October 18, 1977 October 18, 1977 77-2006 APPROVE REFUND TO CHARLES G.^MAGGI, JR. - REGARDING $7.00 IN PENALTIES FOR LICENSING OF HIS DOG On motion of Su~3ervisor Madigan, seconded by Supervisor Lemke and carried, a refund in the amount of $7.00 to Charles G. Maggi, Jr. for penalties for licensing of his dog was approved subject to review by Counsel. 77-2007 ADDITIONAL MATTERS PRESENTED Supervisor hemke stated that he had a report to make to the Board regarding the meeting in Washington, D.C, that he and Larry_Brooks attended. The report was to be made following BCAG on October 19, 1977. BCAG has been canceled. The report to be given later in the meeting. Dan Blackstock, County Counsel, asked the Board for direction on how to proceed in the zoning violation matter of Feather River Manufacturing. It was felt that Counsel should attempt to have the ordinance enforced. Tf the matter reaches the point of going to court then Counsel is to bring the matter back to the Board. 77-2008 ADOPT RESOLUTION 77-164: RESOLUTION MODIFYING .THE XOUTH COUNCIL TO INCLUDE THE ADDITIONAL OATEGORY OF POST SECONDARY/VOCATIONAL EDUCATION ', On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, Resolution 77-164 modifying the Youth Council to include the additional category of post secondary/vocational education was adopted and the Chairman authorized to sign. 77-2009 ADOPT RE50LUTION 77-165: RESOLUTION CHANGING THE NAME OF THE MANPOWER PLANNING COUNCIL TO THE COUNTY EMPLOYMEDIT AND TRAINING ADVISORY COUNCIL (CETAC) ANA PROVIDES REPRESENTATION FROM LOCAL VETERANS ORGAINZATIONS ON COUNCIL On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, Resolution 77-165 changing the name of the Manpower Planning Council to the County Employment and Training Advisory Council (CETAC) and providing representation from local veterans organizations on the Council was adopted and the Chairman authorized to sign. 77-2010 WAIVE FIRST READING: SALARY ORDINANCE AMENDMENT: IMPLEMENTING RESULTS OF CLASSIFICATION STUDY REQUESTS MADE IN THIS YEAR'S BUDGET AND REFLECTS ORGANIZATION CHANGES WITHIN SEVERAL DEPARTMENTS INVOLVING CLASSIFICATION AND POSITION PAY ALLOCATION On motion of Supervisor Madigan, seconded by Supervisor Lemke and carried, the first reading of the salary ordinance amendment implementing results of the classification study requests made in this year's budget. and reflectingrgrganization changes within several departments involving classification and position pay allocation was waived with the change of Senior Health Care Worker from range 16.0 to range 12.O.c,± 77-2011 WAIVE SECOND READING: ADOPT ORDINANCE 1873: SALARY ORDINANCE AMEND REMOVING BOARD OF SUPERVISORS FROM REGULAR SALARX ORDINANCE On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, the second reading of the salary ordinance amendment removing the Board of Supervisors from the regular salary ordinance was waived; Ordinance 1873 was adopted and the chairman authorized to sign. 77-2012 AUTHORIZE PURCHASE OF LANDFILL COMPACTOR TRACTOR IN THE AMOUNT OF $41.,870, INCLUDING SALES TAX AND AUTHORIZE TRANSFER FROM THE RESERVE FOR CONTINGENCIES On motion of Supervisor Madigan, seconded by Supervisor Moseley and carried, the purchase of a landfill compactor tractor in the amount of $41,870 including sales tax was authorized with a transfer from the reserve for contingencies authorized. October 18, 1977 October 18, 1977 77-2013 AWARD OF BID - MENTAL HEALTH FACILITY On motion of Supervisor Madigan, seconded by Supervisor Lemke and carried, the bid of $5,647 per month for the Mental Health Facility was awarded to Symbol Construction, Sacramento. 