73-1872 APPROVAL OF MINUTES
On motion of Supervisor Gilman, seconded by Supervisor Cameron and
carried, the minutes of December 4, 1973 were approved as mailed.
73-1873 COMMUNICATIONS
Petition for abandonment as public highway. A petition by residents filed
for abandonment of Mills Road east of Gage Road. See discussion
later in meeting; hearing date set for January 22, 1974 at 2;00 p.m.
Richard Green, Chico. Mr. Green writes in opposition to the use permit for the
/~ ~ 0 p proposed garbage dump of Bob's Disposal. To be read at hearing
scheduled for 2;00 p.m.
Skow and Jones, Chico. The Attorneys file appeal to Planning Commission's

communication from canvalescent hospitals. A joint communication from Beverly
~ Manor canvalescent Hospital, Chico canvalescent Hospital, Crestwood
G ~ ~• canvalescent Hospital and Riverside Convalescent Hospital requests
that the Welfare Department be instructed to give top priority to
processing Medi-Cal applications for people in acute hospitals awaiting
placement into nursing homes, patients in nursing homes and those
still at home awaiting placement. Referred to Administrative Officer and
Welfare Officer to set up a hearing after Christmas.
Honey Run Covered Bridge Association, Inc. The Association expresses its
gratitude to the Board for the support and cooperation in their
~.0 ~ restoration project and presenting each Supervisors with a history
book of the bridge. Information only.
Richard E. Watson, executive director, California County Employee Safety
Contest. Mr. Watson writes regarding the 1972-73 contest and forwards

Eugene A. Ringel, Mayor-City of Chico. Study of extending "Your Bus" service
to Oroville. He also requests that the Board consider the allocation

and discussed. Mr. Nickelson will check into the request and will
report back to the Board.
Robert P. Mahan, President-Regional Council of Rural Counties. Informs the
Board that the Forest Service has granted a delay in the protest hearing
3 $~ scheduled on the Fibreboard Land. Exchange. Hearing date will be
~ 0' confirmed at a later date. Supervisor Madigan explained the reason
for the delay in the hearing. He spent three hours yesterday with
Norm Wagoner; they have a copy of the initial agreement with
Fibreboard. Discussed. No action taken.
Sutherland Simpson. Appeal of the development in Stilson Canyon as proposed
by Mr. Schlaf. Petition filed with the letter. To be discussed later
in the meeting.
Newhall Land Company. Supervisor Gilman read a letter from the Newhall Land
Company concerning flood insurance. The application for this flood
insurance must be made by the State or County. Flood insurance discussed.
Supervisor Gilman will answer the letter,
73-1874 SUPERVISOR GILMAN TO FOLLOW UP ON GAS ALLOCATION PROBLEM AND SECURE INFORMATION
TO SET UP A HEARING ON THE PROBLEM
Supervisor Gilman requested that the Board authorize him to contact
Congressman "Bizz" Johnson and the Governor to see if a joint meeting could be
set up with the fuel coordinators and the petrolium distributors to discuss
the fuel problem. He feels that it would be very beneficial to the north
part of the State to have this meeting. Supervisor Gilman would like to pursue
this matter withCongressman Johnson and see if the meeting could be set up with
the Federal and State fuel coordinators and petrolium distributors. Request
discussed.
On motion of Chairman McKillop, seconded by Supervisor Madigan
and carried, Supervisor Gilman was authorized to follow up on the gas allocation
problem and secure information on dates to set up a open hearing on the problem.
r/73-1875 ADOPT RESOLUTION 73-196 GIVING NOTICE OF INTENTION TO ABANDON A PUBLIC
HIGHWAY: MTLLS ROAD
Clay Castleberry, Director of Public Works, reported that he has
reviewed the petition for abandonment of a public highway as filed by
Howard Sohnrey and Author Moore. He said the petitioners have requested that
the fee be waived. Waiving of fee discussed.
Mr. gohnrey explained the request. Request discussed.
On motion of Supervisor Gilman, seconded by Supervisor Madigan and
carried, Resolution 73-196 giving notice of intention to abandon a public
highway, Mills Road east of Gage Road, was adopted, January 22, 1974 at 2;00 p.m.

