Such registration shall expire at midnight on the 30th day of June, 3955, and anmanlly thereafter, and shall be renewed ka�.nne--r, before the, let. day of August of each year. The Beard of Supervisors of the County of Butte, State of California, do ordain as follows ' SECTION 1. For the purposes of this ordinance certain words and phrases are hereby defined as follows: "Cramp site" is any area of land within the unincorporated area of this County occupied for camping purposes by any person or persons, whether for sleeping or cooking or recreation, or any combination thereof, and whether tents or other movable structures are employed or not. "Trailer" is any camp car, trailer, trailer coach or other vehicle, with or without its own motive power, which is designated and constructed to travel upon public thoroughfares and to be used for human habitation or any aspect thereof, including but not limited to sleeping or cook- ing. Removal of wheels to immobilize the trailer shall not change this definition. "Trailer site" is any area of land within the unincorporated area of this County used for the parking of a trailer and its employment in say manner as a human habitation, including but not limited to sleeping, cooking or any other aspect or component of human use. SECTICN 2. No person shall use, occupy or attempt to use or occupy any camp site except under the followin;; conditions, and in full compliance with each of them, viz; a. That all litter, refuse and food and human waste shall be burned or adequately buried, as the same accumulates, at a safe distance from any water source and in such a manner that the same shall in no way enter into any river, stream, lake, pond, reservoir or other body of water' within the County of Butte; provided that food waste and litter may be kept in insect and odor proof containers for a period not in excess of 48 hours. The burning of any refuse, litter or food wastes shall be done in such a manner as not to create a nuisance to occupants of neigh- boring camp sites or premises. b. That all fires be located, maintained and guarded at all times in such places and in such a manner as not to endanger property, including the property of the camper, or trees, brush or any other type of vegetation within or in the vicinity of the camp site. c. That the camp site shall contain at least 100 square feet of ground area for each person in the camping party, and in no case less than 800 square feet. d. That all bedding be maintained in a dry, clean and sanitary condition, free of insect parasites and noisome odors. e. That the camp site center shall be no less than 10 feet from the nearest boundary of any other campsite or trailer site. f. That the camp site shall afford adequate drainage for surface waters, including storm waters, and shall not be so located as to endanger "life, health or property in the event of a sudden runn-off of surface waters, in natural water courses or otherwise. g. That no dogs or other household pets or domestic fowl shall be permitted to run at large in the camp site or vicinity. h. That when the camp site is vacated the same shall be cleaned and put in a completely sanitary and neat condition, regardless of its original condition at the time of first occupancy by the party. SECTION 3. That no person shall use, occupy or attempt to use or occupy any trailer site except under the following conditions, and in full compliance with each of them, viz: a. That each of the provisions of sub-sections 2b, 2d, 2f, 2g and 2h hereof shall be complied with, the said subsections being by this reference incorporated in this section with the substitution of the words and phrases "trailer site" and "trailer occupant" for "camp site'' and"camper" whenever Lhe context so requires. b. That no waste water or waste of any kind shall be permitted to run, escape or flow from We trailer upon the surfacr of the ground, or in any manner except into adequate and sanitary sewerage systems connected by liquid-tight and insect-proof pipes or tubes with the trailer, or into liquid-tight and insect-proof containers within or rigidly attached to the trailer. c. SECTION 4. The provisions of this Ordinance shall not apply to any trailer site or camp Me coming within the pnrview of Division 13, Part II of the Health and Safety Code of the State of Cs lifornia; or of Division 2, Part IX, Chapter 1, of the Labor Code of the State of California; nor shall the provisions of this Ordinance apply to any trailnr site or camp site located within any supervised pubLic park, public camp or public picnic groual operated, supervised or maintd.ned by the Federal Goverrurient or the State of California, or any political subdivision or municipality of the ,tato of California, SECTION 5. The County Health Dfficer of this County, and each of his dejuties and assistants, nNd the sheriff of this County and each of his depuMeo and the Cons&bAs of the County, are, and each of them is, authorized and empowered to enforce the provisions