77-2014 PUBLIC HEARING: JOSEPH P, JANKO AND ANDRE?:S WIPPLER - APPEAL CONDITIONS ON EDEN PINES.:-UNIT NO.._2 SUBDIVLSION, AP.50-O1-19, SIX LOTS, SIX BLOCKS WEST OF PENTZ-MAGALIA HWY. SOUTH SIDE OF GATE LANE PARADISE ', The public hearing on the Joseph P. Janko and Andreas WippTer appeal of conditions on the Eden Pines Unit No. 2 Subdivision, AP 50-01-19, six lots, six blocks west of Pentz-Magalia Hwy., south side of Gate Lane, Paradise was held at this time. Hearing open to the public, Appearing: Gary Lippincott. Mr. Lippincott stated that the owners are appealing conditions 8 and 9. Mr. Lippincott stated that condition 8 relates to a rezone application for a low density zoning. This should not be for a land split. Condition 9 deal5with improvements on Pentz-Magalia Highway. This is not feasible at this time. Mr. Lippincott stated that the owners would be willing to have a bond situation or a deposit. On motion of Supervisor Lemke, seconded by Supervisor Moseley and carried, condition 8 was removed from the conditions. On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, condition 9 was amended to accept a deposit for the improvements on Pentz-Magalia Highway. 77-2015 PUBLIC HEARING: CONRADSEN MACHINERY, INC. - CONSIDERATION OF NEGATIVE DECLARATION AND USE PERMIT, AP 36-51-26, EAST SIDE OF PACIFIC HEIGHTS ROAD, 1[2 MILE SOUTH OF GEORGIA PACIFIC WAY, OROVILLE The Conradsen Machinery, Inc. consideration of a negative declaration and use permit, AP 36-51-2b, east side of Pacific Heights Road, 1/2 mile south of Georgia Pacific Way, Oroville was held as advertised. Hearing on the negative declaration open to the public. Appearing: No one. Hearing closed to the public and confined to the Board. On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, the proposed project could not have a significant effect on the environment, and a negative declaration was adopted. Hearing on the use permit open to the public. Appearing: Blair Conradsen. Mr. Conradsen stated that the property was fenced at the present time with a 6-foot chain link fence. Mr. Conradsen stated that he was appealing condition #1 on the use permit. The conditions requires that a 6-foot fence with lath are required. It would cost a great deal to place the laths in the fence. 'The ~us_e perintrs~ f.or ;_, used construction sales. If the property is not visible from the. road then there could be no sales. The business depends upon exposure. Hearing closed to the public and oonfined to the Board. On motion of Supervisor Lemke, seconded by Supervisor Moseley and carried, the use permit was approved with the correction to the use permit stating that it is far sale of used construction equipment and finding that a negative declaration has been adopted with the conditions: 1. E:eisting trees to remain and maintain in a living condition - or - T replace in the event the trees become diseased or die. 3. Deed 30 foot right-of-way to County of Butte measured from the center- line of Pacific Heights Road. 4. Submit driveway and drainage plans to the Department of Public Works for approval and install necessary facilities. 5. Provide additional suitable landscaping outside the fence to improve visual aesthetics. Said plants to be made within one year. On motion of Supervisor Lemke, seconded by Supervisor Moseley and carried, condition ~'~5 was deleted from the motion. AYES: Supervisors 'Lemke, Madigan-and Moseley. NOES: Chairman Richter. ABSENT: Supervisor Winston. 77-2016 PUBLIC HEARING: JOHANNES A. HANSEN = APPEAL CONDITIONS 1, 2, 3, 7, 9, 12 and 15 ON TENTATIVE PARCEL MAP, AP 51-172-26, TWO LOTS, EAST SIDE OF OAK WAY, 350 FEET NORTH OF DAVIS LANE, PARADISE The public hearing on the Johannes A. Hansen appeal of conditions 1, 2, 3, 7, 9, 12 and 15 on tentative parcel map, AP 51-172=~2b,.two:parcels, east side of Oak Way, 350 feet north of Davis Lane, Paradise was held at this time, Hearing open to the public: Appearing: 1. Johannes A. Hansen. Mr. Hansen read a prepared statement asking that the conditions of the Advisory Agency be deleted. Mr. Hansen presented the Board with a copy of the petition that was circulated asking that Azalea Way be widened to 60 feet. The petition showed that this would be impassible. 