Present: Supervisors Ladd, Madigan, Maxon, McKillop and Chair-nan Gilman. Clif Mickelson, Administrative Officer, Daniel Blackstuck, County Counsel9 and Clark A. Nelson, County Clerk, by Susan Laswell, deputy clerk, INVOCATION: Pastor Delbert Curry, Seventh Day Adventist Church, Oroviile Pledge of allegiance to the Flag of the United States of America. 72-1942 APPROVAL OF MINUTES 0[i motion of Supervisor McKillop, seconded by Supervisor Ladd and unanimously carried, the minutes of December 5, 1972 were approved as mailed. 72-1493 COMMUNLCATIONS C. W. Bachman, Chico, Mr. Bachman, civil engineer, writes regarding the Davies parcel map and waives the requirement for action on the parcel map within the 50 day period. It is his understanding that at the term- ination of the 90 day interim zoning, if no new zoning has been established, the Board will rule on the parcel map at the next meeting. Referred to .Tim Lawson. Matthew E, Marsh, attorney, Chico, The attorney sends copy to stop notice filed with the Auditor on behalf of Peterson's Painting Service in the amount of $2,199,05 against the Neves Construction Company contract for the superior court building, Referred to County Counsel. Rich, Fuidge, Dawson, Marsh., Morris, Sandbrook & Grove, Tnc. The Firm representing Neves Construction Gompany writes regarding amounts presently due to the contractor for-the superior court construction. (Copy enclosed with agenda) Referred to County Counsel. United Crusade of Butte County. A. G. Stephens, president, writes that the representatives of the United Crusade and its member agencies would welcome an opportunity to meet with the Supervisors and city councils to discuss alternatives regarding revenue sharing. Discussed; would like more information. City of Gridley. The City writes regarding problems of fire protection because of the bisecting of the City by the Southern Pacific railroad tracks. The City is interested in a cooperative mutual aid agreement with the County for constructing and maintaining a fire house in a location east of the tracks. (Copy enclosed with agenda) Supervisor Ladd said he would try to meet with them sometime this week. John S. Houtman. Mr. Houghton is appealing the decision of the Butte County Planning Commission in which they denied a use permit to allow a chiropractic health service on property zoned A-2. Public hearing set for January 9, 1973 at 1:30 pamo Nola L. Evans, Mrs. Evans writes regarding her property assessments and is concerned with the sudden jump. Re£err~-d to the Assessor. Mrs. Walter W. Krull. Mrs. Krull writes regarding their tax bill and what has happened to ito She wonders what would happen if she didn't pay her taxes and states that no one will admit their mistakes. Referred to the Treasurer and Tax Collector. Butte B'arms. Orlyn B. North, Manager, writes regarding that Butte Farms highly recommends R. A. Mackessy for the position of Agricultural Comissioner. Information .only. page 459 December 12, 1972 December 12, 1972 72-1494 CORRESPONDENCE FROM LIME SADDLE ATTORNEY'S REFERRED TO COt7NTY COUNSEL Correspondence was received from the Lime Saddle attorney's. They felt that this should be referred to County Counsel to look into the situation. On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, toe letter from the Lime Saddle attorney's was referred to Dan Blackstock, who will report back to the Board on the matter. 72-1495 HANK HINDERY TO SEND LETTER TO VENDORS ASKING THEM TO HOLD THEIR REQUEST FOR PROPOSAL IN ABEYANCE Supervisor Madigan brought up at this time the purchasing of equigm ent for Butte County and the quotations the vendors give. He would not like to discourage any good offers, C1if Nickelson stated that he would like for Hank Hindery to send the vendors a letter until some minor details are ironed out. On motion of Supervisor Madigan, seconded by Supervisor McKillop and unanimously carried, the Chairman was authorized to request Hank Hindery, Data Processing Department, to send a letter asking the vendors to hold their request for proposal in abeyance pending further developments. 72-1496 TELEGRAM FROM HAROLD T. JOHNSON CONCERNING THE REVENUE SHARING PROGRAM Chairman Gilman stated that he had received a telegram from Bizz Johnson concerning the Revenue Sharing Programo The total amount of money Butte County received was $789,353. The money was divided as follows: (1) Biggs - $2,396, (2) Chico - $161,892, (3) Gr~.dley - $29,815 and (4) Oroville - $71,827. 