Pledge of allegiance to the Flag of the United States of America. 74-1735 APPROVAL OF MINUTES On motion of Supervisor Cameron, seconded by Supervisor Ladd and carried, the minutes of November 13th and 19th, 1974 were approved as mailed. 74-1736 SUPERVISOR GILMAN E%CUSED On motion of Supervisor Ladd, seconded by Supervisor Cameron and carried, Supervisor Gilman was excused from today's meeting to attend another meeting. 74-1737 COMMUNICATIONS Petition signed by 34 residents is filed protesting alleged conditions fJ 3 ,V d surrounding operation of Continental Nut Plant. Discussed; no action taken. Communications supporting the Chico Work Training Center application for revenue funds have been received from the following: Carl W. Dietz, president, Longfellow Lumber Co., Inc.; Adelle Rowland, Jaann Hayes, and W. W. Dagler of the United California Bank in Chico.- Discussed; Administrative Officer to answer Mr. Dietz`s letter and explain situation. Gloria Ballinger. Protest is filed to Planning Commission decision on ~~ 3,p n November 14, 1974 regarding Environmental Impact Report. Appeal is filed to Planning Commission decision to deny revocation or modification of the Mathews Readymix Inc. use permit at their number two plant in Oroville. Discussed; referred to County Counsel for report later in the meeting. Ernest H. Campbell, Chico. Mr. Campbell writes regarding the Board's action on the alleged misuse of Lindo Channel. County Counsel stated that CARD is going ahead on this matter. Placed back on agenda for Dec. 30, 1974. Judy Edwards, Paradise. Petition for variance to provisions of Sections 19-10 and/or 19-12 of the Butte County Code is filed. Fee has been paid ~~ ~ •~ ~ and Health Department has approved. Set for hearing on December 17, 1974 at 2:00 p.m. Pacific Gas and Electric Company. A claim had previously been filed by the Company for damage to electric and gas facilities due to widening of Skyway. Claim was filed with the Director of Public Works. They now correct filing by filing with the Board of Supervisors. See motion following communications. Butte County Coordinating Council on Mental Retardation and Developmental disabilities. The Council files request for theBoard to make an allocation not to exceed $256 per year to cover travel expenses of three representatives from Butte County between Chico and Redding for meetings. The District files request that the County levy and collect Che maintenance taxes for the District on land lying within Che County, commencing with the 1975/1971 fiscal year pursuant to the Water Code. The DistricC requesCs the Board to consider abandonmenC of a portion of Che Skyway which will no longer be required as a public driveway after the realignment. Butte County Superintendent of Schools. Mr. Evans sends notification of proceeding toward construction of a new facility for education of trainable-mentally retarded children. Chairman Madigan would like Mr. Evans present to discuss matter; placed on agenda for December 10th. Department of Real Estate. The Commissioner files copy of decision in the matter of Irvin D. 5chlaf and others. Mr. Blackstock explained the decision. Copies to be made for Board members. Auditor-Controller. Congressman Johnson. Mr. Johxuson writes regarding communities in flood hazard areas and the opportunity to enroll in the National Flood Insurance Program. See motion following communications. 74-1738 BOARD MEETING TO BE HELD MONDAY DECEMBER 30..RATFtE~ 'THAN.,: DECEMBER 31st. It was moved by Supervisor Cameron, seconded by Supervisor Ladd and carried, that the Board meeting for the week of December 29th, would be held on Monday, December 3Oth, rather than on Tuesday, December 31st, the regular Board meeting day, and that there would be no Board meeting on Tuesday, December 24, 1974. 74-1739 REJECT CLAIM OF PACIFIC GAS & ELECTRIC COMPANY On motion of Supervisor Ladd, seconded by Supervisor Cameron and carried, the claim of Pacific Gas and Electric Company for damage to electric and gas facilities due to widening of Skyway in the estimated amount of $100,000 was rejected and the claim was referred to the County's insurance carrier, the County insurance contractor and to all others interested in said claim. 