This ordinance shall be known as the "Salary Ordinance", and shall be applicable to officers and employees whose salaries are set by the Board of Supervisors, County of Butte. SECTION NO. 2. YUNqULY SALARY SCALE. The followiRL salary ranges are hereby established as a progroasive salary plan and shall be applicable to the monthly rated classes of positions as shown in Section No. S. (a) All offices mid positions in the Cmuty serAce shall be cMssified on the basis of their duties and responsibilities. (b) The initial classifications of positions fox, the 1,)i.orpose of this ordinance shall be as contained in the report "Personnel Classification and Pay Plan, Butte County", dated may 1950, of which certified copies are hereby directed to be filed. with the County Clerk and with the Administrative Officer. The class specifications adopted as a part of tide action shall be used and interpreted as defined in said report. (a) Thn classification Df positions may hereafter be amended by the addition division, consolidation or abolishment of classes upon written recommendation of any depart- ment head on the Administrative Officer and approval by order of the Board of Supervisors. Whereupon the certified copies of the classification plan maintained in the offices of the County Clerk'. and of the Administrative Officer shall be corrected accordingly. SECTION NO. 4. ALLOCATION OF POSITIONS. (a) Each position shall be allocated to its appropriate class on the basis of duties and responsibilities. (b) The initial allocation of positions shall be as indicated in the report en- titled "Recommended Allocations of Positions, Butte County", dated May, 19;0, of which a copy' has been filed with the Administrative Officer. (c). The allocation of Positions may hereafter be changed upon the written recom- mendation ofa department head or the Administrative Officer and approval of the Board of Supervisors;jprovided the proposed change conforms with this ordinance, with the established classification plan, and with the approved budget. SECTION NO. 5. QU,�LIFICATIONS OF EMPLOYEES. (a) Offices and employees holding positions upon the taking effect of this ordi- nance are deemed to be qualified for the position to which they are allocated, subject to the right ofithe department head or the Board of Supervisors to dismiss any employee in ac- cordance with law. (b) Officers or employees hereafter appointed, except to an elective office, shall be required to possess the educational and experience requirements prescribed in the class specification. Provided, however, that any employee of the Welfare Department subject to the State Merit System shall be subject only to standards imposed under that system. SECTION NO. 6. POSITION CLASSIFICATION- i (a), Positions listed in Section No. 7 with the prevailing salary range number shall'. be known as MONTHLY RATED employees. These employees shall be hired and -paid on the basis of a calendar month at the stipulated rate of pay in accordance with other sections of this or- dinance. (b), Positions listed in Section No. 8 with prevailing hourly salary rate shall be known as HOURLY RATED employees. These employees shall be hired and paid on the basis of a stipulated rate per hour in accordance with other sections of this ordinance. (c)' Positions listed in Section No. 9 with the prevailing salary rate as shown shall be known as FLAT RATED employees. These employees shall be hired and paid on the basis of a flat amount as stipulated. SECTION NO. 7. SALARY RANGE-MONTHLY RATED E-INT 10YEES. For, each class of Monthly Rated positions there is hereby established the salary range shown opposite it in this section. The number of positions in each class authorized in each Department or office of the County shall be as approved in the annual. budget. SECTION NO. Cam HOUULY SALARY SCALE. The following two rate salary scale is hereby established for hourly rated em- ployees and shall be applicable to the positions as listed. (a) Rate "B" may apply to now employees and may be the amount paid for a mutual. probationary period of 90 days or three calendar months to ascertain if the individual is qualified to do duties as assigned and fill job responsibilities as listed in Personnel 03as- sification and Pay Plan. (b) Rate "A" may apply to employees who have conjp,,],.eted the probattionary period end whose services have been found satisfactory. Palment of a Monthly Rated employee's salary for a partial month's working time is to be computed by the Auditor's Uepartment.on a basis that is considered equitable to the Comy arO employees, hit in no case stall the remuneration exceed the amount an stipAmad for a full montWs salary. (b) In canes where it is difficult to secure qualified personnel or if a person of unusual qualifications is engaged, the department hand, on recommendation of the Administra- tive Officer, and with authorization of the Board of Supervisors, may hire at the second or third step. (2) The first step is the minimum rate and may nornially he the hiring rate for positions as listed under Section No. 7, 1sJont1dy Rated Empl"ees. (3) The second step is an incentive advancement. Employees may be advanced to the second step at the beginning of the fiscal year provided the advancement is recommended in writing by the department head, Administrative Officer, and approved by the Board of Super- visors. (4) The third step represents the middle value of the Monthly Salary Scale and is the rate at which a fully qualified experienced and ordinarily conscientious employee may expect to be paid after the completion of one year's service at step two, An employee may be advanced to the third step at the beginning of the fiscal year ilion, r(.