13. Butte County Library - equipment acquisition
through State of California Library System - action
requested - ACCEPT INTERNET WORKSTATION VALUED AT

14. Sheriff-Coroner - Board authorization is requested
to purchase one FAX machine in the maximum amount
of $1,800 (DEPARTMENT BUDGET) which is needed in
the Civil Division to FAX subpoenas and other civil
papers - action requested - APPROVE BUDGET TRANSFER
B-087 AND PURCHASE OF FIXED ASSET ITEM.
15. Sheriff-Coroner - under the Federal Drug
Interdiction Program, the County Sheriff's Office
was competitively selected to receive three U.S.
Army surplus OH 58 helicopters for use in the State
funded Marijuana Eradication Program (there is no
cost associated with the transfer of ownership) -
action requested - ACCEPT THREE BELL JET RANGER
HELICOPTERS AS FIXED ASSETS; DECLARE BELL 47
HELICOPTER SURPLUS, OFFER FOR SALE, AND AUTHORIZE
USE OF PROCEEDS TO REFURBISH NEW HELICOPTERS FOR
CIVILIAN USE; AND REQUEST THE AUDITOR-CONTROLLER
ESTABLISH AN "AIRCRAFT MAINTENANCE" TRUST FUND TO
DEPOSIT SALE PROCEEDS FOR MAINTENANCE ON NEW

94-396 16. Emergency Food and Shelter Program (Phase XIII) -
the Mental Health Department wishes to continue as
a Local Recipient Organization and accept $4,275 in
funding from the Butte, Glenn, Colusa FEMA Board
under Phase XIII of the Emergency Food and Shelter
Program. The funds will be used for an emergency
shelter voucher program for the homeless mentally
ill. The term of this agreement is October 1, 1994
through September 30, 1995. The FEMA Program
requires that funds be deposited in a bank that is
FDIC or FSLIC insured, will return cancelled
checks, and that funds be kept separate from all
other funds to document that all interest income is
placed back into the program - action requested -
APPROVE PARTICIPATION IN THE FEMA PROGRAM,
ACCEPTANCE OF $4,274 IN FEMA FUNDS, CONTINUATION OF
THE DEPARTMENT'S FEMA CHECKING ACCOUNT AND DEPOSIT
OF FEMA FUNDS INTO SAID ACCOUNT AT FIRST INTERSTATE
BANK, CHICO.
17. Medi-Cal Acute Psychiatric Inpatient Hospital
Program - proposed is the adoption of a resolution
approving County acceptance of $482,418 from the
State Department of Mental Health, participation in
the Fee-for-Service (FFS) Medi-Cal Acute
Psychiatric Inpatient Hospital Consolidation
Program, participation in the Small Counties
Emergency Risk Pool, and authorization for the
Director-Mental Health to sign the associated State
Department of Mental Health contracts and Small
County Emergency Risk Pool memorandum of
understanding (pending approval of County Counsel
and the Auditor-Controller) - action requested -
ADOPT RESOLUTION 94-144 AND AUTHORIZE THE CHAIR TO
SIGN, AND APPROVE BUDGET TRANSFER B-088 ACCEPTING,
ALLOCATING (REVENUE ACCOUNT NO. 4521705) AND
APPROPRIATING UNANTICIPATED REVENUE OF $482,418.
18. Butte County fiscal year 1994-95 Description of
Proposed Expenditure of Rural Health Services
Funds - the 100$ State funds are utilized to help
cover the costs of medical services to medically
indigent adults and children, with illnesses
diagnosed through the Child Health and Disability
Prevention (CHDP) Program. Disbursement of the
funds to Butte County hospitals and physicians will
be administered by the State - action requested -
APPROVE REPORT AND AUTHORIZE CHAIR TO SIGN
CERTIFICATION.