of this Ordinance. Any officer chargod with the duty of enforcing this ordinance shall have the righL at any time to go upon any trailer site or camp site which Is subject to the provisions hereof, whether lacateU upon private or public land, and inspect the same, and all. installa- tions thereon. Any person who prevents, hinders or delays such officer in the performance of' his duties is guilty of a. violation of this Ordirianue. SECTION 6. Any person who violates any provision of this OrdInance, including any separat subdivision of Section 3 or Section 4 hereof, which subdAiNons me declared to be severaWe and separote, is guilty of a misdemeanor; and upon conviction therefor shall be punished by fine of not to exceed $100.00 or by imprisonment in the county jail for not to exceed two months, or by both such fine and imprisonment. SECTION 7. The sections and provisions of this Ordinance are hereby declared to be severable, aad if any one or Pore of such sections or provisions, inc.luding subdivisions of sections, shall be determined by a cuwt of comMetent jurisdiction to be invalid for any cause, the remaining sections and provisions, gnd all of tWN W-U remain In force and of fent notwithstanding such determination. X75 OF SAID COUNTY, AND DECLARING AN EMERGENCY. The Board of Supervisors of the County of Butte, State of California, do ordain as follows: Section 1. The hereinbelow described area, situate in the County of Butte, State of Calif- ornia, shall be and it is hereby zoned as an "R-3" district, as such district is defined in Ordinance No. 475 of this County, the Zoning Enabling Ordinance, to which reference is hereby made. The said area so zoned shall be and it is subject to the restrictions and restricted uses applicable to "R-3" district, as so defined, the said area so zoned being particularly described as follows: Beginning at the intersection of the center line of Clark Road and Central Park Drive, thence Westerly along the center line of Central Park Drive to a point 150, west of the center line of the Southern Pacific Railroad track, thence southwesterly and parallel to the center line of said railroad track to a point 600' south of the center line of Elliott Road, thence easterly and parallel to the center line of Elliott Road to the center line of Clark Road, thence northeasterly from the center line of Clark Road to the point of beginning. Section 2. The regulation applicable to the district so zoned, as provided in the said Zoning Enabling Ordinance are as follows: This district is for multi-dwelling units and all uses permitted in "R-1" and "R-2" Districts, subject to the securing of a use permit for any use for which a use permit is required in any "R-1" District; and the following uses permitted subject to securing a use permit in each case: (a) Hotels, residential clubs and lodges (b) Hospitals, rest homes, sanitariums and clinics (c) Motels Section 3. The penalties for violations of the zoning hereby imposed upon the said district shall be as provided in the said Zoning Enabling Ordinance. Section 4. The ordinance shall be, and it is hereby declared to be in full force and effect from and after the date of its passage, pursuant to the emergency hereinafter found and declared; and it shall remain in full force and effect until such time as a permanent ordinance covering the above-described area shall take effect, following notice, public hearings, and such other procedures as are provided in said Zoning Enabling Ordinance, or until such time as the Board of Supervisors shall determine that the said area shall not be zoned as an "11-Y district. It shall be unlawful to interfere with, oppose or resist any authorized person who is collecting or impounding dogs under the provisions of this Ordinance, and such author- ized person may go upon private property for the purpose of enforcing this ordinance or coll- ecting or impounding dogs. Any such authorized person, other than a peace officer, shall wear a badge. YOLK By /s/ Genevieve Vines, Deputy County Clerk Chairman ORDINANCE NO. 506 AN ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, ESTABLISHI=IG A GENERAL SETBACK LINE ALONG PUBLIC STREETS, ROADS AND HIGHWAYS, TO BE KNOWN AS THE BUTTE COUNTY SETBACK ORDINANCE AND BEING A PORTION OF THE STREETS AND'HIGHWAYS UNIT OF THE MASTER PLAN OF SAID COUNTY: SPECIFYING THE PURPOSES AND EFFECTS OF SAID SET- BACK LINE: PROVIDING FOR VARIANCES: AND PRESCRIBING PENALTIES FOR VIOLATIONS OF THE ORDINANCE. The Board of Supervisors of the County of Butte, State of California, do ordain as follows;', SECTION 1. A general building setback line is hereby adopted within the unincorporated area of the County of Butte, State of California, as hereinafter specifically provided. SECTION 2. a). This ordinance is part of the precise plan for streets and highways under the Master Plan of the County; and is also adopted pursuant to the provisions of Article 1, Chapter, Title 7 of theGovernment Code of the State of California. b). It