Invocation by Supervisor Moseley. 78-2207 APPROVAL OF MINUTES On motion of Supervisor Moseley, seconded by Supervisor Madigan and unanimously carried, the minutes of November 21, 1978 were approved as mailed with the correction on Page 447, toss'txate: 4. "Postponed Foothill Boulevard, Off-System projec until the 1978-79 Off-System money is available this year," Item 78-2178. ~78-2208 WAIVE SECOND READING OF SALARY ORDINANCE AMENDMENT: ADOPTORDINANCE 1978 '; On motion of Supervisor Richter, seconded by Supervisor Lemke and unanimously carried, second reading of the salty ordinance amendment that increases the CETA participant wage from X1.65 per hour to $2.90 per hour effective January I, 1979, as required by federal regulations ct¢Ia~ivardi~dl;rGn~ance 1978 was adopted and the Chairman authorized to sign. 78-2209 REROOFING OF COUNTY BUILDINGS-BID NO. 24-79: PUT OVER ONE WEEK Only a single bid was received far the reroofing of Chico Memorial Hall and sealing of walls at Superior Court with the bid considerably higher than the original estimate. At request of Administrative Officer, the Purchasing Officer, Building and Grounds Superintendent and Administrative Office was authorized to negotiate with the bidder and other contractors and to report back on how the matter will be handled. Administrative Officer would like to look at alternatives in this matter. Put over one week; no action at this time. 78-2210 MENTAL HEALTH MEALS CO NTRACT: DISCUSSED-NO ACTIO N TA KE N ', No bids were received to provide meals to the residential treatment center in Chico. At this time, they propose to use the Community Hospital to provide meals while they shop around for a more economical place to purchase the meals. The present-cost is $3.10 for the meals. No action at this time. 178-2211 PARADISE MEALS-on-WHEELS: APPROVE CONTRACT AMENDMENT An amendment to the Mealsron-Wheels contract has been prepared to refdect the increased cost per meal of $2.85 the agency is paying to Feather River Hospital. November 28, (978 ___~....___________ Nov_ember28l 1978 _________ On motion of Supervisor Richter, seconded by Supervisor Lemke and unanimously carried, contract amendment to Paradise Meals-on-Wheels-contract was approved and the Chairman authorized to sign. 78-2212 APPROVE AGREEMENT FOR BIDWELL WILDLIFE REHABILITATION CENTER An agreement has been prepared with Bidwell Wildlife Reha ilitation Center ', in the amount of $2,000 for the care, food and other charges for bicds and mammals. Allocation included in Fish and Game budget. On motion of Supervisor Madigan, seconded by Supervisor Moseley and carried, ', the Bidwell Wildlife Rehabilitation Center agreement was approved and the Chairman authorized to sign. AYES; Supervisors Lemke, Madigan, M~ll~y, Chairman (Winston NOES: Supervisor Richter 78-2213 LEASE AGREEMENT-PARADISE RECREATION & PARK DISTRICT: PUT OVER I WEEK A renews 20 year .lease agreement has been prepared with the Paradise Recreation and Park District for property located on the Skyway near Elliott Road, Paradise. Clif Mickelson, Administrative Officer, stated that the lease should be put over one week so that a cancellation clause could be incorporated within the lease. Put-over one week. ', 75-2214 APPROVE TRANSFER: BUTTE COUNTY FAIR BUDGET TRANSFER-1978-5 ', This is a 10,757 transfer of funds between various operating accounts with $8,288 '. coming from the Fair's unbudgeted reserve. On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, Butte County Fair Budget transfer-1978-5 was approved and the Chairman was authorized to sign. 78--2215 AUTHORIZE CANCELLATION OF PENALTIES, INTEREST & TAXES, AP 056-12-0-012-0 (Sale #13326 76} Pursuant to Revenue and Taxation Code Section 4831, the Assessor is requesting the cancellation of penalties, interest and taxes on AP 056-12-0-012-0 (Sale #13326 76) as result of a mapping error which caused the assessment to appear on the 1976-77 secured roll in error. On motion of Supervisor Lemke, seconded by Supervisor Moseley and unanimously carried, cancellation of penalties, .interest and taxes on AP 056-12-0-012-0 was authorized. 