Notice is hereby given by the Butte County Planning Commission that a public hearing will be held on
April 25, 2013 at 9:00 a.m. in the Butte County Board of Supervisors' Roorn, County Administration
Center, 25 County Center Drive, Oroville, California, regarding the following item:
REQUEST FOR ABANDONMENT (Vacation of 52 feet of an 82-foot wide drainage easement): The
Butte County Planning Commission will hold a public hearing to determine whether the proposed
drainage easement abandonment is consistent with the Butte County General Plan. The applicant has also
requested a minor modification to the December 1, 1998 Development Agreement by and between Butte
County and Douglas N. Gunn, Trustee of the Robert and Ann Stephens Charitble Remainder Unitrist, Et
Al. to be consistent with the proposed abandonment. The Planning Commission will not approve or deny
either the proposed abandonment or modification to the Development Agreement.

Location: The portion {52 feet) of the drainage easement proposed for abandonment (vacation) is located
30-feet from the western boundary of Sierra Moon Subdivision, Phase 1, from Keefer Slough on the north
to Mud Creek on the south.
Proposal: The abandonment would vacate the easterly 52 feet of the 82-foot drainage easement between
Keefer Slough and Mud Creek.
If you challenge the proposal in court, you may be limited to raising only those issues you or someone
else raised at the public hearing described in this notice, or in written correspondence delivered to the
Planning Division at, or prior to, the public hearing.
The above mentioned application and reference documents are on file and available for public viewing at
the office of the Butte County Development Services Department, Planning Division, 7 County Center
