Mr. Enzmann requests that if Skyway is widened in Paradise that side:aalks be installed for the general pu'alic and in particular the infirm who must use wheelchairs. In addition, he suggests that every intersection and every public building have ramps for use by citizens who must use wheelchairs. Referred to Public Works for answer. 0. E. Norlie, Chico. Mr. Norlie complains about the increase in his taxes this year a:ad requests explanation .as to why his taxes morn than doubled. Referred to Administrative Officer and to County Assessor for answer. Public Hearing set for December 21, 1971 at 11:00 a.m. Hazel H. Godley. Complaining about taxes placed on her property in the Chica area. Referred to Assessor with the request that Mro Vasco answer the letter and send a copy of his answer to the Board of Supervisorso C. G. Fitzsimmons. Copies to be given to the Board members, 71-2169 LETTER OF APPRECIATION TO BE SENT TO RALPH THIEL, IMMEDIATE PAST PRBSIDENT OF CSAC On motion of Supervisor McKillop, seconded by Supervisor Gilman and unanimously carried, the Board authorized a letter of appreciate to be sent to Ralph Thiel, immediate past president of CSAC, along the same lines as resolution sent by County of Mariposa. 71-2170 APPROVE APPOINTMENT TO OROVILLE CEMETERY DISTRICT On motion of Supervisor McKillop, seconded by Supervisor Maxon and unanimously carried, the resignation of John H, D`Amico as Trustee of the Oroville Cemetery District was accepted with regret, the Administrative Officer was requested to write him a letter of appreciation and the Board approved the appointment of Louis J. DaMassa, 1241 High Street, Oroville, to fill the unexpired term of Mr, D`Amico. 71-2171 APPROVAL AND AUTHORIZATION FOR PACIFIC TELEPHONE TO BILL COUNTY FOR UTILITY RELOCATION WORK ON OROV~LLE-QUINCY HIGHWAY PROJECT NO. 27561-67-2 ~~.~ motion of Supervisor McKillop, seconded by Supervisor Maxon and unanimously carried, the Board granted authorization for Pacific Telephone to bill the County for utility relocation work on Oroville-Quincy Highway Project Noo 27561-67-2, at an estimated cost of $1,550, said company to bill the County for work when completed. 71-2172 ACCEPT RIGHT OF WAY ACQUISITION DEEDS On motion of Supervisor Reynolds, seconded by Supervisor Madigan and unanimously carried, deeds were accepted for right of way acquisition and the Chairman was authorized to sign certificates of acceptance on the following: East Avenue 57191-70-1 Pcl, 20 R, E, Peterson " " " Pclo 25 Jo H. Taylor pakwood Lane (use permit) AP 25-03-44 R, Poor Pentz-Magalia Hwyo (Pcla map) AP 50-35-02 Go Deutsch, East Roe Road (Pc1..Map) AP 55-22-38 Ro Harmer 71-2173 DISCUSSION: COUNTY SERVICE AREA N0. 38 Clay Castleberry, Director of Public Works, explained the matter of Page 222, November 30, 1971 November 30, 1971 funds for capital expenditues, County Service Area No. 38 and for increased storm drain runoff from projects nearing construction stage for said service area, He said that there is a developer that is anxious to participate to help soave the drainage problems in the area, He set out the proposed projects for the area that would participate in this matter, Mr. Castleberry explained the action that would be necessary in this matter, Discussed how the situation should be handledo Mr. Castleberry said he would bring back a proposal for this area in the next few weekso No action taken at this time, 71-2174 STATUS REPORT ON COURTHOUSE CONSTRUCTION Mr, Castleberry presented a status report on the Courthouse construction. He said it appears that the contractor is working but that he is about six pr eight weeks behind in the construction, Mr. Castleberry presented a written report to the Board members. Chairman Reynolds felt that under County Counsel's direction, Public Works Director or the Administrative Officer should write a letter to Mr, Neves, the contractor, and remind him of his commitments under tk~is contract. Mr. Nickelson said he would send a letter to Mr, Neves. 