Pledge of allegiance to the Flag of the United States of America. 74-1578 APPROVAL OF MINUTES On motion of Supervisor Gilman, seconded by Supervisor McKillop and unanimously carried, the minutes of October 9th & 15th, 1974 were approved as mailed, with the change to Item 74-1555, Page 340, beginning of the 3rd paragraph, to state that Betty Smith had recommended that the Board consider the sphere of influence as the boundary for the commission. 74-1579 COMMUNICATIONS Roger S. Burnham, Oroville. Mr. Burnham writes regarding the poor condition of the Berry Creek Station Road because of heavy logging traffic Z C U and bulldozers and other equipment, He feels the heavy users should ~e responsible for upkeep of the road. Referred to Director of Public Works for answering. James A. Rowe, Chico. Mr. Rowe writes as representative of the EOC for ~ ' ~~Q d Chico low income people and supports the concept of financing bus service through the 14 sales tax monies. Board members had a copy of this correspondence; no action taken. Curtis V. Soden, Chico. Mr. Soden writes in opposition to the possible move L'~p ~ of the Butte Meadows transfer station as the new site would be to close to habitation and would create health and other hgzards. 1'fr. Castleberry explained this correspondence; letter referred to him. Joyce L. Hall, Chico. Mrs. Hall writes to urge establishment of a ~ ~ C.d ~ detoxification facility in Butte County as soon as possible. Discussed' referred to Dr. Enloe. Louise Darman Shannon, Chico. Mrs. Shannon writes to urge the establishment 9,0 ,p p of a detoxification facility in Butte County at the earliest possible time. Referred to Dr. $11oe. W. E. Owens, Chico. Mr. Owens writes regarding the drainage problem in the Chico Vecino area and his correspondence with the Director of tf.Q O.d ~ Public Works. He requests that positive action be taken by the County. Supervisor Ladd recommended that the resignation be accepted but that the appointment be put over until November 12th, 1974. No action taken at this time. Northern California County Supervisors Associat~Lon. Norman A. Wagoner, p secretary-treasurer writes to thank the Board for tze hosgital~tg / ~ C'4 extended them during the meetings on October 11_ and 12. No action needed. County Supervisors Association of California. The Association writes regarding ~ O p,V S amendment to CSAC Constitution. Mr. Nickelson will send copies of this to the Board members. Employment -evelopment -epartment, Oroville. Chester Tatoian, manager, submits his resignation as a member of theButte County Manpower / D ~•~ 4 Planning Council effective October 30, 1974. He is transferring to Sacramento as a manpower consultant in the State Manpower Planning Office. See motion following communications. Reclamation Board. A. E. Mc Collam, Chief Engineer and general manager, sends copy of updated propose regulations concerning the Reclamation ~~~ 0 Board's requirements for applications within Butte Basin. He +-~~ requests an opportunity sometime during November or December to make a presentation to this Board regarding these regulations. Chairman Madigan stated they would be in Sacramento Thursday and could check on a date at that time. No action taken at this time. Federal Energy Adm~_=-~istration, The Regional Director in San Francisco sends copy of City of Los Angeles andCounty of Los Angeles ordinances Z setting forth requirements fox posting of gasoline prices and 4 0.3 suggests that Butte County may want to ccnsider a similar ordinance. County Counsel will review these ordinances and will send the Board members his review of this matter. Department of Youth Authority. They set out their recommendation concerning Butte County Juvenile Hall. The report states that 60 days from 3 p 0 October 11th, the Ha11 will be unsuitable for tiie holding of juveniles< Mr. Nickelson said he had run a review of the charges in this letter and sent copies out to the Board members and to the press concerning the deficiencies. Supervisor Ladd said he felt there were several things that should be taken care of; he would like the direction to be given to take care of the matters withou'_ any delays. See motion fallowing communications. Virginia Murphy, Chairman, Butte County Mental Health Advisory Board. Mrs. Murphy G p states that the Mental Health Advisory Board voted that the name of ?