73-1876 ADOPT ORDINANCE NO. 1414, AMENDING THE SALARY ORDINANCE
On motion of Supervisor Gilman, seconded by Supervisor Cameron and
carried, Ordinance No. 1414, amending the salary..ordinance (PEP transition to
regular county budgeted departments pursuant to the PEP base-out plan) was
adopted and the Chairman was authorized to sign.
73-1877 APPROVE AGREEMENT FOR OPERATION MAINSTREAM EXTENSTON
A modification to the Operation Mainstream agreement with the
Bepartment of Labor has been prepared. The modification will extend the
agreement from June 24, 1974 through September 6, 1974 with the additin_~ ~~`

On motion of Supervisor Cameron, seconded by Supervisor Madigan and
carried, the agreement modification for operation mainstream extension was
approved and the Chairman was authorized to sign.
/"73-1878 ADOPT RESOLUTION 73-197 AMENDING RESOLUTION 73-138, A RESOLUTION REGARDING
TRAVEL AND EXPENSES FOR COUNTY OFFICES AND EMPLOYEES
On motion of Supervisor Gilman, seconded by Supervisor Madigan and
carried, Resolution 73-197 amending Resolution 73-138, a resolution regarding
travel and expenses for county offices and employees was adopted and the
Chairman was authorized to sign.
73-1878 PPROVE APPOINTMENT OF ACTTNG WELFARE DIRECTOR: BOB CRISAN
Ed Robinson's last day will be December 28, 1973. The certification
processes for new Welfare Director have been initiated. It is requested that
Mr. Bob Crisan be appointed Interim Welfare Director effective December 29, 1973.
On motion of Supervisor Gilman, seconded by Supervisor Madigan and
carried, gob Crison was appointed Acting Welfare Director effective December 29,
1973.
73-1879 DISCUSSION: STATE. SLID WASTE MANAGEMENT BOARD GUIDELTNES
Clif Mickelson, Administrative Officer, reported that on October 30,
1973 the State Solid WasEe Management Board sent draft of tentative guidelines
on the requirements of SB 5 and requested review and comment by December 15,
1973. Comments from Planning, Public Works and Health Departments have been
secured and a summary report prepared, These departments did not disagree
with the guidelines. Guidelines discussed. It was stated that by January 1, 1975
the State must adopte Statewide policy for disposal of solid waste. A year
later, all Counties must have their guidelines in to the State. In the interim,
there should be good communications between the County and the cities,
Guidelines discussed. Mr. Castleberry said the guidelines indicate
a mandatory collection of garbage. Supervisor Gilman said this might be a good
time to put in a word about the flexibility of the rural areas for mandatory
pick-up of garbage, Mr. Mickelson will follow through with this matter.
Mr. Mickelson will place this matter on the BCAG meeting for
discussion, and will write a letter to the State regarding the guidelines.
73-1880 DISCUSSION: AUTHORIZATI_ON__FOR PEP POSITION FOR CHICO MARSHAL: PUT OVER ONE WEEK
Mr. Mickelson stated that inasmuch as the County has not been able to
obtain a Mainstream person qualified to fill the Chico Marshal's position as
authorized by the Board at Budget time, it is proposed that a PEP position be
used. This can be arranged by reapllgoe a1t~n of PEP funding. This position

will be scheduled for phase into a regular position in the next fiscal year
budget. This item is carried over from last week. Additional information
has been supplied to the Board members. Matter discussed. Supervisor Ladd
had requested that this matter be put over one week, due to his illness.

