By /s/ GENEVIEVE VINES, DEPUTY ORDINANCE NO. 484 AN ORDINANCE TO PROVIDE FOR THE REGISTRATION AND IDENTIFICATION OF DOGS; FOR CONTROLLING STRAY DOGS; FOR THE APPOINTMENT OF A POUNDMASTER; FOR THE IMPOUNDING AND DISPOSAL OF UNLICENSED DOGS; For the HOLDING OF RABID DOGS; -'OR THE MAINTENANCE OF POUNDS; FOR THE PAYMENT OF LICENSE FEES FOR DOGS; AND MAKING A VIOLATION OF THIS ORDINANCE A MISDEMEANOR, AND PROVIDING PENALTIES THEREFOR. The Board of Supervisors of the County of Butte, State of California, do ordain as follows SECTION 1. This ordinance has two purposes: (a) to provide for the registration and identification of dogs that are owned by residents who live in the unincorporated areas of Butte County; (b) to provide a method of controlling stray dogs in the unincorporated areas. `', SECTION 2: Each person who lives in the unincorporated area and owns a dog that is over three months old must register his dog within 30 days after this ordinance becomes effective and each year thereafter during the month of January or within 30 days after he moves into the unincorporated area of the County. The cost of registration will be $2.00 for each male or spayed female and $5.00 for each female. A certificate from a licensed veterinarian may be required before issuing any license for a spayed female dog. For any license issued after the time periods stated in this paragraph a penalty of $1 shall be added to .the cost of regis traticn. SECTION 3: The County Clerk shall be responsible for providing applications and license tags. Dogs may be registered at the Clerk's office or at other designated places. When an owner registers his dog, he will be given a tag which must be fastened to the dog's collar. . All registration fees shall be deposited with the Treasurer of the County of Butte. Applications of dogs that are registered shall be kept on file in the Clerk's office. SECTION 4: The Board of Supervisors may appoint a poundmaster or designate a county official or employee as poundmastor. The poundmaster shall see that provisions of this ordi- nance and laws of the State of California relating to registration and the control and dispo- sition of unlicensed dogs are enforced. SECTION 5: Any unlicensed dog running at large in the unincorporated areas may be im- pounded. If the dog is not claimed by an owner after 72 hours, it may be disposed of. Any unlicensed dog may be claimed at a pound if the owner registers the dog and pays the pound- keeper the cost of boarding and feeding the dog. SECTION 6: On the order of the Health Officer, the poundkeeper shall hold in isolation any dog that is rabid, suspected of being rabid, or has bitten a person. SECTION:7: The Board may construct and maintain pounds and arrange for transportation facilities, or the Board may contract for either or both of these services. The Board may require a faithful performance bond. The fees for collecting, impounding and disposing of " dogs may be determined by negotiation and shall be stipulated in any contract signed by the Board. If a county agency provides these services, the Board shall determine the fees. SECTION 8: The poundmaster shall see that dead animals are collected and disposed of. SECTION 9: It shall be unlawful to interfere with, oppose, or resist arly authorized person , who is collecting or impounding dogs under the provisions of this ordinance. For the immediate preservation of the public peace, health and safety of the area hereinabove described, and the residents and inhabitants thereof, it is necessary that this ordinance take effect immediately. A declaration of the facts constituting the necessity therefor is as follows: There is being contemplated the construction and establishment of a plant for the sale and storage of butane gas and/or other commercial construction within the aforesaid area hereby zoned as an R-1 District and wherein no commercial uses are permitted. Section 6. This emergency ordinance shall take effect immediately upon its passage and before the expiration of fifteen (15) days after its passage shall be published once, with the names of all members voting for and against the same in THE PARADISE POST, a newspaper published in said County of Butte. VINES,DEPUTY (seal) ------------------------------------------------------------------------------------------------ ORDINANCE NO. 488 AN ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AMENDING CERTAIN SECTIONS OF ORDINANCE N0. 417 OF SAID COUNTY Pursuant to amendments to the State Conservation and Planning Act of 1947, the Board of Supervisors of the County of Butte, State of California, do ordain as follows: Sections 1, 3 and 4 of Ordinance 417 of this County shall be and they are hereby amended to read and provide as follows: SECTION 1. MEMBERS. The Commission shall consist of eight members, not officials of Butte County, duly appointed by the Chairman of the Board of Supervisors. Each supervisor shall nominate one member. Three members shall be nominated by City Planning Commissions from their' respective memberships, with not more than one member from each such Commission. Such members' shall not be officials of this County. In addition to the appointed members of the Commission, there shall be two advisory members who shall be the County Counsel or his deputy and the County Engineer or his deputy. SECTION 3. OFFICERS. The Commission shall select its own chairman for term to be desig- nated by the Commission, and such other officers as may be deemed necessary by the Commission.' The Clerk of the Board of Supervisors or his deputy shall act ex officio as secretary of the Commission. SECTION 4. TERM OF OFFICE. Of the members of the Commission first appointed, two shall be appointed for terms of one year, two for terms of two years, two for terms of three years and two for terms