Butte County Fair Board, The Fair advises that the terms of Mrs. Jean Minasian,

Butte County Mosquito Abatement District. The pistrict sends notification that terms
of Robert L. Boyd, T. A. Evans, and Arthur D. Smith are expiring

Dennis Durkin. He writes regarding his views of Commissioner Waiters of the Planning
Commission being in conflict of interest. Letter discussed. Supervisor
Madigan felt that Commissioner Wafters should resign from the County
Planning Commission. Supervisor Richter felt that Commissioner Wafters
~/3,0 0 bad judgment and unfortunate judgment discredits the planning
processes in the county ; ~ County Counse I said that based on the facts
of the letter, there is a conflict of interest; stated he did not know
whether the lector was factual or not. This letter will be checked and
discussed at a later date. Matter to be placed back on the Board's
agenda for Tuesday, January 4, 1977. Letter to 6e sent to City of
Chico regarding this matter.

unanimously carried, that the new Board of Supervisors which will take affice on
January 4, 1976 create a citizens committee to assist the Administrative Officer in

ADVISORY COMMITTEE
On motion of Supervisor Madigan, seconded by Supervisor Richter and
unanimously carried, the resignation of Larry Armstrong as a member of the Citizens
Advisory Committee was accepted, with request that a letter of appreciation for his
services be written to him by the Administrative OfFicer.
7b-2186 REFER LETTER OF FRANK C. BENNETT REQUESTING WITHDRAWAL OF
PROPERTY FROM LAND CONSERVATION AGREEMENT TO ASSESSOR
On motion of Supervisor Ladd, se cone y Supervisor Killop
and unanimously carried, the request of Frank C. Bennet for withdrawal of property
from land conservation agreement was referred to Assessor, with request that he
report back to the Board on his study of the request.
76-2187 APPROVE REJECTION OF CLAIM OF JAMES PILLSBURY
On motion o Supervisor McKi op, seeon ed y Supervisor Ladd and
unanimously carried, the claim of James Pillsbury in the amount of $100,000 general
damages was rejected and reFerred to County Counsel and Insurance Carrier.
76-2188 APPROVE TECHNICAL SERVICES CO NTRACT AND HEAD START GRANT
On motion o Supervisor McKi op, seconded y Supervisor Ric ter
and unanimously carried, the following action was taken:

skills was approved and the Chairman authorized to sign.

2. Approved q~grant with the Department of Health, Education and
Welfare fo provide training and technical assistance for the period January I
through December 31, 1977 at a cost of $3,200 and authorized the Chairman to sign.
76-2189 APPROVE CETA TITLE II MODIFICATION

CETA Title II PSE program $27,266 for fiscal year 1977 base allocation. These
funds will be used to maintain current levels of PSE enrollment.
Counter recession funds discussed. The committee appointed by
the Board comprised of Supervisors Madigan and Richter, Jim Rackerby, Bill Lawrence
and Clif Mickelson met to discuss the use of the recession funds. It was recommended
by the committee that funds be used to transition some of the CETA employees to
regular county positions. Some of the people are going to have to be transitioned.
Mr. Rackerby said the Board was talking about 80 positions under the Public Service
program that have been fined over the past three yeprs. CETA is to be phased out
this year. At that time, the Manpower Planning Council recommends that the
County cease public service employment and go to public projects.
Mr. Rackerby explained how the program is going to be handled.
Funds discussed; no action taken.
On motion of Supervisor Richter, seconded by Supervisor Madigan
and unanimously carried, the CETA Title li grant modification was approved and the
Manpower Director was authorized to sign.
76-2190 APPROVE ADVERTISING FOR BIDS FOR UPPER RIDGE FIRE S?ATION

and unanimously carried, advertisement of bids for Upper Ridge Fire Station was
approved, bid opening set for II:00 a.m., February I!, 1977, Board of Supervisor's
Room, with bids to be submitted to the Clerk of the Board, subject to County Counsel's

TERRITORY FROM THE WILLIAMSON ACT (Continued from 12/14/76)

Counsel, stated that this property involved the Hays and Bunch property. Background
of the matter set out by Mr. Blackstock. The Assessors Office found what they believed
was a description error. Proposed amendment to the description has been approved
by the Board. Mr. Santos felt that the County had made an additional error.
The County took in a parcel of land of about 80 acres that was not intended to
be under the Land Conservation Agreement.
Mr. Santos presented maps of the area involved.

