AN ORDINANCE TO PROVIDE FOR REGISTRATION AND LICENSING OF E DOGS IN THE COUNTY OF BUTTE, FOR THE IMPOUNDING AND KILLING OF UN� ✓ LICENSED DOGS, OR DOGS RUNNING AT LARGE OR IN VIOLATION OF STATE ,� LAW* AND CREATING THE OFFICE OF COUNTY POUNDM�ASTER AND PROVIDING 'FOR *EQ COMPENSATION TBEREOF, AND FOR THE MAINTENANCE OF A POUND IN 'CAR'ING FOR AND DISPOSING OF IMPOUNDED DOGS, AND PROVIDING LICENSE FEES FOR THE � REGISTRATION OF DOS, .POUND FEES AND CASTS, AND DECLARING THE VIC?LATIQN OF THIS ORDINANCE TO BE A MISDEMEANOR, AND PROVIDING PENALTIE FOR THE VIOLATIONS THEREOF. The Board of Supervisors of the County of Butte does., or.dain as follows: ;',SECTION 1: This Ordinance shall be entitled as above, and may in all pleadings or proceedings f be referred to as the "Log License Ordinance. f? ;{SECTION 2: (a) The term "Dog License" as used herein, . shall refer to a license required to be ,annually issued for each individual dog. (b) The term "Kennel Licenser' as used . in this Ordinance, shall be understood and ,construed to mean annual license to be issued to the owner or proprietor of such ]Kennel,wherei.n 1�there is maintained more than five dogs for breeding, training or treating or sale, or other E, Ecormmercial purposes. '( (c) The word "owner" as herein used, shall be construed to include any person who ,owns or controls or harbors or keeps- in- his possession, any dog over the age of three months. `SECTION 3, It is hereby provided that each person owning. any.. dog over the age. .of three months, shall procure. an fore each year a license for such dog, between the first day of October ,and the .last day of. December next ensuing of each year hereafter, or within a period of thirty days after reaching the age of 3, months., or .entering .the County of .Butte, and shall be required ' 'to pay for such license within said period the sum of One Dollar. .($1 C0) for . each male or spayed ,'female, and Two Dollars ($2.00) for each .female dog. If said. license fee is paid after the last lday of December,, said owner. shah, be required to pay the sura .-Of-Two Dollars ($2..00) as a licen- �E 'se. ,fee for . each dog or spayed female dog_ so, owned, and $4.00 for each female dog so owned, and ;any person, the owner of such:a dog, as defined herein, failing to pay said license fee as re- squired hereunder, siall ,be guilty of `a misdemeanor, and on conviction thereof for the first offense shall be ad. jud to pay -a. fire of not less than Three. Dollar's3.0 ) nor more than �Tw�nty-five Dollars($25.60)., and on failure to pay said fine,, the judgment shall provide that �xthe person found guilty shall be impj i.soned in the County Jail of Butte ..County for one day for ;each $3.00. of said. fine remaining. -unpaid, and in case said conviction s for a second offense of violating this Ordinance, the fine therefor shall be not .Less than. iwe' i ty-five Dollars ($25.00),` E;nor more. than ' One Hundred Dollars ( 100.00),. and in case such fine is not paid, .the judgment of ,,conytction shall provide that the person .found guilty. ,of such violation, shall be imprisoned in he �Cc d ty .-Jail: of .the County..of Butte. one day. for each Three Dollars (;3.00) of said fine re•- maining unpaid. `SECTION 4: J;t is hereby provided that each person who owns or controls- a. kennel., or place where there are kept more than five dogs. for breeding purposes, or for training or treating, or sale, ,or other commercial p' pope,, shall pay an annual license fee of Five Dollars ($5.00) for such 3kennel, which shall be the license fo all dogs regularly kept at said kennel. It is further provided that no kennel license shall be issued without a certificate !signed by the Poundmaster that such kennel is operated, .6r is to be operated in accordance with the provisions of this Ordinance, and unless such certificate is made, the owner of said kehnel ;will not be entitled to ,a kennel, license according to the. provisions of this Ordinance. It is furbher provided that when any dog is removed from such kennel, .. the owner thereof shall obtain 'ar annual license as required under this Ordinance. V` , SECTIONh 5: It shabe unlawful, and a misdemeanor, for any person to permit any dog owned by r, , hiM., to roam off of the premises where the same is keptor harbored, between the hours of six . o i clock P.M. , and six o 'clock A.M of the day following, and all persons owning or harboring O: dogs, shall keep, said dogs confined either on leash or chain, or in any building, or in any yard with enclosure sufficient to ;prevent such dog from escaping. PECTION b: It shall be unlawful,, and a misdemeanor, for any person to permit or cause any dog to ;run on the lands of another whereon poultry or livestock is kept, without the permission of the owner of such lands. �E {E ;,SECTION 7: The Tax Collector of the County of Butte .is hereby Guth-6rized and directed to procure suitable applications and license tags to be issued to the owner. or owners of dogs as required by this Ordinance. Said tag shall have a stamp thereon bearing the name of the County of Butte, 4m ,and the year of its issuance, and the owner or person having control ,of-,any dogs, as provided herein, shall pay. to the Tax Collector of the County, of