78-2216 CERTIFICATION OF VOTES CAST AT NOVEMBER 7, .1978 GENERAL ELECTION BY _. COUNTY CLERK: PUT OVERONE WEEK Certification of votes cast at the November 7, .1978 General Election by the County Clerk was put over to Tuesday, December 5, 1978. 78-2217 DAN CODY-RENEWAL OF VARIANCE FOR PLACEMENT OF MOBILE HOME On motion of Supervisor Moseley, seconded y Supervisor Madigan and unanimously carried, renewal of variance to Sections 19-10 and~or 19-12 of the Butte County Code for placement of a mobile home on AP 63-09-22, Box 158, Forest Ranch was approved for Dan Cody. November 28, 1978 ________________ Nov_ember281 1978 _________ _____ 78-2218 IRIS SOLIS-RENEWAL OF VARIANCE APPROVED FOR PLACEMENT OF MOBILE HOME On motion of Supervisor Richter, seconded 6y Supervisor Moseley and unanimously carried, renewal of variance to Sections 19-10 and~or 19-12 of the Butte County Code for placement of a mobile home on AP 72-05-20, 7040 Feather Falls Star Route was approved for Iris Solis, 78-2219 APPROVE DEVELOPMENT OF CHILD PROTECTIVE SERVICES AND HEALTH ', EDUCATION PROGRAM AUGMENTATIONS -The Depar#ment is proposing to develop a program to serve children with problems related to Child Protective Services and to establish a position of Mental Health education assistant to provide public information services. Ftaodl~?g~ for these ', programs will be !00%state funded by Short-Doyle and will require an increase in the existing budget appropriation. Clif Mickelson, Administrative Officer, c~cplained this itemsa This is the result of several meetings Administrative Officer had with Dr. Maguire and Bob Crisan, Welfare Director. Walt Atkins, Staff Services Manager for Mental Health Services, explained why this is being handled in this way. Dr. Maguire stated the first problem was with Title 20, Federal dollars~,and secondly the problem of the number of referrals of abused or neglected children ', have- increased drastically, The Federal dollars are not keeping up with inflation a Mental Health will take over the functions of mental health counseling and the other functions will be handled by Welfare Departmento On motion of Supervisor Lemke, seconded by ~ehairman Winston and ~j unanimously carried, deveiopment.of a program for Child Protective Services counseling, was approved; providing a servicy by private contract authorized; and securing bids; direct the Personnel Department to prepare a sahary ordinance amendment classifying the position of mental health education assistant approved; and accepted State monies to fund the programs. 78-2220 AUTHORIZE PENALTY RELIEF: BOB L. & LILLIAN HEMSTALK A request for penalty relief has been received on unsecured property taxes for Assessment No. 06-8824ES-00. On motion of Supervisor Madigan, seconded by Supervisor Richter and unanimously carried, penalty relief for Bob .L, and Lilliam Hemstalk was authorized as requested by the Treasurer and Tax Collector. ', 78-2221 AUTHORIZE QUITCLAIM DEED, LOT 2b CRESTWOOD UNIT NO. On motion of Supervisor Lemke, seconded by Supervisor Moseley and ', unanimously carried, the Chairman was authorized to sign quitclaim deed conveying. County's interest in Lot 26 of Crestwood Unit No. ! to Gladys A, Lendino in order to clear cloud on title created by error in earlier deed to County for one foot strip. 78-2222 AUTHORIZE ROAD EASEMENT DEED: OLD CLARK ROAD DUMP SITE On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the Chairman was authorized to sign road easement deed conveying a 60-foot wide road easement to Radiology Service Company over a ', partiorr of the ofd Clark Road dump site as a condition of agreement between County and Radiology Service Company; ac epted d ed and authorized Chairman to sign certificate of acceptance, .conveyin~ wide road easement to County of Butte as a condition of agreement between County and Radiology Service Company. November 28, 1978 Page 4600 _`______________ November28~1978 ---------------- 78-2223 ACKNOWLEDGE EDA GRANT FOR MEYER STREET GROUP, CHICO Clay Castleberry, Director of Public Works, reported that a letter was received kla5s morning regarding the Meyer Street group south of Chico; they had applied for EDA job grant, The letter sets out approval of the grant in the amount of $435,000. Board acknowledged receipt of the letter setting out the ' EDA grant funds. 