Home My WebLink AboutPublic Notice for Clean Water Act 401 eoq&b°�sUp aI(S ERV�SORs °RO L 11409 �l��F e�ClFp RNiq PUBLIC NOTICE FOR CLEAN WATER ACT 401 WATER QUALITY CERTIFICATION BEFORE THE STATE WATER RESOURCES CONTROL BOARD July 14, 2009 The Department of Water Resources filed an application with the State Water Resources Control Board for water duality certification under section 401 of the Clean Water Act for the Oroville Facilities on August 5, 2008. The Department of Water Resources has applied to the Federal Energy Regulatory Commission (FERC) for a new license for the Oroville Facilities (Project), FERC Project No. 2100. The Project is located on the Feather River in Butte County and includes Lake Oroville and Thermalito Afterbay. The Department of Water Resources is the lead agency under the California Environmental Quality Act (CEQA), and approved a Final Environmental Impact Report for the Project on June 22, 2008. The State Water Resources Control Board is a responsible agency under CEQA. California Code of Regulations, title 23, section 3858 requires the State Water Resources Control Board to provide public notice of an application at least twenty-one (21) days before taking certification action on the application.
