HomeMy WebLinkAboutOrds 440-452 ORDINANCE NO, All ORDINANCE REPEALING SECTION 707 OF ORDINANCE 333 OOKIUNLY KNOWN AS "COUNTY CODE" AS AMENDED BY ORDINANCE NO. 397, A1Q) ENACTING NEW SECTION 707 OF "COUNTY CODE" WEEREAS, Ordinance No. 333, commonly known as the 'County Code'', set forth in Article 3 thereof, Section 707, certain regulations pertaining to the admission of minors to pool rooms, and WHEREAS, thereafter on the 9th day of August, 1946, Ordinance No® 397 was enacted repealing said Section 707, and enacting a new Section 707 of said ''County Code", and WHEREAS, it is now the desire of the Board of Supervisors of the County of Butte, State of California, to modify said Section 707 to comply with certain recreational needs in some cormiunities of the County; NOW, THEREFORE, the Board of Supervisors of the County of Butte, State of California do ordain as follows: 1. That Section 707 of Ordinance No® 333 as amended by Ordinance No. 397 is hereby repealed, 2. That Section 707 of Ordinance No. 333 shall henceforth read as follows: SECTION 707 PROHIBITING MINORS IN POOL ROOKS OR BILLARD PARLORS EiCEPT WMEN OPEHATED IN CONJUNCTION AITH BOWLING ALLEYS It is unlawful for a person owning, conducting or in charge of any pool, room or billard hall in the County of Butte, outside of the limits of a municipal corporation, to permit or allow any person under the age of eighteen years to enter or be in or about such pool room or bil.liArd hall,C14nless the same is operated in conjunction with and in the same building with a bowling alley This Ordinance shall take effect Thirty (30) days after passage, and before the expiration of Fifteen (15) days after its passage, it, shall be published with the names of the members voting for and against the same, at least once in the PARADISE POST, a newspaper published in the Au"y of Bate. I �IHEREAS, ORDINANCE NO. 438, fixing compensation of officers and employees of the t County of Butte, was duly passed on the 29th day of May, 1950, and I WHEREAS, it has become necessary to change certain compensations therein provided i and add new classifications thereto. NOW, THEREFORE, Be It Resolved that the Board of Supervisors of the County of Butte t does ordain that Ordinance No. 347 shall. hereafter read as follows: Section 1. See 7. Civil Defense and Disaster. Organization. All officers and employees of this county, together with those volunteer forces enrolled to aid them during a disaster, and Oil groups, organizations and persons who may by agreement or operation of law, including persons commandeered under the provisions of Section 6'(C) of this ordinance, be charged with duties incident to the protection of life and property in this county during such disaster, shall constitute the civil defense and disaster organization of the County of Butte. Sec, g. Divisions, Services and Staff of the Civil Defense and Disaster Organization. The functions and duties of the Butte County civil defense and disaster organization shall# be distributed among such ri_i.visions, services and special staff as the board of supervisors shall:" prescribe by resolution. The board of supervisors shall concurrently with the adoption of this ordinance, adopt a resolution setting forth the form of organization, establishment and designation of divisions and services, the assignment of functions, duties and powers, and the designation of offi8ers and employees. Insofar as possible, the form of organization, titles and terminology shalil conform to the recommendations of the Federal Government and the Office of Civil Defense df the State of California. Sec. 9. Punishment of Violation. It shall be a misdemeanor, Punishable by a fine of not to exceed -;:500.00, or by imprisonment for not to exceed six months, or both, for any person during a disaster: A. Wilfully to obstruct, hinder or delay any rrember of the civil defense and disaster or- anization in the enforcement of any lawful rule or regulation issued pursuant to this or= dinance, or in the performance of any duty imposed upon him by virtue of this ordinance; I i B. To do any act forbidden by any lawful rules or regulations issued pursuant to this ordinance, if such act is of such a nature as to give, or be likely to give assistance toithe enemy, or to imperil the lives or property of inhabitants of this county, or to prevent, hin- der or delay the defense or protection thereof; C. To wear, carry or display, without authority, any means of identification specified by the civil defense and disaster agency of the State. Ordinance No. 363 is hereby repealed. Sec. 11. Effective Date. This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and. safety, and shah take effect immediately. The following is a statement of the facts showing its urgency: i The National Security Resources Board of the Federal Government has recently published its plan for the civil defense of the country. The State of California, acting in accordance with the Federal plan, has enacted and made immediately effective the "Civil Defense Act �f 1-950:' Both the Congress and the Legislature have adopted comprehensive civil defense and,dzs aster laws. Both Federal and State plans contimplate immediate adoption of such local leis lation as is necessary to put into operation a coordinatedd.aneffects e civil defense an disaster program so that each. Citizen and each community will be ready in the event of a dis aster to afford as complete protection as is possible to life and property. This Ordinance shall apply to all unincorporated territory embraced within the limits of the County of Butte, State of California. 2. Definitions. A. "Sewage"; As used in this Irdinance, the word sewage shall. include any and all waste substalice, liquid or solid, associated with human habitation, or which contains or raspy be contaminated with human or animal excrete or excrement, offal or any feculent matter. B. "Sewage Disposal Systemo; As used in this 0dinance, sewage disposal system shall include privy, chemical toilet, cesspool, septic tank, drainfield, seepage pit, and any other structure or system used for the treatment or disposal, or discharge of sewage. Cr "Construction": As used in this Irdinance, construction shall include construction, major repairs, or alterations, and relocation. Section 3: Occupied places to have adequate sewage disposal system. It shall be unlawful for any person, firm or corporation to maintain or use any residence, place of business, or other building or place where persons reside, congregate or are em- ployed, which is not provided with a dewage disposal system satisfactory to the County Health