74-1740 COUNTY TO PROVIDE A COUNTY CAR FOR MEMBERS OF BUTTE COUNTY COORDINATING COUNCIL ON MENTAL RETARDATION AND DEVELOPMENTAL DISABILITIES. The travel request for three representatives from Butte County to travel between Chico and Redding for meetings discussed. It was stated that this had been discussed at budget time and turned down. Supervisor Cameron felt that this Council did give a lot of service and that maybe the County should allow them the use of a pool car to take to these meetings. Suggestion discussed. On motion of Supervisor McKillop, seconded by Supervisor Cameron and carried, providing of a county pool car, ~ a pilot basis, was authorized for the halance of the fiscal year for members of Butte County Coordinating Council on Mental Retardation and Developmental Disabilities. AYES: Supervisors Cameron, McKillop and Chairman Madigan NOES: Supervisor Ladd ABSENT: Supervisor Gilman 74-1741 PUBLIC WORKS DIRECTOR TO ADVISE PARADISE IRRIGATION DISTRICT THAT COUNTY WILL HOLD PUBLIC HEARING AT TIME IT IS NECESSARY TO ABANDON PORTION OF SKYWAY Clay Castleberry, Director of Public Works, reported on the request of Paradise Irrigation District for the abandonment of a portion of the Skyway which will no longer be required as a public driveway after the realignment. He stated that this is the portion of the Skyway immediately westerly of the Magalia Dam. Mr. Castleberry will inform them that when the County gets to this area, a public hearing will be held. On motion of Supervisor McKillop, seconded by Supervisor Cameron and carried, Clay Castleberry, Director of Public Works, was authorized to advise the Paradise Irrigation District that the County will hold a public hearing concerning the abandonment of a portion of the Skyway at the time it is necessary. 74-1742 REFER TO COUNTY COUNSEL AUBIT REPORT OF OROVILLE CEMETERY DISTRICT On motion of Supervisor McKillop, seconded by Supervisor Ladd and carried, the Oroville Cemetery District audit report was referred to County Counsel, for study and a report back to:.a6e Board. December 3, 1974 _ _ _ _ _ _ _ _ _ _ _ _ _ _ Iecember=33 1914= _ _ _ _ _ _ _ _ _ _ _ _ _ ,- CHAIRMAN MADIGAN WELCOMED THE STUDENTS OF THE 7th & 8th GRABE CLASSES FROM THE PARADISE CHRISTIAN SCEl00L AT THIS TIME 74-1743 SUPERVISOR CAMERON AUTHORIZED TO ATTEND MEETING IN SACRAMENTO CONCERNING DISTRI$UTION OF FOOD STAMPS Supervisor Cameron reported on the re-negotiat~onsfor the contract with the U.S. Postal Service on food stamps. He said he was able to set up a meeting to be held in Sacramento on December Ilth. The other counties contracting with the Post 0€f ice should be notified of the meeting and they should have representatives at this meeting. A letter will be sent to Assemblyman Chappie and Assemblywoman Davis to tell them that the County will have representatives at the meeting and to state the County hopes that they will be present. On motion of Supervisor McKillop, seconded by Supervisor Ladd and carried, Supervisor Cameron was authorized to be at the meeting to represent this Board, together with Mr. Cris~n or some one from the Welfare Department, a t the meeting to be held in Sacramento concerning the contract with the Post Offices for the distribution of food stamps, and that the other 'aunties involved be requested to have representation at this meeting; that the County's representatives in Sacramento be notified of said meeting with the request that they attend the meeting. 74-1744 AUTHORIZE IMPOUNDING OF ALL MONEY COLLECTED BY TREASURER FOR RECLAMATION DISTRICT 2106 It was moved by Supervisor McKillop, seconded by Supervisor Ladd and carried that all money collected by the County Treasurer for Reclamation District 2106 be impounded and that the matter be referred to County Counsel for further instruction as to whether the County has the right to impound the money, said opinion to be in wrfting. DAVID WILSON On motion of Supervisor McKillop, seconded by Supervisor Cameron and carried, the following action was taken: 1. Approved the Chico Neighborhood Health Center contract amendment, to include the new figure of $15,500, which represents an increase of $7,000 for calendar year budget 1974. 2. Approved the contract between Head Start and Dr. David Wilson to conduct a two day bi-lingual psychological workshop for Head Start; contract t.tals $200. RECESS: 10:00 RECON`9ENED: 10:10 74-1746 AUTHORIZE THE RETAINING OF TOM FOX, ARCnITECT, FOR REMODELING OF THE EXTENDED GARE; ~ FACILITY Tom Fox, architect, has been contacted concerning the remodel of the ECF for purposes of a detoxification center and offices for the Health Services Agency. He is ready to proceed on this project based on an hourly rate until such time as state acceptance can be guaranteed. At that point he would work at 10% £ee of the projected cost of the project. TheBoard members were given copies of Mr. Fox's comments concerning his proposal. Page 421. There were some questions concerning the hallway. A firewall could be put in and the restroems could be saved. Supervisor Ladd stated that the committee would be in on the preliminary planning stages. Remodeling discussed. Supervisor McKillop asked if the Board retained Mr. Fox, how soon could the Board have the plans and specs. Mr. Fox said it should be about three monthso Supervisor McKillop said it was an open-end contract; suppose the remodeling does not receive approval. Mr. Fox said he did not see any real problem. Supervisor McKillop said he would want to limit the time for the $25.00 per hour work. Mr. Fox stated that this time comes out of the total fee. Fees and contract discussed. It was felt that theCounty needs the detox center. Mr. Fox had a letter from Mr. Tandy that