78-2224 DISCUSSION: TREE ORDINANCE Supervisor Lemke stated. he had received a draft of the tree ordinance and wanted to know where the. or~fnpRC~ was at this time. He requested that County Counsel set ovt the implementation costs of the ordinance and then schedule the hearing of the ordinance. At this time, enforcement costs for this ordinance are not known. Mr. Castleberry will have this looked into and will send a memo to the Board. This is just for the- Paradise Irrigation District area. Discussed whether the enforcement of this ordinance could be delegated to someone in the community. Mr. Castleberry will express his concerns in his memo to the Board. 78-2225 REPORT ON CLAIM OF SOUTHERN PACIFIC TRANSPORTATION COMPANY FOR REFUND OF PROPERTY TAXES FOR 1977-78 FISCAL YEAR: TO BE PLACED ', BACK ON AGENDA FOR FIRST MEETING IN JANUARY Dan Blackstock, County Counsel, .explained the report on the claim of Southem Pacific Transportation Company for refund of property taxes for (977-78 fiscal year. Mr. Blackstock has been in touch with the attorney for Southern Pacific Transportation Company. He suggested that the Board hold up on the rejection of the claim; the same claim has been filed against 51 counties, To be placed back on the agenda for the first meeting in January. 78--2226 APPOLNTMENT TO PARADISE MUNICIPAL ADVISORY COUNCIL: PUT OVER ONE WEEK j Chairman Winston requested that the appointment to the Paradise Municipal Advisory Council be put-over one week. '78-2227 COMMUNICATIONS Society for California Archaeology. The Society writes appealing the Advisory Agency's condition X12 relating to the Rnn Wheeler parcel map, four lots, ', AP 71-06-44, Ponderosa Way (a private road), south of Lumpkin Read, Feather Falls area. Set for hearing on December 12, 1978 at 10a5 a.m. AI Thompson, Chico. Mr. Thompson submits his resignation as a member of the County Service Area No. 31 (Biggs Swimming Pool) Advisory Committee. Mr. Mickelson to post-this resignation and will solicit individuals who would be interested in service on this Committee. Thermali#o Elementary School District, The District writes in support of fihe Comprehensive Employment and Training Act Program. Information only. Debbie Altop, Oroville, Ms, Altop writes concerning the need for more recreational activities for young people in the Oroville area. Referred to Chairman Winston for answering. City of Chico. The Company submits a subrogation claim in an amount exceeding $5,000 far an accident occuring August 2, .1978 at Greenville and Myers Streets in Oroville. See motion following communications. Butte County Legal Services. A summons and complaint has been received in the matter of Medora Jenkins, et al, vs, the County of Butte with regard to general assistance, etc. Referred to County Counsel. State Department of Youth Authority. The Department forwards guidelines for applying for funds with regard fo implementation of AB 958 (secure detention of status offenders). Mr. Mickelson stated he had information on this bill; the couhty will not be implementing this bill. Inter-departmental memo to Undersheriff from Ken Wilson, Sr. Animal Control Officer. Reply to correspondence from Mrs. Stephen Davenport regarding the inadvertent killing of her dog. Discussed how the matter could be handled. -This was a human error. Referred to Claims Committee. Muskogee Chamber of Commerce, Oklahoma. In answer to telephone call by Supervisor Madigan relating to their coal fire burning plant. Read and discussed; no action taken. 78-2i~EE13$lEQIGcCLAIM OF STATE FARM INSURANCE COMPANY On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the claim of State Farm Insurance Company in an amount exceeding $5,000 for an accident occuring August 2, 1978 at Greenville and Myers Streets in Oroviile re Jimmie McElhaney was rejected and referred to County's insurance carrier. Chairman Winston stated that the law suit filed by Butte County Legal Services against the County regarding general assistance payments:: s~~s~~d}peaction taken. 