed him
that they had meant that this development would hook up to the City's sewer

The gublic hearing on the application of Garl Dietz for a use permit to
establish a retail lumber yard, including possible pre-cutting and pre-fabrication
on property zoned "A-2" (general) located on the west side of Esplanade opposite
Eaton Road, identified as the southerly approximate 11.82 acres of AP 44•-03x44,
Chico, was held as advertised. Jim Lawson, Planning Director, summarized the
actions of the Planning Commission in this matter. The Planning Commission
recommended denial of the use permit. Mr. Lawson stated that the full Commission
was not present at the meeting when this matter was heard. 'The applicant
appealed the decision of the Planning Commission.
Hearing opened to the public. Letters received in.opposition to the
'Use Permits Carl Rottschalk; Jean Souders, Wallin J. Carlson and City of

the present operation. He said they merely. wanted to operate a retail and

there should be some preplanning before the fact. He felt the County. has

felt this enterprise would benefit the taxpayer and would permit someone
raho owns land to use it to his advantage.

should also be given to the County. The applicant requested that the

to report on the weather conditions. `The Board members felt that the Air
Resources Board should have been ready to go on this matter by the first of
September.

Howard Toussaint, Sanitarian for the Butte County Hea"lth Department, was
present to discuss the proposal for sewage sludge ponds at the Deal Road dump
site for Paradise septic tank pumpers. When the City of Chico gets their
new sewage plant built in Chico, they will take the waste in the Chico area.
Mr. Toussaint said it was estimated that it would cost about $6,000 to
build sewage sludge ponds at the A7•eal Road site. He said the pond should be
fenced at a cost of about $1,200. He said he would like some indication
from the Board whether they would like to make this expenditure. He said there
was a waste disposal problem in "the Paradise area. Mr. Castleberry indicated
that his department would construct the ponds.
Time spent discussing the request, The county would receive about
$100 a week from the pumpers to dispose of their-waste at this site. Mr.
Castleberry and Mr. Toussaint will work. out the details of the plans for these
ponds.
Mr. Castleberry said they were going co open bids for the Gridley
transfer station this Thursday, He will report on the bids at a later date.

A. proposed parade ordinance has been prepared and copies have been .sent
to members of the Board, Supervisor Maxon said he has not had an opportunity
to,,_read the proposed ordinance and requested that it be held over, County Counsel
explained. the ordinance. Mr. Blackstock'said that Sheriff Gillick and Captain
Flamm of the U.ighway Patrol should be present when the ordinance is discussed.

71x1919 APPOINTMENT OF MEMBER AND ALTERNATE TO S'C BOARS OF DIRECTORS
`Time spent discussing the appointment'of a member and alternate to
CSAC Board of Directors for voting on Constitutional amendment. Supervisor-Maxon
explained his objection to the amendment to the Constitution.
On motion of Supervisor Maxon, seconded by Supervisor Gilman and
carried,:,Supervisor McKillop was appointed as a member and Supervisor Reynolds
as the alternate to CSAC Board of Directors for voting on the Constitutional
amendment,
Supervisor McKillop requested that the Board set out their feelings
concerning .the amendment. Chairmam-Reynolds-felt Che amendment: would give
better balance to the counties. Supervisor Maxon felt that each matter should be
ratified by each county. Supervisor Gilman said that John Perez had spoken
to.him about supporting .some individual to be on the executive committee. It
was stated that the executive committee was very important, It was. suggested
that Supervisor McKillop support Mr. Wagerman.
Discussed action to be taken at the. meeting,
On .motion of Supervisor Reynolds, seconded.by Supervisor McKillop
and carried, the proposed constitution amendment for the State Supervisors
Association was approved,

A vacancy exists on the Planning Commission due to the resignation of
Commissioner Glenn Kendall. Supervisor Gilman said he has nominees for the
position, but he was not ready to make the appointment at this time. .Matter
to be placed back on the agenda in two weeks°time.

Supervisor McKillop asked questions concerning the memo from Donald
Black, Agricultural Commissioner, concerning AB 1161. Supervisor McKillop
felt the Board had opposed this bill at an earlier meeting. Administrative
Officer requested to check on this matter and if no action has been taken,
the matter was to be placed back on the agenda, _Mr. Nickelson will discuss
the .mat ter with Mr. Black,
71m1922 DISGUSSIONo OPPOSITION TO BUSSING OF SCHOOL CHILDREN
Supervisor Maxon said he would like to see Butte County oppose the
bussing of school children. He explained his opposition. He said he would
like. to request that County Counsel prepare a resolution in opposition to
this matter. County Counsel was requested to prepare a resolution and
presEnt.it to the Board for-..consideration.
71-1923 REQIiEST FOR EXECUTIVE SESSION
Ed Brown, Assistant County Assessor, said he has been in contact with
have Vasco, County Assessor, and he has requested that Mr. Brown meet with the
Board in executive session to discuss litigation and also a personnel matter,
Mr, Brown_discussed,the matter with County Counsel; Dan Blaekstock, County Counsel,
said it would be in order to have an executive session at this time°

RECONVENED: The Board reconvened at,2o45 following an executive session.
