State Department of Parks and Recreation. The Department requests support from
~po p0 the Board concerning the establishment of a seaplane landing area within
Lake Oroville State Recreation Area. Discussed; Board opposed the
request. See motion following communications.
State Water Quality Control Board. The Department writes concerning the
undertaking of a study into the cou~:ty's septage problems. Howard Toussaint
3 Z• ~ 0 explained this matter, County has made a study of this situation. Mr. Toussaint
to answer letter.
Office of Secretary of Treasury. A check in the amount of X408,317.00 for Anti-
Recession fund enclosed. Mr. Nickelson explained the fundsr stating that
this is for the first two quarters out of five quarters that the County will
,L y~ receive these funds. Mr. Nickelson suggested that a committee be formed
P 0 to meet with the staff and come back with a recommendation as to what

On motion o Supervisor Ladd, seconded y Supervisor McKi op and
unanimously carried, request of Bachman Engineering, Chico, for extension of time on the
filing of the Jane Fuggitt parcel map for AP 56-28-18 was granted for a period of
eighteen (18) months.
76-1980 APPROVE APPOINTMENT OF GLENN A. BISSELL, REPRESENTATIVE OF VETERANS
OF FOREIGN WARS, MAX WILLIE POST NO. 2039, PARADISE MEMORIAL HALL
On motion of Supervisor Ladd, seconded y Supervisor McKi op and
unanimously carried, the Beard concurred with request of Veterans of Foreign Wars, Max
Billie Post No. 2039, for the appointment of Glenn A. Bissell as their representative to
the Paradise Memorial Holl Committee for a four year term to expire August (980,
replacing,John Derrough.
76-1981 IMPLEME NTAT10 N TO ASSEMBLY BILL 3121 TO BE FUNDED FROM MENTAL
HEALTH BUDGET
Report of the Juvenile Justice Commission and Mental Health Advisory Board
of their joint meeting and initial recommendations with regard to implementation to
Assembly Bill 312! discussed, Staffing for implementation set out and discussed. It
was felt the State should be forced to fund #his program. Dr. Svihus or Dr. Maguire
will be requested to appear next week to discuss this program.
It was moved by Supervisor Richter, seconded 6y Supervisor McKillap and
unanimously carried, that implementation to Assembly Bill 3121 be Funded out of the
Mental Health Budget under the 90-10 concept of funding.

1N THE COMPUTERIZATION OF ACCOUNTING FUNCTIONS

computerization of accounting functions discussed. Supervisor Ladd objected to the
$100 per hour for one accountant. Fees discussed. Mr. Mickelson recommended
that the Board approve the proposal for the study to help solve the present problem
that exists between the Auditor and Data Processing Department.
On motion of Supervisor Madigan, seconded by Supervisor Richter and
carried, proposal of Ernst & Ernst for the study to evaluate alternatives in the
computerization of accounting functions was approved.

OF A SEAPLANE LANDING AREA WITH LAKE OROVILLE ST. RECREATION ARPA
On motion of Supervisor Lad ,seconds y C airman Cameron and
unanimously carried, the Board opposed the request of State Department of Parks
and Recreation for the establishment of a seaplane landing area within Lake Oroville
State Recreation Area, with the request that the setter points out all the reasons
that this Board set out why this should not be done.
76-1985 COMMITTEE SET UP TO STUDY USE OF ANTI-RECESSION FUNDS
On motion of Supervisor McKiilop, seconded 6y Supervisor Richter and
unanimously carried, Supervisors Madigan and Richter were appointed as a
committee to meet with the staff to study and make recommendations for the use
of the Anti-Recession funds received by the County from the Federal Government.

unanimously carried, the claim of pions Brown in the amount of $500 was rejected
and referred to County's insurance carrier, with the direcfiion that the insurance
carrier is not to investigate this accident os it occurred on a State Highway.
7b-1987 SUPERVISOR RICHTER EXCUSED TO MEET WITH ATTORNEY GENERAL
RE DEVELOPMENT IN BUTTE COUNTY
Supervisor Ric ter exp ained the matter of meeting held this morning to
discuss the shut down of development in Butte County. Impact of this shut-down
set out . Supervisor Richter stated that he is going to go down to Sacramento this
morning to meet with the Attomey General and bring these problems to his attention.
The residents of this county are all affected by this shut-down. The people feel
that the State should not hold up all the development in this county. This would
be putting hundreds of people out of work. If the stipulation was lifted right now,
there would still be a sizeable impact. This is a critical situation. Supervisor
Richter was instructed to tell the Attomey General to call Ray Johnson if there
is any problem.
Supervisor Richter excused at this time to go to Sacramento and
meet with the Attomey General.

