Read and discussed; no actfon taken. 75-1826 SUPERVISOR RICHTER: REPORT O N LETTER RECEIVED FROM ELDERLY GENTLEMAN REGARDING TAXING OF HIS PROPERTY Supervisor Richter commented on a letter from an elderly gentleman, age 83, regarding the assessment of his home. The assessment has doubled. These old people are living on retirement funds and it is difficult for them to exist and still pay these high tuxes; they do not receive food stamps or any other county aid. People requesting the Board to fund their projects should think about these old people that are helping to fund the projects by their tax payments. Chairman Ladd commented on this matter. He stated that the Board brings about some of these increased costs by the approval of new construction and development in the county. 75-1827 SUPERVISOR CAMERON: REPORT TO THE BOARD REGARDING MEETING IN SAN JOSE ON FQOD STAMP OUTREACH PROGRAM Supervisor Cameron reported t at t e State ad a representative at the Son Jose meeting ro report on the food stamp outreach program. A representative from the State will be at_a meeting s_?,t'~r November (4th, with Bob Crisan, Welfare Direclor, and other representatives of the County. 75-1828 STATEMENT AND MOTION BY SUPERVISOR MADIGAN: ILLEGAL LOT SPLITS AND SUBDIVISIONS-MOTION TO ADD PERSONNEL TO DISTRICT ATTORNEY'S OFFICE TO HANDLE INVESTIGATION AND PROSECUTION OF LOT SPLIT ACTIVITY Supervisor MaiJigan presents a prepare statement raga ing t pro em of illegal lat splits and subdivisions in the County. Statement read and discussed. It is Supervisor Madigan's febling that the subdivisions are illegal and that the law should be enforced. He is in favor of ending these illegal activities and proposes the following motion: --- ---~ - Page 331. ~~ ' " " - - - -- November 4, 1975 November 41975 It was moved by Supervisor Madigan that there be added to the office of the district attomey the following positions: An Attomey A criminal investigator A land use technician 2 clerical personnel These positions will be funded for a period of two years. During that two~year period this staff will be authorized and charged with the duty of pursuing civil and criminal prosecution of illegal lot split activity. Said positions will be effective January I, 1976. The Board assumes these positions will be used by the District Attomey for the exclusive purpose of illegal lot split activity. Supervisor Richter seconded the motion. Supervisor McKillop stated that there was a great deal of froth to the statements just made; he does not want to take action at this time regarding the man power for this work. It was suggested that maybe the positions could be filled by people already on the Covnfy payroll. Chairman Ladd said the statement had been made that the illegal land divisions ware continuing. He would like to know where these land divisions are located. It was suggested That the District attomey could report on the illegal divisions later today. Supervisor McKillop said he would like to have the motion amended ro delete the manpower. It is the feeling of Supervisor McKillop that if these positions ore filled without control, the District Attomey would be using this manpower for other duties within his office. Mr. Mickelson was requested to contact Ken Leach, District Attomey, and request that he appear before the Board later today to discuss this matter. _..... _ Motion tabled. 75-1829 APPROVE GRANT MODIFICATION: PEP, MODIFICATION NO. 20; --- - . Approved a one year non-compensated medical leave of absence for Mrs. Lucy Bames commencing November 1, 1975 and ending October 31, 197b, and that a budget transfer be authorized in the amount of $4,725 from regular help to extra help. On motion of Supervisor Madigan, seconded by Supervisor Cameron and carried, Juvenile Hall Supt. was authorized to file application for funding for kitchen equipment; and call for bids for kitchen equipment was authorized, with bid opening set for December 3, 1975. Authorized certification by the County Administrative Officer as to observance and compliance with terms and conditions for the Veterans Service Officer allocation. 