is found and declared that all requirements of reference, notice and hearing T elative to the adoption of precise plans, under Article 11, Chapter 3, Title 7 of the said ;':Government Code, have been heretofore complied with; and that the Butte County Planning CommisS- .'ion has recommended the adoption of this Ordinance to the Board of Supervisors. c). The purpose of this Ordinance is to provide for and insure the preservation and the orderly, economic and adequate development and expansion of an adequate highway transportation` system within the County; and to protect and conserve the public interest, presently and for the future, in streets, highways and roads within the County, having adequate alignment, di- mensions and vision clearance, by preventing the encroachment of permanent improvements the 2existence of which would render unnecessarily difficult, impracticable and uneconomic the mainten- ance and expansion of an adequate highway system., It is found and declared that the establishment 'of a minimum setback line is necessary to the carrying out of the general purposes set forth in the subsection, and to the protection and preservation of the public interest and safety. d). This Ordinance shall be known and cited as the BUTTE COUNTY SETBACK ORDINANCE SECTION 3. A building line setback is hereby established along each side of every street, 'highway and road which is dedicated to the public use and is within the unincorporated area of rthis County. Such building line set-back shall be and it is hereby located parallel to and distant I,fifty (50) feet from and on both sides of the established centerline of each such street, highway and road. The space between the setback lines on either side of each such street, highway and road shall constitute the setback zone, which shall be one hundred (100) feet in width. SECTION 4. It shall be unlawful to erect, within any setback zone, any building or structure whatsoever, including but not limited to derricks, windmills, silos, outdoor motion- picture screens, advertising structures, barns, houses, outbuildings and platforms; or to dig,', excavate or install within any setback zone any well or other excavation whether for water or for oil or other hydrocarbon products or for any other purpose, or install subsurface structure of ;any kind; provided, that this section shall not apply to trees, agricultural crops, open fences , or public utility installations (exclusive of permanent buildings) erected under authority of law; ',nor shall it apply to any building, structure, wall, excavation or subsurface structure in exist '..' tence as of the date of this Ordinance, all of which existing buildings, structures, walls, exca- vations and subsurface structures shall be deemed to be in non-conforming uses. SECTION 5. This ordinance shall apply to any d;reet, highway or road within the unincor- , porated area of this County which is hereafter dedicated to and accepted for the public use, effective as of the date of acceptance of the same for public use by duly constituted authority; ; provided, that any building, structure, well, excavation or subsurface structure within the setback zone of any such street, highway or road which is in existence at the time of acceptance of the same for public use, shall be deemed to be a non-conforming use and shall not be subject to Section 4. New employees shall be appointed at the first step of the salary range in effect for the class of position to which they are appointed. If a department head is unable to fill a position at the first step, he may request authorizty to appoint at a higher step of the range. The Administrative Officer shall investigate and report his findings to the': Board. The Board may then authorize appointment in a higher step of the range. Whenever the Board grants such authority, all employees being paid at lower steps in the same classification' shall be given a special advancement to the step at which the new employee is appointed. (B) Re-erpployment. A person re-employed in a class of position in which he previously held permanent status and mom which he was separated in good standing may, upon recommendation of the head of the department in which he is being re-employed and approval of the Administrative Officer, be appointed to the same step of the salary range for the particular class of position' as the step which he occupied at the effective date of his resignation. The employee may be increased to this step upon writtea recommendation of Lhe department head. 384 (K) Overtime: The following provisions shall apply to overtime work. l: In the event an hourly-rated employee is required to work eight or more hours in any one work day in a classification rated above his normal working classification, the prevailing rate may be paid to the employee at the discretion of the department head. 21 For other permanent employees except for resident hospital physicians, if in the judgment of a department head, work beyond the normal work day or work week is required, he may: authorize such overtime to be compensated for in equivalent time off. In unusual circumstances, on the recommendation of the department head and with advance approval of the Board of Super- visors employees may be paid for overtime service at the same rate at which said persons are employed. 