2. Gary Lippincott. Mr. Lippincott set out the reasons that a change in the lines of the lots was not feasible. The road cannot be widened without an agreement and the people on the road are not willing to sign the agreement. On motion of Supervisor Zemke, seconded by Supervisor Moseley and carried, condition 2 was deleted from the parcel map. On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, condition Z was deleted and condition lA was added to read: expand 15 foot flag to 20 feet wide. Discussion of condition 15 had at this time. Adjacent parcels must be shown on the map, The condition has to remain on the map. Discussion of condition 3 had at this time. It was felt that a two-way traversabfieeaccess was provided. On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, condition 7 was changed to reflect that instead of RS-9-LD III standard, an asphalt dike and asphalt walkways would be acceptable. The appeal on condition 9 is mute because of the change in condition 7. The appeal on condition 12 could be solved without having to pay the $1,800 per acre. Page 20. October 18, 1977 October 18, 1977 Discussion of a permanent committee to hear the appeals on requirements for tentative subdivision and parcel maps and make a recommendation to the Board was continued to October 25, 1977. 77-2017 PUBLIC HEARING: GLORIA SANTIVANEZ - APPEAL OF CONDITION OF A FIRE HYDRANT ON TENTATIVE PARCEL MAP, AP 36-4707, TWO PiARCELS, EAST SIDE OF INGLEWOOD DRIVE., 850 FEET NORTHERLY OF ORO-BANGOR HIGHWAY TO THE PROPERTY LINE, OROVILLE_._ The public hearing on-the Gloria Santivanez appeal of condition of a fire hydrant on tentative parcel map, AP 36-47-07, two parcels, east side of Inglewood Drive, 850 feet northerly of Oro-Bangor Highway to the property line, Oroville was held at this time. Hearing open to the public. Appearing: Ron Graves; Surveyor. Mr. Graves stated that the property has two existing houses on it at the present time. The parcel split would not increase the amount of homes in the area. Hearing closed to the public and confined to the Board. Zt was moved by Supervisor Moseley that the appeal be upheld. Motion dues for lack of second, On mation of Supervisor Lemke, seconded by Supervisor Madigan and carried, requirement ~~1 was changed to meet the requirements of the Butte County Fire Department by requiring a deposit for the assurance of a fire hydrant with the pro rata share to be determined by the Public Works Department. 77-2018 PUBLIC HEARING: RUSSELL GUIVER - APPEAL DENIAL OF A BOUNDARY LINE MODIFICATION, AP 35-123-7, 8, 9, AND 10, WEST SIDE OF POMOLO AVENUE BETWEEN C STREET AND D STREET, SOUTH OROVILLE. The public hearing on the Russell Guiver appeal denial of a boundary line modification, AP 35-123-7, 8, 9, and l0, west side of Pomolo Avenue between C Street and D Street, South Oroville was held at this time. Hearing open to the public. Appearing: Ron Graves, Surveyor. Mr. Graves stated that there:>areffive substandard lots in the South Oroville.area. Mr. Guiver proposes to make four lots instead of the five. They w31 still be substandard. Mr. Guiver is trying to make a bad situation better. On motion of Supervisor Moseley, seconded by Supervisor Lemke and carried, the appeal was upheld and the map was modified to include 57 1/2 feet wide lots. 77-2019 PUBLIC HEARING: LINDA MEXER, PARADISE - APPEAL OF CONDITIONS OF TENTATIVE PARCEL MAP, AP 54-142-21, TWO LOTS ON THE WEST SIDE OF SAWtiiILL ROAD, 665 FEET SOUTH OF NUNNELLY ROAD TO ACCESS STRIP, PARADISE. ', The public hearing on the Linda Meyer, Paradise appeal of conditions of tentative parcel map, AP 54-142-21, two lots on the west side of Sawmill Road, 665 feet south of Nunnelly Road to access strip, Paradise was held at this time. Hearing open~to the public. Appearing: Roger Daughtery. Mr. Daughtery stated that he had verified legal access to Foland Road. Mr. Daughtery stated that it had taken two years to acquire the signatures on a petition for the private road. Would this comply with requirement ~~1. Mx. Daughtery went down the list of conditions on the parcel map. The matter is continued to later in the meeting with Mr. Daughtery to talk with Mac Parker regarding the requirements for the conditions. -Page 21. October 18, 1977 ', October 18, 1977 77-2020 APPROVE COMMUNITY ACTION AGENCY ITEMS ', On motion of Supervisor Lemke-,.seconded by Supervisor Moseley and carried, the following Community Action Agency items were approved: 1. Approved te~ehncal consultant contract to develop and conduct two training sessions for the Butte County Head Start staff for an amount not to exceed $183. 