2. Accepted the work of Parma-Tite Ispofing Company for roofing work an buildings in Gridley, Biggs, Oroville, and Paradise, authorized the Chairman to sign the Notice of Completion and instructed the Clerk to record said Notice of Completion with the County Recorder. RECESS: 9:55 RECONVENED: 1D:15 75-1835 APPRDVE COUNTY 5ERVICE AREA ND. 37 AMBULANCE CONTRACT Chairman Ladd reported that theambu7ance contract was put over tram last week. A meeting was held of the Advisory Committee. The committee recommends that the Board approve this contract. Page 333. November 4, 1975 ~ ~ __ _________________~o~rexnberg~147~====_---_______-_ Chairman Lsdd explained that the committee feels the past service was good and they want to eontinue the contract. Tom Struthers, Purchasing Agent, stated that the cost of the contract is reasonable. Supervisor Richter stated that he would like to see a procedure set up by the purchasing agent as to putting out calla for qualifications. This concept discussed by Supervisor Richter. On motion of Supervisor Richter, seconded by Supervisor Madigaa and unanimously carried, the contract with Gridley Ambulance Service for County Service Area No. 37 was approved, subject to approval as to form and for fiscal and budgetary control and authorized the Chairman to sign. 75-1836 DISCUSSION OF PROPOSAL FOR OB CARE PUT OVER AT THIS TIME Chairman Ladd stated that the discussion of proposal for obstetrical care is put over at this time. 75-1837 DISCUSSION: HEALTH SYSTEMS MEETING; COUNTY COLNTSET. TO ATTEND Supervisor Cameron stated that there ie to be a meeting regarding the health areas on Novmm bar 12. Be requests that someoae from County Counsel's office be present ae there are several legal matters that will be discussed, one of which is the possibility of a joint powers agreement. Supervisor Cameron will also be attending this meeting. It was the consensus of the Board that County Counsel should be present at this meeting. 75-1838 ADDPT RESOLUTION 75-152 AUTHORIZING SALE DF TAX DEEDED PROPERTY The Tex Collector presents notice of iatention to sell tax deeded property described as AP 033-11-0-OG3-0, comprising three scree, more or less, in the City of Oroville, Pleasant Valley Tract, minimum price $1,800. Carl Morton, Treasurer, explained that this is a piece of property that had not been bid on at the auction. A wtitten offer has been received to buy khe property if the minimum price is lowered to $1,800. Mr. Morton explained that a deposit has been made for the advextising. The property will be advertised and an auction held. If the property receives higher bids, the cost of the advertising will be paid for by the county. On motion of Supervisor McKillop, seconded by Supervisor Cameron and unanimously carried, the Board adopted Resolution 75-152 authorizing sale of tax deeded property as described above. " Supervisor Cameron requested that the housing development look at these properties £or use intthe housing program. Mr. Mickelson is to meet with Bob Nicholson and Carl Moxton to discuss this possibility. 75-1834 ADOPT RESOLUTION 75-153 SETTING ASIDE SALE OF PROPERTY AT PUBLIC AUCTION A piece of property located on Kelly Ridge was previously sold at public auction by the Tax Collector and had a prior encumberaace as page 334. November 4, 1975 ,~"+, ~~_~~.---_-__=====dav~rnb~x_4EI9Z~===______________ road right-oE-way. At the time of sale the purchaser was not aware of this fact. The first step is procedures to correct the situation is to adopt a resolution setting aside the sale. Hal McDonald, assistant director of Public Works, explained the matter. This was before the Board last week. Supervisor McRillop moved and it was seconded by Supervisor Madigan that Resolution 75-153 setting aside sale of property at public auction be adopted and the Chairman authorized to sign. Dan Blackstock, County Counsel, explained the process to be followed in this matter. He feels this should take care of the proble m. Mr. Morton stated that is being done at the request of the county aad sot at the request of the purchaser, although he fa agreeable to it. The buyer's money has been refunded at the instruction of the State Controller. Vote on above motion: Ayes: Supervisors Cameron, Richter, Madigam, McKillop and Chairman Ladd; Noes: none] AbsenC: none; Not Voting: none. 75-1840 ACCEPT INNlPROVEMENT OF FIRLAND ACRES ASSESSM&NT DISTRICT The improvements are complete for the Firlsad Acres Assessment District. On motion of Supervisor Cameros, seconded by Supervisor Madigan and unanimeusly carried, the improvements of Firland Acres Assessment District were accepted and release of labor and materials bonds was authorized. 75-1841 ADOPT RESOLUTION 75-154 RE INDUSTRIAL PARK ACCESS ROAD AND APPROVE AGREEMENT FOR-SALE FOR RIGHT OF WAY ACQUISITION Mr. McDonald explained that one resolution has been prepared to cover the condemnation for utility easements needed for this project and authorizing acquisition of the property. On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, the following items were approved: 1. Adopted Resolution 75-154 authorizing condemnation for utility easements needed for the EDA Project - Industrial Park Access Road E/S SR 70, south of Oroville aad authorizing acquisition of property by eminent domain Eor same; approve piano and specifications; autbo raze Chairman and Director of Public Works to sign plane; adopt ,wage scale; and approve bid opening for 11 a.m. at the Public Works Office on November 26, 1975 , and Chairman authorized to sign resolution. 