Butte, . or the Poundmaster of said County; as hereinafter provided, the fee or fees required hereunder within the time provided above, and 00 ,shall procure such license and tag and shall attach said tag to a collar to be permanently worn E. Py said dog, and said application shall bear the name of the owner of said dog, and the owner 0 shall, in making such application, state the age,. sex,. color and breed of the dog for which said license is requested, and the name and address of the owner thereof and upon the. issuance of said license, the Tax Collector of the County of Butte shall: endorse upon said application, the number of the license tag issued in pursuance thereof, and all applications so endorsed, shall .be kept! on file in the office of the Tax Collector for public inspection, and it is hereby made the duty of said Tax Collector to collect in advance of the issuance of such license the fees herein re- quired. The cost of procuring the necessary tags and application for said license is hereby dec ; fared to be a charge against the County Pound Fund, and the County Purchasing -Agent is hereby directed to purchase such necessary tags and applications as may be required by the County Tax Collector annually. SECTION ; There is hereby created and established the office of County Poundmaster. Said Poundmaster shall be appointed by the Board of Supervisors, and hold 'office subject to the pleas- ure of said Baird, and said Board may, by resolution, from time to time employ such deputies or assistants to said County Poundmaster, to hold office at the pleasure of the Board, at, such com , pensation as may be by resolution fixed: Said County Poundmaster shall receive in full for' all services performed by him, such compensation as shall be fixed from -time to time by the Board of Supervisors, by resolution, payable monthly out of the County Pound Fund as hereinafter provided;. Thi Board of Supervisors shall, from time to time, make such provisions, as it may. deem proper, for the expense incident to the enforcement of this ordinance, for transportation facilities for: ;said Poundmaster, and for the expense of impounding and feeding dogs, . and disposing of the same.'::. SECTION 9: The duties of said County Poundmaster shall be as follows: To enforce all provisions of this Ordinance and. the laws of the State of - California relating to the issuance of licenses, the impounding and destroying of unlicensed dogs, the im-- pounding of sny licensed dog found running at large in the County of Butte when. the same is un- f lawful under the terms of this Ordinance; to destroy all dogs not redeemed by. any person as pro vided hereby; `to maintain and keep a pound or other place where dogs may be kept under restraint`€ in a proper and sanitary manner, and feed and keep in a humane manner all impounded dogs..` A :dog impounded under the terms hereof shall be kept and maintained by said County Poundmaster for a' period of seventy-two ('72) hours, after which, if said dog is not redeemed, or otherwise ..disposed of, it shall be humanely :destroyed by said County Poundmaster. The 'County Poundmaster shall; in addition to the aforesaid duties, cooperate with the Health Officer of the County for the "pre- vention of rabies, the quarantining of all dogs. suspected of having rabies, and shall with the `' consent of the owner, and upon the certificate of a qualified physician or veterinarian destroy any dog forthwith, infected with rabies. The County Poundmaster shall, upon the date when this Ordinance becomes effective, and thereafter upon his re-appointment` to office, give aor�d to, the County of Butte in the . penal sum of One Thousand Dollars ($1,000.00), with corpora to sureties, for the faithful performance of the duties of his office. SECTION 10: It is hereby provided that for taking up and impounding any dog as provided by this Ordinance, the Poundmaster shall collect a fee of Two Dollars ($2.00) , and in addition thereto, the sum of ten cents (10¢) per day for each day the dog is lawfully kept, as compensation for its feed and care; Itis further provided that any dog. taken up. and impounded under the terms of this Ordinance, may be redeemed by the owner thereof within said period of 72 hours while said dog is in the possession of said Poundmaster, upon the payment of all license fees due. un.der this Ordinance, and the necessary costs of impounding and keeping said . dog, and on payment of the sum of 10¢ per mile for each mile actually traveled in impounding and releasing said dog. (SECTION 11: The County 'Poundmaster shall pay unto the.. County Treasury all fees, costs or mileage ounty collected by him in discharge of his duties under this Ordinance, and the CTaxCollectorof the County of Butte is directed to pay all license fees by him collected to the said County k Treasury of the County of Butte, and the .County Treasurer . is required hereby to deposit. all said ` (bmoneys so received by him, in a separate fund to be known as theCoounty Pound Fund: which is here- ;� by established for the purpose of carrying out this Ordinance. All of said payrrients shall is made monthly, and shall be accompanied by an itemized .statement of collections and expenses., and it is ofurther provided that