See motion following communications, Page 124. ~ December 13, 1977 December 13, 1977 _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ 77-2377 REJECT CLAIM On motion of Supervisor Madigan, seconded by Supervisor Moseley and unanimously carried, the claim of Richard Thomas Wainwright, Kathleen Wainwright, Jemnifer Wainwright, Jean Wainwright and Walter Wainwright in the amount of $3,000,000.00 as a result of personal injuries, property damage, and general damages was rejected and referred to Counsel and the insurance carrier. 77-2378 REJECT CLAIM On motion of Supervisor Madigan, seconded by Supervisor Zemke and unanimously carried, the claim of Stanley and Emily Fortier for personal injuries, denial of civil rights, etc, was considered a petition to file a late claim and was denied and referred to Counsel and the insurance carrier. 77-2379 REJECT CLAIM On motion of Supervisor Moseley, seconded by Supervisor Lemke and unanimously carried, the claim of Kenneth Jenkins, a minor and his parents, Kenneth and Lucille Jenkins in the amount of $750,000 was rejected and referred to Counsel and the insurance carrier. 77-2380 SET PUBLTC..HEARING RATE - DISCUSSION_OF PROBLEMS INVOLVING FEDERAL PROGRAMS IN LOW INCOME ANA ELDERLY HOUSING - HOUSING AUTHORITY TO BE PRESENT Supervisor Winston stated that problems exist involving the federal programs in low income and elderly housing. Mr. Melton, Housing Authority, should be asked to attend as well as-Ward Connerly, Connerly and Associates. There should be an open discussion of the problems. The Administrative Office to have Mr. Melton attend the meeting and assign an analyst to him to discuss some of the problems. The matter is set for hearing December 20, 1977 at 10:00 a.m. 77-2381 APPROVE SAFETY MEMBER RETIREMENT STUDY On motion of Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, a safety member retirement study was approved with the full cost of the study to be $197 with the cost equally shared with the county and the Chairman-authorized to sign. 77-2382 REAPPOINTMENT -PERSONNEL APPEALS COMMISSION On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the following people were appointed to the Personnel Appeals Commission:-for a four year term: Roy McKernan Ed Bronson 77-2383 ADOPT ORDINANCE 1891: SALARY ORDINANCE AMENDMENT: WAIVE SECOND READING On motion of Supervisor Winston, seconded by Supervisor-Lemke and unanimously carried, the second reading of the salary ordinance amendment was waived; ordinance 1891 was adopted and the Chairman authorized to signo 77-2384 APPROVE PURCHASE OF EQUIPMENT - ADMINISTRATION BUILDING, CONSTRUCTION DEPARTMENT - PRINTING CALCULATOR ($16S) AND DRAFTING STOOL ($23) On motion of Supervisor Lemke, seconded by Supervisor Winston and unanimously carried, the purchase of a printing calculator ($165) and a drafting stool; ($23) for the Administration Building, Construction Department from within existing department fixed asset appropriations were a pproved. 77-2385. AUTHORIZE ADMINISTRATIVE OFFICER TO NEGOTIATE, .AND RETURN.A FIRM OFFER FOR BOARD CONSIDLRATION - OROVILLE PARKING FACILITIES 'FOR COUNTY STAFF On motion of Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, the Administrative Officer was authorized to negotiate and return a fir€n offer for board consideration for downtown Oroville parking facilities for county staff. -Page 125. OF PURCHASING RECORDS - PURSUANT TO GOVERNMENT CODE SECTION 26202 FOR RECORDS OVER THREE YEARS OLD On .motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, destruction of purchasing records pursuant to Government Code Section 26202 for records over three years old was authorized, 77-2387 AUTHORIZE ADMINISTRATIVE OFFICER TO EXECUTE AGREEMENT - ASSOCIATED STUDENTS AT CHICO STATE AUTHORIZING USE. OF COUNTY.. OFFICE SPADE IN THE CHICO MUNICIPAL COURT BUILDING BY THE CONSUMER PROTECTION AGENGY On .motion of Supervisor Moseley, seconded by Supervisor Madigan and unanimously carried, the administrative Officer was authorized to execute an agreement between the county and the Associated Students at Chico State authorizing use of county office space in the Chico Municipal Court Building by the Consumer Protection Agency. 