County Service Area (CSA) charges - several of the CSAs have been operating this year with limited funding, relying on their available fund balance and current fees to carry them through this year. The fees are insufficient to provide the services for fiscal year 1998-99 and future years. Proposition 218 enacted by the voters November 5, 1996 requires a protest hearing and in most instances an election prior to the increase of any fee or service charge within a CSA - action requested - ADOPT RESOLUTION 97-168 SETTING A PUBLIC HEARING FOR LISTED COUNTY SERVICE AREAS FOR TUESDAY, MARCH 10, 1998 AT 10:00 A.M. Annual flow testing of all firefighting breathing apparatus in the Butte County Fire Department is a requirement of both the manufacturer and Cal OSHA - action requested - APPROVE BUDGET TRANSFER B-095 AND PURCHASE OF FIXED ASSET ITEM. 14. Social Welfare - Board authorization is requested for the purchase of a FAX machine (maximum amount of $1,203/Department budget) to provide service to the North County Employment Center. Gridley Branch Library - Board authorization is requested to accept and appropriate $2,500 in Continuing Operation Trust Funds from the Gridley Friends of the Library for their support of Gridley Branch Library public service staff hours - action requested - APPROVE BUDGET TRANSFER B-102; APPROVE LETTER OF APPRECIATION AND AUTHORIZE THE CHAIR TO SIGN. 17. County Library - the California State Library has awarded Butte County Library Literacy $879.00 in unanticipated revenue for fiscal year 1997-98 from the State Library matching funds grant for adult literacy services - action requested - APPROVE BUDGET TRANSFER B-103 ACCEPTING AND APPROPRIATING UNANTICIPATED REVENUE. 18. Northern Valley Catholic Social Services (NVCSS) - on August 12, 1997 the Board approved an extension for fiscal year 1997-98 for a Children's Services counseling contract with NVCSS. Inadvertently, an encumbrance number associated with a different contract was used - action requested - 1) UNENCUMBER THE FISCAL YEAR 1997-98 BALANCE REMAINING ENCUMBERED TO CONTRACT X10482; 2) CHANGE CONTRACT NUMBER FOR NVCSS COUNSELING FROM X10482 TO X10236; AND 3) TRANSFER FULL AMOUNT ($74,700) OF FISCAL YEAR 1997-98 CONTRACT INCLUDING REVENUES, EXPENDITURES AND BALANCE OF ENCUMBRANCE FROM X10482 TO X10236. 19. Drescher Tract Road Assessment District - on February 25, 1997 the Board of Supervisors commenced the process to form Drescher Tract Road Assessment District, and authorized the Chair of the Board of Supervisors to sign the U.S. Department of Agriculture Pre-Application for Federal Assistance. The purpose of the district is to improve Drencher Tract Road to County standards for County acceptance at no cost to the County. The district formation is progressing and Federal funds are presently available for the district - action requested - ADOPT RESOLUTION 97-169 AUTHORIZING CHAIR TO SIGN APPLICATION DOCUMENTS RELATED TO FEDERAL ASSISTANCE IN THE ESTABLISHMENT OF THE DRENCHER TRACT ROAD ASSESSMENT DISTRICT, WITH THE UNDERSTANDING THAT THE TOTAL COST IS TO BE PAID BY THE LAND OWNERS WITHIN THE DISTRICT. 20. Monthly Investment Report - the Treasurer-Tax Collector submits the November 28, 1997 report in accordance with the Butte County Statement of Investment Policy dated July 1, 1997 - action requested - ACCEPT FOR INFORMATION. County property at 1010 Cleveland in Chapmantown - the Board is requested to provide funding from Community Development Block Grant Program Income (Fund 140) in the amount of $1,505 to be used to rehabilitate the residence at 1010 Cleveland in Chapmantown so it may be used as a resource and counseling center - action requested - APPROVE REQUEST. 22. Development Services Department classification study recommendations: A. Adoption of a salary ordinance amendment implementing changes in the Department's Planning and Administrative Divisions: Reclassify current Administrative Analyst II (salary range [SR] 1168) to Principal Analyst {SR 1248); delete one position of Principal Planner or Senior Planner and add one position of Principal Planner; flexibly staff one Associate Planner position as Senior Planner/Associate Planner; delete one position of Assistant Planner/Planning Technician and add one position of Principal Planner; flexibly staff one Office Assistant III position as Secretary I/Office Assistant