73-1881 BUDGET TRANSFERS APPROVED
On motion of Supervisor Gilman, seconded by Supervisor Madigan
and carried, the following budget transfers were approved;
B-31 Dog Control - $91 from special department expense to extra help
B-32 public Guardian - $400 from salaxies and wages regular
to extra help
73-1882 REPORT: OVER PAYMENT ON EOC OPERATION
Mr. Mickelson reported on the memo sent to be Board from Mrs. Windsor
concerning the over-payment in the EOC operation. A telegram has been received
from the Federal Government that they will approve ''in-kind" payment up to
December 31st. The County will not have to put in any "hard cash" at the
present time. Mr. Mickelson said that they expe.at._ to have next week a
department organizational proposal. He said they were on top of the problem
at the present time. No action needed at this time.
73-1883 AUTHORIZE ADVANCE DEPOSIT TO POST OFFICE FOR PREPAID MAILING PERMIT
WELFARE DEPARTMENT
On motion of Supervisor Gilman, seconded by Supervisor Cameron and
carried., the Auditor was authorized to make the advance deposit to the Post
Office in the amount of $500 for the Welfare Department prepaid mailing permit.
73-1884 AUTHORIZE PURCHASE OF TWO REPLACEMENT NCR BOOKKEEPING MACHINES FOR
AUDITOR'S OFFICE
F. H. Seely, County Auditor, reported on the problems with-title
present bookkeeping machines in his department. Mr. Seely requests replacement of the
two NCR machines with new machines at an estimated cost of $6,000 each, or a
total of $12,000. The Administrative Office has reviewed this situation with
the Auditor and feels that replacement rather than rebuilding of the old machines
is the best solution. Use of revenue sharing funds would be proper for this
purchase.
Discussed the deposition of the machine at the County Hospital; it is
a National Register machine. Mr. Michelson will check on this machine.
Purchase of the two machines discussed.
On motion of Supervisor Madigan, seconded by Supervisor Gilman and
carried, purchase of two replacement NCR bookkeeping machines for Auditor's
office was authorized, to be funded from Revenue Sharing funds.
73-1885 PUBLIC HEARING SET; PETITION FOR VARIANCE TO PROVISIONS OF SECTIONS 19-10 and/or
19-12, LAWRENCE J. RICtiARDS
- A public hearing was set for January 8, 1973 at 2;00 p.m. on the
petition for variance to provisions of Sections 19-10 and/or 19-12 of the
County Code by Lawrence J. Richards, Oroville.

73-1887 DISCUSSION AND INFORMATION ITEMS - PUBLIC WORKS
Clay Castleberry, Director of Public Works, reported on the right of
way agreements for sale, East First and Madrone Avenue. He said he has found
that several things has happened regarding these agreements for sale. Part of
this property has been annexed to the City of Chico. He requested that the
Board rescind their action taken on November 20th, Item 73-1781. These
agreements will now go to the City of Chico. Request to rescind the approval
of the agreements of sale discussed. Mr. Castleberry said he would take the
responsibility for this matter.
On motion of Supervisor Gilman, seconded by Supervisor Madigan and
carried, the Board requested that Public Works Director affect an assignment of
the County's right and responsibility to the agreements for sale of property on
East First and Madrone Avenues, Chico, as approved in Board item 73-1781, approved
on November 20, 1973, to the City of Chico.
(B) REPORT ON ENTERPRISE BOAT LAUNCHING RANIl~ BID
Mr. Castleberry reported on the bids received for the Enterprise
boat launching ramp. Bids discussed.
On motion of Supervisor Gilman, seconded by Supervisar Cameron and
carried, the low bid for the Entexprise boat launching ramp was accepted
from Hughes and Ladd Corp., Redding, in the amount of $i2b,858.
(C)__ BRIEF DISCUSSION REGARDING SUBDIVISION RIGHT OF WAY RE UTILITIES
Mr. Castleberry reported on the problem concerning a subdivision
that is under way. They gave an easement to the Water Company serving the
area and then deeded the easement to the County for a right of way. It was
felt the policy should be that the County has the first call on right-of-ways.
Discussed; no action needed. Information only.
73-1888 RESCIND ACTION ON CONTRIBUTION FOR CLEARANCE OF DRY CREEK: NEW MOTION
CONTRIBUTING $1,250 TO CITY OF OROVILLE FOR MAINTENANCE OF DRY CREEK
Mr. Castleberry reported on the contribution to the City of Oroville
for maintenance of Dry Creek. It was felt that only $1,250 would be needed,
rather than the $2,500 originally offered.
On motion of Supervisor Gilman, seconded by SupervisorMadigan and
carried, the Board rescinded their original motion contributing $2,500 to
the City of Oroville for maintenance of•Dry Creek, and stated that $1,250
would be contributed for the maintenance of Dry Creek.
73-1889_DISCU'S.SION: FILING OF ENVIRONMENTAL IMPACT REPORTS FOR NEW ROADS
Mr. Castleberry stated that Supervisor Gilman had advised him
that probably next week the County will have to commence filing Environmental
Impact Reports on all new roads that will be constructed. Supervisor Gilman
explained this statement; he stated that the criteria has been set up in
the matter. Tf anything has an impact on the environment, then a report will
have to be filed. No action takeni'age 142.