2. November 4, 1975 r"` ~"`1 _________________t~uceinber4t147~5=====________-____ 75-1843 INFORMATION AND DISCUSSION ITEMS: PUBLIC WORKS Mr. McDonald stated that the revision of the subdivision ordinance is now available for distribution. Supervisor McRiliop questioned Mr. McDonald regarding the CALTRANS meeting to be held in Marysville. There was a meeting in Redding that Mr. Castleberry is attending. Discussion of whether the Maryavil7e meeting is an extension of the Redding meeting. It was the feeling cf the Board that Mr. McDonald should attend the meeting is Marysville. 75-1844 ADOPT ORDINANCE 1639 RE DOG CONTROL, AMENDING CHAPTER 4 OF BUTTE COUNTY CODE Supervisor Cameron stated that he had received several calls concerning the ordinance. Many people have the impression that this ordinance includes a leash law. Mr. Blacketock stated that it does mot. Supervises Richter discussed hie views that this ordinance is in effect a leash law. Discussion. On motion of Supervisor Cameron, seconded by Supervisor Madigan and unanimously carried, the second reading of the ordinance was waived and Ordinance 1639 amending Chapter 4 of the Butte County Cade relating to dog control wen adopted and the Chairman authorized to sign. 75-1845 RE7ECT CLAIM OF MRS. FRED MCDERMICK County Counsel stated that this claim has been studied and he now recommends that the Board reject the claim. On motion of 5uperviear McKiilop, seconded by Supervisor Cameron and unanimously carried, the claim of Mre. Fred McDermick in the amount of $146.50 was rejected and referred to the county insurance carriers. 75-1646 DISCUSSION: CLAIM FOR ADDITIONAL. SERVICES BY ARCHITECT RE JUVENILE HALL PRO3ECT; PUT OVER TWO WEEKS County Counsel explained the letter he had written to the Board regarding this matter. Thin involves two change ordars, Nvs. 1 and 2. One change order involves a decrease in the agreed price. Mr. Blackstock stated that the contract provides that the additional services shall he provided upon request sad shall be paid for. Mr. Ward is now requesting payment for work done which fie claims amounted to 52 hours. Supervisor Cameron explained some of the items thaC Mr. Ward had been requested to change but stated he had no idea how long these take in changing the plans. Amounts involved in the change orders discussed. Thin matter put over two weeks to allow the Board to get a recap of the project. CHAIRMAN LARD RECOGNIZED THE STUDENTS FROM LAS PLUMAS HIGH SCHOOI. There were no suggestions. hatter put over to next meeting. 75-1848 APPOINT REVEREND JACOBSEN TO ALCOHOL ADVISORY BOARD AND TECHNICAL ADVISORY COMMITTEE ON DRUGS On motion of Supervisor Cameron, seconded by Supervisor Madigan and unanimously carried, Reverend Ingmar K. Jacobsen, 3577 Hilldale Ave., Oroville was appointed to the Alcohol Advisory Board and Technical Advisory Committee on Drugs for a term of three years. 75-1844 APPROVE APPOINTMEiVT~OF DOROTHX DEANE TO CAILD HEALTH AND DISABILITY PREVENTION PROGRAM ADVISORY BOARD Supervisor Cameron stated that he felt the recommendation as submitted in the letter from the board should be considered. Chairman Ladd questioned about the regulations covering the appointments. Mr. Nickelson will check .on these. On motion of Supervisor Cameron, seconded by SupervisaC Madigan and unanimously carried, Dorthy Deane, 1188 Hi1lView Way, Chico was appointed to the Child Health and Disability Prevention Program Advisory Board. 75-1850 SET PUBLIC HEARINGS The following items were set for public hearing on November 25, 1975 at 1:30 p.m. in the Board o£ 5upexvisoxs' Room, Gounty Administration Building, Orovflle: 1. Charles Just - rezone from R-1 (Single-Family Residential) to C-2 (General Caomtiercial) for the westerly portion of pm perty located cn the west side of Wildwood pane, approximately 150 feet west of Skyway, Paradise. 2. Richard C. Applegate - rezone from A-5 (Agricultural) to S-2 (Suburban) for property located oa both aides of Stanford Iane, approximately '~ mile south o£ Durham-Oroville Bray., Durham. 75-1851 ADOPT ORDINANCE 1640 INTERTNi ZONING AREA NEAR OROVILLE AIRPORT Mr. Lawson explained the request £rom the Planning Commission that an interim A-5 zone be placed on the property located around the Oroville Airport, bounded by State Hwy. 162 (Oro Dam Blvd. West) an the south, 18th Avenue on the east, Grsad Avenue on the north and being the west line of Sec 15 on the west, located in Sec 14 and 15, T19N, R3E, MDB63i. Mr. Lawson stated that there has been same indicati on that the ~ area it going to be subdivided. There has been discussion regarding a motorcycle raceway. This request for an interim zoning is to allow the study of the Page 337. 