III; and delete one position of Secretary I/Office Assistant III, II, I and add one position of Secretary I/Office Assistant III (salary and benefit cost of $5,352 for fiscal year 1997- 98/Department budget)- action requested - ADOPT ORDINANCE 3377 AND AUTHORIZE THE CHAIR TO SIGN; (FROM 12-9-97) AND Page 353 December 23, 1997 December 23, 1997 97-398 B. Adoption of a salary ordinance amendment - District Attorney/Criminal Division - reclassifying the vacant position of Program Manager-Staff Services to the classification of Information Systems Analyst III. Historically, this position of Program Manager-Staff Services has been utilized in the capacity of technical support in the installation and maintenance of computer application and information systems - action requested - ADOPT ORDINANCE 3379 AND AUTHORIZE THE CHAIR TO SIGN. Introduction of a salary ordinance amendment reclassifying a Paralegal (salary range 1150) in the Office of the Public Guardian to a Staff Services Systems Specialist (salary range 1170) at a total fiscal year 1997-98 cost of $1,934 (Department budget) - action requested - WAIVE READING OF THE ORDINANCE. 30. Resolution Establishing the Boundaries of a Targeted Employment Area as required by the Enterprise Zone Act of 1996 - action requested - ADOPT RESOLUTION 97-170 AND AUTHORIZE THE CHAIR TO SIGN. 31. Storm Damage Project Management - a resolution amending Resolution No. 97-49 (April 22, 1997) has been prepared relating to management of storm damage projects from the 1997 Winter storms. The amended resolution provides for adding the following projects: Big Chico Creek Streambank Stabilization Project (DSR No. 4230-97-13), $75,000; and Butte Creek at Durham Mutual Water Company Dam (DSR No. 4230-97-4), $100,000 - action requested - ADOPT RESOLUTION 97-171 AND AUTHORIZE THE CHAIR TO SIGN. Notice of completion of work for storm damage repair of Pulga Road at 0.23 miles and 0.90 miles north of State Highway 70, County Project No. 76555G-97-1 - all contract work has been completed in accordance with the plans and specifications - action requested - ACCEPT CONTRACT WORK, AUTHORIZE CHAIR TO SIGN THE NOTICE OF COMPLETION, AND AUTHORIZE RECORDING OF THE NOTICE OF COMPLETION. 34. Butte County Fair Association - Amendment no. 8 - proposed is an amendment extending to December 31, 2002, the agreement entered into on January 1, 1983, providing for operation and management of the Butte County Fair, fairgrounds, related personnel and activities - action requested - APPROVE AMENDMENT N0. 8 TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 35. Public Defender contract - Myra L. Bailey - as part of the 1997-98 budget, the Board authorized an additional half-time contract for public defender services, specifically looking at family support, drug court, and domestic violence diversion. The contract, in the amount of $27,059 (Public Defender budget unity, equates to a "half time" public defender and runs for the period January 1, 1998 through June 30, 1998 - action requested - APPROVE PUBLIC DEFENDER CONTRACT WITH MYRA L. BAILEY AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND AUDITOR-CONTROLLER. (Contract no. X10841) 36. District Attorney - requests Board authorization to submit an application for $164,211 in State Investment Funds (SIF) to implement new legislation that requires Family Support Division (FSD) personnel to be co-located with Welfare Department staff - action requested - AUTHORIZE THE DISTRICT ATTORNEY TO SUBMIT APPLICATION. 37. Parent Education Network, Inc. (PEN}/Behavioral Health- Youth Services Division - proposed is the renewal of a contract services agreement for the provision of collaborative, multi-disciplinary, in-home mental health services to Butte County children and their families. The term of the agreement is July 1, 1997 through June 30, 1998 in the maximum amount of $35,000 (Department budget) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract no. X10834) Page 356 December 23, 1997 December 23, 1997 97-398 38. State Department of Mental Health, County Performance Contract 97-77137, fiscal year 1997-98/Butte County Behavioral Health (BCDBH) - the County is required to establish a community mental health service to cover the entire area of the County, and to reimburse the State for its use of State hospital beds. The County desires to contract with the State for the provision of professional and inpatient hospital services to persons who are acutely mentally ill, including mentally ill persons who require health care services - action requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. 