73-1890 QUESTIONS CONCERNING WARD BLVD. LOT SPLIT PROBLEM
Supervisor Madigan asked Dan Blackstock, County Counsel, for a
report on the Ward Blvd. lot split problem. Mr. Blackstock said he had
not received the deed at this time; he was told .that the Title Company
would have the deed of reconveyance to him today. He will check on the
matter and will report back later in the day.

73-1891 REPORT BY OROVILLE CEMETERY DISTRICT BOARD ON INCREASE COSTS FOR BURIAL PLOTS
Mrs. Faye Openshaw, secretary-manager, of the Oroville Cemetery District
appeared and introduced the Board of Directors to the Board members. Mrs.
Openshaw set out the background that led up to the increased costs for burial
plots and services within the Oroville Cemetery District. She read
correspondence from the Auditor's office concerning the tax rate. Revenue
received by the district set out and discussed. The only way they could
operate the district was to increase the costs for burial plots and services.
Increase in costs discussed.
Chairman McKillop thanked Mrs. Openshaw and the Board of Directors
for their report; no action taken.
73-1892 DISCUSSION OF CLAIM OF WTLFRED OLSON M D PUT OVER ONE WEEK
County Counsel requested that the discussion on the claim of
Wildred Olson, M.D. be put over one week.
73-1893 R. G. SHIPPEN, WESTERN GEOPHYSICAL COMPANY OF AMERICA: REQUEST FOR
C PERMISSION TO CONDUCT GEOPHYSICAL SURVEY FOR ATLANTIC RICHFIELD COMPANY
~ p.~ R. G. Shippen, representing Western Geophysical Company of America,
~'~' presented the request for permission to conduct geophysical survey for
Atlantic Richfield Company on certain county roads. Mr. Castleberry explained
his worry about the survey. The company uses a vibrator truck; they go 44 feet
and make a recording. There will be a flag man at the site of the study.
He explained how the survey was conducted, Mr. Castleberry said he would like
someone from his department to/hut and look at the recording being made.
Study discussed. Mr. Shippen explained the roads the survey would
cover. Mr, Blackstock said the County would request a certificate of insurance
showing that the County is insured in the matter.
On motion of Supervisor Gilman, seconded by Supervisor Madigan and
carried, the permission to conduct geophysical survey for Atlantic Richfield
Company on certain county roads was granted to Western Geophysical Company of
America, subject to a trial basis, and that theCounty is included as an
"also insured" on the insurance policy during the ogeration, and that a man
from Public Works Department be present at the first recording.
73-18.94 APPEARANCE OF JAMES HANSEN. OROVILLE: INVESTIGATION OF THE HOSPITALS
Mr. James Hansen, Oroville, asked if the investigation~~~on the
two men that died in the rock piles was being handled. He said another man
had just died in the County; he was moved out of the hospital to a convalescent
home. He said he would like this checked out. The man's name was Jack Wilson.

73-1895 APPEARANCE: CLAUDE WILLIS, FOREST HILL: ITEM ON HIS TAX BILL
Claude Willis, Forest Ranch, brought up an item that was on his
tax bill. This concerned a joint powers agreement with Chico Recreation
and Park District. He said he did not believe that he or his neighbors were
within the CARD area. Mr. Blackstock suggested that Mr. Willis go down
and talk to the Tax Collector; there could have been an error made when
data processing was working on the tax bills. Mr. Willis said he would check
with the Tax Collectors office regarding this matter,

The public hearing on the appeal of issuance of use permit to
Bob's disposal for a refuse transfer station on Myers St., Chico, was held
as advertised, Mr. Lawson set out the background of this use permit,
stating that the nse permit had been approved by the Planning Commission.
Since approval by the Planning Commission, the Health Department has made
various conditions. Mr. Lawson read the conditions and explained the
conditions of the Health Department.