sets out the guidelines required by the State. Supervisor McKillop felt the matter should be referred to Public Works, Br. Enloe spoke on the plans for the detox center. He referred to the resolution from Orange County. He did not feel that the regulations would be a problem. More information could be acquired from the State. Mr. Castleberry suggested that the Board could authorize Mr. Fox to make the changes in the schematic plans under his direction. Suggestion discussed. On motion of Supervisor McKillop, seconded by Supervisor Cameron and carried, the Board authorized the retaining of Mr. Fox as architect for the remodeling of the Extended Care Facility, at the 10% figure, to prepare the plans and specifications, under the direction of the County Department of Public Works and with the concurrence of the committee in the matter. 74-1747 TEMPORARILY POSTPONE SECOND READING OF SALARY ORDINANCE The second reading of the salary ordinance amendment that would establish positions for Welfare food stamp issuance discussed. Reading of said ordinance put over temporarily. 74-1748 AWARD BID FOR TYPEWRITERS Six bids were received f©r the typewriters budgeted in the current year and low bid was by Patty Typewriter Shop of Chico. Their bid meets specifications. Tom .Struthers stated that the Treasurer would like an electric typewriter; the Sheriff's department would like to have a 13" manual typewriter. Guy Hart had bid the best bid for the 13" typewriter. Bids discussed. On motion of Supervisor McKillop, seconded by Supervisor Cameron and carried, the bid of Patty Typewriter Shop of Chico was accepted, in the amount of $6,761.96, with the addition-of an electric typewriter for the County Treasurer-'-s._Office and with the .purchase of a 13" manual typewriter for the Sheriff's Department from Guy Hart. 74-1749 DEFER ACTION QI~ THE MIDI CAL INDIGENT POLICY The result of several conferences with the hospital administrators of the private hospitals in the county have resulted in the proposal for changes to present policy, particularly with regard to illegal aliens and out-of-state transients. Mr. Nickelson explained this item. Hia office is in agreement with the hospitals, with one exception. Because Chico has become a medical center in this valley, the Board should not have to take over the costs for aliens from other counties. Page 422. - December 3, 1974 DecemberT3~ 1974_ _ It was felt that this matter should be put over for further study so that the matter could be looked at more thoroughly. Some of the other counties have no provisions for taking care of these aliens. Supervisor McKillop said he would like to see this Board make a recommendation to the State Legislature for a plan to take care of these aliens. Policy discussed. Supervisor McKillop said he wauld still rather study the matter more; he feels this is a state problem. On motion of Supervisor Ladd, seconded by Supervisor McKillop and carried, the medical indigent policy was deferred at this time, so that the County could continue to work on the matter. 74-1750 ACTION ON SURPLUS FIRE ENGINES APPROVED One surplus engine Eras been transferred to the Cohasset Volunteer Fire Company for use under an agreement where the county maintains ownership, but the Company maintains the equipment. The Department has another surplus engine available and wishes to make this one available to the Clipper Mills Volunteer Fire Company. It is requested that theBoard authorize transfer of the surplus engine to theClipper Mills Company with the county to maintain ownership, and that insurance coverage on both vehicles be included with the county's blanket automobile insurance policy. Increased cost to the county on the Cohasset machine would be approximately $40 annually, but would be a net savings to the Volunteer Company of $190 annually. No increase in cost for the Clipper Mills engine. Matter discussed. On motion of Supervisor McKillop, seconded by Supervisor Ladd and carried, the Board approved the following: (a) to maintain the engine used by the Cohasset Company in county's ownership and include in county's blanket automobile insurance policy. (b) Maintain the surplus unit now available in county's ownership and transfer to the Clipper Mills Volunteer Fire Company and include vehicle on county's biankeC automobile policy. 74-1751 APPROVE ALTERNATIVE N0. 6 ON HOUSE NUMBERING STUDY Butte County Association of Governments forwards its recommendation of Alternative No. 6 to the Board on establishing a countywide addressing system. This recommendation has full concurrence from theCities of Biggs, Gridley, Oroville and Chico. The team doing the study will come up w_th the plan for the implementation. They will also come up with a list for name changes. Mr. Castleberry explained how this matter will be handled. This will be before the Association of Governments first and then will be sent back to the Board. On motion of Supervisor Cameron, seconded by Supervisor McKillop and carried, Alternative No. 6 was approved as the system to be incorporated in the study being conducted by Chico State University. 