2. Approved EOC 1978 and budget grant submission and authorized Chairman to sign; approved provisions for the new salary schedule, effective January 1, 1978. 3. Approved EOC Affirmative Action Program and Plan. 77-2021 APPROVE:;EURCHASE :OFRRE(3B R9DIOSlFOR~{,FISH:.AND€3GAME Gene Mercer, Fish and Came Commission, stated that the Commission would like to purchase two CB radios. The money is in the budget. On motion of Supervisor Moseley, seconded by Supervisor Lemke and carried, the purchase of two CB radios was approved. 77-2022 APPROVE FISH_AI3D GAME WATER FOWL OPEN SEASON - SOUTH SECTION OF FOREBAX Ranger Jim Hartman, Fish and Game, stated that the Fish and Game would like to open a water fowl open season on the south section of the Forebay. This would be down from Nelson bridge and would be the lower portion of the forebay. On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, the Board has no objections to a water fowl open season and hold the State responsible far any liability. 77-2023_APPEARANCE: TERRY HAMILTON, EATON ROAD, CHICO, Terry Hamilton stated that he would like to have his property taken out of the interim zoning that was placed on his property as a result of the airport study. Mr. Hamilton stated that he would like for it to go to A~2 zoning. It was felt that the property should not be removed from the interim zoning as a permanent zoning was being studied and was becoming very close to being completed. 77-2024 PUBLIC HEARING: JAMES IM. JOHNSON, CHTCO: APPEALS CONDITIONS OF TENTATIVE PARCEL MAP, AP 47-37-01, THREE LOTS LOCATED ON THE SOUTH SIDE OF KEEFER ROAD, 1000 F_EET_ WEST OF HICKS LANE, CHTCO ', The public hearing on the James M. Johnson appeal of conditions of tentative parcel map, AP 47-37-O1, three lots located on the south side ',. of Keefer Road, 1000 feet west of Hicks Lane, Chico was held at this time. Hearing open to the public, Appearing: Cal Bachman. Mr. Bachman stated that there was nothing in the immediate future for a community service district in the area. It is a good investment to make the deposit for drainage if there is something planned~'n the area. On motion of Supervisor Madigan, seconded by Supervisor Lemke and carried, .the appeal was denied. 77-2025 PUBLIC HEARING: PEACHTREE SUBDIVISION - APPEAL PERMANE~]'E DRAINAGE CONDITIONS AND WOULD LIKE TO PAY $1,800 PER ACRE DEPOSIT AND INSTALL DRY- WELLS, AP 43-08-02, SEVEN LOTS, NORTH SIDE OF WEST 8TH AVENUE,-WEST OF MEADOW ROAD, CHICO. Mr. Bachman stated that McCain and Associates have started some initial work in the area and would like to make the deposit and put in dry-wells until the work has been completed. This would supply the solution. Approved contract agreement with State Department of Faod ', and Agriculture to provide laboratory tests for milk and water samples and authorized Chairman to sign. ', 2. Approved submission of the alcohol program budget to the ', State fox the 1977/78 fiscal year and approved the request for allocation of funds. 77-2029 APPROVE SUBMISSION OF THE MENTAL HEALTH SHORT DOYLE PROGRAM BUDGET AND APPLICATION TO THE STATE FOR SHORT DOYLE FUNDS On motion of Supervisor Lemke, seconded by Supervisor Madigan ', and carried, submission of the Mental Health program budget and application to the State for Short Doyle funds was approved, 77-2030 ADOPT RESOLUTION 77-165A: RESOLUTION OF SUPPORT OF AB 989 WHICH WOULD ASSIST PROPERTY OT.