Fortino Subject: Paradise Pines Golf Course Attachments: image001.png Honorable Supervisors: After much effort and several meetings, it appears as we are about to bring forth an application for a rezone and general plan amendment for a portion of the now closed Paradise Pines Golf Course in order to create approximately 31 new residential lots. I would like to again thank you for taking time out of your schedules to meet with us over the last year to hear about our project. In the interim we have been pursuing the ability to transfer the residual property to the Paradise Pines POA. We have met with a committee nominated by the Board to work with us and the committee seems very favorable. However there is an apparent difficulty in doing so. In order to transfer or receive property, or to include additional members, their by-laws require a successful supermajority ballot of the voting power. This means that we would need at least 2,010 approving votes of the approximately 3,000 property owners. After much research, we found out that the highest number of votes received on any vote in the last 20 years or so has been right around 800 votes. With that understanding, we feel hesitant to invest the time and significant expense to conduct an election with what is likely very little chance of success. With that in mind, we wish to move forward with our application anyway. We intend to offer an exclusive use easement to the POA over the residual property and hope to form our own district (at roughly the same assessment) to assist in the payment of property taxes and to assist the POA with maintenance. Our thinking is that the POA can still get the full enjoyment of the amenity (walking trails and open space) and we can assist with the maintenance, all without having to determine a way to transfer the property in fee. I am attaching a sketch of our proposal and a couple of photos of the future walking trails. Please do not hesitate to call or email me if you have any questions or would like additional information.