74-1752 COUNTY SERVICE AREA N0. 26 SEWER PROJECT: ADOPT MOTION OF CONCURRENCE WITH DECISION OF THEItMALITO IRRIGATION DISTRICT & AUTHORIZE CHAIRMAN TO EXECUTE NONDISCRIMINATION AGREEMENT & EQUAL OPPORTUNITY AGREEMENT The Thermalito Irrigation District has received 17 bids £or phase one of the County Service Area No. 26 sewer project. Their Board of Directors adopted a resolution of intention to award bid, and they request concurrence from the Board of Supervisors. It is also requested that the Board of Supervisors join in execution of the required nondiscrimination agreement and equal opportunity agreement. Action should be subject to the bonds being sold and the funds being placed in the County Treasurers Office. On motion of Supervisor McKillop, seconded by Supervisor Ladd and carried, the following action was taken, pursuant to County Counsels approval and recommendation: 1. Adopted motion of concurrence with the decision of the Thermalito Irrigation District Board in awarding the bid to Manual G. Rodrigues in the amount of $952,945.50. ~. Authorized the Chairman to execute the nondiscrimination agreement and equal opportunity agreement required by the Farmers Home Administration. 74-1753 DISCUSSION: DEFERRED COMPENSATION PROPOSAL. Discussion o€ a deferred compensation proposal was held at the recent Management Council meeting and is presented to the Board for consideration. Mr. Sullivan and Mr. Brazell were present to explain the plans. The Management Council felt that they would like a deferred income plan. They would like to make the recommendation that the plan be made available to all of the County employees. Proposal discussed. This would not be an exclusive proposal. There is an administrative cost in this matter. The Auditor would be authorized to make the deductinns from the employees salaries. The only cost to the County would be for the time taken to make the deductions. Su~rvisor McKillop said that as long as the company knows that they will not have an exclusive on this, he would go along with it. The business with the employees should be done after working hours. Supervisor Cameron said he would not be ready to issue a letter of authorization today. He would like to look at it more closely. Supervisor Ladd said that maybe the employees could handle this in the Association publication. Jim Rackerby, Personnel Director, said he would like to meet and confer with the employees. He will let the Board know when they want this back on the agenda. 74-1754 BUDGET TRANSFERS APPROVED On motion of Supervisor Cameron, seconded by Supervisor Ladd and carried, the following budget transfers were approved: B-Q40 Chico Municipal Court - $150 from office expense to equipment maintenance B-041 County Counsel - $25 from office expense to memberships B-043 Welfare - $7,092.80 from general relief budget professional and specialized services account to the welfare adminis- tration budget professional and specialized services account. This is to transfer all unencumbered appropriations from the general relief budget to welfare administration to reflect change of responsible department and is a budgetary adjustment only. 8-044 Paradise Constable - $316 from other transportation and travel to office expense 8-045 Superintendent of Schools - $357 from office supplies to equipment maintenance 8-046 Building and Subdivision - This sets up $1,200 in the overtime .account and it comes from unanticipated revenues within building subdivision fund Page 424. This is actually re-establishing the appropriation for the balance of the state grant received Last year as the unused protion was not reserved as a prior year appropriation. 74-1755 DISCUSSION: REPRESENTATIVE OF THE STATE DEPARTMENT OF PARKS AND RECREATION SPOKE CONCERNING THE PROPOSED TRANSFER OF 181 ACRES IN THE BIDWELL RIVER PARK A representative of the State Department of Parks and Recreation, Lon E. Spharler, spoke concerning the proposed transfer of 181 acres in the Bidwell River Park. This would be for a unit of the State Park System. This property was originally given to the State by the Bidwell family; the state transferred it to the County in 1915 and the County has been leasing a portion of the property to the Chico Park and Recreation District. The State has taken a slightly different view of the Sacramento River now; they feel that maybe they should provide a series of parks along the Sacramento River so peopae could land for overnight stays or picnics. Fishermen could use these parks for their activities. Supervisor McKillop asked how the Chico Recreation and Park District felt about the matter. He was told that they are on record as endorsing the proposal. Chairman Madigan asked if the County could reserve the mineral rights. Mr. Spharler said he did not see any real problem with this idea. Mr. Castleberry