~ ~ p' Mr. Gayle Reynolds be submitted to the Board for consideration for the appointment to fill the vacancy created by the resignation of Marjorie Bryan. Goldstein, Barceloux, & Goldstein, attorneys at law, by Alan Burchett. ~ They request that the hearing on the appeal of use permit for ~•~ James La Force be continued to November 12th. Request approved; see public hearings later in the minutes. James P. Sweeney, Executive Director of N. T. Enloe Memorial Hospital. He states that he is in receipt of a copy of Mr. Pete Schabarum's letter to the Board in which Mr. Schabarum indicates the Los Angeles D O , L Z Board of Supervisors` endorsed H.R. 5307, which provides for the reimbursement of medical treatment facilities for aliens. Discussed; no action needed as action has already been taken. Donald R. Schaub. He writes in opposition to the proposed rezoning on i~ 3,p ~ Moore & Warren Road, Paradise. To be held until the public hearing this afternoon. William D, Spalding. They request clinics to those people over age,65. Letter read and discussed. Supervisor Ladd felt that it would be a good idea. Letter referred to Dr. Enloe. Br. Erlingheuser, Tlealth Officer, .yJ~ ~,0 D said that maybe the County could purchase the vaccine and hold clinics and give the shots to those requesting Chem. ale stated the County had had remarkable success with the clinics for those over 65. Supervisor Ladd said he would like to have Dr. Erlingheuser look into this matter. Dr. Erlingheuser will report back to the Board regarding these purchases of vaccine. 74-1580 ACCEPT RESIGNATION OF CHESTER TATOIAN, MEMBER OF BUTTE COUNTY MANPOWER PLANNING COUNCIL On motion of Supervisor Ladd, seconded by Supervisor McKillop and unanimously carried, the resignation of Chester Tatoian, manager of the Employment Development Department, Oroville, as a member of the Butte County Manpower Council, effective October 30, 1974, was accepted, with a request that a letter o£ appreciation be sent to Mr. Tatoian, for his services to the County. 74-1581 DIRECT THAT NECESSARY REPAIRS BE DONE TO THE JUVENILE HALL AND THAT NECESSARY CREWS BE PUT ON TO COMPLETE THE WORK AS SOON AS POSSIBLE, INCLUDING THE PAINTING On motion of Supervisor Ladd, seconded by Supervisor Cameron and unanimously carried, a written directive was authorized to be written directing that the minor repairs at Juvenile Hall be done and that the necessary crews be put on to complete the work as quickly as possible, including the painting at the building. 74-1582 APPROVE AGREEMENT WITH PLACER COUNTY FOR PLACEMENT OF JUVENILES Dan Blackstock, County Counsel, reported that he had received a proposed agreement with Placer County for the placing of our juveniles at their facility. The agreement is the same as the one with Shasta County, with minor changes. He set out the changes in the agreement. Mr. Blackstock recommended that the Board approve this agreement to indicate to the State that the County is following through on their report of Juvenile Hall. Agreement discussed. On motion of Supervisor Ladd, seconded by Supervisor McKillop and unanimously carried, the agreement with Placer County for care of Butte County Juveniles was approved and the Chairman was authorized to sign. 74-1583_AQpROVE APPOINTMENT TO BUTTE COUNTY MENTAL HEALTH ADVISORY BOARD On motion of Supervisor Cameron, seconded by Supervisor McKillop and unanimously carried, the appointment of Gayle Reynolds to fill the vacancy created by Marjorie Bryan's resignation was approved, as a member of the Butte county Mental Health Advisory Board. 74-1584 AUTHORIZE NEGOTIATIONS WITH COOK & ASSOCIATES FOR CONTRACT FOR PLANS & SPECS FDR PROPOSED PARADISE LIBRARX Supervisor Cameron reported that he had met with the architect and discussed the proposed Paradise library, He said he would like to recommend that the Board authorize negotiations with Dan Cook z: Associates for a contract for the preparation of plans & specifications. Recommendation discussed. On motion of Supervisor Cameron, seconded by Supervisor McKillop and unanimously carried, negotiations with Dan Cook & Associates were authorized for a contract for the preparation of plans and specifications for the Paradise library building. The Board members had all received a copy of this report, It had been the Board's recommendation that the overtime be kept to a minimal amount. Use of overtime discussed, No action taken. 74-1586 APPROVE CONTRACT WITH HELEN HANSEN FOR TECHNICAL SERVICES FOR HEAD START AND APPROVE GOVERNMENT SECTOR OF THE P.DMIPIISTERING BOARD On motion of Supervisor McKillop, seconded by Supervisor G~.lman and unanimously carried, the following action was taken: 1, Approved the contract with Helen Hansen for training for Head Start parents and staff and the Chairman was authorized to sign. 2. Approved the reorganization of the Government Sector of the Administering Board of the Community Action Agency as follows: Supervisor Jack Madigan, Chico City Councilman Dave Murray, Butte County Sheriff's Department-Ken Nickelson, County Superintendent of Schools-Duane Powers and Employment Development Department-Ralph Berryman. 