77-2388 AUTHORIZE NEGOTIATION FOR ARCHITECTUR?.L':SERVICES TO EXPAND ANIMAL SHELTER FACILITIES On motion of Supervisor Winston, seconded by.Supervisor Moseley and unanimously carried, negotiation for architectural services to expand Animal Shelter facilities was authorized. 77-2389 REPORT CONCERNING PROPOSED ESTABLISHMENT OF HUMAN SERVICES ADVISORY COMMITTEE CONTINUED TO DECEMBER 20, 1977 The report concerning proposed establishment of Human Services Advisory Committee was continued to December 20, 1977. 77-2390 APPROVE BUDGET TRANSFER On motion of Supervisor Moseley, seconded by Supervisor Madigan and unanimously carried, the following budget transfer was approved: B-68 Federal Revenue Sharing - miscellaneous projects. Transfers $6,276.50 from unallocated appropriations to resurface parking lot in order to increase the appropriation for the Feather River Opportunity Center parking lot engineering and resurfacing to meet the requirements of the contract award by the Board of Supervisors on October 11, 1977; Minute -Order 77-1975; Change Order No. 1, approved November 29, 1977, Minute Order 77-2285; acceptance of work approved November 29, 1977; Minute Order 77-2286; and the contract for engineering services approved September 18, 1977, Minute-Order 77-1796. 77-2391 ADOPT RESOLUTION 77-190: ESTABLISHMENT OF FAIR MARKET VALUE - 2 311 D STREET - HOUSING AND COMMUNITY DEVELOPMENT (HCD) On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, Resolution 77-190 establishing fair market value for 2311 D Street was adopted and the Chairman authorized to sign. 77-2392 APPROVE LOANS - COMMUNITY DEVELOPMENT BLOCK GRANT - HALTIWANGER, $20,578, 3% @20 YEARSe YOUNG, $11,200, 3% @30 YEARS On motion of Supervisor Lemke, seconded by Supervisor Madigan and carried, Community Development block grant loans to Haltiwanger, $20,578, 3% @ 20 years and Young, $11,200, 3% @30 years were approved. AYES: Supervisors Zemke, Madigan, Moseley and Chairman Richter. NOES: Supervisor Winston. 77-2393 AUTHORIZE ENROLLMENT OF EOC EMPLOYEES IN DENTAL PLAN COMMENCING JANUARY_I 2978 On motion of Supervisor Lemke, seconded by Supervisor Moseley and unanimois ly carried, enrollment of EOC employees in county group dental plan commencing January 1, 1978 was authorized. Page 126, December 13, 1977 December 13, 1977 77-2394 APPROVE CONTRACT AMENAMENT - DEPARTMENT OF AGING - INCREASING THE AMOUNT OF THE GRANT FROM $68,626 TO $82,343 On motion of Supervisor Winstari, seconded by Supervisor-Lemke and unanimously carried, the contract amendment with the Department of Aging increasing the amount of the grant from $68,626 to $82,343 was approved and the Chairman authorized to sign. 77-2395 APPROVE CONTRACTUAL CONCEPT - SB 38 - CONTRACTING WITH AN ORGANIZATION TO PROVIDE THIS SERVICE AND THAT THE ALCOHOLISM ADVISORY BOARD BE ASKED TO REVIEW PROPOSALS Discussion of the contractual concept of SB 38 had at this time. This is the establishment of optional county programs under which persons convicted of driving under the influence of alcohol may participate in a treatment program. Chairman Richter stated that the program should be monitored and measure the result so the board can see the results. Supervisor Winston stated that this program gave the courts some latitude and judgment. It was moved by Supervisor Winston, seconded by Supervisor Moseley that the contractual concept of SB 38 be approved with the added provision t hat the program be monitored as closely as possible so the board can be appraised of this. Discussion of the program had at this time. The program is to be self supporting. Supervisor-Lemke stated that there should be some kind of an inventory of the accidents, injury and fatalities as to probable cause and the history of accidents in Sutte County. -Early next year the board should start some kind of program to start eliminating causes of accidents. On .motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, a request was made to the CHP and appropriate agencies for a fatality and accident inventory. 