1. Mr. Tony Santos. Property involved set out. He stated
that there were two parcels to this description that was sent to the Ag, pepartment.
Description taken from Mid Valley files set out and discussed. {n the corrected
agreement, parcel I had been left out. Mr. Santos stated that the Hays parcel
should have been left out. It is 80 acres. He felt this was a mistake made by a
typist. The Hays and Bunch property should have been left out of the agreement
but was placed in by a typing mistake.
Bob Bains, deputy county counsel, stated that the County has a
complaint that will be filed against Mr. Santos. In Mr. Santos`s letter of December 8th,
he discusses two parcels as Parcel B and A. There is no problem with Parcel A.
Parcel B is the real problem. Mr. Hays and Mr. Bunch are not willing to add
land to the Williamson Act; they hove the parcel that is less than the maximum requirement.
They request to be deleted from the agreement.
Mr. Santos statetl.that if the County had used the corrected description,
then the Hays property whould have been out of the Williamson Act.
Mr. nnUlky, representing Mr. Hays and Mr. Bunch, stated that
they tlid not think they were under the Williamson Act; they do not want to be
under the act. Mr. Mulky had written to the County requesting that Mr. Hays
be deleted from the Williamson Act. Mr, Mulky stated he had no knowledge of
the matter that was presented by Mr. Santos.
ft appears that an error was made when the amendment to the
description was presented. Deletion of Parcel (was not included in the amendment
by mistake.
Mr. Hays purchased the land with the thought that they were not
under the Williamson Act. It was felt that the error should be corrected.
Mr. laabert Cook was present at this time. He is vita prexident
of Mid Valley Title Company. He verified the description s presented by Mr. Santos.
Placing of the Hays property within the Williamson Act was a mistake .
Mr. Blackstock said a mistake had been made and the appropriate
action should be to withdraw the Hays property from the Williamson Act.
Mr. Dave Murray, Chico, stated that if the agreement were
ro be amended to delete the Hays and Bunch property from the Williamson Act,
what arrangements will be made to pay the County for the benefits in taxes
that have been received by Mr. Hays and Mr. Bunch.
Hearing closed and confined to the Board.
It was moved by Supervisor Madigan, seconded by Supervisor Richter
and unanimously carried, that the Hays and Bunch property be excluded from the
Williamson Act; that the loss of taxes be computed and paid by the property owners.

On motion of Supervisor Ladd, seconded by Supervisor McKillop
and unanimously carried, the petition for variance to provisions of Sections 19-10
and/or 19-12 of the Butte County Code for plocement of a mobile home at Route 2,
Box 412, Gridley, AP 21-23-22 was approved, for Richard L. and Mary Gregg,
for a period of one year.
76-2193 DISCUSSION: REAL ESTATE PROBLEMS IN BUTTE COUNTY

$utte County. He stated that basically there is a slow down in the creotian of
lots in Chico. The value of lots is on the increase. There is a shortage of home
sites in Chico and the area relatively close to Chico. Mr. Imhoff stated that he had
gone through the multiple listings and found that the price of lots was alarming. A
homesite is a 5-acre parcel with an avenge price of $18,000. The second thing is the
inventory of existing property in Chico.
Supervisor {2ichter felt that some of the lots that are computed
could be divided up. Price for these lots set out. Septic system requirements
discussed. It was stated that the average person cannot offord the lots that
are available.
Mr. Imhoff said he would like to see the Board adopt a resolution
of encouragement to the developers. He felt the Planning Department should help
the Board and relieve them of pressures. People feel that they have to appeal to
the Board on any building requirement as most of them are fumed down by the
Planning Commission. He would like to see the encouragement from the
Planning Commissioner.
Sewers in northwest Chico would be a great help. The lot
sizes should be made smaller in size. Additional building lots are needed at
this time.
Supervisor McKillop felt that Mr. Imhoff `s presentation has been
very good but it should be given to the City of Chico. They are the ones that
would have to supply the severing for the urban area. When there is a revision
of the General Plan, the developers should have some in-put to it as their in-put
would be helpful.
Orring Stratton, Chico, stated that +he mischief of this shut-down
will be with the County for a long time. It will be reflected in everyones taxbilis
for quite some time to come .
Mrs. Clare Cooper, Paradise, stated she was trying to live in Paradise.

She has two mobile homes ready to move on the property. One of the mobilehomes
is for her mother. Their furniture is in the warehouse. Approval of a lot split is
needed. Her property consists of six acres. The property is on Pentz Road above
Wagstaff. She is net in the urban area.
Supervisor Richter stated he was going down to Sacramento to talk
to people there again. The County's hands are tied until the agreement is changed.
Mr. Castleberry will look into Mrs. Cooper's problem and will try
to work out something on a n emergency level.
James Manson, Oroville, set out his opposition to the building
shut-down.