74-1587 APPROVE WAIVING OF FIRST READING OF SAIARY ORDINANCE AN~NDMEldT A salary ordinance amendment hss been prepared to add 34 CETA Title II positions to tlce county's Public Service Employment Program, 4 staff pasitions to Manpower Program Administration, and reclassify 2 sheriff cleric II's to deputy sheriff I's. Amendment discussed, S~spervisor Ladd asked that in approving the amendment, does it mean the filling of the positions. Mr. Nickelson explained the action. On motion of Supervisor Gilman, seconded by Supervisor McKillop and unanimously carried, the reading of amendment to the salary ordinance amendment was waived, with the request that the filling of tCao of the Manprwer positions be held up at this time, 74-1588 APPROVE AGREEMENT WITH DRAINAGE DISTRICT ~b100 FOR EMPLOYEE IiEALTH INSURANCE On motion of Supervisor McKillop, seconded by Supervisor Gilman and unanimously carried, the agreement to include the 2 employees of Drainage District ~k100 in the county health insurance plan was approved and the Chairman was authorized to sign. 74-1589 AUTHORIZE ADVANCE STEP HIRING OF A BUILDING PLAN CHECKER POSITION The Public Worlcs Department requests authority to hire a building plan checker at the C step of the pay range. The Department has encountered difficulty in finding qualified persons interested at the A step. This position has been open for about a year. Mr. Castleberry feels that this would be the best investment in cutting down on the overtime in that department. They have 150 building permits waiting to be processed. Mr. Castleberry feels that the man is well qualified. On motion of Supervisor Gilman, seconded by Supervisor Cameron and unanimously carried, filling the building plan checker position up to the C step of pay range 21.5 f,~'+93 bi-weekly) was authorized. 74-1590 APPROVE APPO1I~~MENT OF COMMITTEE FOR NEGOTIATIONS FOR CONTRACT FOR HEALTH SERVICE AGENCY OFFICE AND DETOXIFICATION UNIT Board authorization is requested to hire an architect to draw plans and specifications for the proposed Health Services Agency Office in Ward 9A of the old hospital buildings and the Detoxification Unit in the old Ward 9B. Services of an architect is needed because the proposed Page 351. October 22, 1974 ~~~___========October 22:?974_=======____~_- remodeling is extensive and includes a sprinkler syster and will require formal bidding procedures. Mr. Nickelson explained this item. On motion of Supervisor Ladd, seconded by Supervisor Cameron and unanimously carried, the chairman was requested to appoint a committee to negotiate for an architect to prepare plans and specifications for the proposed Health Services Agency Office and the Detoxification Unit and bring back a proposal to this Board. On motion of Supervisor Gilman, seconded by Supervisor McKillop and unanimously carried, Supervisors Cameron and Ladd were appointed as a committee to negotiate for an architect for the preparation of plans and specifications for the proposed Health Services Agency Office and Detoxification Unit. 74-1591 ',OLD OVER: AMENDMENT TO DANCE HALLS AND SKATING RINKS ORBINANCE At the request of Mr. Nickelson the amendment to the dance halls and skating rinks ordinance was held over so that changes could be made to the proposed amendment. 74-1592 APPROVE GOLDEN FEATHER FAIR BUDGET The Fair budget for the calendar year 1975 has been approved by the Fair Board and is submitted for approval to the Board of Supervisors. The budget has been reviewed by County Auditor and approved. On motion ofSupervisor McKillop, seconded by Supervisor Gilman and unanimously carried, the Golden Feather Fair budget for the year 1975 was approved and the Ch«irman was authprized to sign. 74-1593 BUDGET TRANSFERS APPROVED On motion of Supervisor Ladd, seconded by SupervisorMcKillop and unanimously carried, the following budget transfers were approved: B-017 Clerk - $3,630 transferred from regular salaries to extra help and is to cover for a regular employee who was granted a six month medical leave of absence. Also $250 is transferred from office expense to overtime and is to cover overtime for court clerks. B-019 County Counsel - $172 from office expense to equipment and X200 from extra help to overtime B-020 Public Works - $120 from general administration equipment to engineering and administration equipment and $40 from office expense to engineering and administration equipment. 