39. BeneSphere Administrators - proposed is an amendment and supplemental agreement to the County's administrative services agreement with BeneSphere Administrators for administration of the County's Internal Revenue Code Section 125 Flexible Spending Program for 1998. The amendment and supplemental agreement provide for the renewal of services, web site enrollment support fee, and the Health Insurance Portability and Accountability Act (HIPAA) certification setup fee in the amount of $10,000 (Department budget) - action requested - APPROVE AMENDMENT AND SUPPLEMENTAL AGREEMENT AND AUTHORIZE THE DIRECTOR-PERSONNEL TO SIGN ON BEHALF OF THE COUNTY, AND DIRECT THE AUDITOR-CONTROLLER TO RELEASE PAYMENT TO BENESPHERE UPON APPROVAL OF AMENDMENT AND SUPPLEMENTAL AGREEMENT. (Contract no. X10456) 40. 1997-98 Master Grant Agreement No. 97-10757A1 - the State Department of Health Services provides 100$ State funding for AIDS related education, counseling and testing activities in Butte County. Under the terms of this amendment, the State will make available an additional $9,468 in funding for use with the Early Intervention Program (EIP). The total amount of State funds available for 1997-98 is increased to $297,158 - action requested - APPROVE AMENDMENT Al TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 41. State Department of Health Services Agreement No. 97- 11550 - under the terms of the agreement, the State will provide 100 State funds for prevention, education and case management services for identified lead-poisoned children. The maximum amount available under the agreement is $58,882 for the period July 1, 1997 to June 30, 1998 - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract No. R40042} 42. State Department of Health Services Agreement No. 97- 11885 - under the terms of the agreement, 100$ State funding in the amount of $100,000 is available to continue the Hepatitis A Prevention Project during the period January 1, 1998 to December 31, 1998 - APPROVE BUDGET TRANSFER B-099; APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract No. R40044) Page 357 December 23, 1997 December 23, 1997 97-398 93. Enloe Hospital - 1997-98 Options for Recovery Contract - the County Department of Social Welfare (BCDSW) is requesting approval of a $139,802 contract with Enloe Hospital to provide training services for the Options for Recovery Program. The BCDSW operates the Options Program in collaboration with the Touchstone Program at Enloe Hospital and the Butte County Department of Behavioral Health (BCDBH). The contract, commencing July 1, 1997 through June 30, 1998, is in the maximum amount of $139,802 {75~ Federal/17.5 State/7.5~ County (Enloe Hospital/BCDBH/BCDSW) - action requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND AUDITOR-CONTROLLER. 44. Gerald Flanagan, attorney at law - proposed is an agreement for the provision of legal services required by the Welfare Department/Children's Services Division which continues the services provided by the current contractor, Gerald Flanagan, from January 1, 1998 through June 30, 2000. The monthly contract amount of 59,491 (100 State) includes compensation for appellate counsel hired by Mr. Flanagan - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF AUDITOR-CONTROLLER. 45. Alcohol and Drug Advisory Council - the Director- Department of Behavioral Health requests that the Alcohol and Drug Advisory Council, which is no longer mandated by the State, be dissolved - action requested - DISBAND THE ALCOHOL AND DRUG ADVISORY COUNCIL. Maurice Johannessen, Senator, Fourth Senatorial District - writes to alert the County to a proposed state water regulation change that could prove disastrous to north state ranchers, farmers and cities who depend on that water. The term being used is "Equitable Apportionment" of state water rights, which could reprioritize California's long-standing rights to surface and groundwater and put wildlife concerns first in line. A Draft Environmental Impact Report (DEIR), which will be released to the public by December 1, apparently identifies seven alternatives for prioritizing water.