all sums to become due to the said County Poundmaster as salary and com- 'sensation shall be paid onlyupon on the rendition of an itemized claim, approved and allowed by 1the Board of Supervisors, and upon a warrant by them ordered to be drawn by the .County Auditor upon the special fund hereby created, and it is hereby expressly provided that no item of expense .or compensation accruing under the terms of this Ordinance shall be paid from any fund except such special fund hereby created. SECTION 12: The net amount from all fees collected for .the :issuance of dog licenses, and for the impounding, care and redemption of dogs, and -of .all. fines collected under the provisions of this:; 'Ordinance, or under, act No. 384 of the General Laws of the Otate of California, approved June 3,;' 1921, shall be paid into the County Treasury, and shall constitute a fund to be known as. the Coun- ty Pound Fund, which shall be used in the manner following: FIRSTLY: To pay the costs of the issuing of dog license tags, SECONDLY: To pay necessary fees and costs for impounding and keeping, and red- eeming of dogs impounded or killed, pursuant to law or this Ordinance. THIRDLY: The unencumbered balance remaining in said fund at the end of the fis cal. year may be carried over to the credit. of such fund for the next fiscal year or may be revert- ed to the general fund of the County. SECTION 13: It is hereby declared to be unlawful, and a misdemeanor for any person to commit any; act contrary hereto, or fail or refuse to do or perform any required act, under the terms her and such. violation or omission is hereby declared to be a misdemeanor, and is hereby made punish- able by a fine of not less than $3.00 nor more than $25.00, or by imprisonment in the County Jaii for a term not to exceed three months, or in case said fine is not paid, the person found guilty '; shahl be imprisoned in the said County Jail of Butte County, for a period of one day for each Three Dollars ($3,00) of said fine remaining unpaid. SECTION 14.- It is hereby declared that no person is eligible to, nor can be appointed County Poundmaster, or Assistant or Deputy unless he be a citizen of the United States, over the age of twenty-one (21) years, andhas resided in the County of Butte for one year continuously next before his appointment. SECTION 15; All Ordinances, or parts of Ordinances in conflict herewith, are hereby repealed. This Ordinance shall take effect thirty days after its passage, and before the expiration of fifteen days after its passage shall be published with the names of the ;;members voting for or against the same for at least one week in some newspaper published in the County of Butte. Said tag shall have a stamp thereon bearing the name of the County oP Butte, and the year of its issuance, and the- owner or person having the con- trop of any dogs, as provided herein, shall pay to the County Clerk of the County of Butte, or the Pound Master' of said County, as hereinafter provided, the fee or Fees required here- under within the time provided above, and shall procure such license and tad and shall attach `' said tag to a collar to be permanently worn by said dog, and said application shall bear the name of the owner of said dog,, and the owner shall, in making such application, state the age, sex, color and breed of the dog for which said license is requested, and the name and address of the owner thereof and upon the issuance of said license,' the County Clerk of the County of Butte, shale endorse upon said application, the number of the license tag issued in `' pursuance thereof, and all applications soendorsed, shall be kept on file in the office of the County Clerk for public inspection, and itis hereby made the duty of said County Clerk to collect in advance of the issuance of such license the fees herein required. Subject to the provisions hereinafter set forth the compen- sation of the assistants, deputies, clerks, attaches, employees and otYier persons employed in the offices, departments and institutions of the County of Butte, and the number thereof, are hereby fixed as set forth in the schedules in the sections following: SECTION . 2i Except where otherwise indicated in the following sections the compensations herein provided shall be deamed to mean the compensation per month. County officers and employees who have been continuously employed by the County of Butte for one year or more shall be entitled to sick leave with pay ' j not to exceed, however, thirty days for any one illness, provided that said officers and em- ployees shall establish by a certificate of a duly licensed and practicing physician that they are wholly incapacitated from performing any duties of their employment. 'Sick leave with �i pay shall not be allowed for confinement by reason of childbirth or for injuries compensable EE f; under the Norkmen' s Compensation Act. B. The officers and heads of departments of the County .shall notify the County Auditor in writing of the absence of any employee when said employee shall have been absent from work or employment by reason of illness for three. continuous days. All ordinances and resolutions inconsistent with the provisions 6 "` of this ordinance are hereby repealed. SECTION 7.
