HomeMy WebLinkAboutOrds 460-466 COUNTY OF BUTTE STATE OF CALIFORNIA ORDINANCE NO. 460 AN EMERGENCY ORDINANCE AMENDING EMERGENCY ORDINANCE NO. 458 DIVIDING THE COUNTY OF BUTTE INTO JUDICIAL DISTRICTS, NAMING SAID DISTRICTS AND ESTABLISHING AND DESCRIBING THE BOUNDARIES THEREOF AND DECLARING THAT SAID D1 5TRIC.TS 30 NAMED, DESCRIBED AND ESTABLISHED, SHALL TAKE PRECEDENCE OVER JUDICIAL TOWNSHIPS NOW EXISTING. The Board of Supervisors of the County of Butte, State of California, do ordain as follows: Section 1. That the County of Butte, State of California, be and the same is hereby, divided into judicial districts, and the judicial districts hereinafter named be, and the same' are hereby, named and established and the descriptions of the boundaries thereof shall be as hereinafter set forth; Section 2. BIGGS JUDICIAL DISTRICT Beginning at point of intersection of the south boundary of Section 20 Twp. 18 N. The Judicial Districts herein named, established and described shall take precedence over Judicial Townships as set forth in Article 1, Chapter V1, of Butte County Ordinance No. 333, and any other ordinance of the County of Butte describing said Judicial Townships wherever said ordinances shall he in conflict. Section 9: This Ordinance is an emergency ordinance passed for the inuflediate preservation of public peace, health and safety, and that a declaration of the facts can- stituting the necessity is as follows: That this ordinance is passed to comply with and pursuant to Section .1.1, Article VI of the Constitution of the State of California, as Amended, in 1950, ffid the Municipal and Justice Court Acts of 1949. Section 10: Thin ordinance shall take effect immediately upon its passage and adoption, and before the expiration of fifteen (15) days after its passage shall be published once with the names of the members voting for and against in the BIGGS Id9:�WS, a newspaper pub- lished in the County of Butte, State of California. SHORT TITLE. This ordinance shall be known as the "Salary Ordinance" and shall be applicable to officers and employees whose salaries are set by the Board of Supervisors, County of Butte. SECTION No. 2. (a) MONTHLY SALARY SCKLE. The following saleary ranges are hereby established ns a progressive salary plan and shall be applicable tel the monthly rated classes of positions as shown in Section No. 7. (a) All offices and positions in the County service shall be classified on the basis of ;their duties and responsibilities. (b) The initial classifications of positions for the purpose of this ordinance shall be as contained in the report "Personnel Classification and Pay Plan, Butte County", dated May 1950 ; of which certified copies are hereby directed to be filed with the County Clerk and with .the Administrative Officer. The class specifications adopted as a part of this action shall be used and interpreted as defined in said report. (c) The classification of positions may hereafter be amended by the addition, division, con solidation or abolishment of classes upon written recommendation of any department head or the Administrative Officer and approval by order of the Board of Supervisors. Whereupon the cer ti.fied copies of the classification plan maintained in the offices of the County Clerk and of the Administrative Officer shall be corrected accordingly. SECTION NO. W ALLOCATION OF POSITIONS, (a) Each position shall be allocated to its appropriate class on the basis of duties and responsibilities. (b) The initial allocation of positions shall be as indicated in the report entitled "Recom- i mended Allocations of Positions, Butte County", dated May, 1950, of which a copy has been filed with the Administrative Officer. (c) The allocation of Positions may hereafter be changed upon the written recommendation of a department head or the Administrative Officer and approval of the Board of Supervisors,, provided the proposed change conforms with this ordinance, with the established classification! plan, and with the approved budget. SECTION NO. 5 2UALIFICZTION3 OF EMPLOYEES. (a) Officers and employees holding positions upon the taking effect of this ordinance are deemed to be qualified for the position to which they are allocated, subject to the right of l the department head or the Board of Supervisors to dismissan employee in accordance with law. (b) Officers or employees hereafter appointed, except to an elective office, shall be rei quired to possess the educational and experience requirements prescribed in the class speci- fication. Provided, however, that any employee of the Welfare Department subject to the State Merit System shall be subject only to standards imposed under that system. SECTION NO. 6 POSITION CLASSIFICATION. (a) Positions listed in Section No. 7 with the prevailing salary range number shall be known as MONTHLY RATED employees. These employees shall be hired and paid on the basis of a cal- endar month at the stipulated rate of pay in accordance with other sections of this ordinance.! (b) Positions listed in Section No. 8 with the prevailing