71,2175 REPORT ON THE GRIDLEY AREA-LARKIN ROAD BRIDGE DETOUR Clay Castleberry, Director of Public Works, reported on the Larkin Road bridge, in the Gridley area, This bridge is being replaced. He said that no detour was being contemplated. The farmers in the area have expressed concern about taking agricultural uses out onto a highway, A farmer in the area has offered the use of his private bridge for agricultural purposes. He said the bridge might need some maintenance work due to the added use. Mra Castleberry will write a letter and thank the farmer for his offer to the County, 71-2176 WATER ENGINEER'S REPORT George Stamm, Water Resources engineer, reported to the Board concerning various water items referred'to him by the Board of Supervisorso He said he had attended a meeting on November 4th in Red Bluff on flood information. They explained the new sophisticated system they are using for weather forecasts. They are now using the weather satellite and will be able to deliver a much more complete weather forecast than in the past. There is also a cpntinuous FM station that will broadcast weather information. Mr. Stamm said the County will be receiving tele-meter information on the Chico-Mud Creek-Sycamore Project. He said they have just completed a tour of the levee maintenance control project. Mr. Stamm said ha had attended a meeting on the 19th of November, The levees along the Sacramento River were discussed. The Water Resources staff has recommended that many of the levees be degraded, The recommendation was tabled at this time until more study has been made. A stipulation was passed that no levee construction or modification should be done until the matter had been studied. Mr. Stamm reported on the release of water from the Oroville Dam reservoir. He will keep the Board informed on this matter, Mr. Stamm reported on the two applications presented last week for the diversion of water, The State Reclamation Board has indicated that the portion of the Chico ', Page 223,_ November 30, 1971 = sTovemher 30~ 1911 Landing project in Butte County has been reactivated, The project does meet the requirements for tite flood plain zoningo It was felt that this project should be supported,. The Chairman said the Board should urge the two Senators from California-Butte County area- to suppart this project. Mr. Stamm will draft corresponde~.ice stating that this Soard supports this projecto A telegram will be sent urging the Senators to support the emergency work on the Sacramento River projecto Supervisor McKillop said the County should determine if the River Road is one of the roads that are being considered in this project. Supervisor McKillop asked Mr. Stamm if something could be started now or in the near future to have the major draw down from the Oroville Lake in August rather than September. Mr. Stamm will work on this matter and will report back to the Board. RECESS: 9:45 - The Board recessed to go into an executive session on l~.tigation. RECONVENED: 10:20 71-2177 APPEARANCE: MR, LEROY SMITH, GRIDLEX Mr. Leroy Smith, Gridley,^said he saw a news report where the Fisl~i and Game Commission had killed some wild trout on the North Fork of the B'eather Rivero The poispn and dead fish float down the rivero This news item was on Channel 12 News. The County Administrative Officer was requested to check on this matter with. the Fish & Game and request a report fr~.m them, Matter also referred to Mr. Mercer of the local Fish & Game Commission and Mr. Mickelson will check with Channel 120 Mr. Smith said he understands that the Shifletts are buying acreage out west of Gridley to store rice hulls, He protests the purchase and the issuance of the use permit. Mr. Smith said the land was being purchased from the Cardoza's. Mr,Smith felt that the rice hulls could not be stock piled, This will be discussed when Mr. Lawson is present at this meeting. No action taken at this time, 71-2178 APPEARANCE: MAX KOENIG OROVILLE-ARBITRARY ASSESSMENT PLACED ON PROPERTY Max Koenig, Oroville,'appeared to discuss his request that the Board of Supervisors sit as a Board of Equalization on the "arbitrary" personal property assessment placed on his tax bill by the County Assessor, Mr. Koenig requested that a member pf the Assessor's office be present during this discussion. Mr, Koenig laid he was present at this time to determine the legal steps the Board desires him to take to secure a hearing before the Assessment Appeals Board, He requested that the Assessor's office rectify this error, County Counsel recommended that this matter be referred to him. The Board of Supervisors has no authority over this matter. This is an Assessment Appeals Board matter. Mr. Blackstock said he would review the request before he advises the Board what action should be taken on this matter. Mr. Blackstock will report back next week to this Soard on this request. The report will be in writing, with a copy being forwarded to Mr. Koenig, Dave Vasco, County Assessor, explained how the assessment was placed on the property. Mr, Koenig had not filed his affidavit and the law states that the Assessor can make an estimate of