72-1496 COMMUNITY ACTION AGENCY GOVERNING BOARD - ADOPTION OF BYLAWS Clif Nickelson summarized the bylaws and some of the changes. On motion of Supervisor McKillop, seconded by Supervisor Madigan and carried; the Community Action Agency Governing Board bylaws were adopted. AYES: Supervisors Ladd, Madigan, 1~IcKillop & Chairman Gilman. NOES: Supervisor Maxon. 72-1497 APP ROVAL OF SUPLEMENTAL GRANT APPLICATIONS FOR HEAD START PROGRAM Mrs. Moellenberndt and Mrs. West showed a short slide program concerning the Head Start Program in Butte Countyo Mrso West then explained the grants and what they would be used ford On motion of Supervisor McKillop, seconded by Supervisor Ladd and carried, the two fiscal 1973 suplemental grant applications for the Head Start Program were approved, AYES: Supervisors Ladd, Madigan, McKillop & Chairman Gilmano NOES: Supervisor Maxon> X72-1498 ADOPT RESOLUTION 72-210 ESTABLISHING NOTICE OF INTENTION TO OPT OUT A5 COMMUNITY ACTION AGENCY AND TO SET PUBLIC HEARING THEREFOR AND TO DESIGNATE THE BUTTE COUNTY ECONOMIC OPPORTUNITY COUNCIL, INC., THE PRESENT ADMINISTERING BOARD, AS THE COMMUNITY ACTION AGENCY FOR THE COUNTY OF BUTTE Clif Nickelson set out the possibilities of someone else taking over the CAA other than the Board of Supervisorso The transition would be a slow one and they would still need some help from the Board, He said that San Francisco would work with them and the change would take anywhere from six months to a year, Supervisor Madigan felt that they should determine a termination dated Dan Blackstock stated that a public hearing date should he set. The date was set for January 23, 1973 at 1:30 p,m, Page 460 December 12, 1972 December 12, 1972 On motion of Supervisor McKillop, seconded by Supervisor Maxoa and unanimously carried, Resolution Noo 72-210 Establishing Notice of Intention to Opt Out As Community Action Agency and to set Public Hearing Therefor and to Designate the Butte County Economic Opportunity Council, Inco, The Present Administering Board, as the Community Action Agency for the County of Butte, was adopted and the Chairman was authorized to sign. 72-1499 APPROVE AGREEMENTS FOR SALE Clay Castleberry summarized the action requested, On motion of Supervisor Maxon, seconded by Supervisor Ladd and unanimously carried, the following agreements for sale were approved and the Chairman was authorized to sign and authorize Auditor to issue warrants upon demand of County's escros agent, Right of way acquisition - agreements for sale - Ord Ferry Road 42071-71-1, Pcls. 7 & 9 0. Stutzman 0,127 ac, Exchange " " A, Beltramo 0,810 $549 No/impr. $549 72-1500 APPROVAL OF EQUIPMENT ACQUISITION (SNOWPLOW AND RADIOS) AND TRANSFERS OF FUNDS Clay Castleberry summarized the needs for the Public Works Departments Time was spenf discussing the high cost of snowplowinge On motion of Supervisor Maxon, seconded by Supervisor McKillop and carried, the Public Works Depto was authorized to purchase one additional snowplow blad and attachments for a four-wheel drive, 3/4 ton pickup which has been purchased. They were authorized to purchase five radios instead of the six requested and a transfer of $5,185 from the road reserve to cover the costso 72-1501 WEST PARADISE ACCESS DIVISIONS REPORT PUT OVER ONE WEEK Clay Castleberry said that he would not report on the West Paradise access divisions todayo Report put over one weeks 72-1502 PUBLIC HEARING SET: AUSTIN A. GILLHAM REZONE FROM °`A-3" TO "A-R" Public Hearing was set for January 9, 1973 at 1:30 p.mo for Austin Aa Gillham - rezone from "A-3" (agricultural) district to "A-R" (agricultural- residential) district for property located on the south side of State Highway 32, 1,000 feet east of Muir Avenue, identified as AP 42-10-02, containing 1002 acres, more or less, Chico, RECESSED: 10:00 a.mo RECONVENED; 10:20 a.m, 72-1503 ADOPT ORDINANCE NOe 1310 REPEALING ORDINANCES 1296 AND 1300 Dan Blackstock stated that there are a series of maps to be considered today, He discussed the environmental problem - AB 889 - and suggested that the Board may want to repeal Ordinances 1296 and 1300. Time spent discussing the matter and what the other counties are doings Problems in the departments were set out by Jim Lawson and Clay Castleberry. It seems that there