'There is an existing subdivision with five-acre parcels that there is a problem with. Mr. Lawson stated that they have a resolution from the City of Oroville supporting this interim zone. On motion of Supervisor Madigan, seconded by Supervisor Cameron and unanimously carried, Ordinance 1640 interim zoning the area delineated above for a period of 120 days was adopted and the Chairman authorized to sign, with the finding that this is done for the health, safety and welfare of the commmnity and because a study is in progress on the area. 75-I8 2 ADOPT ORDINANCE 1641 INTERIM ZONING AREA NEAR MUD CREEK CHICO The Planning Commission requea~ that as interim S-2 zone be placed on the property located west of Esplanade, south of Mud Creek and notch of East Avenue, Chico. Mr. Lawson indicated the area involved on a map. This area is being studied for permanent zoning. Mx. Lawson stated that he had been told that 89% of the aigaaturea have been obtained for the zoning. It was also stated that this interim zoning would not atop the zoning of the frontage along Mud Creek that 3s presently before the Commission. Supervisor Richter asked that people interested in this be allowed to speak. No one was present that wished to speak on the matter. Chairman Ladd felt that the S-2 zoning of the property to a waste of land. Supervisor Richter stated that there is a lot of controversy over Che area. He feels this zone will prohibit multi-family unite from developing in the area. On motion of 5upervieor Richter, seconded by Supervisor Madigan sad unanimously carried, Ordinance 1641 interim zoning the above area S-2 for a period of 120 days was adopted and the Chairman authorized to sign, with the finding that this is done for the health, safety and welfare of the community and to allow time to study Che permanent zoning. 75-1853 APPEARANCE: OLIVE THOMPSON~ AUTHORIZE GERTIFTCATION RE FLOOD PLA7SIIITG Olive Thompson, Red Carpet Realtors, stated that they need certifi- cation from the County regarding areas outside the city limits aCating whether the property fa in the flood plain area. Mr. Castleberry had previously written a letter stating that the property was not but the language of the letter was not satisfactory to FHA. Supervisor McKillop explained that there has been a problem about getting the maps that delineate the areas. Mr. Miakeleon stated that he had copies of the maps, which he distributed to the'Soard. Mr. Nickelson stated that this was brought up because properties are being held up because lending inetitutiona want this certification. Supervisor Madigan questioned why the county is being held responsible for this. He feels this is another mandate of liability thaC was never passed on. He feels the ccunty should not get involved. Page 338. November 4, 1975 ~~ f'1 _________________~bv~rnber_4t19Z~_______________--_ George Stamm, contract engineer, explained that a Pennsylvania firm had been contracted to draw up the maps. When these were checked with the county records, the maps were found to be erroneous. They were notified and new maps are on the way. When these sew maps arrive, the county has 21 days to comment on them. 1{e stated that they could use these maps and indicate Co the lender that the maps the county has are erroneous and that further maps are on the way. Discussion of the laws pertaining to the lending institutions; they cannot loan money unless there is the required certification. Discussion of solutions to the problem. Supervisor McKillop felt that the Board should take the responsibility of this problem from Mx. Castleberry. Supervisor Madigan stated that he would like to see the legislation regarding this. Chairman Ladd felt that the goerd could use these maps even though they are erroneous as that is all there is to work with until the correct ones arrive. Discussion of language needed in letters of certification. Mike Pyeatt, administrative analyst, read some of the requirements for the letters. Slade for the use permit granted to Walter L. and Eleanor Zahnd to allow a group home at 983 Wagstaff Road, paradise was held as advertised. Jim Lawson, Planning Director, set out the background of this appeal. Tire home is allowed under the Lanterman Act, which allows group homes in residential areas. The County has an ordinance that requires that a use permit be obtained, with conditions. Dan Blackstock, County Counsel, explained the law governing these matters. He