988 CHAIRMAN TO SIGN LETTER FOR EVENING MEETING RELATING TO WATER
PROBLEMS ON DELTA
Dan B ac stock, County Counsel, stated he had received a letter concerning
a meeting tonight relating to the water problems in the delta. The letter does not
refer specifically to wells. Mr, Blackstock suggested to the Board that they. consider
taking a position before the hearing relative to a number of items. Use of fresh
water wells that would supply additional water into the waterways discussed. Items
#o be considered;
(I) .Effect an the water table. Mr. Blackstock recommended that the Board
oppose such a utilization of said wells in this County.
(2) Recommended that they discuss and oppose the use of the transportation
facilities to transport surplus water.
(3) Recommended they oppose the use of transportation facility for
transporting Federal water.
(4) Recommended discussion with them this evening of the use of Oroville
Reservoir for the study of salinity control in the delta. They could argue that the reservoir
is a great asset for salinity control in the delta.
Mr, Blackstock recommended that an official presentation be mode at the
hearing fhis evening.
Supervisor Madigan will attend the meeting this evening. County Counsel
will prepare a letter encompassing the points set out above.
On motion of Supervisor McKillop, seconded by Supervisor Madigan and
carried, County Counse! was instructed to write a letter setting out the points
encompassed above over the Chairman's signature and that Supervisor Madigan take
said letter to the meeting to be held this evening.

ABANDONMENT OF RAILROAD TO STIRLING CITY
C airman Cameron commence on a otter received from Congressman bhnson
regarding the abandonment of railroad to Stirling City. The letter states that the subject
right of way will stay intact for 120 days. Letter referred to Public Works Department.

On motion of Supervisor McKillop, seconded by Supervisor Madigan and
carried, Affirmative Action Plan approved.
991 APPROVE PAYMENT FOR REPLACEMENT OF CARPET FOR HEAQ START
Rozia Kahn, 1:.O.G. Director, reporte tat carpeting or t e Head Start
facility had been replaced at a cost of $348.00. The children and the teacher were
stumbling over the old carpet. In the past they only required approval by the Board
of expenditures over X500.00.

carried, payment of $348.00 for the replacement of carpeting for Mead Start
was approved, to be taken_a from equipment account within Head Start Budget.
76-1992 APPROVE MANPOWER fTEMS: VOCATIONAL EDUCATION AND CETA TITLE I

from CETA Title I special funds for vocational education to be used For individual
referrals for 40 CETA eligible participants. These participants will be paid allowances
through the University Foundation, California State University, Chico while they
attend vocational education courses. This activity will be coupled with CETA Title I
work experience part time positions as recommended by the Manpower Planning Council.
Modification of the Comprehensive Manpower Pfan adding $263,440 which
brings the total to $1,016,293 as recommended by the Manpower planning Council.
Increased funding will provide: 150 in-school work experience slots for youth for the
spring semester; 10 full time work experience slots for unemployed and economically
disadvantaged adults; 40 part-time work experience slots for CETA eligible participants
in the individual referral program; and 150 slots for the three week "start up" of the
1977 Summer Youth Program.
On motion of Supervisor Ladd, seconded by Supervisor McKillop end
corned, the following action was taken:
I. Approved $70,952 allocated Pram CETA Title 1 special funds for vocational
education ro be used for indicidual referrols for 40 CETA eiigible participants and
authorized Manpower Director to sign.
2. Approved modification of the Comprehensive Manpower plan adding
$263,440 which brings the total to $1,016,293 as recommended by the Manpower
Planning Council and authorized Manpower Director to sign.

PLACEMENT OF MOBILE HOME EAST OF DE SABLA STORE IN MAGALIA
The public hearing on the Ernie Kctxdom, petition r variance to provisions
of Sections 19-10 and/or 19-i2 of the Butte County Code For the placement of a mobile
hnme on AP 065-07-013, east of the DeSab6 store in Magnlia vas held at this time.
Howard Toussaint, County Sanitarian, set out the background of Fhis petition, stating
that Health Department has no objections in this matter.