value if the affidavit is not filed. Mr. Koenig said he also wanted to discuss the matter of Veterans Exemptions, He said to his knowledge the Board had not taken action on his ', Page 224. Supervisor Maxon said the County should investigate these matterso 'ore Vasco explained how the Veteran Exemptions are handled. The Assessor audits the accounts of the applicantso Representatives of the Assessor's office go to Sacramento and examine income tax returns of the applicants, The Assessor's office uses every bit o£ information available to them to determine whether the exemption should be allowed, Supervisor McKillop said he would like to see a copy of County Counsel's report on veterans exemptions, Mr, Blackstock will present copies of the report. to the Board members, 71-2179 REPORT ON SALE OF TAK DEEDED PROPERTY BY TAK COLLECTOR D, .Co Swinney, Treasurer and Tax Collector, summarized the sale of various parcels of tax deeded propertya Mro Swinney listed the parcels ~~ 2,. ~ 0 sold and the revenue received for the sales, The parcels were sold over the redemption amount Seto Mr. Swinney said he would like the Board's reconsideration of the policy of placing a $50x00 minimum on parcels of land to be solder Request discussed, No action takeno Mro Swinney reported on the revenue received from the Hotel-Motel tax. ~ p ~.~~The revenue has gone up in the last year, Mr. Swinney also explained the budget transfers for his office. One transfer is for a file cabinet and folders for storage of items concerning bond sales. Mr. Swinney suggested that a file cabinet be included occasionally from the revenue from the bond sales, Discussed; no action taken, 71-2.150 APPROVE INCREASE IN BHI RATES FOR TWO CHILDREN On motion of Supervisor Reynolds, seconded by Supervisor McKillop and unanimously carried, increase in BHI rates for one child (04-40-9395) from $81 to $200 per month and another child (04-40-12712) from $93 to $188 a month was approved as requested by the Welfare Department for children who are mentally ill and extremely difficult to handle. 71-2181 SUPERVISOR MADIGAN SELECTED AS DIRECTOR ON NORTHERN CALIFORNIA SUPERVISORS BOARD OF DIRECTORS . On motion of Supervisor Reynolds, seconded by Supervisor Maxon and unanimously carried, Supervisor Madigan was selected as Director on Northern California Supervisors Board of Directors and a copy of said selection to be sent to the Association prior to the December 9th meeting. The Board members elected to remain on the same committees they served on during the past year, 71-2182 PUBLIC HEARING: SECO ENTERPRIEES, INC. - PROPOSED REZONING FROM "A-R" (AGRICULTURAL RESIDENTIAL) TO "PA-C" (PLANNED AREA-CLUSTER) DISTRICT, LOWER WYANDOTTE ROAD, OROVILLE The public hearing on the proposed rezoning from "A-R" (agricultural residential) to "PA-C" (planned area-cluster) district to allow construction of a 188 unit multiple family complex, on property described as located on the south side of Lower Wyandotte Road, approximately 1/4 mile east of Wyandotte Avenue, identified as AP 34-35-30, Oroville (Seco Enterprises, Inc,) was held as advertised. Jim Lawson, Planning Director, summarized the action of the Planning Commission in this matter. The Planning Commission approved the Page 225. November 30, 1971 November 30, 1971 rezoning. Several residents ,had opposed the rezoning at the Planning Commission hearings. Roads within the rezoning explained. The condition that the development be hooked up to a sewage system was acceptable to the applicant. Hearing opened to the public. Appearing in opposition to the granting of this rezoning: to Mro Frank Clegg, Lower Wyandotte Road, He said the reason that more people were not present to oppose this rezoning was that they could not afford to take the time from work, He opposes the rezoning, but he felt that his feelings would not taunt in this mattex. 20 Mr. .Tames Toney, Greenville Street. He said the people in his area did not want to be rezoned. He was told that this rezoning would not effect the surrounding property owners, merely the property owned by Seca Enterprises, Into Appearing in favor of the rezoning: 1, Mrs, Ernest Albrecht, Yankee Hillo Hearing closed to the public and confined to the Board at this time, Time spent discussing the proposed rezoningo Discussed the condition that the existing road to the side of the development would be extended out to Lower Wyandotte Road, Discussed the extending of Greenville Street, making it a thxough street. Mr. Vasco, one of the developers, stated that Public Works representatives went over