AN ORDINANCE SUBdITTINu TO THE QUALIFIED EZECTORS OF
THE COU""I OF BUTTE, STATE. OF CALIFORNIA, PROPOSED AMEND-
MENTS TO THE CalURTER OF THE COUNTY OF BUTTE, STATE OF
CALIFORNIA, SAID 'AMENDMENTS ,BEING PROPOSED BY THE BOARD
OF SUPERVISORS OF THE C(UNTY OF BUTTZO` STATE OF CALIF-
ORNIA, AS PROVIDED IN ARTICLE XI, SECTION &, OF TkF
CONSTITUTION OF THE STATE OF CALIFORNIA, AND PROVIDING
THAT THE SAME BE VOTED UPON AT A SPECI,,L ELECTI'N TO BE
HELD ON THE FIRST DAY OF JUNE, 1945, CALLING SAID
ELECTION, ESTABLISHING VOTING PRECINCTS FOR SAID ELECTION,
FIXING POLLING PLACES THEREFOR, APPOINTING ELECTION
OFFICERS THEREFOR, AND DIRECTING THE COUNTY CLERK OF THE
COUNTY OF BUTTE, STATE OF CALIFORNIA, TO CAUSE THE PRO-
POSITIONS SUBMITTING THE PROPOSED AMENDMENTS TO THE CHAR-
TER OF THE COUNTY OF BUTTE, AND THE QUESTION OF THE
ADOPTION OR REJECTION OF SAID PROPOSED AMENDMENTS TO THE
ELECTORS TO BE PRINTED ON THE BALLOT FOR SUCH SPECIAL
ELECTION
WHEREAS, under the provisions of Section. 7j, Article XI of the Constitution of
the S=Mate of California, the Charter of the County of Butte, may be amended by proposals
submitted by the Board of Supervisors of the said County to the qualified electors
thereof at a general or special election, and
WHEREAS, pursuant to resolution of the Board of Supervisors of the County of
Butte, State of California, dated April 5th, 1948, passed acid adopted in conformity with
with the provisions of Sections 7j, Article XI of the Constitution of ttae State of Calif-
ornia; said proposed amendments to the Charter of the County of Butte were published for 10
days in the Oroville Mercury-Register, a daily newspaper of general circulation printed,
published and circulated in the said County of Butte, and
WHEREAS, a primary elects n will occur in said County of Butte in not less than
30 days, nor more than 60 days of the said publication of the proposed charter amendments
as aforesaid;
NOW, THEREFORE, the Board of Supervisors of the County of Butte,,State of Calif-
ornia, does ordain as follows:
SectA.�,,n,lj That it is hereby ordered that a special election be held, and that
the same be consolidated with the primary election to be held throughout the County of
Butte, State of C<lifornia, on the 1st day of June, 1948, for the purpose of submitting to
the qualified electors of the said County of Butte the said proposed amendments to the
Charter of the County of Butte, pursuant to the pr.visi ns of Secti.:n 7j, Article XI of
the Constitution of the State of California; said consolidated election to be conducted
under the authority of Section 10050 of the Electi,ns Code of the State of California.
Section 2: That said special consolidated electin shall be conducted by Boards
of 'Election and elects,>n officers as provided for under the laws pertaining to consolidated
elections as set forth in the Electi<.:,ns Code of the State of California.
Secti,:)n 3: That at said special consolidated election the polls shall be opened
at '7 o'clock A.M. of the day of said election, and must be kept open until 7 ofelock P.M.
of the same day, when the polls shall be closed, except as provided by Section 5734 of
the Elections Code of the State of California.
Section 4: That during said hours said special consolidated election will be held
and conducted at the legally designated polling places in each election precinct in the
County of Butte; that the palling places in the several elect.icn precincts in said County
of Butte and the names of the several persons who have been found, and are hereby declared
to be qualified for their respective positi:ns, and have been appointed and :are hereby ap-
pointed as election officers .for the conduct of said special consolidated'election in the
several electin precincts as named, selected and designated by the Board of Supervisors of
said Countyof Butte, as provided by law, are as follows, to-wit:'