77-2396 APPROVE AUCTIONEER'S BOND AND APPLICATION - BUTTE COUNTY AUCTION AND RANCHg BANGOR On motion of Supervisor Winston, seconded by Supervisor Moseley a nd unanimously carried, auctioneer's bond and application for Butte County Auction and Ranch, Bangor was approved. EXECUTIVE SESSION: The board recessed at 9:25 a.m. to hold an executive session regarding a personnel matter. RECONVENE: The board reconvened at 9:55 a.m. following an executive session regarding a personnel matter. The board instructed the Admin- istrative-Officer as to how to proceed. 77-2397 AAOPT ORDINANCE 1892: PUBLIC HEARING: EXTENSION OF INTERIM R-N (RESIDENTIAL NONCONFORMING) RESIDENTIAL PROPERTX LOCATED IN SOUTH OROVILLE The public hearing on the extension of interim R-N (residential nonconforming) residential property located in South Oroville was held as advertised. Mr. Knudson stated that he was concerned that the South"Oroville area would be built up like the San Francisco area due to the small lots. 2. 3anet Lewis. Ms. Lewis stated that she would like for this zoning to be flexible for mobile homeso 3. Carolyn Higgins. Ms. Higgins-asked the board what non- conforming means. Chairman Richter set out the meaning of the interim zoning. 4. Mr. Inger. Mr. Inger stated that the area is in very bad c ondition. The county should condemn-and tear down some of the shacks in the area. 5. Lew Coleman. Mr. Coleman stated that he did not think that any zoning was necessary in the area. Mr. Coleman stated that he did not think that the people in the ,area wanted reconstruction and r ehabilitation. 6. Audrey O'Neal. Ms. O'Neal stated that she would like to see the zoning stay. Ms. O'Neal was in support of the interim. 7. Luther Ford. Mr, Ford stated that the area should be cleaned up and the shacks should be taken down. 8. Steven Martinez. Mr. Martinez stated that he was in favor of the interim zoning. 9. Eva Perrish. Ms. Perrish asked if small businesses would be allowed in the area. 10. Seal Patterson. Mr. Patterson stated that he was concerned the city of Oroville would try to annex South Oroville after it has been fixed up. Mr. Patterson stated that the rehabilitation is a good thing and that the interim should be continued. 11. Norval Ingasser. Mr. Ingasser stated that he was also c oncerned that the city of Oroville would try to annex the area. Hearing closed to the public and confined to the Board. On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the interim R-N zoning was extended for a period of 8 months; Ordinance 1892 was adopted and the Chairman authorized to sign. 77-2398 PUBLIC HEARING: JOHN R. HART - APPEAL OF VARIANCE DENIAL TO ALLOW BUILDING 3.75 FEET FROM THE SIDE PROPERTY LINES ON PROPERTY ZONED "S-R" (SUBURBAN-RESIDENTIAL) LOCATED ON THE NORTH SIDE OF LUPIN AVE., APPROX. 100 FEET EAST OF SAN VERBENA WAY, IDENTIFIED AS AP 48-23-38 & 39 The public hearing on the John R. Hart appeal of variance denial to allow buildings 3.75 feet from the side property lines on property zoned "S-R" {suburban-residential) located on the north side of Lupin Ave., approximately 100 feet east of San Verbena Way, identified as AP 48-23-38 and 39 was held as advertised. Jim Lawson, planning director, set out the background of the appeal. The project is categorically exempt from environmental review. Hearing open to the public. Appearing: Sally Hart. Mrs. Hart stated that the reason she was given that the variance was denied was that vehicles could not get to the buildings. There is a great deal of property. Supervisor Winston stated that looking at the parcels it looks like it is the only way the property can be divided. Mr. Lawson stated that there are two existing houses. It is a matter of them being able to divide for their convenienceo The applicant admit s.4 that the property is useable as it is. On motion of Supervisor Winston, seconded by 'Supervisor .Moseley and carried, the applicant is deprived of the right of the other. property