has been a large amount of clerical work needed, On motion of Supervisor Maxon, seconded by Supervisor Ladd and unanimously carried, Ordinance No, 1310 was adopted repealing Ordinances 1296 and 1300, pending guidelines from the state and the Chairman was authorized to sign. Number three was deleted from the list and denied later in the meeting, On motion of Supervisor Maxon, seconded by Supervisor Madigan and unanimously carried, the following nine tentative parcel maps were approved, subject to the conditions of the Planning Commission, with the adoption o£ the findings that they have no environmental impact, and with the findings that they are consistent with the General Plan. 1. On motion of Supervisor Maxon, seconded by Supervisor McKillop and unanimously carried, the following five tentative parcel maps were approved, subject to the conditions of the Subdivision Committee, with the adoption of the findings that they have no environmental impact, and with the findings that they are consistent with the General Plan, 1. The map was discussed and gone over by the Board. On motion of Supervisor Maxon, seconded by Supervisor McKillop and carried, the map was approved with a 60 ft. easement back to Lot 2 and that the easement at the rear of Lot 2 be 35 ft. up to Lot 1, and that the map is consistent faith the General Plan, subject to the conditions of the Subdivision Committee, with the adoption of the findings that they have no environmental impact and that it will not be used for any further development without consent of the Board of Supervisorso AYES: Supervisors Ladd, Madigan, Maxon & McKillop. NOES: Chairman Gilmano 72-1508 DENIAL OF TENTATIVE PARCEL MAP RECOMMENDED FOR APPROVAL WITH NO ENVIRONMENTAL IMPACT On motion of Supervisor Ladd, seconded by Supervisor Madigan and carried, the tentative parcel map for Ross L. Bradford, AP 40-05-11, 2 lots, on Mesa Road, off Oroville-Chico Hwy., near Chico was denied. AYES: Supervisors Ladd, Madigan, McKillop & Chairman Gilman. NOES: Supervisor Maxon. 72-1509 APPEARANCE OF DEL GEDDES, LARWIN DEVELOPMENTS Mr, Del Geddes appeared for Larwin Developments at this time. Their map was denied at last weeks meeting and was put over until December 19. Supervisor McKillop felt that this matter could be taken care of now. The matter was then discussed by the Board. A letter was passed out to the Board from Larwin Developments requesting the approval of the tentative map, Matter further discussed. On motion of Supervisor Maxon, seconded by Supervisor McKillop and carried, the tentative map was approved as requested in the letter from Larwin with the conditions that the parking on the Skyway was to be a condition of the approval of the tentative map, that it also be agreed by the developers that a lot for a fire station be deeded to the County and the lot for the fire station be approved by Jerry Letson, our county's forest ranger and that the covenant be recorded as a condition prior to the recording of the final map. NOES: Supervisor Ladd and Chairman Gilman. 72-1510 APPEARANCE OF CART CARLIN Mro Carlin appeared before the Board at this time concerning the payments to the sub-contractors on the New Superior Court Building. They have not filed a stop notice. The; would like their money now. Matter discussed. He does not feel that the sub-contractors should be penalized for something the contractors are doing or not doing. Matter discussed, 72-1512 REPORT FROM BOB LEMKE PARADISE CHAMBER OF COMMERCE PUT OVER ONE WEEK Mr. Lemke stated that he would not give his report today concerning the questions being prepared for inclusion in the Paradise questionnaire,: Matter put over one week. Carver - rezone from "A-R" (agricultural- residential) district to "AR-MH" (agricultural-residential mobile home) district for property located on the north side of Lower Wyandotte Road, one mile west of District Center Drive, identified as AP 36-31-38, containing 22 acres more or less9 Oroville, was held as advertised, Jim Lawson summarized the request. It has been recommended for approval by the Planning Commission. Hearing opened to the public: Mr, C. A, Withington appeared and feels that it should be zoned "A-3". Mr. Withington summarized the history of this area and what it is like today. He is against the "AR-MH" zoning. Hearing closed to the public and confined to the Board, The rezoning was discussed by the Board. 