Time for opening of ids for Orovi a transfer station operation.
No bids were received. Mr. Elmer Johnson filed a letter making comments on the
time frame. Mr. Castleberry will report back to the Board on the letter within
two weeks.
Letter referred to Public Works for further study.
On asotion of Supervisor McKillpp, seconded by Supervisor Madigan
and unanimously carried, the fetter regarding the bid for the Oroville transfer operation
was referred b Public Works, with request that they report back to the Board in
two weeks time.

Patrick Pogins, Chico, showed charts setting out u~ mg
development iin the CoUnfy. The graph indicates single Family residents.
Building peek explained. Forecast by California Bank of overall increase in
population in Butte County explained. Mr. Porgins sold he was questioning
the validity of the lass itself due to the shutdown.
Supervisor McKillop felt this matter should have been placed on
the agenda for discussion.
No action taken.
John Luva:as-made a brief statement on behalf of Friends of Butte
County. He stated he lives on the east side of Chico. The organization has been
labeled as a 'ho-growth"organization. They do not oppose the growth of this
County but feel it should be planned. Point of the moratorium in building set
out. He said there is a shut down because the County has failed far years to
comply with the law. It is his feeling that the law had not been follow'sd by
the County. Fie felt that it was tragic that people could not afford to purchase
homes because of the increases in prices. The problem could be eased by making
more land available for building.
The west side of Chico cannot be aped to developments. The 14

responsibility is with the County for the Board to find sewerage disposal
system for the east side of Chico. Mr, Luvaas felt the City of Chico would go along
with any effort the County makes to provide sewers in the east side of Chico.
He felt the west side should be kept for agriculture.
Mr. $lackstock stated that the position of the Ci ty of Chico
has been adamant. No Hone is going to cut into the sewers unless they are
annexed into the City. -Background of the matte r set out by Mr. Blackstock,
The only way that area is~going to get sewered is for the City of Chico to agree
to it,
Mr, Luvaas felt that the City of Chico and the County representatives
should sit down and try fo work out a solution to the sewerage problem.
76-2196 DISCUSSION: IMPLEMENTATION OF ASSEMBLY BILL 3121: APPROVE
REQUEST OF DISTRICT ATTORNEY FOR ADpITIONAL PERSONNEL
The District Attorney requests an additional attorney and
stenographer in order to implement the mandates of AB 3121. Mr, Leach
stated he had sent a memo to the Board members outlining what will be
required of his office.
Chairman Cameron asked if it would be possible for the County
t,o get along fora 30 day period, prior to approving additional personnel.
jhere is a possibility that this bill will be asked to be put over.
Mr, Leach said there would be a fight to not delay this bill.
He has no reason to believe that there will be o delay in this bill. The County
has to start functioning under this bill by the 3rd of iJanuary, 1977, He will
have to sit down with Probation Department to discuss the functions.
Mr. Nickelson stated he was pleased that Mr, Leach had asked
for as few people as he did. Request explained. There is also a request from
the Probation Department for a:dditionai help.
Request discussed.
It was moved by Supervisor Richter, seconded by Supervisor Madigan
and unanimously carried, that it was the intent of this Board to approve the
request to have a salary ordinance amendment to add one attorney and one clerk
to the District Attorney's staff, to impliment AB 3121.

76-2197 GRANT MODIFICATION FOR REAL ESTATE FRAUD UNIT DISCUSSED:
ADOPT RESOLUTION 76-186
T grant mo i ication extending the grant has been prepared.
The modification extending the grant will provide an odiiitional $36,000 in
federal funding and $2,000 in state funding and will result in a sixteen month
budgetary period, page 364,

On motion of Supervisor Richter, seconded by Supervisor McKillop
and carried, the Board rescinded their previous action taken during the morning
session and renamed the "Real Estate Fraud Unit"the "Consumer protection Ageney".
AYES: Supervisors Madigan, McKillop, Richter and Chairman Cameron
ABSTAINING: Supervisor Ladd
Request for grant modification discussed. Chairman Cameron
stated that when this was originally discussed, the Iota[ funding had been
quo#ed as $I,fi00. Howard Casogrande stated that this grant modification was
for Ib months rather than 12 months; they have funds in the budget for the second
year funding.
Mr. Leach explained the grant, stating that ane of the "ifs"would
be, is whether the need would continue, in the spore amount or a lesser degree as
time goes one. He would hesitate to bet what the situation would be at the end of
this contract.

authorizing the project coordinator to sign the grant modification, Chairman

facilitate the grant modification.