Appearing in opposition; Mr. Phillip Hour, attorney for the
opposition, made a brief statement in opposition to the issuance of the
use permit. He filed a petition containing 106 signatures of people who
operate business in the area or awn property in the area. The general
objections are due to sanitation. They feel that there would be a rodent
problem with this operation, He stated that this proposed use would be
50' from the Lassen Foods property. If the use is granted, the Lassen
Foods people will not be able to expand their operation.
Many letters were presented to the Board in opposition,
Mr. Ralph Seales, manager of Lassen Foods, spoke in opposition.
Clay McGowan, Chico, stated he opposes the use permit, setting out
his reasons for opposing the use.
Stephen Burns, former owner of the property that would house the use,
spoke in opposition. He stated that he had sold the property to the Johnsons
with the stipulation that there would be no garbage trucks or garbage on the
premises.

SUBDIVISION: APPEAL OF ENVIRONMENTAL IMPACT REPORT
Mr. Lawson informed the Board that a public hearing would have to
be set on the appeal of the Environmental Impact Report of the proposed
development by Irvin Schlaf for a 40 unit subdivision in Stilson Canyon.
The hearing would knave to be advertised.
A public hearing was set for January 22nd, 1974 at 2;00 p.m.
73-1915 DISCUSSION: DEVELOPMENT ON LASSEN AVENUE CURBS & GUTTERS RE UIRED
Supervisor Madigan asked Mr. Lawson how many of the developments
on Lassen Avenue had the conditions for cubs and gutters and have not put
them in. Mr. Castleberry explained the requirements and why same of the
developments have not installed the curbs and gutters. He said that on
the use permits that were issued, these developments will have the curbs
and gutters installed, Supervisor Madigan questioned him about the mobile
home park just west of the Freeway on Lassen Ave. Mr. Lawson will check
on this and report back to Supervisor Madigan.
73-191b AUTHORIZE DEFENSE TO BE PROVIDED IN MATTER OF NEVES V. COUNTY OF BUTTE
Dan Blackstock, County Counsel, presented letters requesting that

F. H. Seely, Fred 1Tnfried, and himself in the matter of Neves v. County of
Butte, et a1. Request discussed.
On motion of Supervisor Cameron, seconded by Supervisor Madigan and
carried, the Board authorized defense to be provided to the above named in
the matter of Neves v. County of Butte, et al; Butte County Superior Court
No. 56640.

to County Counsel.
On motion of Supervisor Madigan, seconded by Supervisor Gilman and
carried, County Counsel was instructed to notify the attorneys for the
Ward Blvd. lot split problem that the County is going to commence litigation
proceedings immediately.

73-1918 DISCUSSION: REQUEST BY LOCAL CHAPTER OF COMPREHENSIVE HEALTH PLANIQING
TO DO A STUDY OF THE LOCAL HOSPITALS, AS FAR AS EXTENDID CARE, ACUTE CARE, ETC.
IS CONCERNED
Frank Harlan has requested that the local Chapter of the Comprehensive
Health Elanning Board would like to do a study of the acute, extended and
emergency care provided by Butte County Hospitals. Chairman McKillop felt
that it would be fine for them to make the study, The Board agreed that the
study could be made, with the request that they report back to the Board
on their study.
73-1919 DISCUSSION: MEMO ON MUNJAR PETITION-TITLE COMPANY TO MAKE STUDY
Supervisor Madigan said he would like to go back to the memo from
Mr. Lawson concerning the M~njar property. He said he would like to suggest
that the Board authorize someone outside the County employee, complete the
report for the State. Mr. Nickelson was authorized to do some checking on
possible people that might be able to make the report and he will report
back next week to the Board.