-.,corrmendation in writing by the department head, Administrative Officer and approved by the Board of Super- visors (5) The fourth step is reserved to reward employees whose work is well above the average for their class, An employee may be advanced to the fourtl; stop at the beginning of the fiscal year after the cornrletion of crura year at the third step, upon convincing proof, Qi writing by the department head that the employees's work is above average and upon recommends-, tion by the Administrative Officer and approval by the Board of Supervisors. (6) The fifth step Is reserved as a reward for mitstanding service, hn employee may be advanced to the fifth step at the beginning of the fiscal year after completion of two years of service at the fourth step, upon convincing proof in writing by the department head that the emp3oyee's work is outstanding, and upon recommendation of the Administrative Officer an approval by the Board of Supervisors. (9) Rates of compensation as provided for in Section No. 7 are fixed on the basis of full­time!service. If any position provided for in the budget is by appropriate langua,e specified as being for less than full time service, the amount of compensation paid shell be adjudged accordingly. SECTION NO. 11. ADJUSTMENTS. In any case where by reason of unusual circumstances riid adherence to the foregoin--, principles related to salary adjustments would cause a manifest injustice, the Board of Supervisors on recommendation of a department head or the Administrative Officer may make such order relating thereto as in its discretion is proper. SECTION NO. 12. OU','3IDF ACTIVITY. No full-time employee of the County shall engage in any occupa- tion or outside activity which is incompatible with his employment by the County. Any officer� or employee engaging in such occupation or outside activity for compensation shall inform the Board of Supervisors of the time required and the nature of such activity, and the Board shall determine whether or not such activity is incompatible with County employment. SECTION NO. 13. MAINTENANCE PROVISIONS. In every case where full or part maintenance is furnished to an employee, the following amounts shall be deducted from the salary authorized for the employee: For individual meals 25� each Room (single) . . . . . . . . . . .;10.00 per month Maintenance, where other than room and board is involved . . SECTION -40. 14. VACATIONS. (a),After six months of service each full-time officer and employee shall be en- titled to a vacation of Five Sixths (5/6) of a working day, for each month of service, not to exceed 14 calendar days. (b) Unused vacation may be accumulated to a total of not more than 20 working days, or four calendar weeks. All vacations shall be taken at such time or times during the calendar year as may be approved by the heads of the departments. (d) � No vacation shall be allowed to any person w1io is discharged from County ser- vice for cause. A person about to resign, about to retire or who is to be laid off without fault ,on his part, and who has earned vacation time to his credit shall be paid for such vacation on the effective date of such resignation, retirement or layoff. SECTION NO. 15. SIGH LEAVE 'v,1IT1I PAY. (a) !After six months of continuous service, each full-time officer and employee shall be entitled to, one working day of sick leave with pay for each month or major fraction thereof served, up to :an accumulated total of 60 working days. Such sick leave with pay can be granted only upon the recommendation of the department head in case of bonafide illness of an employee .'or in the death of a relative of the first degree. A department head or the Administrative Officer may require evidence in the form of a physician's certificate or otherwise in the ad- ,'equacy of the irea5on for all employee's absence during the time for such sick leave is requested, In the event an employee is absent due to disability incurred on duty he may utilize accumulated sick leave to compensate for the difference between Workmants Compensation Insurance allowances and full pay. 211TION NO. 16 OVERTIME. (a) It is the policy of the County that overtime work is to be discouraged, If, in, the judgement of the department head, work beyond the estpblishr�d rTork wpelc, As required, he shall report the circumstances to the Board of Supervisors, and he shall not oblige the County to compensate for such overtime in any fonn or manner except on the specific advance authorization of the Board of Supervisors. Provided that in case of emergermy to prevent loss of life or damage to property, the department head may authorize such overtime pending the earliest opportunity to seek the approval of the Board. If any section, subsection,paragraph, sentence,clause or phrase of this ordinance is, for any reason hold to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the veliditY or constitutionality of the remaining per.