Chairman Cameron said he felt this was an item That should be
Taken up by the new Board.
Mr. Leach stated this was a matter that the Board had already
acted upon; this is just an amendment to secure available funds for the program.
Supervisor McKilbp stated this was a budgetary factor and it is in the budget
of this time.
Appearances:

belonged in the Sheriffs Office not in the D.A.'s Office.
Bill Lawrence, County Auditor, stated that The appropriation
would require a 4/5 vote. Mr. Blackstock stated that the Board is not making
an appropriation at this time; the grant appl ication requires a different funding
of this program. Mr. Mickelson stated there would have to be a transfer of
funds when the funds are received.
Mr. Casagrande stated that a delay in this matter might cause
the County ro loose the money.
Grant discussed. Supervisor Madigan requested that Chairman
Cameron reconsider his vote. Chairman Cameron stated that he does not want to

and carried, that the County process the grant application, Adopt Resolution 76-186,
authorize the Chairman to sign fhe resolution and to consider the County's

• ~ A wntract has been prepared with Mr. and Mrs. James Cooper
for the placement of 'i601"juveniles in Butte County with regard to the
implementation of AB 3121 on January I, 1977. Contra t calls for six placements
at a base rate of $300 per month, plus $2.50 per child per day when placements
are made .
Clif Nickelson, Administrative Officer, stated there was a problem.
The person mentioned in the contract has lost interest in the contract. Mr. Nickelson
would like to have the Board authorize the Administrative Officer and Probation
Officer to work out an agreement to take these juveniles some place on January I, 1977.
Funding of the program discussed. Mr. Nickelson will determine if lVlsntal Health
funds con be used.

out the areas involved in the Thermalito basin. Acreage estimate set out. tle
stated there are other Counties involved in the matter.
The Department of Water Resources wants to drill 150 wells and
these wells will produce water; amounts of water that will be obtained set out.
Ib,050 acre feet of water per day per unit is estimated to be taken from these wells.
The pumps will be worked six months out of the year. It is the State's feeling
that the land will re-general itselft~uring the time the wells are not being pumped.

Mr, Blake explained what he felt the State planned to do
and what would happen to the land involved. He requested that the Board oppose
the State's plans to take this water.

ruling here about General Assistance. Under this ruling, in order to receive
General Assistance, the applicant must ga to work for the County for 4 hours
per day. After they go to work, they pay back the money they have received
under General Assistance.
Program discussed. This policy will be looked at by Mr. Crisan,
Welfare Director, and will be discussed when he appears before the Board.
76-2211 APPEARANCE: BILL GEDD15
Mr. Bi Ge is stated he would like to request a reconsideration
of the appeal of Centrex Aggregates determination. They have completed the E.I.R.
This is requested on the basis that this would subject the applicant to a long term
delay.
Dan Biackstock, County Counsel, ggid that they do have a draft
E.LR. completed; they'•have determined that an E.I.R. is not necessary. The
information was not available to the committee. The use permit hearing has not
been set at this time. Their data could be submitted and they could secure a
negative E. L R. Mr. Biackstock said he would recommend that they refer
this information back to the Committeen and have them make a determination.
Under the new guidelines, a project could be modified. tf the project is
modified in a certain way, there would 6e no significant adverse affect.
Mr. Biackstock stated that this would require two use permits;
one from the State and one from the County. Supervisor Richter stated that the
impact was in relation to the dust and the hauling out on the road. The Company
would be required to widen the road.
In order to +:xpedite the process, Mr. Geddis would like to
have the Board reconsider this matter. Mr. Biackstock explained how matter
could be handled.

and unanimously carried, the Board directed the Board of Zoning of Adjustment to
set a hearing on this matter, and to reconsider their decision regarding the
requirement of an E. L R., providing that the project brought before the Board of

of Friends of Butte County. He stated that this element has not had an E.I.R.
He feels that an E.I.R. should be required. If there is a revision in the General
Plan, there will be~•. an environmental impact.
Dan Blackstock, County Counsel, requested that the modification
be read into the record. Jim Lawson, Planning Director, read the proposed
modification, which is as follows: "Page 14.5(A) All prime agricultural land
(as defined in the Williamson Act) outside designated urban areas should be designated
as "Agricultural "on the Land Use Plan Map."
Mr. Luvaas stated that this should be put in with the other elements,
and that they should have an E.I.R.
proposed change discussed. It was stated that this hearing
was advertised by the County.
Adoption of the four elements discussed. The Board will then
have a review of the entire General Plan.