78-2229 PUBLIC HEARING: E. T. COTTON-ABANDONMENT OF THAT CERTAIN TWELVE FOOT PUBLIC UTILITY EASEMENT: PARADISE PINES UNIT N0. 15, ADOPT RESOLUTION 78-198 The public hearing on the E. T. Cotton abandonment of all that certain 12 foot public utility easement lying along the south line of Lot 47 as shown on the map of "Paradise Pines Unit No. 15"recorded in Book 38 of maps of record at pages 42 through 44, County of Butte, State of California was held as advertised. November 28, 1978 Page 4:~2. ________________November28,_l978_____ ', 78-2230 PUBLIC HEARING: LARRY BANNON-APPEAL OF SUBDIVISION VIOLATION COMMITTI CONDITION #I ON CERTIFICATE OF GOMPLA~ANCE, EAST OF ORO BANGOR HIGHWAY, SOUTH OF RUTHERFORD LANE, OROVILLE The public hearing on the Larry Bannon aplpoeal of Subdivision Violation Committee condition #I on a certificate of compliance for property identified as AP 72-14-22, 300 feet east of Oro Bangor Highway, .1,200 feet south of Rutherford Lane, Oroville, was held at this time, Clay Castleberry, Director of Public Works, set outthe background of the appeal. Mr. Bannon did not create the parcel; he did buy it, It is not possible to achieve a larger right-of-way. Mr. Castleberry said he would recommend that the Board approve the appeal on the condition that therer: not be any further divisions until a wider access is obtained, Hearing opened to the public. Appearing: No one, Mr. Castleberry stated that Mr. Bannon was present° but would not speak if the Board concurred with his recommendation. Hearing closed to the public and confined to the Board, On motion of Supervisor Moseley, seconded by Supervisor Lemke and unanimously carried, appeal of Larry Bannon of Subdivision Violation Committee condition I upheld, with the recommendation of Public Works Director that there be no further division until a 60-foot right of way is obtaineda 78-2231 CLOSED HEARING: ELIZABETH V. EISENHOUR-APPEAL OF NEGATIVE DECLARATION AND DEMED REZONE FROM "A-5" TO "S-R", WEST OF ALOMO AVENUE, CHICO: ADOPT ORDINANCE 1979 The closed hearing on the Elizabeth V. Eisenhour appeal of negative declaration and denied rezone from "A-5" (agricultural -five acre parcels) to "S-R" (suburban- residential) ofproperty located on the south side of Bell Road, approximately 50 feet west of Alamo Avenue, identified as AP 42-02-13, Chico held as continued from November 21, 1978. This hearing is closed and confined to the Board, Supervisor Richter stated he had not been present -,last-week and he has received numerous telephone calls on this matter. He stated that thisproperty touches the City of Chico's rezone. The map indicates parcels that are zoned S-R, The people would like to see all the property within that area zoned "S-R", It was moved by Supervisor Richter, seconded by Supervssor Moseley and unanimously carried, that having reviewed the environmental review report, the Board found that the proposed project could not have a significant effect on the environment and a negative declaration was recommended and approved at this time. On motion of Supervisor Richter, seconded by Supervisor Lemke and unanimously carried, the appeal of Elizabeth V. Eisenhour was upheld, with the finding that it is consistene with the General Plan and is in the best interest of the public, safety and welfare of the people; Ordinance 1979 was adopted and the Chairman authorized to sign. RECESS: 10:20 RECONVENED: 10:30 78-2232 PUBLIC (CONTINUED) HEARING: HIGNELL ~ H!GNELL, INC. APPEAL OF ADVISORY AGENCY'S CONDITION #16 ON TENTATIVE PARCEL MAP: MANZANITA AVENUE AT CEANOTHUS AVENUE, CHICO: UPHELD APPEAL The continued hearing on the Hignell and Hignell, Inc. appea[ of Advisory Page 463. Navember 28,.1978 November 28~ 1978 Agency's condition #16 on a tentative parcel map relating to the establishment of a single family zone in order to comply with the :general plan, AP 48-203-15, four Pots, south side of Manzanita Avenue at Ceanothus Avenue, Chico. held;. Mr. Castleberry set out the background of this hearing. This is the property that is fronting on Manzanita. This had been referred back to the Committee to examine the surrounding area. The Committee found that the property abutted , but was not surrounded.