72-1514 ADOPT ORDINANCE N0. 1311 ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "AR-MH" (AGRICULTURAL RESIDENTIAL-MOBILE HOME) DISTRICT, PURSUANT TO ORDINANCE N0. 475, AS AMENDED On motion of Supervisor Maxon, seconded by Supervisor Ladd and unanimously carried, Ordinance No, 1311, An Ordinance Zoning a Portion of the County of Butte, State of California, an "AR-MH" (Agricultural-Residential- Mobile Home) District, Pursuant to Ordinance No, 475, As Amended, was adopted and the Chairman was authorized to sign, 72-1515 PUBLIC HEARING: U. 5. HERTZ, INC. - USE PERMIT FORA 131 UNIT MOBILE HOME PARR The Public Hearing for U. S. Hertz, Inc. - use permit for a 131 unit mobile home park on property zoned "A-2" (general) and "C-2" (general commexcial), located on the southeast corner of U. S. 99E and Eaton Road, identified as AP 44-47-62 and part of AP 44-47-63, Chico, was held as advertised. Jim Lawson summarized the action of the Planning Commission. Hearing opened to the public: A man in the audience who did not give his name said that he is objecting to this and would like it to go on record. NOES: Supervisor Maxon, 72-1516 ADOPT ORDINANCE NOo 1312, AN ORDINANCE AMENDING AGRICULTURAL BURNING GUIDELINES AND ADDING THERETO PROVISIONS PERTAINING TO BURNING FOR FOREST MANAGEMENT, RANGE IMPROVEMENT AND IMPROVEMENT OF LAND FOR WILDLIFE AND GAME HABITAT The public hearing was held at this time on the above entitled matter, Don Black, Agricultural Commissioner, spoke at this time concerning the proposed ordinance, He then turned the hearing over to Neil McCabe, deputy County Counsel, who summarized the ordinance. On motion of Supervisor Maxon, seconded by Supervisor McKillop and unanimously carried, Ordinance Noo 1312, an Ordinance Amending Agricultural Burning Guidelines and Adding Thereto Provisions Pertaining to Burning for Forest Management, Range Improvement and Improvement of Land for Wildlife and Game Habitat, was adopted and the Chairman was authorized to sign. 72-1516 ADOPT RESOLUTION N0. 72-211, A RESOLUTION ADOPTING WOODWASTE BURNING RULES ~~ AND REGULATIONS AND MAKING VARIOUS MODIFICATIONS OF AND ADDITIONS TO THE RULES AND REGULATIONS OF THE BUTTE COUNTY ATR POLLUTION CONTROL DISTRICT The public hearing was held at this time on the above entitled matter. Don Black asked if Neil McCabe would summarize the resolution for the Board. Mre McCabe did so. The Board asked Dro Heindl's feelings on this matter. She stated that she had discussed this with Mro Black and they felt that some sort of a system of permits could be set up and there would not be too much of a burden on them. No one appeared for or against the proposed resolutiono Matter was discussedo On motion of Supervisor Maxon, seconded by Supervisor Ladd and unanimously carried, Resolution No, 72-211, a Resolution Adopting Woodwaste Burning Rules and Regulations and Making Various Modifications of and Additions to the Rules and Regulations of the Butte County Air Pollution Control District, was adopted and the Chairman was authorized to signo SUPERVISOR MAXON EXCUSED HIMSELF FROM THE MEETING AT THIS TIMEo 72-1517 ADOPT ORDINANCE N0. 1313, AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTX OF BUTTE, STATE OF CALIFORNIA, AN "A-R" (AGRICULTURAL-RESIDENTIAL) DISTRICT AND ESTABLISHING REGULATIONS FOR THE USE OF LAND AND THE CONSTRUCTION OF BUILDINGS The Board discussed the request for interim zoning in the area of Colusa Highway west of Gridley adjacent to Gridley city limitsa Supervisor McKillop, Supervisor Ladd and Clay Castleberry went and viewed the propertyP Page 465 December 12, 1972 December 12, 1972 ,7im Lawson summarized the zoning for the Board, Supervisor Ladd stated that he felt the land owners in this area are in favor of the interim zoning. Ron Sanford, Gridley, appeared at this time. He has obtained signatures of the people who are in favor. He said there is only one parcel where there may be a negative reaction. Matter further discussed, On motion of Supervisor Ladd,:.seconded by Supervisor,:Mc~fillop and carried, Ordinance No, 1313, An Interim Ordinance Zoning a Portion of the County of Butte, State of California, an "A-R" (Agricultural~Residential) District and Establishing Regulations for the Use of Land and the Construction of Buildings, was adopted and the Chairman was authorized to sign, AYES: Supervisors Ladd, Madigan, McKillop & Chairman Gilman. ABSENT: Supervisor Maxon.. 