Supervisor Richter stated he hoped the Board, would adopt

Al Appleman, Oroville, stated that this new ordinance is based
on something that the Federal Government was trying #o take over. The miners
in Nevada are against it and they are appealing the matter to Washington.

to have the new guidelines ready by January I, (977. Fees are to be established
by special resolution.
Fees discussed. Fees explained by John Stutz, one of the committee
members. It was felt that the fees would just cover the expenses of the office.
Effectiveness of the Planner discussed. It was felt the fees should
be the same for private enterprise and the public projects. E.1.R. reviews
discussed .
It was stated that once the agency is set up, the County is going to
develop a data bank. Without data, a lot of the large E.I.R.s are going ro hwve
ro go out to bid.

and unanimously carried, Resolution 76-191 establishment revised fee schedule for
processing environmental review applications was adopted, adopting the recommended
schedule on page 1 of memo regarding deposit fees, but fees set out on page 2 left
open at this time, and the Chairman was authorized to sign.
76-2235 DISCUSSION OF ENVIRONMENTAL REVIEW GUIDELINES:
ADOPT RESOLUTEON76-192 ADOPTING GUIDELINES
Environmental review guidelines discussed. •.. Questions set out
by the guidelines discussed. Supervisor Richter said there were a series of
questions that cannot be answered any way but yes, and they have to be qualified.
Guidelines explained. Supervisor Richter Felt they should be
turned over to a Citizens Committee for study and have County Counsel present
to advise the committee.
Mr. Blackstock stated that if the Board determines that these
should be referred to the committee, he will be happy to work with them. lie
also requested that the Board give the order that, not withstanding, all County
departments era ordered fio comply with the State guidelines.
On motion of Supervisor Richter, seconded by Supervisor McKillop
and unanimously carried, Resolution 7b-192 -environmental review guidelines
adopted, directed all County Departments to comply with the State guidelines,
authorized the Chairman to sign, and requested that the Citizens Advisory Committee
meet and study the guidelines and that they make their recommendation to the
Board, if possible, at the January 4, 1977 meeting.
76-2236 WAIVE FIRST READING OF SALARY ORDINANCE AMENDMENT

7b-2237 APPROVE PLANS R SPECS FOR REPAIR TO WELFARE DEPARTMENT
On motion of Supervisor igon, seconded y Supervisor McKillop
and unanimously carried, the plans and specifications for repair of Welfare
Department for fire damage were approved, call for bids approved, with bids
to be opened at Public Works Department on January 21, 1977 at 4 p.m.
76-2238 APPROVE AGREEMENT WITH COUNTY OF SU7TER FOR HOUSING OF JUVENILES

is having problems in being able to house juveniles. They would like to enter into
an emergency agreement with Butte County for placing of juveniles at Juvenile Hall.
The dollar amount would be determined between the Auditor, Mr. Mickelson and
the District Attorney.

for the Auditor's Department, as recommended by the Grand Jury.

Supervisor Madigan stated wou d i e a report at the
January 4, 1977 meeting of the participation of County employees in the
United Way .
Supervisor Madigan stated #here would be a water symposium
in Red Bluff on Friday, January 14, 1977 at 10:00 a.m. The new Supervisors
should be invited to attend,
76-2241 SUPERVISOR RICHTER NOTE OF APPRECIATION OF THREE BOARD
MEMBERS LEAVING THE BOARD AT THIS TIME
Supervisor Ric ter state a wanted to thank the three Board
members that are leaving for the two years of extremely,informative meetings.
He said he has grown b have a great deal of respect for them. He has appreciated
the civil attitude and commitment to tha process of these Board members. He said
he would like to thank, especially, Mr, McKillop for his many years on the Board;
he has learned a great deal from him. Supervisor Madigan concurred with these
statements.
76-2242 AUTHORIZE REVIEW OF COUNTY HEALTH INSURANCE FOR,EMMPLOYEES

plan premium payment for the present health plan for county employees. He
suggested That maybe the County should adopt a process of self insurance,
There is c:$l:50,OOD increase in premiums that is going to be hard to come up with
by the County. He would I ike to hove the County toll for bids to be opened on
the 25th of January, 1977 on the concept of self insurance program or a 'stop loss"
program. Bids shauld be reviewed and a report given to the Board on February I.
On motion of Supervisor McKillop, seconded by Supervisor Madigan
and unonimously carried, call for bids for health insurance for County employees
was authorized, to be opened January 25th, with a report of sold bids ro be given
to the Board on Tuesday, February I, 1977, with the understanding that this will
not affect the employee benefits.

WIDE HOME MAKERS TASK FORCE
On motion o Supervisor McKi op, seconded by Supervisor Madigan and
unanimously carried, the Board concurred with the appointment of Bob Crisan,
Welfare Director, on the Stnte wide Homemakers' Task Force.