owners for they cannot divide about 4-1/2 acres, the appeal is upheld and the variance is granted to allow a building 3.75 feet from the side property lines with the findings that because of, special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of this chapter deprives such property of privileges enjoyed by other property in the 'vicinity and under identical zoning classification. AYES: Supervisors Lemke, Moseley and Winston NOES: Supervisor Madigan and Chairman Richter 77-2399 PUBLIC HEARING: ROBERT GROHS - APPEAL OF VARIANCE DENL4L TO ALLOW A CARPORT 1.5 FEET FROM THE SIDE PROPERTY LINE ON PROPERTY ZONED "A-R" (AGRICULTURAL-RESIDENTIAL) LOCATED ON THE NORTH SIDE OF GASA LOMA WAY, APPROA. 600 FEET SOUTHWEST OF QUINCY ROAD,-IDENTIFIED AS AP 34-152-13, OROVILLE The public hearing on the Robert Grohs - appeal of variance denial to allow a carport 105 feet from the side property line on property zoned '"A-R" (agricultural-residential) located on the north side of Casa Loma Way, approximately 600 feet southwest of Quincy Road, identified as AP 34-152-13, Oroville was held as advertised. Jim Lawson, planning director, set out the background of the appeal. Hearing open to the public. Appearing: 1. Robert Grohs. Mro Grohs stated that his driveway is a 10% grade and in order to back his boat into the carport i:t necessary to have the carport wider than normal, Mr. Grohs stated that the request was b ecause of the steepness of the lot. 2. Jeanette Grohs. Mrs. Grohs stated that this is the only place that the carport can be placed. Any other place would mean traveling across leach fields or cutting down trees on the property. Hearing closed to the public and confined to the board. On motion of Supervisor Winston, seconded by Supervisor Moseley and carried, the appeal was upheld with the finding because of topographic features involved, the nature of the use is such to allow the applicant full use of the property and the variance is necessary to prevent ahem being denied muse that is granted to other neighbors. AYES: Supervisors Lemke, Moseley and Winston NOES: Supervisor Madigan and Chairman Richter Page 129 December 13, 1977 December 13, 1977 77-2400 PUBLIC HEARING: PLANNED USE HEARING - REVENUE SHARING DISTRICT ALLOCATION PROGRAM - SET HEARING DATE OF JANUARY 3, 1977 AT 11:15 A.M. The public hearing on the planned use hearing of the Revenue Sharing district allocation program was held:-:as advertised. Gerald Lively, administrative analyst, stated that there will have to be another hearing on, the proposed budget for the revenue sharing. The board will need public imput in the hearing. A proposed budget must b e established and published for the hearing. Hearing open to the public. Appearing: 1. Nora Wiley, Gridley, representing the library study group. Mrs. Wiley stated-that the board has allocated $200,000 for the library in Gridley. Mrs. Wiley stated that an additional $75,000 would be needed and would like the board to consider a request for that amount. 2. Dorothy Russell, Quota Club, Mrs. Russell stated that she concurred with Mrs. Wiley. 3. Sally Copeland, Gridley. Mrs. Copeland stated that she concurred with. Mrs. Wiley. 4. Mrs. Ralph Osborne. Mrs. Osborne stated that she was representing the Gridley Women's Club. Mrs. Osborne stated that she concurred with Mrs. Wiley. 5. Ran Rorea, president, Gridley Junior Women's Club. Mrs. Korea stated that the Gridley 3unior Women's Club is supporting the request of Mrs. Wiley as is the g~~aniS Club. 6. Steve Evans, Butte Environmental Council. In order for them to receive funds there would have to be an agreement drawn up. The hearing on the proposed budget is set for January 3, 1978 at 11:15 a.m. 77-2401 APPROVE PUBLIC WORKS ITEMS On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the following Public Works items were approved: 1. Waived the second reading of the ordinance establishing speed limits on roads in Thermalito area; adopted Ordinance 1893 and authorized the Chairman to signo 2. Adopted Resolution 77-191 accepting in full 1977-78 