~by~multiple family dwellings. The Committee could not find that it was surrounded and abutted multiple family uses. Supervisor Richter said he understands that this is zoned A-2; this allows for multiple family uses. The applicant was delighted to go for the zoning as requested; they were told now that the City of Chico would not be able to serve them with sewers. The applicant would like to hie the zoning requirement: condition waived, Bettye B;imir, Planning Director, set out-the area on a zoning map. Parts of the area has been annexed to the City of Chico, She could not find that the area was surrounded by like use. Earl Nelson, Environmental Review Director, set-out the background of the area,- Supervisor Richter asked how many divisions are being asked for; four parcels, .two of them have existing homes on them., ', Hearing opened to the public. Appearing: I. Mr. Rolls,-engineer for the applicant. Set out an aerial photo showing .what is happening in the subject property area. He stated that the parcel map carries with it no commitments one way or the other. This parcel map was submitted '; in Ju Iy, 1978. ', 2. Fred Hignell . He stated that they were trying to hook on to the City of Chico's sewer system. Basically, the reason that they need the parcel map is so that they can pay the people for the property. They have been waiting a year now for payment. Chairman Winston felt there must be a solution to this problem. ', Hearing closed to the public and confined to the Board. Supervisor Richter stated that the Board could lift the condition; he believes that the General Plan i amendment applies to this map. The backside of the property could be referred to as ', industrial as the County has been extracting gravel from the property. It was moved by Supervisor Richter, seconded by Supervisor Madigan and unanimously carried that the Board uphold the appeal regarding Advisory Agency's condition I6 on the tentative parcel map, with the finding that the possible development as proposed is.consistent with the General Plan as it relates to surrounding uses, 78-2233 DATA PROCESSING FACILITIES MANAGEMENT PROPOSALS: TENTATIVELY SCHEDULED FOR TUESDAY, DECEMBER 5, 1978 Data. Processing Facilities Management proposals were recei>5ed from: Sierra National Corporation; Computer Sciences Corporation and Systems and Computer Technology Corporation. These proposals are quite detailed. Mr. Mickelson recommended thatthe Board take these under advisement for one week. There is a Page 464, November 28, 197$ November 28, 1978 date processors users meeting to be held Friday. Supervisors Lemke and Madigan are on the committee and they wilt meet with Mr. Mickelson to review the proposals. Tentatively scheduled for Tuesday, December 5, 1978. Each proposal will be considered at-that time. 78-2234 PRESENTATION BY REPRESENTATIVES OF THE U. S. FISH & WILDLIFE SERVICE, PORTLAND, OREGON Representatives of the U. S. Fish & Wildlife Service, Mr. Jim Foster, appraiser for. the service and Dave Brown, biologist; .present #o show a movie regarding the Pacific Flyway. Mr Foster explained the bird stamp act; the project is an easement project of 4,000 acres. The movie covered the Central Valley. Movie Shawn at this time. Chairman Winston thanked the representatives for the showing of the movie. Butte Sink located on the map. There are about 4,000 acres in Butte County. Sutter County ;has approved this program. Colusa County also has acreage in this area being proposed. Mr. Foster has contacted the seven owners of the property in Butte County; they all support the concept but they all want to look at it. The first step is to get the County's approval. This is an easement concept. People can still hunt on the property but they cannot change the water pattern. The