explained the conditions that are placed on the use permits. The provision before the Boord today relates to the home for dependent children. Dependent children are those that are wards of the Court. These could be children that have been abused or abandoned. Conditions that can be placed on the use permit explained by Mr. Blaekstock. Hearing opened to the public. Appearing: I. Mrs, Margaret Worley, representing the League of Women's Voters. Tfre League supports the establishment of the home. 2. Mrs. Jackie Padburg, 209 W. Francis Willard Ave., Chieo. She is a group home '.counselor for Tehama County; she felt that this home would be well supervised and was very impressed with the care the children received. She spoke in favor of the home. The Zahnds darnot live in this home, but they do live within one mile and could return to this home in a very short period of time if needed. 3. Mrs. Mita lVlarkland, public member of the CCCJ. Spoke in favor of the home and urged that the Planning Commission's decision be concurred with. 4. Mr. Wally Zahnd, applicant. He set out the type girl that would be in the home. They have not committed a crime but they are a wand of the court. Information concerning the operation of the home and type girls thot would be placed under his care presented to the Board members. The Board asked Mr. Zahnd if he could use the information on the girls as the operator of the home. The file can be used as a tractability guide for the girls. No girls are placed in the home that ire considers to be dangerous. Supervisor Richter stated he had gone out to this home and was very impressed with the home. Fla questioned Mr. Zahnd about a girl sitting by him at the table that had helped her mother do away with the father; Mr. Zohnd stated she had received immunity for her testimony. Supervisor McKillop questioned jvlr. nd about the girls that he brings in rrage l~bvember 4, 1975 ~.` ~'"~: November 41 1975 during the day. This use changes the use of the building. If a permit had been issued to Mr. Zahnd, the Board could move to revoke the pem,it as they felt he was in violation of the permit. Mr. Zahnd could not conduct a school at this site by bringing in other students. Mr. Zahnd filed letters with the clerk from neighbors and school officials that endorse his operation of this home. Mr. Blackstock said he would recommend that the Board refer this matter to Brian Rix, deputy county counsel, and to the District Attorney as some type action should be taken because of the violation of the law. The room was rebuilt without the benefit of a building permit; this might affect the safety of these people. It has not been inspected. The County has to proceed on the criminal side and the Board could then make a decision regarcJing the use permit. On motion of Supervisor Richter and seconded by Supervisor Madigan the violation of rebuilding the room by Wolter L. and Eleanor Zahnd without a building permit and operatitg the group home for girls on Wagstaff Read, Paradise, without a use permit was refereed to the District Attorney and County Counsel for appropriate action; that the Building Department be required to go out and make art inspection of the building in question and that the matter of the transporting of the students to this home be investigated. It was the feeling of the Board members that the operating of the home without a use permit was o'eriminal action; also the rebuild'ng of the room without a building permit indicates the lack of feeling about the law. Supervisor McKillop said he would rather see the motion tabled at this time until after the hearing is closed. Motion tabled until the hearing is completed. Mr. Zahnd stated he had opened the home for operation because fie had received his State license. He did not know you could oot transport students and operate a school on the premises. Another building will be found to be used as a school for #hese girls. Others appearing: I. John Heston, Wagstaff Fcad. His home is next door to the Zahnds' operation. Acts of the girls were set out that he felt would be dangerous to the people in the neighborhood. One of the children put a knife to the throat of another girl, Then stole the managers' car and took it to Yubo Gity, where it was found. Another girl took all her clothes off and replaced them with clothes she hod hid there, and left the clothing on Mr. Heston's property. lvk. Heston stated he had given the girls clothing to Officer Dan Young and he had returned the clothing to Mrs. Zahnd. 