74-1594 APPROVE APPOINTMENTS TO MEDICAL AND DENTAL ACCESS ADVISORY COMMITTEE AND TO CHILD__H_EALTH AND DISA3ILITY PREVENTION PROGRAM ADVISORY BOARD Dr. Erlingheuser explained the matter of the appointments to the Medical and Dental Access Advisory Committee 8tid to the Child Health and Disability Prevention Program Advisory Board. Mr. Gray spoke on this matter. Mro George Gray is Dept. Chief of Mass Transit, State Page 353. ' October 22, 1974 _ _ -~ _ _ _ _ _ _ _ _ - _ _ ~cYohgr=22, =1474 _ _ _ _ _ _ _ _ _ _ _ _ _ _ of California. Mr. Gray stated that there has been a growing need for public transportation services. He set out the t3ifferent services used. He said there were three main areas why public transportation is needed. (1) The unserved by the automobile (2) he environmental consideration and (3) resource constraints. He said that 5 out of 10 are unserved by an automobile. The public hears about the petroleum shortage; now have problems with metal shartages, also anti-freeze shortage. There are other ~_•easons why the public needs to look into mass transit. A look has to be given to the unserved. The persons under 18 years of age and those over the age of 65. 14% of the households in the Chico area have no automobile. The elderly and the handicapped need the service of public transportation. Mr. Gray said that with all this to be considered, the State`s rol e is to help. SB 325 is to provide funds to help in L-hese matters. The County should look at the whole spectrum and look at the type services that they might caa~~~t to meet. Once a commitment has been made, give it full support. Services of Amtrak discussed. Air. Gray said the State is trying to preserve abandoned right-of- ways of railroads. The Chico-Stirling City railroad line is to be abandoned. Air. Blackstock stated that this particular line was built under a certain type ]egislation. As soon as the ~~til~oad company ceases to use the railroad right- of-way, the easement caill revert back to:"the owners. Mr. Castleberry reported that the railroad company has acknowledged the Board`s request for tha.s right-of-way. Air. Castleberry stated L-hat about a year ago the Association of .governments and Butte County ser,.t an application to the State speaking to a transportation system between Paradise, Oroville and Chico. Is there any possibility of any other system that might work. Discussed; no action. Transportation needs discussed; no Board action taken. 74-1596 PUBLIC WORKS ITEMS APPROVED On motion of SupervisorMcKillop, seconded by Supervisor Gilman and unanimously carried, the following action was taken: 1. Accepted the work of Stuart & Unf.ri.Qd~ Contractor, for the work on building addition to Public Works and Planning Office, authorized the Chairman to sign the Notice of Completion and instructed the Clerk to record said Notice with the County RecordeC. 2. Accepted the final map of Simmons Subdivision {7 lots Mt. Ida Road near Oroville. ) 3. Acdepted the work of Robinson Construction Company for the reconstruction of Wyandotte Avenue from Lincoln Boulevard to 2fl0 feet west of .Lower Wyandotte Road, Oroville, authorized the Chairman to sign the Notice of Completion and instructed the Clerk of the Board to record said Notice with the County Recorder. 4. Approved the paving overlay project on East Avenue between the railroad tracks and Highway 32 which caas a budgeted project. Page 354. October 22, 1974 ___________ __~4c~ohe~22=1924______________ 74-1597 INFORMATION AND DISCUSSION ITEMS: PUBLIC WORKS (a) Butte County FAS Program resubmission. Mr. Castleberry said this lets the Board know the projects that they are planning on. The Board has already approved the Pentz Road project. Projects being considered set out. The projects will all be brought to the Board for approval. (b) Timothy Road landfill site - Regional Water Quality Control Board requirements. Mr. Castleberry said the State was coming out with new requirements. (c) Acquisition of Davison property for Olive Highway Project. Mr. Castleberry explained this item. County Counsel will prepare the documents and this will be brought back for Board action, (d) Federal flood insurance program report. Mr. Castleberry stated that the maps that were sent to the County concerning this matter are not the right maps. He said that the only areas that should be included in this are those where the County has already adopted a flood plain zone and where building permits are needed in these areas. He said they would have to refute the maps that were sent to them. George Stamm, County water resources engineer, stated that the maps that were sent are not those areas that are subject to flood hazard. The maps were prepared by an engineering firm in Pennsylvania. Mr. Stamm