3: Resident hospital physicians shall be on duty at the times, and in the manner prescribed by the hospital administrator, who may however, in his discretion allow compensating;; time off for work performed on legal holidays, only. Such compensating time off if granted and not taken shall not be paid for upon termination of employment and shall not be a charge against the county without the approval of the Board of Supervisors. 4. The maximum amount of equivalent time off for overtime permitted in any one calen- dar year shall be ten (10) working days, unless otherwise ordered by the Board of Supervisors. 5. No department head may employ a person from outside the service of the County or from outside his department as a substitute for a regular employee who is on leave of absence with pay on account of overtime service, nor shall any department head assign or transfer any person within the department as a substitute for any person who is on leave of absence with pay%'. on account of overtime service, where such person assigned or transferred receives an increase in pay as a result of such assignment or transfer, it being the intent of this provision that where persons are allowed time off with pay for overtime service the department must perform the work of such absentee without additional cost or expense. (1)' Evening and Night Pay Differential for Hospital Employees. On recommendation of the Hospital Administrator, hospital employees assigned to duty on the evening or night shifts may rereceive $10.00 per month extra. SECTION NO. 6 CLASSIFICATION PLAN: The classifications listed in Section 3A constitute the Classification Plan, originally contemned in the "Personnel Classification and Pay Plan, Butte County, California'", dated 1950. (a) Class Specifications. Each classification shall have a. written class specifi cation describing the duties of the position and the qualifications necessary for a person to hold the position. These specifications may be revised or abandoned on recommendation of the Administrative Officer and gproval on minute order by the Board of Supervisors. (b) Allocation of Positions to Classifications. The number and classification of permanent positions shall be as approved by the Board of Supervisors in the Final County Budget. After the Budget is adopted, department heads shall not appoint more persons to a classification at any given time than the budget provides without prior approval of the Board of Supervisors, except that with the approval of the Administrative!; Officer, an appointment may be made to a lower grade of an authorized classification without permanently downgrading the position unless this is agreed to by the department head. (c) Classification Changes. A department head may request that a position be re- classified if he believes there has been a change in the duties and responsibilities of the position. Requests shall be made on forms provided by the Administrative Office. They shall be forwarded to the board with a recommendation by the Administrative Officer that the request be either approved or denied. When a position becomes vacant and before it is refilled, either' a department head or the Administrative Officer may recommend to the Board that the position be reclassified. (d). Review of Classification Plan. The Administrative Officer shall be responsible;' for continuous review of the classification plan. He may review classifications and make recom- mendations on classification problems to the Board. SECTION NO. 7: TERMS OF EMPLOYMENT: The following rules shall apply to all classified employees in the County of Butte: (a) Qualifications. Officers and employees holding positions upon tle taking effect of this ordinance are deemed to be qualified for the position to which they are allocated, subject to the right of the department head or the Board of Supervisors to dismiss any employee, in accordance with law. (b) Permanent Appointments. A new appointment or a promotion appointment to a classified position shall be made by a department head. However, any person considered for appointment must have the qualifications described in the class specifications for the position'! The Administrative Officer may review qualifications of prospective employees on the basis of information supplied by applicants; or he may require written or oral examiniation. Appoint- ments shall be made in writing on forms prescribed by the Administrative Office. So that qualifications of a prospective employee may reviewed, a copy of the appointment form shall be delivered to the Administrative Office before the person begins work or before his promotion' takes effect.