special salary range shall be known- as MONTHLY RATED employees and shall apply to hospital occupations only. These employees `shall be hired and paid on the basis of a calendar month at the stipulated rate of pay in accordance' with other sections of this ordinance. (c) Positions listed in Section No. 9 with the prevailing hourly salary rate shall be known as HOURLY RATED employees. These employees shall be hired on the basis of a stipulated rate per hour in accordance with other sections of this ordinance. (d) Positions listed in Section No. 10 with the prevailing salary rate as shown shall be known as TPLAT RATED employees. Payment of a Monthly Rated employees salary for a partial monthts working time is to be computed by the Auditor's Department an a basis Wt is conaidwed equitable to the County and employees, but in no case shall. the remuneration exceed the amount as stipulated for a fall month's salary. (b) In cases where it in difficult to secure qualified personnel or if as person of unusual qualification is engaged, the department head, on recounendation ofthe Administrative officer, and with authorization of the Boand of Supervisors, may hire At thea,.Cond or third atep. (2) The first step is the minimum rate and may normally be the hiring rate for positions as listed under Section No. 7 and 8 Monthly Rated Employees. (3) The secand step is an incentive advancement. Employees may be advanced to the second stop at the beginning of the fiscal year provided the advancement is reconnended in writing by the department head, Administrative Officer, and approved by the Board of Supervisors and in service date is three or more months before the beginning of the fiscal year. (4) The thrid stop represents the middle value of the Monthly Salary Scale and is the rate at which as fully qualified experienced and ordinarily consclenuiouo employee may expect to be paid after the completion of one year's service at step two. An employee may be ad- vanced to the third step at the beginning of the fiscal year upon recommendation in writing by the department head, Administrative Officer and approved by the Board of Supervisors. (5) The fourth step is reserved to reward employees whose work is well above the average for heir class. An employee may be advanced to the fourth step at the b eginning of the fiscal year after the completion of one year at the third step, upon convincing proof in writing by the department head that the employee's work is above average and upon recommendation by the Administrative Officer and approval by the Board of Supervisors. (6) The fifth step is reserved as a regard for outstanding service. An employee may be ad- vaned to the fifth step at the beginning of the fiscal year after completion of two years of service atlthe fourth step, upon convincing proof in writing by the department head that the employee's work is outstanding, and upon recommendation of the Administrative Officer and -. approval by the Board of Supervisors. (7) In the event step two or three is used for the hiring rate in accordance with paragraph 1-(b) of this section, an employee may be advanced to the next step at the beginning of the fiscal year provided his service date is three or more months prior to the beginning of the fiscal year. (b) In the event an employee is promoted or reclassified during the current year and such promotion or reclassification takes place three or more months before the beginning of the fiscal year, `the employees may be advanced one step at the beginning of the fiscal year upon written recommendation of the department head, Administrative Officer and approval of the Board of Supervisors. (8) Notwithstanding the foregoing provisions of this section, an employee who is promoted or reclassified from one class to another having a higher overlapping salary range shall be ad- justed to the; minimum of the new range or to one step above his old salary. (9) Rates of compensation as provided for in Section N0.7 are fixed on the basis of full- time sercice. If any position provided for in the budget is by appropriate language specified as being for :less than full time service, the amount of compensation paid shall be adjusted accordingly. SECTION NO. 12 ADJUSTMENTS. In any case where by reason of unusual circumstances rigid adherence to the foregoing principles related to salary adjustments would cause a manifest injustice the Board of Supervisors on recommendation of a department head or the Administrative Officer may make such order relating thereto as in its discretion is proper. SECTION NO. 13 OUTSIDE ACTIVITY. No full-time employee of the County shall engage in any occupation or out- side activity which is incompatible with his employment by the County. Any officer or em- ployee engaging in such occupation or outside activity for compensation shall inform the Board o' Supervisors /of the timejrequired and the nature of such activity, and the Board shall determine whether or not suvh activity is incompatible with County employment. SECTION NO. 14 MAINTENANCE PROVISIONS.
