OF SAID COUNTY, REFERRING TO EXISTING ORDINADTCE NOS. 475 and 522 OF SAID COUNTY AND DECLARING AN EMERGENCY The Board of Supervisors of the County of Butte, State of California, do ordain as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of Calif- ornia, shall be zoned as an 11R-2" Residential District as hereinafter described and subject, to all of the restricted uses applicable to an "R-2" District, said area so zoned being located in the Community of Paradise, California, described as follows: Beginning at the quarter corner common to Sections 22 and 23 of T. 22 N. R. 3 E; thence Westerly along half section line to its intersection with the centerline of Southern'' Pacific Railroad R/'"; thence Southwesterly along centerline of said R,!"' to its inter- section with the half section line of Section 29 of said Township and. Range; thence Southerly along said half section _line to quarter corner common to Section 32 and Section 5' of T. 21 N. THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE DO ORDAIN AS FOLLOWS: 1. That Ordinance No. 467 of the County of Butte,known as the "COUNTY CODE",- shall be ,amended by adding thereto Section 113, under Chapter IX thereof, entitled, "Miscellaneous", which said section shall read as follows: "Section 113: CLAIRVOYANTS, FORTUNE TELLERS, ETC: Every person engaged in the business of clairvoyance, fortune telling, psychist, seer, astrologist, plamist, or other persons claim- ing to read and/or foretell the past, present or future, shall pay a license tax of Two Hundred l; Fifty Dollars ($250.00) per quarter, payable to the Tax Collector of the County of Butte. Appli- cation for such license may be made to the Tax Collector of the County of Butte by the payment of the tax for one quarter, and, upon application being made, Tax Collector shall immediately refer applicant and application to the Sheriff of the County of Butte, and all applicants shall'I be photographed and fingerprinted by said Sheriff, and the Sheriff shall either approve or disa- pprove of the granting of said license within thirty (30) days. If the granting of said license is disapproved by the Sheriff, the license fee paid upon making the application shall be returned to the applicant. If the application is approved by the Sheriff, the applicant shall furnish to the Sheriff the name, age, sex, permanent address, and other pertinent information required by the Sheriff concerning each and every person who shall be employed by applicant in such business, or take part therein, in any manner whatsoever, and said applicant shall keep any and all records " of said business as shall be required by the Sheiiff, and shall submit copies thereof to the Sheriff, as he may require. A violation of this section shall be a misdemeanor." 2. This Ord'.nance is for the immediate preservation of the public peace, health and safety of the County of Bntte. SECTION 2. The following regulations shall apply in an "R-1'! Residential District: 2.1 Uses Permitted: 1). Single-family dwellings 2). Accessory buildings 3). The following uses subject to securing a Use Permit in each case: a). Golf courses and country clubs b). Public and quasi-public uses, including churches, fire houses, hospitals, parks and playgrounds, schools and public utility buildings. c). Private stables 2.2 Building Site Area Required.: Eight thousand one hundred twenty- five (8,125) sq. ft. 2.3 Minimum Buildings Site Width Required: Sixty-five (65) ft. 2.4 Front Yard Required: Twenty-five (25) ft. 2.5 Six (6) feet, unless building site is less than sixty (60) ft. in width, in which case side yards equal to ten (10) percent of such width, but not less than five (5) ft. shall be required. SECTION 3. The penalties for the violation of the zoning hereby imposed upon said district shall be as provided in the said. Zoning Enabling Ordinance. SECTION 4. The ordinance shall be, and it is hereby declared to be in full force and effect from and after the date of its passage, pursuant to the emergency hereinafter found and declared; and it shall remain in full force and effect until such time as a permanent ordinance covering the above-described area shall take effect following notice, public hearings, and other procedures as are provided in said Zoning Enabling Ordinance, or until such time as the Board of Supervisors shall determine that the said area shall not be zoned as an 11R-1" District. SECTION 5. For the immediate preservation of the public peace, health and safety of the area hereinabove described, and the residents and inhabitants thereof, it is necessary ',, that this ordinance take effect immediately. A declaration of the facts constituting the necessity therefor is as follows: The adoption of such Interim Zoning Plan is necessary in the public interest, to maintain the status quo in such district pending the determination of the application ' for such permanent detail zoning. Section 5 of said Ordinance is amended to read as follows: "SECTION 5: (a) The term "subdivision" as used herein, shall mean any land divided for the purposes of sale or lease, whether immediate or future, by any person, firm or corporation, into five or more parcels, excluding land dedicated for cemetery purposes, under the Health and Safety Code of the State of California. Provided, however, that when land is divided for the purpose of sale or lease into less than five parcels, for residential purposes each of such parcels shall ' comply with the minimum lot-size requirements set forth in Section �5, except upon application to and approval by the Planning Commission of reduced area or dimension requirements, or both; and , provided further that each such parcel shall border upon an existing public street or highway, or shall have adequate access to the same by a connecting right of way not less than sixty (60) , feet in width." "(b) Other terms used herein shall have the same meaning as prescribed in Division 4, 13art 2, Chapter 2, of the Business and Professions Code of the State of California, unless differently defined in this Ordinance." 2. No subdivision shall be approved unless the proposed provisions relating to domestic water supply, sewage disposal and surface-water drainage are adequate to preserve and protect public health and safeguard sanitation. The Butte County Health Department shall advise and make recommendations to the Planning Commission as to public health and sanitation requirements, and the subdivider's proposals relating to the same. A community sewerage-disposal system may be required when the subdivision is located within a reasonable distance of an existing, operating and available sewerage system, and it is practical and feasible to connect with and be serveO by Lhe same.''