76-1994 PUBLIC HEARING (CONTINUATION) YEARLY REVIEW OF USE PERMIT FOR
WALTER & ELEANOR ZAHND GROUP HOME, PARADISE
continuation of t e pu ie caring on t yearly review of use permit
for Walter and Eleanor Zahnd, AP 51-12-57, to allow a group home for six teenage girls,
pursuant to Welfare and Institution Code, Section 5116, located on the north side of
Wagstaff Road, approximately 250 feet east of Gregory Lane, containing .80 acres,
more or less, Paradise was held at this time.
Public Works iepartment was to make an inspection of this facility.
Questions on parking and ingress and egress had been requested to be answered.
Mr. Zahnd present at this time. Hs requested the Clerk to read two letters
setting out the use of the Chico Universify's video equipment. Mr. Zahnd had
approval of the department head for the use of the .equipment. Letters read and
discussed .
Appearing:
1. Mr. Eugene Brissell, Wagstaff Road. He lives across the street
from the Zahnd operation. He urged the Board to deny the extension of the use permit;
he also suggested that Chairman Cameron use descretion for voting on this issue.
2. John Heston, Wagstaff lmad. He requested that if the Board is
going to approve the use permit, they only issue it for another year. This home has
created quite a problem this past year.
3. 5herril! Horton, Counsellor employed by the Zahnds. She feels
that this is a real home for the girls.
Mr. Zahnd displayed copies of the use permit that he had signed,
There have been problems with some of the neighbors. He feels that they run one of
the finest homes for girls in the northern area.
Hearing closed to the public and confined to the Board.
Chairman Cameron stated that the County Counsel had advised him that
it would not be a conflict of interest for him to discuss and vote on this matter
because Mr. Zahnd's name had appeared in favor of his campaign. :When he
came on the Board in 1973, he had instigated having these permits placed on the
Board's agenda for discussion. In this way the Board con see the type operators
that run these homes.
According to the report of the building inspector, the final inspection
of the Zahnd operation has been made. The hearing today is to make a determination
as to whether the operation should continue. The report has shown that the
violations have been noted and have been taken care of. All the violations (lave
been corrected and taken care of.
On motion of Supervisor Madigan, seconded by Supervisor McKillop
and carried, renewal of the use permit for Welter and Eleanor Zahnd to allow a group
home for six teenage girls was denied, with the findings that Mr. Zahnd is not serious
about living up to the conditions placed upon the use permit.

Eleanor Zahnd stated it has been voted to deny the use permit. Will
they have to take the girls out of the home immediately. County Counsel was
instructed to talk to the Zahnds about the removal of the girls from this home.
Mr. Blaekstock stated they would be in violation Fmmediately. He will not bring
nn injunction at this time to Tequire them to cease the operation. The intent of
this Board is not to renew the use permit, but in view of hardship, the conditional use will
be extended to Mny Ist. ,
It was moved by Supervisor Ladd, seconded by Supervisor Madigan and
carried that the Zahnd's use permit For operation of the giouphome for six teenage
girls was extended to May (, 1977 to find another home to which the girls could be
moved .

76-1995 PUBLIC HEARING: CENTEX AGGREGATES, INC: APPEAL OF DETERMINATION
TO REQUIRE AN ENVIRONMENTAL IMPACT REPORT FOR USE PERMIT FOR PORTABLE
AGGREGATE PLANT
T pu is aring on the Gentex Aggregates, tnc. appeal of Planning
Commission `s determination to require an environmental impact report for a use permit
to allow portable aggregate plant on property zoned "A-2"identified as AP 25-04212,
located on the north side of Vance Avenue, east of Sacramento Northern Railroad
rightrof-way, containing 29.24 acres, more or less, northeast of Gridley was held
at this time. Mr. Mc Keenan, Planning Department, set out the background of this
appeal. The E.I.R. Committee decided on October 4, 1976 that the impact from this
operation would be in conflict with the General plan. Trucking of the mined materials
could affect agricultural crops in the orchards. The project could also affect the use
of recreational activities. It is within the designated Floodways as shown on the Corp of
Engineers maps. It could affect fish and wildlife.
A state law was passed that requires each County to adopt an ordinance
for standards for this type operation. SurFace mining permits would then be
issued. At this time, this Board has not adopted such an ordinance.
Hearing opened to the public. Appearing:
I. Bill Gettis, representing Centex Aggregates, lnc. The historircal use
of this property is as a borrow pit. The County has had a borrow pit in that area for
many years. JustiFication for this operation set out. gust problem explained.
Fle said that there are no endangered species that utilize this site. He requested that
the appeal be upheld. He does have an E.I.R. that has been prepared for them.
Chairman Cameron questioned the stafF about this operation. He asked
how this conflicts with the General plan. The area is set out as orchard and field crop
area so it would be in conflict with the Genera! Plan.
Requirement for the E.I.R. discussed. The State has requested that an
E.I.R. be prepared for the Mathews itrady-Mix operation. To be consistent
with this, an E.I.R. should be required for this operation.