+INERS AND TAX COLLECTORS TN SOLVING PROBLEMS OF NON PAYMENT ', OF "YEAR OF PURCHASE" TAXES ', On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, Resolution 77-165A in support of AB 989 which would assist property owners and tax collectors in solving problems of non payment of "year of purchase" taxes was adopted and the Chairman authorized to sign; a copy of, which is to be forwarded to the Senate Business and Professions Committee, Senator Alex P. APPROVAL OF ADDRESS AREA MAP WriICH SETS UP THE BOUNDARIES OF THE FOUR ADDRESSING AREAS The waiving of the second reading and adoption of the ordinance ', providing a uniform system of street names and approval of the address ', urea map which setssup the boundaries of the four addressing areas was continued to October 25, 1977. 77-2034 PUBLIC HEARING DATE SET: PROPOSED USES OF REVENUE SHARING FUNDS UNDER THE DISTRICT AtiZOCATION PROGRAM - CONSIDERATION OF SCHOOL SIDEWALKS AND BICYCLE FACILITIES - REPORT BY CHAIRMAN RICHTER RE: MEETING IN CHICO ', A public hearing date of November 1 , 1977 at 11:00 a.m. was set to hear the proposed uses of Revenue Sharing Funds under the District Allocation Program and consideration of school sidewalks and bicycle facilitieso Chairman Richter reported on the meeting that he and Supervisor Madigan held for revenue sharing funds in their districts. The overwhelming opinion at the meeting was that sidewalks and bicycle facilities were needed in the Chico area. It is hoped that the City will come up with some of the money to help with the project. Supervisor Madigan stated that there is a need for facilities on East 8th Avenue and on Vallombrosa also. There were no small workshops which would have been a good idea. Supervisor Zemke stated that the new regulations were discussed at the meeting. The new regulations are going to single out people who have put on a comprehensive program such as the one in Butte County. There are only about 100 areas that are doing what Butte County is doing. There are three different types of programs. They are as follows: 1. Single project programs. 2. Single comprehensive programs. 3. Comprehensive multi-year programs. Page 28. October 18, 1977 October 18, 1977 The Comprehensive multi-year program is the one that Butte County is most interested in. They are looking at a national rating program now rather than a regional .one. All of the draft regulations were brought back and the new grants have not been written as yet. There is a 10-point criteria, Supervisor Lemke stated that he and Mr. Brooks met with the Farmers klome Administration regarding the ditch in the South Oroville area. A grant has been prepared that would be for 50 percent funding. The cost of the project would be about $318,000. It looks like the County will be able to get one-half funding. The project application would be handled on the State level. Ward Connerly, Connerly and Associates, stated that he thought that the Board had seen the results that are taking place in the South Orovile area. The County is in a good position for next years funding. Butte County has a comprehensive program and HT7D is to make a comprehensive multi-year program. This would enable the County to stabilize the staff situation. This program is not a give away program. It is generating jobs. There is a problem in the south Oroville area. There are absentee owners of property that will not improve their property, This makes the neighborhood look very bado The owners should be made to do something about the houses. The County cannot buy the property as there would have to be relocation benefits paid. The ditch is an eyesore. The ditch is in the different year projects. Possibly the ditch could be considered as a project in itself. This way it could be taken care of at once. The loan advisory committee is not working out. The committee should be abolished and the loans screened by the Administration Office. The 312 funds cannot go through the commitee. There is a problem in the Chapmantown area getting the building inspectors and the Health Department in responding to the calls. One solution to the problem would be to hire within the Block Grant Program the necessary staff to carry out the Block Grant Program.