ballots, stationery, and all of the materials and things necessary for the proper -,and
legal conduct of said consolidated election to the officers of said election.
Section 6: That the propositi,:,ns of said proposed amendments to the Charter
of the County of Butte, State of California, in addition to any other matter required by
law, be designated and set out an tile ballots to be used in said con;3olid;ted election in
the manner and form as follows:
PROPOSITION NO. 1. (a) Amending Article IV, to Secti n No. 6
of the Butte County Charter to read as follows: "The compensa-
tion of the members of the Beard of Supervisors, District
Attorney, and the A adit6r shall be regulated by the Legisla-
ture of the State of California by statute applicable to the class
of counties in which Butte County is now, or shall hereafter be
placed. The Board of Supervisors shall have the power, and it
shall be the duty of such Board to regulate the salary of county
or township officers, including Justices of Inferior Courts,
other than the Board of Sup-rvisors, the District Attorney, and
the Auditor." (b) "That the compensation of any elective
county or township officer shall not be increased during the
term for which tie was elected or appointed." (c) 'IT'

tion of any elective cr,unty or township officer shall remain the NO
same as now provided In Article IV, Section No. 6 of the Butte
County Charter until changed by the Legislature or the Board of
Supervisors of the County of Butte, as provided in Section (a)

Said Proposlti:n No. 1 is for the purpose of placing the
responsibility for the compensation of elective, county and
township officers upon the Board of Supervisors, with the excep
tion of tile Board of Supervisrs, themselves, the District
Attorney, and the Auditor, whicil would be regulated by the State
Legislature upon recommendation of tile Grand Jury of the County
of Butte, as required by law.
PROPOSITIGN NO. 2. Amending Article IV, Section 11 of the Butte
County Charter to read as follows: wwThe compens,,.,ition of the :-----------
appointive county officers, assistants, deputies, clerks or : YES

the Butte County Charter may be increased or decpersed by the
Board of Supervisors as provided by law".
This propcsitin is to clarify the responsibility of the NO

schedules of salaries for appointive officers, deputies, and
assistants.

and be in face at the expiration of the publication of the same as herein provided and
directed.

ORDINANCE NO. 415 ,OF TETE COUNTY OF BUTTE
STATE OF CALIFORNIA
The Board of Supervisors of the County of Butte, State of California, does ordain
as follows.
lm SECTION 677 of Ordinance No. 415 of the County of Butte is amended to read as
follows®
,,SECTION 677: Every pawnbroker shall pay a license fee of Thirty Dollars per quar-
ter',. For the purpose of t.ais ordinance a "pawnbroker is defined to be a person, firm or cor-
poration engaged in conducting, managing or carrying on the business of "pawnbroking, or the
business of lending money for himself or any other person, firm or corporation upon personal
property, pawns, or pledges; or the business of purcaasing articles of personal property and
reselling, or agreeing to resell such articles to the vendors or their assignees at prices
agreed upon at or before the time of such purchase%
A ,,pawnshop„ is defined to be any room, store, building or other place in which any
such business is engaged in, carried on or conducted.
Except as hereinafter in this section provided every second-hand dealer shall pay
a license fee of Twenty-Five Dollars per year.
For the purpose of this ordinance a "second-hand dealer" is defined to be a person,
firm or corporation whose principal business is conducting, managing or carrying on the busi-
ness of buying, selling or otherwise dealing in miscellaneous second--hand goods, wares or
merchandise®
Except as hereinafter in this section provided, every junk, dealer shall pay a licenee
fee of Twenty Five Dollars per quarter. For the purpose of this ordinance, a w+junk dealer„
is defined to be a person, firm or corporation having a fixed place of business in the County
of Butte, and whose principal business is conducting, managing or carrying on a business of
buying, selling or otherwise dealing in, either at wholesale or retail, any old rags, sacks,
bottles, cans, papers, metal, wrecked machinery or automobiles, or other articles commonly
known as junk.
Except as hereinafter in this section provided, every junk collector shall pay a
license fee of Ten Dollars per year for each wagon, vehicle or cart used by him in his busi-
ness+ as such junk collector. For the purpose of this ordinance a "junk collector" is defined
to be a person, firm or corporation not having a fixed place of business in the County of
Butte, who goes from house to house, or from place to place, gathering, collecting, buying,
selling, or otherwise dealing in any old rags, sacks, bottles, cans, papers, metal or other
articles commonly known as junk.
Provided, however, that any institution or organization which is conducted, managed,
or carried on exclusively for the benefit of charitable purposes, from which no profit derived
either directly or indirectly by any individual firm or corporation, other than bona fide em-
ployes thereof, engaged in or carrying on the business of second-hand dealer or junk dealer,
shall pay a license fee of One Dollar per year, and any such charitable institution or organ-
ization engaged in or carrying on the business of junk collector shall pay a license fee of
One Dollar per year for each wagon, vehicle or cart used by it in such business; and
Further provided, that any such charitable institution or organization claiming to
came under the provisions of this proviso shall furnish to the Board of Supervisors, in addi-
tion to the shatter of information otherwise provided for in this ordinance,a certified copy of
its corporate charter, if any, together with a .statement in writing, duly sworn to by one of
its officers; setting forthe the purposes of such institution or organization, which sworn
statement shall include a detailed statement as to its manner of doing business and dispensing:
charity, and including such other competent information with respect to such institution or
organization' as said Board of Supervisors may prescribe.°
2:' SECTION 687 of Ordinance No. 415 of the County of Butte is amended to read as
follows:
"SECTION 687: It shall be unlawful for any pawnbroker, second-hand dealer, junk
dealer, or junk collector to sell or otherwise dispose of any article or thing within five
days after making a report to the Sheriff as required in Section 682 of this ordinance that
such articl6 or thing has been purchased or received by such pawnbroker, second-hand dealer,
junk dealer,, or junk collector provided, however, that the provisions of this section shall
not apply to! motor vehicles duly and regularly cleared for transfer by the State of California,
Division of MOtorVehicles."
3:! SECTIONS 691 and 692 of Ordinance No. 415 of the County of Butte are hereby
repealed.