Jfficer. Section 4t Unlawful. sewage disposal. It shall be unlawful for any person, firm, or corporation to construct, maintain or use any sewage disposal system which results in any of the following: A. Sewage overflowing any lands whatever, B. Sewage emptying, flowing, seeping, or draining into, or affecting any streams, springs, rivers, lakes, or other waters within the County of Butte. Provided, however, that if with respect to existing sewage disposal systems, it would be ex- ceptionally difficult, if not impossible, to comply with the Provisions of this Section of, the 'rdinance, the Health Officer shall have the power by special permit to allow such vari- ation from the provision of this section as will prevent unnecessary hardship or injustice, and at the same time most nearly accomplish the general purpose and intent hereof. Section 5. Permit to c0nstr0ct sewage disposal system. It shall be unlawful for any person, fisc, or corporation to construct any sewage dis- posal system which is not to be connected with an approved public sanitary sewer, without, first submitting plans of the proposed sewage disposal system to the Health Officer and 5e- curing a written permit from the Health Officer to construct said sewage disposal system. Said permit shall be conspicuously posted at the site of construction. The health Officer may require the following information to be submitted in the plans: A. Plot plan of the, promises, includin,,,, lot elevations. B. The size wid type of septic tpnk. C. The plan of the absorption field, including dimensions and other pertinent information. D. The type of soil and the results of percolation tests. S. Any other information relating to the safe and proper functioning of said sewage disposal system. No sewage disposal system constructed under the provisions of this ordinance shall be put into use until an inspection of the completed system has been made and a certificate of completion has been issued by the Health Officer. The Health Officer shall issue a certificate of completion immediately after his inspection of We completed sewage disposal system, provided that said system meets the requirements of this Ordinance. Failure of the health officer to inspect any system within fifteen (15) days after he receives a written request to inspect said system shall constitute a waiver by the Health Ifficer of said inspection and the cer- tificate of canpletion. Section 6- Permits for pit privies. it shall be unlawful to construct or maintain any pit privy for the disposal of sewage without a written permit from the Health Officer. No permit to construct or maintain a pit, privy shall be issued unless the following cond"ions are complied with-, A. The location of said privy shall be satisfactory to the Health Ufficor. B. The sewage deposited therein shall fall into a vault or pit in the ground, constructed especiaRy far that purpose. U. The privy building and privy vault shall be at all times inaccessible to rodents and insects. D. The privy building and vault shall be constructed in such a manner as to prevent the entrance of rain water and surface water into said vault or pit. E. All privy buildings shall be maintained in as clean and sanitary condition satisfactory to the health Officer at all times. The Health officer may, after rea;.5onable notice, revoke any permit to maintain a pit Privy if the above conditions pertaining to pit privies are not complied with. Section 7- T,iinirnum requirements for the construction of water carriage sewage disposal systems. At any residence, place of business, building, or other place where persons reside, con- gregate or are employed, where there is installed a water flubi toilet system, there shall also be constructed or installed a private and separate sewage disposal system consisting of a septic tank and underground drainage system for the sanitary disposai of the septic tank effluent, Said septic tank and underground drainage sjstem shall be so constructed as to meet the following require menw: A. Septic tanks. Septic tanks shall be of two-compartment construction, the first com- partment being twice the capacity of the second and having a minimum capacity, of 500 gallons. Said ta -ak shall be of the type constructed and located in accordance with tie recommendations of the State Department of Public health and the County health Officer. The septic tank is located above ground, it shall be air and odor tight. 1. Size: The minimum capacity of the septic tank shall be 750 gallons. The health officer, at his discretion, way require a larger septic tank, if he deems it necessary in order to carry out the Ment of this ordinance. 2. Materials: The septic tank shall be constructed of concrete, irrigation heart grade redwood or other equally dirable material satisfactory to the County health Officer. B. Drains: The effluent from the septic tank shall be discharged into an approved ab- sorption field, the construction of which shall be such that the effluent shall. at no time overflow the surface of the ground. The absorption field shall. be laid at a grade not to exceed 4" to 1COI� The effluent lines shall be laid in a Lreiieli not less than .1,811 wide, whict has a layer of 1" to 2-i" loose rock at least 6" thick on the bottom of the trench and at least 2" thick over the top of the effluent lines, A ininimum of 150 square feet of leaching area shall be provided in the bottom of the trench. Additional leaching area may be required by the Health Officer, if in his opinion it is necessary in order to insure the proper functioning of to sewage disposal system. Where conditions are such that, in the opinion of the Health officer, an absorption field cannot reasonably be expected to function, the health �i,'ficer shall allow other, means of underground effluent disposal, provided that such other means of disposal. do hot violate the laws of the State, or do not endanger the public health, or create a nuisance. Section 8- 'Enforcernent. it shall be the duty of the County Health Officer to enforce the provisions of this Or- dinance, and the County Health Officer, or his duly authorized representative, is hereby empowered to enter at any reasonable hour any premises necessary to the enforcement of this Ordinance. Section 9. Any person, firm, or corporation who violates or refuses or fails to comply with the provisions of tSis Ordinance shall be guilty of a misdemeanor, and shall be punished upon conviction by a fine of not less than 125.00 nor more then 4500.00, or by imprisonment in tne county jail for riot more than six (6) months, or by both such fine and imprisonment.