reported on the areas that the County use for obtaining gravel. The property to be taken over by the State would be that property along the Sacramento River. A proposal will be written up in this matter. The County could reserve a right to the aggragate and bank protection for the people in Che area. Dale Wilson, State Engineer, answered questions about the County roads. The eastern boundary of the property is the County road. If erosion should occur, the Corp would have to take care of it. It was moved by Supervisor McKillop, seconded by Supervisor Cameron and carried, that it is the intent of this Board to negotiate with the State for the land acquisition of the property for the State, in conjunction with County Counsel working up a proposal with Public Works and George Stamm for the retaining of the aggragate and mineral rights. 74-1756 DR. ENLOE REPORTS: MORATORIAM ON IMPLEMENTATION OF REGULATIONS FOR COMMUNITY CARE FACILITIES & FUNDING APPLICATION FOR FAMILY PLANNING PROJECT Dr. Enloe reported on the moratoriam on implementation of regulations for community care facilities. The resolution from Orange County has already been approved; it requests the State not to implement the regulations for another year. Discussed; no action taken. Federal funding for the p'amilyePlanning Project remains at Che $70,000 level although administrative jurisdiction has been transferred from HEW to the State Department of Health. Application has been reviewed and approved by Counsel and budgetary and fiscal approval will be contingent upon budget appropriation being set up. On motion of Superviso McKillop, seconded by Supervisor Cameron and carried, Family Planning Project and application for funding was approved. Page 425. December 3, 1974 _ _ _ _ _ _ _ _ _ _ _ _ _ _ I2egember=3~ ].9~4= _ _ _ _ _ _ _ _ _ _ _ _ _ _ 74-1757 DISCUSSION OF THE USE OF RAW DITCH WATER FOR DOMESTIC PURPOSES FOR INDIVIDUAL RESIDENCES Howard Toussaint, County Sanitarian, explained the use of raw ditch water for domestic purposes for individual residences. The property in question has been requested to be annexed to the Oroville-Wgandotte Irrigation District. LAFCO has recommended that these annexation be denied. It is contended that raw ditch water is not a pure source of water. He has discussed this with other counties. The Water Quality Control Board is requiring that before construction is commenced, the developer must list the source of water, Treatment facilities could be used by the developer. Jim Glander, County Building Department, said that this is something that the County staff has not been complying with the State regulations concerning the water problem. Supervisor Ladd explained what has been stated~at_the LAFCO meetings. It is felt that if the County is going to regulate the type water to be used, then a permit should have to be required. Supervisor Ladd said he does not thintc it is in the best interest of the County to oppose use of ditch water if 'they have a treatment facility. They should utilize the water that is available. It was moved by Supervisor Ladd, seconded by Supervisor McKillop and carried, that the application for a @ermit to build must contain a statement of source of water; it will be required that they have potable water; that ditch water will require a treatment facility and that this requirement be dovetailed into the new requirements. 74-1758 PROGRESS REPORT ON WELL ORDINANCE AND DISCUSSION OF REQUEST OF THE WATER QUALITY CONTROL BOARD TO INCLUDE REGULATIONS COVERING DRY WELLS USED FOR STORM DRAINAGE Howard Toussaint gave a progress report on the well ordinance. They have met with the well drillers and the majority of the drillers were in agreement with the County. Use of dry wells set out. The Water Quality Control Board has requested that a regulation be placed on the storm drainage wells; there are some problems that could be created by these wells. Clay Castleberry, Director of Public Works, set out his thinking, in the matter. He explained the incident of pollution of water in this matter. He said that maybe direction should be given to come up with standards for the regulation of these wells. George Stamm does not think these dry wells work properly. The amount of drainage that they do does not outweigh the problems they create. Ile would recommend that. they be prohibited except in the cases where it could be guaranteed that no contamination exists. Until that type proof is available, they should not be allowed. Wells discussed; no action taken at this time. RECESS: 12:05 RECONVENED: 1:30 74-1759 DISCUSSION OF ALLOCATIONS TO CHAMBERS OF COMMERCE: APPROVE CONTRACTS Bob Nicholson, Economic Development Commission Director, was present to discuss the allocations to Chambers of Commerce. Amounts set out Page 426. December 3, 1474 Aecember 3, 1974 in the budget discussed. It was stated that amounts to be allocated to the Chambers would be discussed later, but the budget was approved with the