seconded by Supervisor Bille, and said ordinance was passed this 26th day of April, 1948, on

AN ORDINANCE FOR THE LEVY AND COLLECTION OF
TAXES FOR AUGIaENTIAG FUNDS FOR CAPITAL OUTLAYS
WHEREAS, the Board. of Supervisors of the County of Butte, State of California, by
ordinance, have created special funds for capital outlays within the County of Butte, to-wit,
1. Funds for the construction, acquisition, improvement, extension of, or addition
to, the Hall of Records of said county and the jail of said county, and/or other County build-
ings at Oroville, Butte County, California;
2. Funds for the construction, acquisition, Impr(,vement, extension of, or addition
to, the County Hospital Building and improvements therefor, and other County buildings used
in connection therewith at Thermalito District, Butte County, California;
3. Funds for the construction and acaulsition of the Butte County Clinic located
it Chico, Butte County, California;
AND, WHEREAS, it is necessary to augment the aforesaid special funds;
NOW, THEREFORE, the Board of Supervisors of the County of Butte, State of California,
does ordain as follows:
There is hereby created a special fund as provided for by Act 8496a of Deering's
General Laws of the State of California, as amended in 1945, to augment the special funds for
capital outlays hereinabove referred to and numbered 1, 2 and 3.
For the fiscal year 1948-49, taxes shall be levied and collected for the augmen-
tation of funds as follows:
For the fund for capital outlays for the construction, acquisition, improvement, ex-
tension of, or addition to, the Butte County Hall of Records and Jail, and/or other county
buildings at Oroville, Butte County, California, in the amount of ONE HUNDRED THIRTY-TWO
THOUSAND DOLLARS (4132,000.00).
The fund for capital outlays for the construction, acquisition, improvment, exten-
sion of, or addition to, the Butte County Hospital Building and improvements and other County
building used in connection
qnnection therewith in Thermalito District, Butte County, California, the
sum of ONE HUNDRED FIFTY THOUSAND DOLLARS (6150,000.00).
The fund for capital outlays for the construction, acquisition and improvement of
the Iktte County Clinic located at Chico, Butte County, California, the sum of TWENTY FIVE,