this project thoroughly, The mobile home park next to this development has already deeded 30' right of way, It was felt that the exteDSion of this road would be the best choice for the County. The developer has complied with all the other regulations, Mr. Castleberry explained the proposed road in this area, He felt that the County could use the 30' right of way at the edge of the mobile home park. He said he could live with the suggested extension of Greenvile Street. Time spent discussing the roads in the area. Supervisor Gilman said he could not make a decision at this time; he would like to see the site before he makes a decision. He does not feel he has enough information. Hearing continued to Tuesday, December 7, 1971 at 11:00 a.m. 71-2183 PUBLIC HEARING: BUTTE COUNTY PLANNING COMMISSION INITIATED PROPOSED REZONING FROM "A-2" (GENERAL), "A-R" (AGRICULTURAL-RESIDENTIAL), "AR-1" (AGRICULTURAL-RESIDENTIAL), ''R-1" (SINGLE-FAMILY RESIDENTIAL}, "RT-1" . {MINIMUM DENSITY RESIDENTIAL-TRAILER}, and "PAC-C" (PLANNED AREA-CLUSTER) DISTRICTS, TO "S-1" (MINIMUM DENSITY SUBURBAN RESIDENTIAL),"S-2" (MEDIUM DENSITY SUBURBAN RESIDENTIAL} AND "A-3" (AGRICULTURAL} DISTRICTS, WEST CHICO STUDY AREA The public hearing on the Planning Commission initiated proposed rezoning from "A-2" (general), "A-R" (agricultural-residential), "AR-1" (agricultural-residential), '.'R-1" (single-family residential}, "RT-1" (minimum density residential-trailer}, and "PAC-C" (planned area-cluster) districts, to "S-1" (minimum density suburban residential), "S-2" (medium Page 226. November 30, 1971 November 30, 1971 density suburban residential) and "A-3" (agricultural) districts, for that property described as the West Chico Study Area was held as advertised. Mr, Lawson explained the actions of the Planning Commission in this matter. The Planning Commission recommended approval of this rezoning. There was a joint study made with the Chico Planning Commission and it was the recommendation, following the study, that the rezoning should be approved. Mr, Lawson stated that the Vistec and Schultz properties are included within this rezoning. The interim zoning excludes the Vistec and Schultz propertys. The rezoning would not affect the existing uses in the area. ~ ~ 3,o O A letter from the Chico Planning Commission was read and discussed. Hearing opened to the public at this time, Appearing in opposition: 1, Mr, Robert Blade, attorney at law, appearing on behalf of Vistec. It was their feeling that the use permit issued to them exempted them from the zoning. They now learn that they are not exempto They have been working on the conditions placed on the use permit. They tried to be annexed to the City of Chico and hook on to the City sewers, This request was rejected. They applied to the State Water Control Board to put in their own sanitary system. It appears that their application is receiving favorable consideration, They request that Vistec be excluded from this zoning. 2, Mr. Wayne Weddell, architect for Vistec, gave the background of the development, They are proceeding at full speed to comply with the requirements. He stated that Vistec has invested over $125,000 on this project and they would not like to loose it. He said the company would like to receive their building permit before Christmaso 3. Dro Wmo Shultz, Oak Park Aveo, Chico, He requested that he be exempt from this zoning. He said this zoning made no provision for his developmento He has been refused by the City of Chico to be annexed or to be allowed to hook up to their sewer systeme Mr. Lawson explained why Vistec and Dr. Schultz's property had been included within this zoning, Chairman Reynolds said he could see no buffer zoning in this area. 4, Dan Fellecotti, Oroville. He said he was in sympathy with the Vistec property, He said he represents construction and he feels that this is a good project and will give a lot of work to people in the area. 5a Mrs, Ernest Albrecht, Yankee Hill 6. Herb Heidinger, Oroville, He owns property on Dayton Road. He feels that this zoning is unfair; if the County is going to rezone this property they should also rezone the Diamond International property. He does not desire to be included within the zoning. He desires to be in the A-3 zoningo 7. Mr. John Robinson, Dayton Road. He would like to be included Page 227. November 30, 1971 November 30, 1971 in the A-3 zoned He is using his land for A-3 purposes, 8. Mr, Ray Uhl; he owns property close to the city limits of Chico, He objects to the rezoning and desires to be excluded. 