72-1518 CHAIRMAN TO SIGN LETTER WRITTEN TO THE RECLAMATION BOARD REGARDING PERMITS, LAND USAGE AND EASEMENTS George Stamm presented a letter to the Board written at the direction of the Board to the Reclamation Board regarding permits, land usage and easements. Chairman Gilman said that the letter is acceptable and that he would sign it. 72-1519 ADOPT ORDINANCE NO. 1314, AN ORDINANCE AMENAING ORDINANCE N0. 1284 OF THE COUNTY OF BUTTE KNOWN AS THE "SALARY ORDINANCE" Clif Nickelson set out the reason for the ordinance. On motion of Supervisor McKillop, seconded by Supervisor Ladd and carried, Ordinance No, 1314, An Ordinance Amending Ordinance No, 1284 of the County of Butte, Known as the "Salary Ordinance," was adopted and the Chairman, was authorized to signe ABSENT: Supervisor Maxon. 72-1520 APPROVAL OF GRANT MODIFICATION FOR THE PUBLIC EMPLOYMENT RROGR.AM A grant modification to Section 6 of the Emergency Employment Act requesting an additional $44,900 has been prepared to extend the program through ,7anuary 31, 1973. On motion of Supervisor McKillop, seconded by Supervisor Ladd and carried, the grand modification was approved and the Chairman was authorized to sign. ABSENT: Supervisor Maxono 72-1521 ITENLS DECLARED SURPLUS PROPERTY The Mental Health Dept, requested that the Board declare a Kodak copy machine and an adding machine surplus property. The Public Works Dept, requested Chet the Board declare the items on the Old Durham Maintenance yard surplus. On motion of Supervisor McKillop, seconded by Supervisor Madigan and carried, the following was declared surplus property: (1) Mental Health - Kodak copy machine and an adding machine; Purchasing Agent was authorized to dispose of. Minimum price $400, in casho (2) Resolution 72-213, A Resolution Declaring Intention to Sell Property - Approximately 2100 of an acre located at the intersection of Highway.32 and North Lindo Avenue. ABSENT: Supervisor Maxon. ~T2-1523 ADPOPT RESOLUTION N0, 72-214, APPROVING AGREEMENT WITH STATE RE AGRICULTURAL COMMISSIONER'S SALARY On motion of Supervisor McKillop, seconded by Supervisor Madigan and caxxied, Resolution 72-214, a Resolution Approving Agreement With State re Agricultural Commissioner's Salary, was adopted and the Chairman was authorized to sign. ABSENT: Supervisor Maxon. 72-1524 BUDGET TRANSFERS APPROVED Budget transfers discussed. On motion of Supervisor Ladd, seconded by Supervisor McKillop.and carried, the following budget transfers were approved: (1) B-34 Administration. This transfers $38.78 from salaries and wages regular to extra help and is to cover expenditures for caages incurred prior to the approval of the budget, and establishment of the administrative analyst position. (2) B-36 Mental Health. This transfers $1,000 from salaries and wages regular and $540 from office expense, with $1,000 going to extra help and $540 to rents and leases of equipment. (3) Gridley Justice Court. $2.,00 is transferred from the reserve to extra help in the Court budgeto (4) B-38 Public Works - Yards and Stores. $200 is transferred from maintenance of structures and grounds to overtime within the Yards and Stores budget and is to cover equipment serviceman relief on vacation, which was not anticipated in the budget. (5) B-39 Auditor-Controller. $400 is transferred from salaries and wages regular to overtime and is to cover Board approvert} overtime required for end of year reports and audits, due to resignation of regular employee. ABSENT: Supervisor Maxon. 72-1525 NEW COURT BUILDING FINANCING PUT OVER ONE WEEK The matter of the New Court building financing was discussed at this time, It was the feeling of the Board that this item should be put over for one week. 72-1526 At1N.0UNCEMENT BY CHAIRMAN GILMAN Chairman Gilman announced that there will be a Revenue Sharing Seminar on Friday in Sacramento at 10:00 a.m. He would like to see at least one Board member attendo Supervisor McKillop stated that he would be able to attend. ROY GARLIT Chairman Gilman explained that the executive session was for the purpose of hiring a new EOC Director, He felt that they had made a good decision. On motion of Supervisor McKillop, seconded by Supervisor Madigan, and carried, Mr. Roy Garlit was hired as the new EOC Director. He will be hired at step E which pays $1,128 per month.