2. Mr. Eugene Gressel. This is an area of fine single Family homes; owned mostly by senior citizens. They object to the bringing in of these six girls and having the home run as a business. The Zahnds have been bussing five or six girls a day to the home fur schooling. He felt these girls should have 24-hour a day supervision. Mr. Gressel felt that this violates their wnstitutional rights to hove this type home in their midst. It was his feeling that the Board should glue the other residents some protection through the use permit. The operation of thfs~type Fiome has a detrimental effect of these .' elderly people; because of their health, this operation is harmful they felt. ~ ----- Page 349. Proper protection should be provided for the elderly that live in the area if the use permit is granted. Letters read by Mr. Gressel filed with the Clerk. 3. Mrs. Mary Lou Nigro, 3435 Neal 13~ad, Paradise, suited she teaches the girls at both homes. She is the mother of five girls and the girls from the homes have been visitors in her home. The program of operation at the Zahnd homes has impressed her very much. d. Mr. Arthur Kruger, Wagstaff Ib~ad, Paradise, objected to the issuance of the use permit to operate this home. This is a residential area and he did not feel the area was zoned for this type home. 5. Mrs. Eleanor Zahnd expressed her regrets that the neighbors are feeling such fear; these fears will disappear with time. Safety of these girls explained. Legality of the school explained; she felt that it was no different than visitors coming to the home. They do want to comply with the law; intent of the operation explained. Mrs. Zahnd read letters in support of this operation; letters filed with the Clerk. She stated that she knows of no such incident of anyone being threatened wifh a knife. Any girl that might be a threat to anyone is not taken into this home. $875 a month is given to the Zahnds for the care of each girl under their care, Mr. Bressel stated that after hearing the statements given today and for the safety of thee'Itderly people, the widows and the ailing, he would like to see the Board deny the use permit. If this cannot be done, then put the permit on an annual basis and have Mr. Zahnd live on the premises. 6. Mr. John Bisher, Paradise, felt the suggestion of hoeing the use permit on an annual basis is a good one. He thanked the Board for being so courteous by listening to these people express their feelings today. 7. Mr. Lloyd Swimmer, Chico; a student. It was his feeling that Mr. Zahnd was one of the best; he could provide a healthy type environment for these girls. This is an important issue #o deal with; the County does not have enough of these homes to take can: of these girls. 8. Ms. Sherrill Horton; she lives in the home as a counselor for the Zahnds. The girls are always supervised; the girls are concerned about people liking them. Hearing closed to the public and confined to the Board. Supervisor Cameron mode a statement at this time; felt it was very regretful that Mr. Zahnd did not obtain his use permit before starting his home. hle also should have obtained a building permit. These homes are allowed in the residential areas; they do not devalue property. The law states that, these homes can be allowed. Metter of the conditions explained. He stated he has visited this operation and it is run properly; the place is neat and clean. Because Mr. Zahnd failed to get a use permit for the operation and to obtain a building permit to rebuild the garage into a room, this matter has to be set aside and the legal procedure will have to be carried out. There will be an investigation of the building permit and the operation of the home without the use permit. Chairman Ladd said they would take these issues one at a time. Under the building permit, he was sure that the Board would never vote ro issue a use permit where there was work done that would be dangerous ro the safety of the girls. There has been penalties established. It is his feeling that the building department should Inspect the home; they should certify that it complys with the building code and collect the fees for the building permit. Supervisor Cameron asked if there was ony reason why Mr. Zahnd could not take care of the building permit violation and have the building inspecrors go out and that they report back ro the Board as quickly as possible. It was his feeling that it would be harmful ro the girls to move them. Mr. Leach stated that he knew the Board has hadr numerous hearings concerning these matters. Supervisor McKillop felt the District Atromey could implement these investigations without any additional staff. Mr, Leach said the Board would have ro staff the proposal, Certain things are being done at present. He has the definite feeling that the days of the Attorney General's Office representation in the County and