suggested that the maps be reviewed very carefully. If they are incorrect, the County should notify HUD. Supervisor Ladd said it seemed to him th a the Board members should have a map that has been prepared by Mr. Castleberry and ~. Stamm and that delineates the portion that is na~~ covered by the County ordinance. Mr. Castleberry said he would get this information to Supervisor Ladd and the other Boa-rd members. No action taken at this time. (e) Supervisor McKillop questioned Mr. Castleberry about a traffic hazard on the Skyway. Mr. Castleberry said the Public Works Department would look at this area. Skyway. (f) Supervisor Cameron commented on the parking and selling along the (g) Mr. Castleberry reported that he had attended a garbage meeting in San Francisco. Some of the rules may be changed. Discussed; no action taken. (h) Supervisor Gilman said he has had complaints along Stewart Avenue. Enforcing of restrictions is not being handled. Discussed; no action taken. RECONVENED: The Board reconvened at 11:25 following an executive session. 74-1598 APPEARANCE: MISS LEE ANN KNAl?P, REPRESENTING PROJECT RESPONi1 Miss Lee Ann Knapp, represented the project RESPOND,-said the project was working out of CAVE, Chico. Right now, they are trying to find out the needs for transportation. She is present hoping that something will be done in the future to meet the public needs> This group is working on a volunteer basis. When someone calls, a member of this project picks them up in their automobile and takes them to the doctor's office or wherever they might have to go, Basically now, i~ is only students that 8re responding to the needs of these people. She said she was hoping that with the awareness of this project, that people e;ill call on them until something is set up in the way of transportation. 74-1589 ADOPT RESOLUTION '4-143 APPOINTING COUNTY OFFICERS AS PROPER REPRESENTATIVES OF THE COUNTY TO PROSECUTE AND DEFEND ACTIONS IN THE SMALL CLAIMS COURTS IN COUNTY Dan Blackstock, County Counsel, explained the proposed resolution appo• ting County officers as proper representatives of the County to prosecute 2.nd defend actions in the samll claims courts in the County. He said attorneys cannot represent people in this type court, This resolution will allow the various county officers'ao be authorized to file the documents. Time spent discussing the proposed resolution and the purpose of adopting said resolution. County Counsel stated that this is one of the changes that will be made in the ordinance; he will have a report to the Board in a week or so. The interim ordinance should be corrected to delete the township of Stirling City, He explained the proposed zoning for the area. Supervisor Cameron said that something would have to be done rapidly in that area. Mr. Lawson said they have prepared an interim ordinance for the township of Stirling City. Mr, Blackstock stated that when the County adopts an interim ordinance, they cannot make tlie zoning less restrictive than the existing zone. Mr. Bloc?.cstock felt that it should be found that the interim TM-160 zoning was placed on the township of Stirling City by error, and was improper as it is inconsistent to the Ceneral Plan. Chairman Madigan said he feels that there is a lack of communications; this Board has not even considered the location for the proposed City-County library in Chico. Site discussed. County Counsel said the wou'_d sceggest that the county ask the City of Chico who is going to take care of the re-location of the people that axe at present leasing the building. It was felt that maybe the City would have all this information when the Board meets with them. Chairman Madigan asked if the Board wanted this on next weeks agenda? Yes-matter placed on the agenda for Tuesday, October 29, 1974. Mr. Blackstock stated that earlier in today's meeting, the Board discussed the modifying of the subdivision ordinance. After a study of the ordinance, as it presently stands, he feels that it covers the matters the Board '_cad discussed. The ordinance allows the Planning Director to extend the time for filing of the map for one year. If the condi~i.ons a~~e not met, the Board would not have to approve the filed map. Map presented for discussion by the Planning Director discussed. There are conditions on the map that must be met. This map had some sanitation problems. Supervisor Cameron said he would like to see what h•s been done and what conditions have not been met. Supervisor Ladd felt that instead of~having the Planning Director continually bringing these matters to the Board, the Planning Director should be able to grant an extension on the maps.