amounts as recommended. Supervisor McKillop felt the Board should ratify their action taken at budget time. Allocations the Chambers discussed. Appearing to discuss the allocations to the Chambers: 1. Raymond R. Richter, representing the Paradise Chamber of Commerce. They feel that there is a discrepancy in the dispursements of the funds. Board reconsideration is being requested; he explained their request. Supervisor McKillop stated that the County has an Economic Development Commission; it would be best if this request was presented by Che Director of the Economic Development Commission. He would like to see this whole tl ng discussed and a solution set out. The Board interested in the development of the entire County. Request discussed; no action taken.' It was moved by Supervisor McKillop, seconded by Supervisor Ladd and carried, that the Board approve the allocation of the funds set out in the contracts with the Chambers of Commerce of the County, as delineated in the Budget; approve the various contracts and authorized the Chairman to sign. Supervisor Cameron said Chat as far as spending so much money to go to fairs and shows, he would rather give the money to the Econom~e Development Commission to go out and bring in industry to make more jobs for the people in the County. He stated that these people have been working with the Planning Commission and they are studying the area for permanent zoning. Supervisor Ladd said he sees no reason to interim zone the area. Mr. Bill Hansell, Skyline Blvd., present to discuss the matter. He said the people in the area have been meeting to discuss and study the matter of zoning in their area. He set out the background of the situation; he requested that they be allowed to have an interim zone for a short period of time. Supervisor Cameron stated that it appears to him that this group is doing what the Board tells other groups to do; they should be commended for getting the ball rolling. Time spent discussing the request. Supervisor McKillop said he would not recommend anything if Supervisor Ladd plans to vote "No" on it. Dave Rush appeared as representative for the City of Chico. He reported on the sites selected by the City. Their No. 1 recommendation is a site on Vallombrosa, just east of the main post office building. Other sites set out and discussed. Chairman Madigan said the owner has been contacted and he is willing to sell providing they can keep a 60' right of way. The right of way would be east of the post office and west of the location that would be needed. Two acres would be needed for the building site. Site discussed. December 3, 1974 Dece,.iber 3,_1974 and carried that it was the intent of this Board to purchase the property on Vallombrosa Avenue for the City of Chico-County library site, subject to approval by County Counsel, and approval was given to the securing of an appraisal of the property. 74-1764 CONTINUATION OF DISCUSSION ON WELL ORDINANCE Continu<.tion of discussion of well ordinance and discussion of request of the Water Quality Control Board to include regulations covering dry wells used for storm drainage. Supervisor Ladd felt there should be a policy for the installing of dry wells when it is feasible to solve a problem area. He suggested that it might be possible to install dry wells when the flooding problem would be temporary. Mr. Toussaint asked if the Board would like them to spell this out as an addition to the well ordinance and bring it back to the Board. This seems to be a problem peculiar to the Chico area. Matter discussed. Supervisor Ladd asked if the wells could be built so that a cap could be placed on them. Mr. Toussaint will re-study the matter and will bring back something that the Board could study. He will come up with something that the Board could say "Aye" or "Nay" to; he will inform the Water Quality Control Board that the County is studying the matter. 74-1765 DISCUSSION OF AMENDMENT TO SEWAGE DISPOSAL ORDINANCE TO MAKE CERTAIN RE UIREMENTS IN THIS ORDINANCE CONDORM WITH SUBDIVISION ORDINANCE RE UIREMENTS Howard Toussaint explained the amendment to sewage disposal ordinance to make certain requirements in the ordinance conform with subdivision ordinance requirements. He said they tried to write this up in such a way that it would not be a hard-:hip on those parcels that were created prior to the ordinance. Supervisor Ladd questioned Mr. Toussaint about the amendment. He said that No. 2 says~~that parcels created prior to this amendmentthat lesser distances may be permitted by the Health Officer. He suggested that the "may" be changed to "shall". County Counsel will put this amendment into legal language and return it to the Board for their consideration. On motion of Supervisor McKillop, seconded by Supervisor Cameron and carried, Howard Toussaint was authorized to prepare the draft of the ordinance amendment and take to County Counsel for his study. 74-1766 DIS4U~SION OF REPEAL OF AMENDMENT OF ORDINANCE N0. 