94-396 19. Audit report - Matson and Isom Accountancy
Corporation submit the Audit Report for the fiscal
year ended June 30, 1994 for Butte Community
College District - action requested - ACCEPT FOR
INFORMATION.
20. Adoption of a salary ordinance amendment -
Department of Social Welfare - (1) transfer of one
Social Worker IV/III position from GAIN (570-002)
to Services ( 570-004) ; ( 2 ) transfer of one Social
Worker III/II position from Services to GAIN (this
will leave the authorized position totals for the
GAIN and Services budget units unchanged); and (3)
in the Perinatal Program (570-007), add a one-half
time Office Assistant II/I position. Funding is
from within the current department budget
(FEDERAL/STATE) - action requested - ADOPT
ORDINANCE 3169 AND AUTHORIZE THE CHAIR TO SIGN.
21. Adoption of an ordinance amending Section 28A-2 of
Chapter 28A, entitled "Mobilehome and Mobilehome
Lot Standards" of the Butte County Code, pertaining
to violations of said chapter - action requested -
ADOPT ORDINANCE 3170 AND AUTHORIZE THE CHAIR TO
SIGN.
22. Introduction of a salary ordinance amendment - as
part of the 1994-95 final budget, the District
Attorney's Office was authorized two additional
Deputy District Attorney positions and one
Receptionist position. As a result of a
classification study conducted by the Personnel
Department, the. proposed ordinance modifies the
title and job specifications for the Chief District
Attorney Investigator/Administrator to District
Attorney Chief Investigator, eliminates a
Supervisor-District Attorney Investigator position
and adds a Manager-Staff Services position and a
Receptionist position (DEPARTMENT BUDGET) - action
requested - WAIVE READING OF THE ORDINANCE.
23. Resolution in recognition of Ted Cleveland, Butte
County Assessor, upon his retirement after 25 years
of dedicated service to the County of Butte -
action requested - ADOPT RESOLUTION 94-145 AND
AUTHORIZE THE CHAIR TO SIGN.

94-396 24. Oroville Quincy Highway reconstruction, Federal
highway administration project no. PFH119-1(2) and
2(2), Quincy-Oroville - the Federal Highway
Administration (FHWA) project to reconstruct the
Oroville Quincy Highway from Mountain House to Four
Trees has been completed, with the exception of a
few minor details that cannot be completed until
next spring. The FHWA has requested acceptance of
the project by Butte County, which is a condition
of the County/FHWA project agreement. Public Works
has conducted a final inspection of the project
with FHWA and U.S. Forest Service and is satisfied
the project is completed in substantial conformity
with approved plans and specifications - action
requested - ACCEPT FHWA PROJECT N0. PFH119-1(2) AND
2(2), QUINCY-OROVILLE FOR OPERATION AND
MAINTENANCE, AND AUTHORIZE DIRECTOR-PUBLIC WORKS TO
EXECUTE LETTER OF ACCEPTANCE ON BEHALF OF COUNTY.
25. Contract change order no. 4 - traffic signal
installation at the intersection of State Highway
32 and East Avenue (County contract no. 56171-92-
1) - contract change order no. 4 provides payment
to the contractor for two contract items of work
that are completed but had payment limits under the
contract. The contract work has been completed in
substantial conformity with the approved plans and
specifications, except for minor items and the work
is presently suspended due to inclement weather.
The withholding of these funds is not necessary for
the security of the contract. CCO no. 4 provides
payment of the following bid amounts, subject to a
five percent retention: Item l: clearing and
grubbing, $36,000; item 2: watering; $35,000 -
action requested - APPROVE CONTRACT CHANGE ORDER
NO. 4 AND AUTHORIZE CHAIR TO SIGN.
26. Program supplement no. 017 to State-Local
Transportation Partnership Program agreement no.
SLTPP-5912 - reimbursement of funds for qualified
projects under State-Local Transportation
Partnership Program requires execution of a Program
Supplement to Master Agreement SLTPP-5912. Program
Supplement No. 017 covers funding for reimbursement
of participating share of construction costs for
the project to reconstruct Oroville Bangor Highway
from La Porte Road to 1.5 miles west and La Porte
Road from Oroville Bangor Highway to 1.1 mile
south, Project No. SB94-5912(008) - action
requested - ADOPT RESOLUTION 94-146 AUTHORIZING
EXECUTION OF PROGRAM SUPPLEMENT NO. 017 AND