it was moved by Supervisor Ladd that the Board uphold the appellant in his
appeal and not require an E.I.R. Motion died for lack of a second.
On motion of Supervisor McK311op, seconded by Supervisor Madigan
and carried, the Board upheld the Planning Commissian's determination to require an
environmental impact report for a use permit to allow portable aggregate plant on
property zoned "A-2"identified as AP 25-042-12, located on the north side of Vance
Avenue, east of Sacramento Northern Railroad rightrof-way, containing 29.24
acres, more or less, northeast of Gridley.

two articles from Monday's Chico Enterprise record paper. The articles relate to
the water projects. He was told that Supervisor Madigan was going to attend the
meeting this evening and that a letter had been written by County Counsel to be

Mr. Bo Cam ers, Business Manager of Paradise S oo s, appeared to
discuss Mr. Lawrence's response to the Paradise School District's letter, The crux
of the matter comes down to who has the legal responsibility of notifying districts of
assessed valuations.
Response explained and discussed. Board members had copies of the
letters. Superintendent of Schools was unaware of the situation.
It was felt That the legal responsibility would lay with the Superintendent
of Schools if he had the proper information. Mr. Powers has stated that they have no
record of ever receiving the information from the Auditor. This type activity does
hit the schaol districts pretty hard.

tax roil through a tax exemption. This occurred during the 1975-7d roll. The
exemption had been sent to the Auditor in June, 1975. It was felt the school
district should have been notified of the exemption. Mr. Lawrence has told
them that he has no responsibility to notify them of a tax loss. It would be
incumbent on the Superintendent of Schools to check each year for each school
district. A copy of Mr. Powers latter was given to Mr. Chambers.
It was stated that a new policy was being implemented by the Auditor
due to the letters #rom the Paradise School District.

Mr. Nickelson stated that if the Board approves the formation of
the E1R office, that authorization to hire et any step of the range be given.

76-2028 DISCUSSION; ADDITIONAL POSITIONS FOR PUBLIC WDRKS DEPARTMENT.
Supervisor Ledd stated that he did not see why Public Works
needed three people to take over the workload. Mr. Nickelson stated
that Public Works was actually getting two people as one of the positions
was being transferred from the Planning Department. There would be a
redirection of the workload and will be taking a lot off the Environmental
Review Committee.
76-2029 ADDTTTONAZ MATTER5 PRESENTED BX SOARD MEDfBERS.
Supervisor Madigan stated that a public hearing had been set
concerning withdrawal Exam the"Williamson~Act~end asked County Counsel
to explain why a public hearing must be held if an individual wants out
of the Williamson Act. County Counsel explained this matter to Supervisor
Madigan.
Supervisor T.add stated that there is a proposal to ban 24DD.
This is damaging t'o the ranchers. The Board should take an position on
this matter and notify Lhe Nd,ne Northern Countiesof their decision.
The Agricultural Commiiaioa should speak at the Board meeting next week.

Supervisor Ladd stated that an item concerning the State Energy
Resources CoQanission estimate of the next 10 years seemed a little short
of whet would be tteeded. Supervisor Ladd stated that this was very dangerous
to underestimate the needs for electricity. It was felt that a letter
should be written end someone be in attendance at the public hearing that
is scheduled.
Chairman Cameron stated that the contractors fQr Juvenile Hall
are fighting and there ie no wort being done. It was felt that the contractor
should come to the Board neat week and explain the matter.
Chairman Cameron stated that the Northern Counties Emergency
Medical Council was meeting in Redding December 11 & 12, 1976. Chairman
Cameron stated that the Supervisors were meeting Thursday sight to discuss
the medical situation.

up in the Gridley Memorial Hall, P.G.&E, toot the attitude that it was Che
fault of the furnace and not their man.