of four years. Their successors shall be appointed for terms of four years. If a vacancy shall occur, otherwise than by expiration of term, it shall be filled by appoint- ment for the unexpired portion of the term. The terms of advisory members shall correspond to their respective official tenures. This license shall be obtained within thirty days after this ordinance become; effective and Rand year thereafter during the month of January, or within thirty days after a kennel goels into operation. No kennel license shall be issued until the poundmaster or his authorized representative has first issued a certificate that the kennol is operated in a sanitary and prOTer manner so as not to constitute a nuisancs to the neighborhood. The Administration of the salary plan for the classifications' listed in Section 3 (A) and (B) shall be as follows: A. New Employees. New employees shall be appointed at the first sten of the salary range in effect for the class of position to which they are appointed. If a department head is un- able to fill a position at the first step, he may request authorizty to appoint at a higher step of the range. The Administrative Officer shall investigate and report his findings to the Board. The Board may then authorize appointment in a higher step of the range. Whenever'. the Board grants such authority, all employees being paid at _lower steps in the same classifi- cation shall be given a special advancement to the step at which the new employee is appointed. B. Reemployment. A person reemployed in a class of position in which he previously held permanent status and from which he was separated in good standing may, upon recommendation of the head of the department in which he is being reemployed and approval of the administrative officer, be appointed to the same step of the salary range for the particular class of position as the step which he occupied at the effective date of his resignation. C. Step Increases Within Range. At the beginning of each fiscal year all permanent employees may be given a regular advancement to the next step in their salary range subject to the following conditions: (1) The step advancement must be based on satisfactory performance and be recommended by the person's administrative superior--the department head or administrative officer, whichever is appropriate--and be approved by the Board. The following provisions shall at,ply to overtime work: (1) In the event an hourly-rated employee is required to work eight or more hours in any one work day in a classification rated above his normal working classification, the prevailing rate may be paid to the employee at the discretion of the department head. (2) For other permanent employees except for resident hospital physicians, if in the judgment of a department head, work beyond the normal work day or work week is required, he may authorize such overtime to be compensated for in equivalent time off. In unusual circum- stances, on the recommendation of the department head and with advance approval of the Board of Supervisors, employees may be paid for overtime service at the same rate at which said persons,' are employed. (3) Resident hospital physicians shall be on duty, at the times, and in the manner prescribed by the hospital administrator, who may however, in his discretion allow compensating time off for work performed on legal holidays only. Such compensating time off if granted and not taken shall not be paid for upon termination of employment and shall not be a charge against the county without the approval of the Board of Supervisors. (4) The maximum amount of equivalent time off for overtime permitted in any one calendars year shall be ten (10) working days, unless otherwise ordered by the Board of Supervisors. (5) No department head may employ a person from outside the service of the County or from outside his department as a substitute for a regular employee who is on leave of absence with pay on account of overtime service, nor shall any department head assign or transfer any person within the department as a substitute for any person who is on leave of absence with pay on account of overtime service, where such person assigned or transferred receives an increase in pay as a result of such assignment or transfer, it being the intent of this pro- vision that where persons are allowed time off with pay for overtime service the department must perform the work of such absentee. without additional cost or expense. On recommendation of the Hospital Administrator, hospital employees assigned to duty on the evening or night shifts mayl! receive $10.00 per month extra. SECTION NO. 6 CLASSIFICATION PLAN. The classifications listed in Section 3A constitute the Classification Plan, originally contained in the "Personnel Classification and Pay Plan, Butte County, Calif- ornia," dated 1950. A. Class Specifications. Each classification shall have a written class specification describing the duties of the position and the qualifications necessary for a person to hold the position. These specifications may be revised or abandoned on recommendation of the Admin- istrative Officer and approval on minute order by the Board of Supervisors. B. Allocation of Positions to Classifications. The number and classification of perma- nent positions shall be as approved by the Board of Supervisors in the Final County Budget. After the Budget is adopted, department heads shall not appoint more persons to a classification at any given time than the budget provides without prior approval of the Board of Supervisors,',;' except that with the approval of the Administrative Officer, an appointment may be made to a lower grade of an authorized classification without permanently downgrading the position unless this is agreed to by the department head. (2) Unused