federal aid safer off-system funds apportionment in the amount of $151,499 and authorized the Chairman to sign. 3. Approved contract change order no. 1, ~Baggett-Marysville Road,project no. 21461-74-1 in the increasing amount of $1,050.88 for installation of an additional cross culvert to alleviate a drainage problem at the bridge over the WPRR tracks and authorized the Chairman to sign. 4. Accepted the work of Robinson Construction Co, Inc. far the Baggett-Marysville Road, project no. 21461-74-1; authorized Chairman to sign Notice of Completion and instructed Clerk to record said Notice of Completion with the County Recorder. 5. Authorized release of maintenance bond and accepted roads for maintenance for Kelly Ridge Subdivision Unit 4A, road and drainage improvements. Page 131 December 13, 1977 December 13, 3.9'7'7 77-2402 DISCUSSION OF PROPOSED AGREEMENT FOR, STATE ROUTE 32 PUBLTG ROAD CONNECTIONS ~ CONCUR TO PROCEED WITH THE PROPOSED AGREEMENT Clay Castleberry, public works director, stated that the agreement would require the developer to put up money to pave the approaches when the state takes action. This would allow the filing of parcel maps. At the present time, a freeway fence and agreement restricts access from Forest Ranch to Chico. There are a lot of proposed developments at the present time> Dan Blackstock, county counsel, stated that the access is :•under state control. There is a problAm of determining the amount of the deposit. Mr. Castleberry recommended that the board approve the proposed agreement and allow Public-Works to proceed in an orderly manner while waiting for state approval. On motion of Supervisor Madigan, seconded by Supervisor Lemke and unanimously carried, the baard concurred with proceeding with this type of agreement. 77-2403 DISCUSSION: MEMORANDUM FROM ADVISORY AGENCY CONCERNING APPEALS TO MAP CONDITIONS Clay Castleberry, public works director, set out the memo from the Advisory Agency. This is for information only. Supervisor Lemke stated that Public Works should present a list of the conditions to the applicant when they apply for splitting a parcel. Clay Castleberry stated that the 1968 master drainage study for Paradise was a good plan until the state law changed. The law says that the county is not to have drainage fees unless there is a master plan that shows the location of the pipes.' The proposed plans that the b oard approved will provide the rational basis for fees. Chairman Richter stated that maybe the board should establish a building and development advisory committee. The committee could monitor the services provided by Public-Works. Mr. Castleberry stated that the building inspectors meet with contractors and crafts people in the Chico area. There is also a Building Code Appeals Committee. Supervisor Winston stated that he would like to discuss this matter with Chairman Richter and Mr. Castleberry. 77-2404 DISCUSSION OF FUNDING CONSIDERATIONS FOR CUSSICK AVENUE STORM DRAINAGE PROJECT TN CHTCO Discussion of funding considerations for Cussick Avenue storm drainage project in Chico was held at this time. Clay Castleberry, public works director, stated that by using revenue sharing funds it is more difficult to go to bid and mare costly. Mr. Castleberry stated that the b oard could save 10~ if the project was not funded by revenue sharing money becuase of the Davis-Bacon Act. Dan Blackstock, county counsel, stated that the county must pay the prevailing wage. The only thing would be additional reporting accounts. Supervisor Lemke asked that Counsel check into the minority requirement that was struck down in Los Angeles. The Nine Northern Counties is respoinsible for the initiation of this strategy. A meeting will be held tonight at 7:30 p.m, in Eureka. This will be the only one in Northern California. Chairman Richter stated that it is regretful that Butte County was singled out. Supervisor .Madigan stated instead of the state trying to build a pipeline from Oregon to transport water to Southern California they should be looking at the coastal rivers.