9, Mrs, Maxie Swansono She desires to remain in the present zoning district and to be excluded from the S-1 zoninge 10. Mr. Robert C, Knudsen, l.o~c Pine Ave, He lives in a A-2 zone and desires to remain in the same zoning district. He filed a letter requesting that he be excluded from the rezoning. 11. Mrs, Carl Travis, San Jose, She requested that she be included in the A-3 zone. They are planting their property to trees and desire to be ina agricultural zone. 12, Mr. Roy Nystrom, He said he would like to be excluded from the A-3 zone. Appearing in favor of the rezoning: to Mrs. Deva Mer1o, She said she was in favor of the A-3 zoning. 20 Mr, Albert Storme, Sacramento Aveo He commended the Planning Commission for coming up with this zoning, 3. Mrs. Marie Cinquini, Chico, stated she was in favor of this rezoning, She said these people should be taxed as agricultural so that they can continue to farm their land. 4. Mr, Max Hi11, Aak Park Ave., Chico. He opposes multi-dwellings in this area, He does not like the thought of Dr. Shultz' development going in next to his home, 5. Mr, Robert Britton, Chicoo He said he felt the high density developments should be east of the red zoning line. 6, Mr. John Roole, City Hall, Chico. He explained the reasons the City was supporting this. rezoning. He set out the need for the buffer zone. He said there was an adequate supply of housing in Chico; there is an adequate amount of R-3 zoning in the City of Chico, zoning. 7. Mr. Wmo Gannou, Chico. He explained why he favored this 8, Mrso Helen Kinney, 1536 Bidwell Drive. She favors the rezoning, 9. John Stutz, Morehead Ave. He said he represents Mr. Sanchez, also, He feels that the A-3 zone should be approved, 10. Mr. Neil Campbell. Hearing closed at this time and confined to the Board, Supervisor McKillop said there was one item that should be spoken to; that is the matter of the sewage disposal discharge requirements for the Vistec Development and the Schultz apartmentsa This will be discussed Page 228. Chairman Reynolds said he would like to see where the R-3 zones were in the Chico area. He would like to review the matter, This rezoning would be a major decision by the Board. Chairman Reynolds explained his feelings in this matter. He said he would like to have the Planning Director recolor some of the maps to set out the deletions within this rezoning proposal. Supervisor Maxon said the problem of the Vistec development, and the Schultz's property should be considered. Supervisor McKillop said that if the Board was going to send the rezoning back to the Planning Department for the deletions to be set out, then maybe the Board should consider leaving the people out of the rezoning who had appeared at the Planning hearings and requested to be excluded. Supervisor Gilman said he questions whether the County can come up with a plan to zone this whole area, Chairman Reynolds said that a great deal of deliberation was going to have to be given to this rezoning before the Board made their decision. Chairman Reynolds requested that Mr. Lawson could indicate on the maps whether the land was planted, in orchards or not. Hearing continued to Tuesday, Aecember 7, 1971 at 11:00 a,m. RECESS: 1:20 to reconvene at 2:30 p.m. RECO:d-1~F:NE: 2:30 p,m. 71-2184 DISCUSSION: VISTEC DEVELOPMENT & SHULTZ APARTMENTS - HOWARD TOUSSAINT Howard Toussaint, Director of Sanitation, appeared before the Board to d_Cscuss the proposals of Vistec Developments and of Dr. Shultz for sewage disposal discharge requirements for their planned building developments, Both parties have applied to, the Regional Water Quality Control Board--Vistec proposing an aeration unit and Shultz proposing a large septic tank system. Mr. Toussaint stated that Vistec meets all of the requirements except for the formation of a county service area to act as the public agency to handle the sewer system. Recalling previous Board policy, Mr. Blackstock stated that the Board requirement for a community sewer system expressly precludes septic tanks as a means of disposing of sewage. Consequently, the system as proposed by Dr. Shultz does not meet Board requirements. Mr. Blackstock explained the method of forming a county service area to representatives of Vistec Developments, Dr. Shultz spoka to the Board regarding the community sewer system and means by which he could meet requirements for said system. 