vacation may be accumulated to a total of not more than 20 working days, or four calendar weeks. (3) Vacations shall be taken at such times as may be approved by the heads of the depart- ments. (4) No vacation shall be allowed to any person who is discharged from County service for cause. (5) A person about to resign, about to retire or who is to be laid off without fault on his part, and who has earned.vacation time to his credit shall be paid for such vacation on the effective date of such resignation, retirement or layoff. However, on the recommendation < of a department head and with the approval of the Administrative Officer, unused vacation time may be withheld from an employee who resigns without giving two-weeks notice to the department head. G. Sick Leave with Pay. (1) After six months of continuous service, each officer and employee in a permanent posi- tion shall be entitled to one working day of sick leave with pay for each month or major fraction thereof served, up to an accumulated total of 60 working days. Such sick leave with pay can be granted only upon the recommendation of the department head in case of bonafide illness of an employee. A department head or the Administrative Officer may require evidence in the form of a physician's certificate or otherwise in the adequacy of the reason for an employee's absence'. during the time sick leave is requested. (2) In the event an employee is absent due to disability incurred on duty he may utilize accumulated sick leave at the time of disability to compensate for the difference between Work- men's Compensation insurance allowances and full pay. H. Absence Due to Death or Critical Illness in Family. Whenever any person holding a , permanent position provided for by this ordinance, the compensation for which is fixed by the month, is compelled to be absent from duty by reason bf the death or critical illness where death appears to be imminent, of either father, mother, brother, sister, wife, husband, or child, such ,person shall be entitled to a maximum of three (3) working days absence with pay. I. Leave of Absence Without Pay. Leave of absence without pay may be authorized by the ,Board of Supervisors upon the recommendation of the Administrative Officer. An employee shall not be entitled to leave of absence as a matter of right, but only upon good and sufficient reason, and then not to exceed a period of one year. Upon returning to active employment, the employee may be paid at the same step that was in effect when he began his leave of absence, J. Holidays. (1) Monthly rated employees shall have time off with pay on those legal holidays desig- nated by law or by proclamation. Without limiting the generality of the term "sale by pal lic auction" the same shall include a We in which, instead of the lidders making increasingly higher bids for an article or articles of merchandise offered for sale, thp auctioneer annaunces the price 36.2 at which he will sell one or more articles of merchandise and then, if no sale occurs, increas- ingly adds additional Articles of merchandsie to those originally offered, with or without vary- ing the previously announced price, until a buyer is finally induced to buy the accumulated ar- ticles at the price fixed; and such term shall also include a sale in which, instead of the bidders making increasingly higher bids for an article or articles of merchandise, the auction- eer announces the price at which he will sell one or more articles of merchandise and then, if no sale occurs, decreases the price of the article or articles so offered until a buyer is finally induced to buy the same. SECTION 90g. It shall be unlawful for any person, firm or corporation to sell, or attempt''' to sell, by auction, or to advertise for sale by auction in any manner, any goods, wares or merchandise falsely representing or pretending the same to be in whole or in part a bankrupt or insolvent stock, or damaged goods, or goods savved from a fire, or to make any false state- ment regarding the previous history, ownership, quality or character of such goods, wares, and merchandise; or to offer for sale at auction any article and induce its purchase by any bidder'' and thereafter to substitute another article in lieu of that offered to and purchased by the bidder, except with the bidder's express knowledge or consent. It shall be unlawful for any person falsely to act as bidder in the capacity of "capper", "booster", or"shiller", as those terms are commonly used and employed in the business of auction- eering, for the purpose of increasing the amount of bids at any auction sale, or to offer to make, or to make, any false bid, or to pretend to buy any article offered for sale at public auction. It shall be unlawful for any permitee to connive, procure, or acquiesce in any act or acts of such false bidding. SECTION 90h. The provisions of this ordinance shall not apply to judicial sales or to sales by executors or administrators; and the provisions hereof relative to permit and bond shall not apply to any auction or auction sale conducted and held for charitable or benevolent pur- poses, and wholly conducted in good faith by charity, church, or other sponsor of such auction or sale. SECTION 90i. This ordinance is an amendment to Article 3 of Chapter VII of the County Code of the County of Butte, and all applicable provisions thereof, including the penal provisions of 'Section 90, but not limited thereto, shall govern the interpretation and enforce ment hereof. This Ordinance shall take effect thirty days after its passage and before the expiration of fifteen days after its passage it shall be published with the names of the members voting for and against the same at least once in PARADISE POST, a newspaper published in the County of Butte, State of California.