- tions of this ordinance, it being hereby expressly declared that this ordinairce and each section, subsection, paragraph, sentence, clause and phrase thereof would have been adopted irrespective of the fact that any one or more other sections, subsectioris, parn.graphs, sen- tences, clauses or phrases be declared invalid or unconstitnjasai. CTZ�IE, Deputy PUBLISHED - i 258 ORDINANCE NO. 45 f t AN ORDINANCE DESIGNATING AND NAMING "BIDWELL RIVER PARK" AND REGULATING THE USE THEREOF. The Board of Supervisors of the County of Butte do ordain as follows: SECTION 1: The hereinafter described real property, situated in the County of Butte, State of California, is hereby designated as a public park and dedicated for the recreation al use and benefit of the People of the State of California, subject to the limitationsl:pre-ii scribed in the deed or conveyance thereof and those prescribed by law. SECTION 2: Said real property is designated and named "BIDWELL RIVER PARK% SECTION 3: The Road Commissioner of the County of Butte is vested with the supers vision, control and management of said Park. SECTION 4: It is unlawful to cut, break, or otherwise injure any flower, bush, vine, shrub or tree growing in said Park, excepting by an employee of the County of Butte in the regular course of his employment. SECTION 5: It is unlawful to remove any earth or soil, or to perform or commit any ex- r cavation within the boundaries of said Park without the permission of the said Road Commis- i sioner first had and obtained. SECTION 6: It is unlawful to throw or deposit in said Park any garbage or filth, glass, broken ware, hay, straw, dirt, rubbish, or cuttings from plants or trees. SECTION 7: It is unlawful to build a fire in said Park except at those particular places designated and appointed by the said Road Commissioner and which designated and ap- pointed places are plainly marked with a sign stating that fires will be permitted there. SECTION 8: It is unlawful to camp in said Park. SECTION 9: It is unlawful to park a house-trailer in said park for a period longer than six hours in any calendar month. SECTION 10: It is unlawful to build or construct or place on said park property any structure of any kind without a written permit so to do first had and obtained from the said;! Road Commissioner. SECTION 11: It is unlawful to discharge firearms or kill or injure any bird or animal in said Park, without permission so to do first had and obtained from said Road CommissionerJl 3 SECTION 12: It is unlawful for any person owning or having control of, or being the keeper of any horse, mule, cow, goat, sheep, ass, hog, or domestic fowl, to permit the same to run at large in or graze or feed in said park without permission so to do first had and obtained from said Road Commissioner. j SECTION 13: The real property herein referred to is more particularly described as follows: i All that certain real property, situated in the County of Butte, State of California, and bounded and described as follows, to wit: All that strip of land of varying width bounded on the west by the Sacramento River and an Inlet thereof; on the East by the west line of Sutter Avenue and the West line of the County Road, said strip of land extending from the North boundary of Rancho Arroyo Chico in the N.W.1 of Section 22 Township 22 North of Range one West; M. D. B. & M. to the southerly extremity of said Rancho Arroyo Chico on the North bank of Chico Creek near its confluence with the Sacramento River in Section 2 Township 21 North of Range 1 West, M. D. B. & M., excepting and reserving therefrom Lot Thirty-two (32) of the Meridian Subdivision of the John Bidwell Rancho. Also all that strip of land of varying width including both banks and the Cannel of Linde Channel otherwise called Sandy Gulch, from the point where said Lindo Channel intersects the line of the Park deeded by Annie E. K. Bidwell to the City of Chico, July 10, 1905, to the point where said Lindo Channel disembogues into Chico Creek. CLEWE, Deputy. ORDINANCE No. 459 AN 04ERGFLICY ORDINANCE PROVIDING SALARIES FOR THE JUDGES OF THE BIGGS, DURHAM AND PARADISE JUSTICE COURTS. WHEREAS, in accordance with Section 11, Article 6 of the Constitution of the State of California, as amended in 1950, and the Municipal, and Justice Court Act of 1949, the Justice Courts, as provided therein, will begin to function on the 1st day of January, 1952, in the BIGGS JUDICIAL DISTRICT, 'the DURHAM JUDICIAL DISTRICT and the PARADISE JUDICIAL DIST- RIGT, of the County of Butte, State of California; and WHEREAS, it is requisite and necessary that salaries be provided for the Judges of said courts; NOW, THEREFORE, the BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, do ordain as follows: Section 1. The salary of the Judge of the Justice Court of BIGGS JUDICIAL DISTRICT shall be $150.00 a month; Section 2. The salary of the Judge of the Justice Court of DURIU04 JUDICIAL DISTRICT shall be $150.00 a month; Section 3. The salary of the Judge of the Justice Court. of PARADISE JUDICIAL DIS- TRIUT shall be $165.00 a month; Section 4. That it is necessary for the immediate preservation of public peace, health and safety that this ordinance become effective immediately, and the facts constituting such necessity are that the Justice Courts of the Biggs, Durham and Paradise Judicial Districts, as provided in Section 11, Article 6 of the Municipal and Justice Court Act of 1949, will be- gin to function on the let day of January, 1952, and that unless the salaries of the Judges of said courts are provided for prior to that date said courts will be unable to properly and adequately function; Section 5. This ordinance shall take effect immediately upon its adoption and pas- sage, arid, prior to the expiration of fifteen (15) days after the passage thereof, this or- dinance, together with the names of the members of the Board of Supervisors voting for and against the some, shall be published once in the OROVILLE PIERCURY, a newspaper printed and pub- lished in the County of Butte, State of California.