929 RELATING TO MOBILE HOME OCCUPANCY PERMITS Discussion of repeal of amendment of Ordinance No. 929 relating to mobile home occupancy permits discussed. Mr. Toussaint felt that this ordinance is inadequate. A permit should not be needed to occupy mobile homes. Mr. Toussaint explained the purpose of the requested amendment repeal. They would like permission to go to County Counsel and have this modified. Mr. Toussaint was authorized to meet with County Counsel to work up an amendment in this matter. Supervisor McKillop brought up the matter of an area where trailers are permitted. There have been people move in on elaborate septic systems. Mr. Toussaint said there are.: many people that are breaking the law. Citation procedure discussed, County Counsel could get together with the zoning inspector on these violations and issue a citation. On motion of Supervisor McKillop, seconded by Supervisor Ladd and carried, the first reading of the ordinance to allow reassessment for damages resulting from a calam`v was waived. 74-1778 REPORT ON CONFERENCE WITH WATER RESOURCES DEPARTMENT PERSONNEL: COUNTY COUNSEL TO REQUEST AMENDMENT FOR THE YEAR 1975 TO LOWER THE AMOUNT TO 800 FT. Dan Blackstock, County Counsel, stated he had sent the Board members a report on the conference with the Water Resources Department personnel. They feel that there should be a Formal request by the Supervisors to change Schedule A of the water contract. At this time, they are asking authorization for the Chairman to sign a letter that Table A be lowered to 800 acre feet; this is over the sales to the California Water District. Mr. Blackstock said he was requesting that the Board approve the request for an amendment to the Water contract to lower the acre feet set out in Table A to 800 acre feet, for a one year period of time. Amendment discussed. George Stamm explained the request for the amendment. Bill Lawrence said they were requesting direction from the Board. Mr. Lawrence said that all the counties have not signed the amendment. There are 17 counties that have agreed to the amendment. Mr. Lawrence feels that the County should only R;y for the 800 acre feet. Mr, Madigan asked if it would do any good to talk to Mr. Fairbanks. Surplus water discussed. Mr. Lawrence said the County could commit a portion of their entitlement. This matter should really be studied and a recommendation should be made to the Board. Mr. Blackstock said they would be hearing from the State regarding this matter and he would report back to the Board. Harry Hansen Page 436. _ _ _ _____ _ _ _ _ _ _ ____December 3,=1974= _ _ _ _ -~--_ __ _ _ _ _ _ - 74-1781 DISCUSSION: IMPOUNDING OF MONEY BY COUNTY TREASURER FOR RECLAMATION DISTRICT 2106 Chairman Madigan stated he would like to go back to the discussion of the impoundment of fu:Kls of Reclamation District 2106 by the County Treasurer. Mr. Blackstock explained the matter of the impounding of the funds. This matter had been referred to the State Controllers Office. They stated that they were no going Co give us an opinion about the matter. Mr Blackstock then talked to the County Counsel of Glenn County. They agreed at that time that they would hold out there, also, but he does not know what they have done since this discussion. Mr Blackstock contacted the Attorney General`s office; he fedls he will get a prompt answer from that office. He will discuss the matter Friday when the deputy attorney general will be here in Oroville. The question that came up this morning is a different question. It is whether or not, which relates to impounding of ?unds, would relate to this type fund. It is different than the legality of the assessments. It should be kept clear that the County would not be losaing any money on this. Chairman Madigan questioned Mr. Blackstock about Attorney General's opinions. Mr. Blackstock said that as a general rule, he is not limited in the requesting of the Attorney General opinions. Discussed; no action taken. 74-1782 REAPPOINTMENT-DAVE HOSTETLER TO THE DURHAM '40SQUITO ABATEMENT DISTRICT PUT OVER ONE WEEK The reappointment of Dave Hostetler to the Durham Mosquito Abatement District was put over one week in order that Supervisor Gilman could be present. 74-_1783 APPROVE APPOINTMENTS TO BUTTE COUNTY MOSQUITO ABATEMENT DISTRICT On motion of Supervisor Ladd, seconded by Supervisor McKillop and carried, the following action was taken: 1. Art Smith was appointed to fill Lawrence Stevens place... on the Board , with a letter of appreciation being sent to Lawrence Stevens, for his ser'trices to the County. 2. R. A. Boyd was re-appointed as a member of the District Board. 