This action was taken in accordance with Section 73 of the Streets and Highways Code. Your attention is directed to Section 100.9 of the Streets and Highways Code regarding relocated State highways, which bypass cities or business districts. The directional signs erected by the State on such highways shall be left in place and maintained by the local agency. The relinquishment will become effective upon recordation with the County Recorder. Our District Office will handle the recording and will advise you immediately thereafter. TURNER, Chief Office of Land Surveys Division of Right of Way and Land Surveys Enclosure "Caltrans improves inability across California" f TRANSPORTATION COMMISSION RESOLUTION No. R-3766 PASSED eY CTC JUN 3 0 ,2010 CALIFORNIA TRANSPORTATION COMMON RELINQUISHMENT OF HIGHWAY RIGHT OF WAY IN THE COUNTY OF BUTTE, ROAD 03-BUT-70-PM 20 . 5/21 . 9, 03-BUT-99-PM 22 . 8/24 . 3, 03-BUT-149-PM R2 . 4/R2 . 8 Request No. 035797-X WHEREAS, highway right of way within the County of Butte, along Table Mountain Boulevard, State Route 70, hereinafter particularly described, has been superseded by a change in the location of said highway; and WHEREAS, by Cooperative Agreement Numbers 03-0240, 03- 0241, and 03-0242, all dated October 29, 2003, between the County of Butte and the State of California, the County waived the 90- day notice requirement and agreed to accept title to said superseded highway and to the collateral facilities, as shown on attachments labeled `Exhibit A' , attached to and made a part of each of the said cooperative agreements, upon relinquishment thereof to said County by the State of California; and WHEREAS, by letter signed August 3, 2009, the County agreed to accept title to drainage easements, appurtenant to and a part of SEGMENT 7 of said relinquishment, hereinafter particularly described; and WHEREAS, the State of California has acquired right of way for and has constructed the above-mentioned collateral facilities in the County of Butte; along Route 70, between Route 149 and Route 191, along Route 99, from Post Mile 22 . 8 to the Durham Dayton Highway, and along Route 149, on Shippee Road, in accordance with said agreements; and WHEREAS, this Commission has found and determined, and does hereby find and determine, that it is desirable and in the public interest that said highway right of way so superseded and said collateral facilities be relinquished to the County of Butte for use as county roads . NOW, THEREFORE, IT IS VOTED by the California Transportation Commission that it relinquish, and it does hereby relinquish, to the County of Butte, effective upon the recordation of a certified copy hereof with the Recorder of Butte County, all of the State of California' s right, title and interest in and to said superseded highway right of way and said collateral facilities in said County, together with the right of way and appurtenances thereof, described as follows : That portion of State highway right of way labeled as SEGMENT 1 through SEGMENT 7, inclusive, together with the drainage easements, appurtenant ' and a part of said SEGMENT 7, all as indicated on that certain map filed for record on May 11, 2010, as Document No. 2010-0015333, in State Highway Map Book No. 4 , Pages 83 to 88, inclusive, Butte County Records . RESERVING unto the State of California an easement for drainage purposes within SEGMENT 7, as shown on sheet 5 of said State Highway Map. RESERVING AND EXCEPTING unto the State of California any and all rights of ingress to and egress from the State Highway hereby relinquished, in and to the adjoining freeway, except at such points as now are or may be established by resolution of this Commission.