Fish & Game Service would have the power to flood the land to keep it wet. This would be the primary watering area for the birds. They are asking the County for permission to proceed with the project on a willing seller-willing buyer concept. Importance of preserving the wet sands acknowledged. Et was moved by Supervisor Richter, seconded by Supervisor Madigan and unanimously carried that the Board gives approval to the U. S. Fish & Wildlife Service to pursue acquisition of the wildlife easements on a willing seller-willing buyer concept, within the confinesagf Butte County for the wildlife wet lands concept program. RECESS: 11:25 RECONVENED: I I :30 78-2235 APPEARANCE: DR. STUTZMAN, ORD FERRY ROAD, CH1C0, RE AVAILABILITY OF REPORT ON NCPA SPRAYING Dr. Stutzman, Ord -Ferry Road, Chico, stated this was the third time he has appeared before the Board to ask about the report that was to be presented to the Board about the drifting of NCPA spraying within this County. In September he appeared and hoped that the ~yrt of the study would be available. ', This study report was necessary because there was much conflicting data about NCPA spraying. It had bean stated that the report would be available in early September. He is attempting to find out when the report would be available. Chairman Winston requested that Mr. Mickelson call Mr. Bandy and obtain .comments from him about this report. Dr. Stutzman asked what authority this Board had in this matter; Mro Bandy is appointed by this Board but he is responsible to the State. The Chairman stated that the State of California has control of the Ag Commissioner, Mr. Bfackstock stated that-this Board is subject to State Law. The Board members carry out the dictates of the law. If there is a drift problem; this is a misdeamenor. Page 465. November 28, 1978 ------- --------November 281978__________-___._ Mr. Blackstock stated that the Board appoints the Ag Commissioner. The Ag Commissioner is responsible for the enforcement of State Iawo The Board must do its duty as they see it and comply with the law. 1~drr. Stutzman stated that if the Board has no control over the Ag Commissioner as to use of pesticides, then is he wasting his time appearing before the Board. He was told that if Mr. Bandy does make findings that such and such a condition exists, then the Board must act on his recommendation.. Administrative Offi cer to write a letter to Dr. Stutzman to inform him of the status of the report and when he might be abletbo expect the report to be available for viewing. 78-2234 APPEARANCE: -DON BLAKE RE MEETING WITH DEPT. OF WATER RESOURCES Don Blake stated he was present today to talk about the Board's meeting with Department of Water Resources. He unders#ands that the Chairman and County Counsel will meet with Dept, of Water Resources on December 4th, relating to the County assigning the entitlement water to other agencys. He asked if ltwould be all right if he attended this meeting. He was told that it was a private meeting and he could not attend. He requested that action on the contract for water be put off until after the first of the new year, 78-223~CHAIRMAN TO SIGN LETTEROF CONDOLANCE TO MRS. LAVENDER Chairman Winston stated that the Board mem rs had read a out a man drowning in San Francisco. This man was Joseph Lavender who had helped the County develop the south side in Oroville. Chairman Winston-was authorized ', to sign a letter of condolence addressed to Mrs. Lavender. 78-223 ADMINISTRATIVE OFFICE TO PREPARE RESOLUTIONS DIRECTED TO FAMILIES OF-MAYOR MOSCONE AND SUPERVISOR MILK Chairman Winston commented on the tragedy that took place in San Francisco yesterday with the killing of Mayor Moscone and Supervisor Milk. Chairman Winston said he decried the tendency on the part of people to take out their frustrations on Government officials; Chairman Winston requested that the Administrative Officer prepare a resolution directed to Mrs. Moscone and another resolution directed to the heirs of Supervisor Milk as to the tragic events that took ',' place on Monday, November 26, 197$.