71-2185 PUBLIC HEARING: PROPOSED ORDINANCE AMENDING CHAPTER 10, BUTTE COUNTY CODE Mr. Lawson, Director of Planning, advised the Board of the import of this proposed ordinance. Hearing opened to the '.public: No appearances. Ida Road (1291 Mt. Ida Road), west of Wyandotte Miner's Ranch Road and east of La Mirada, Oroville. Subject to the following conditions: 1. That the 45-foot right-of-way be extended to the north property line. 2, Extend the 60-foot right-of-way to Parcel 2, 3o That the final map bear the following statement: "No further division of these parcels shall be made until sixty feet of•access is provided to Mt. Ida Road," 4. Indicate a 50-foot: building setback line, measured from the center- line of each access, 5o Prove availability of treated water, either by the Oroville- Wyandotte Irrigation District or a well, to the satisfaction of the Health Department, 71-2189 DISCUSSION: PROPOSED ROUTES FOR PACIFIC GAS & ELECTRIC TRANSMISSION LINES Representatives from Pacific Gas & Electric Company were present along with Mr. Lawson to discuss with the Board two proposed routes for transmission linese Discussion followed, with Supervisor Maxon proposing a public hearing to apprise the landowners concerned of this project before it is implemented. Supervisor McKillop moved to endorse the Planning Commission's recom- mendation and invite comments, from the people in the area affected by the Page 230, November 30, 1971 November 30s 1971_ _ transmission lines, holding a public hearing if public interest so dictates. Supervisor McKillop withdrew his motion and this matter is placed on the agenda for December 7, 1971, for decision. If public interest warrants it, this matter will be scheduled for a public hearing; in the alternative, action will be taken on December 7, 1971. 71-2190 REPORT OF EAST AVENUE REZONING Last week County Counsel was instructed to talk to owners adjacent to the Macdonald property in'Chico to see if the County could obtain a 60- foot right-of-way to act as a buffer to the MacDonald property. Discussion today regarding the possibility of fencing as a solution to the problem, and also maintaining the original concept of an "R-4" zoning. Mr. Lawson and County Counsel are to report back to the Board on this matter next week. 71-2191 APPROVE CONTRACT BETWEEN FROC AND BUTTE COUNTY FOR PSYCHIATRIC REHABILITATION SERVICES On the motion of Chairman Reynolds, seconded by Supervisor Gilman, and unanimously carried, the 'contract between Feather River Opportunity Center and the County for the supplying of psychiatric rehabilitation services was approved and the Chairman was authorized to sign. 71-2192 APPROVE SATISFACTIONS OF MORTGAGE On the motion of Supervisor McKillop, seconded by Supervisor Maxon, and unanimously carried, the following Satisfactions of Mortgage were approved: 1. Robin V. Hershey far care received at Butte County Hospital in the amount of $458.00; paid in full November 24, 1971, 2. James E, Schindler for care received at Butte County Hospital in the amount of $1,229.63; paid in full October 21, 1971, 3. Annie Machler for care of Henry Machler received at the Butte County Hospital in the amount of $969.30; paid in full November 24, 1971. 71-2193 AUTHORIZE ADDITIONAI; CALCULATOR FOR ADMINISTRATIVE OFFICE Funds are in the budget for the purchase of a calculator in the Pur- chasing budget and a calculator in the Personnel budget. Funds total $1,400. Location -Carmel; Number of nights' lodging - two; estimated cost - $103; travel by private cax. 24 Jim Johanssen and Winston Barlow to travel to San Francisco to check the books of the wood-cutting businessa 71-2196 APPROVE BUDGET TRANSFERS On the motion of Chairman Reynolds, seconded by Supervisor Gilman, and unanimously carried, the following budget transfers were approved: B-7 Biggs Justice Court transferring $200 from professional and special services and $100 from jury and witness expense to office expense. B-10 Treasurer transferring $3,693 from reserve for contingencies to Treasurer's budget. 71-2197 APPROVE ANNUAL MERIT INCREASE FOR LAWRENCE 3. LAWSON, DIRECTOR OF PLANNING On the motion of Supervisor Madigan, seconded by Supervisor McKillop, and carried, the annual merit increase for Lawrence J. Lawson was approved, thus making a change from R 28,5, Step C to R 28,5, Step D. 71-2198 DISCUSSION: TAX REFORM AND LOCAL EXPENDITURE CONTROL Supervisors discussed various amendments to the tax reform program, and Supervisor Maxon moved to endoxse the suggestion of the Sacramento County Board of Supervisors and endorse the concept of expenditure control at the local level as proposed by the Governor of California. Supervisor Gilman seconded the motion and subsequently withdrew said second, Motion died for lack of a second.