74-17$4 APPROVE APPOINTMENTS TO BUTTE COUNTY FAIR BOARD ~~ On motion of Supervisor Ladd, seconded by Supervisor McKillop and carried, R. A. Cassady and Herbert McClanahan were re-appointed members of the Butte County Fair Board, £or three year terms, commencing January 1, 1975. Supervisor Cameron requested a copy of the Resolution of when this Fair Board was formed; he set out the matter of appointments. He stated that Mr. Duborg does not live in the fifth District. Mr. Nickelson said he would check the matter of appointments out and will report back next week. 74-1785 MATTERS PRESENTED BY BOARD MEMBERS Supervisor Ladd said he had several items for discussion: 1. The County has acquired the parcel of ground adjacent to the Gridley Court building. It was the intent of the Board that they would re-locate some of the people Lb the existing structure as space is needed. He would like Administrative Office to be instructed to work towards this. Mr. Nickelson will commence operations to have the people in the Ag Department, Assessor's Office and the Health Department moved to the new structure. Page 437. December 3, 1974 _______________December 3,=1974=====_______-__ Z.. Overtime. Supervisor Ladd said there are a few of the depa::tments using overtime that is quite alarming. He would like to have the Board members look at this overtime. If they agree with Supervisor Ladd, then something should be done about the overtime. Mr. Mickelson said he has not been able to follow up on the overtime usage. He will have the PEP analyist look into this matter. Discussed. Supervisor Ladd felt that if the overtime was going to be a trend, he would rather hire another person to handle the work done on overtime. No action taken. Supervisor Cameron stated that the Paradise Library Committee had met; they have the first floor plan for the building. They will meet again when they have the first full blown plans ready for inspection. 74-1786 BUILDING DEPARTMENT TO BE NOTIFIED THAT PARCEL MAP NOT REQUIRED ON AD30INING PARCELS Supervisor Cameron said there is a problem about propexty that he has been contacted about. There is property that people having been purchasing over a period time; each parcel has separate parcel numbers even though they are adjacent. These people would like to Seel the lots and they were told that they would have to have parcel maps. He explained tae problem. He asked if the County should adopt an ordinance. as E1 Dorado County did, that if the parcels harts been assigned separate parcel numbers, as of March 2, 1972, do they have to file a parcel map. Matter discussed. This would be only contiguous property. It was felt that if the land was contiguous that a map would not be required if the owner were to sell one of the parcels. The Building Department will be notified that a parcel map would noC be required on adjacent parcels that are to be sold and County Counsel was requested to prepare an =amendment to the ordinance to make this matter clear to all persons involved. It was moved by Supervisor Cameron, seconded by Supervisor Ladd and carried that a letter of notification be sent to Public Works and Planning that they are to follow Section 20.22.5 of the County Code, and to state that a map is not required on adjacent parcels, owned by one owner, and that County Counsel be requested to prepare a proposed amendment to the ordinance that would drop the requirement of the filing of the map on such parcels. Appeal period on E.I.R.s discussed. The State was arguing for a mandatory 30 d<:ys. Mr. Blackstock will review this matter and will report back to the Board. Supervisor Ladd questioned the enormous volume of material that is required in the matters. He set out how he felt the format and form could be prepared. It was suggested that maybe Mr. Blackstock and the Director of Planning could come up with a format for this item. 74-1787 OTHERS MATTERS PRESENTED BY BOARD MEMBERS Chairman Madigan said that at the Anaheim meeting, quite a £ew of the RCRC people were wondering when they would get the fibreboard money. Chairman Madigan said he called the Department of Interior and explained why the money was being held up. Ch2irman..,Madigan asked about the Superior California Water meeting that will be held in Redding sometime in February. Page 438. December 3, 1974 December_3~ 1974 Supervisor Ladd announced that the Regional Council of Rural Counties will be meeting December 12th at Prospector's Village. He invited the Board members and the press to attend. County Counsel stated that he would be meeting Wednesday with the attorney and contractor for the Skyway. On Thursday the deputy attorney general will be meeting with them to discuss this matter. It was suggested that it would be constructive if this deputy att®rfley~general could be present at the December 11, 1974 land division violation hearings to hear the testimony that will be presented. 74-1788 SUPERVISOR LADD APPOINTED MEMBER OF BOARD OF DIRECTORS, NINE NORTHERN COUNTIES SUPERVISORS ASSOCIATION On motion of Supervisor McKiilop, secottded by Supervisor Madigan and carried, Supervisor Ladd was appointed as the County's representative on the Board of Directors of Che Nine Northern Counties Supervisors Association, with Supervisor Cameron serving as alternate.