the State Real Estate Board is limited; they came in ro investigate definite cases. They are not going to solve all the problems of Butte County. The District Attorney's Office cannot continue investigating these areas that have illegal lot splits. This is,a difficult area ro rwrk in; this problem consumes manpower at an unbelievable rate;. Staffing discussed. Mr. Leach said that if the Board wishes ro follow through with this, the minimal staff that would be required irtould be one attorney, one investigator and one land use engineer. They have a man in their office who has become a supervising attomey that could be used to investigate these matter. Butte County has become famous for these violations. Mr. Leach felt that land use is a paramount important issue in this county. The abuses that have been demonstrated shows the need for such a program of investigation of the problem. Time spent discussing the need for such a program. Mr. Leach felt that a vigorous enforcement program in this urea might be a deterent action in the matter. The Board asked Mr. Leach if it would be possible to have a quarterly monitoring of this as to what was being done in the matter. Mr. Leach stated they could make a report ro the Board as ro the cases under investigation and the status of the cases. Use of CETA people discussed. Mr. Nickelson said the County could have about any class that was needed under CETA. He did not know if there are funds to fill these positions. Supervisor McKillop suggested that the proposal be given to Mr. Nickelson and have him take it up with Mr. Rackerby to see if something could be worked out. The staffing would be CETA people, including the attomey. OF WATER RESOURCES ON WATERENTITLEMENTS Dan ac stoc ,County Counsel, stated they met with representatives of the Department of Wafer Resources, Mr. l3~bie, and with Assemblyman Chappie to discuss the amendment relating to water en#itlements. Mr. lipbie stated they would be communicating with the County about Amendment No. 3. Assuming that the State will go along with a retro-active application, then the County will end up the year with a credit balance. Mr. Blackstock stated he left the meeting with the feeling that Mr. Rubie is a conservationist; he is interested in conserving water. If the State does not give the county credit, then the County will be 'sn default. The County is interested in holding the entitlement. Mr. Blackstock stated he would strongly recommend that the County not go into default. The agreement should be reviewed every year by this Board. 75-1866 MATTERS PRESENTED BY BOARD MEMBERS Supervisor Cameron cammente on t meefir~, of the Northern Supervisors Association to be held In Redding on November 8th to discuss revenue sharing. Supervisor Richter stated that the County belongs to NACO; it is stated that they support oid to New York. This distcorbs him that the County belongs to an organization that takes this type stand. He felt a letter should be written asking them if it is true that they do support aid to New York. Mr. Nickelson will have Mr. Merelman write a fetter to them determining their stand. Mr. Nickelson suggested that a letter be written to our representatives in Congress requesting that they support the extension of revenue sharing. Discussed whether the County should support the Supervisors Association if they determine that representatives of the County be sent to Washington D.C. to do what they can to have revenue sharing funds extended. A report is :requested stating what the County has lean doing with their revenue sharing funds, particularly in the field of social welfare. The County~,;fieeds to point out what is allowed for FROC and the other agencies within the County. Chairman Ladd felt that all the revenue sharing dollars hove been spend for social service programs. On motion of Supervisor McKiilop, seconded by Supervisor Cameron and unanimously carried, the Board's representative at the meeting on November 8, 1975 in Redding was authorized to support Nine Northern Counties Supervisors Association and participate in the cost of sending someone to Washington, D.C. to urge the extension of revenue sharing funds. 75-1867 LETTER TO BE WRITTEN REGARDING ANOTHER STUDY OF SACRAMENTO RIVER Supervisor Madigan requested t at Gounty Counse oo at t i tat George Stamm had reported on this morning relating to flood plain zoning. County Counsel will be requested to prepare a brief synopsis of the bill. Supervisor Madigan stated that the State Director of Water Resources and of Fish & Game is going to have a restudy of the Sacramento River. They would like a member of the Flood Control Committee be a the committee making the study. Page 354.