(CSU), Chico - proposed is an amendment to the
agreement to monitor 30 suction lysimeters and the
collection and analyzing of water samples for
nitrates at five field sites in County Service Area
114. Total compensation is not to exceed $7,800
(CSA 114) - action requested - APPROVE AMENDMENT TO
AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN.
28. Roger K. Masuda, a law corporation - proposed is a
one year renewal of an agreement to retain attorney
services to help on issues regarding the Butte
Basin Groundwater Users Association. All work
assignments are approved and monitored by County
Counsel's Office - action requested - APPROVE
AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN.
29. Chico Professional Offices - proposed is a lease
for the facility at 578 Rio Lindo Avenue, Suite 1,
Chico which has been utilized for the Mental
Health, Alcohol and Drug Services, Adult Services
Unit as their Adult Outpatient Unit since 1983.
There is no increase in the lease amount from last
year. The term of the lease is July 1, 1994
through June 30, 1995 for a maximum of $18,823.92
(RESTRICTED) - action requested - APPROVE LEASE
AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN.
30. 1994-95 State Department of Mental Health annual
performance contract - proposed is a contract which
covers the maintenance of effort, program
principles, program reimbursement methods, quality
assurance and performance outcomes for 1994-95.
The term of the contract is July 1, 1994 through
June 30, 1995 with no fiscal responsibility on
behalf of Butte County - action requested - APPROVE
CONTRACT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO
APPROVAL OF COUNTY COUNSEL AND AUDITOR-CONTROLLER,
AND AUTHORIZE DIRECTOR-MENTAL HEALTH TO SIGN
PERFORMANCE CONTRACT.
31. California State University, Chico, School of
Nursing - proposed is an agreement wherein students
from the CSU, Chico, School of Nursing will be
assigned for clinical nursing experience at the
Mental Health Department's Inpatient Unit.
Students placed in the program will participate
without financial compensation. The agreement is
effective July 1, 1994 through June 30, 1999 -
action requested - APPROVE AGREEMENT AND AUTHORIZE

94-396 32. Juvenile Hall - proposed is an agreement with
Plumas County for use of one bed at Juvenile Hall
with said County to pay a daily rental rate for the
occupancy of the bed. The agreement is similar to
the agreement (approved July 26, 1994) with Glenn
County for five beds - action requested - APPROVE
AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN.
33. Cal-Learn Program - the Cal-Learn Program (SB 35
and SB 1078/Statues of 1993) was established to
address the unique educational, vocational,
training, health, and other social service needs of
Aid to Families with Dependent Children (AFDC)
dependent teenage parents to help them achieve
self-sufficiency. The legislation requires all
counties to implement Cal-Learn by April 1, 1995,
and by September 1, 1995, all eligible teens must
be noticed of program requirements and become Cal-
Learn participants - action requested:
A. APPROVE CAL-LEARN PROGRAM PLAN FOR 1994-95;
B. Introduction of a salary ordinance amendment
adding two full-time Social Worker III/II
positions (FEDERAL/STATE) - action requested -

C. Northern Valley Catholic Social Service -
proposed is a contract for the purpose of
providing services to the County in
implementing and conducting the Cal-Learn

94-406 Public hearing - consideration of the re-adoption of a
Utility User Tax as follows:
The tax is levied in the amount of five (5) percent for
residential users and three (3) percent for non-
residential users living and doing business in the
unincorporated area of Butte County. Where utilities
offer rate assistance programs for customers with special
needs, citizens who meet the utility's criteria may be
exempt from, or eligible for, reduced tax levies.
Utilities taxed are natural gas, electricity, telephone
(except as exempted by the Federal Communications
Commission), and water. Estimated annual revenue from
the tax is $4,100,000 for fiscal year 1994-95. The tax
is collected by utility companies as part of their
regular billing cycle and forwarded monthly to the Butte
