This condition was approved by the Board of Supervisors on September 28, 2004, the subdivision approval was challenged in Court and as part of the Court settlement, which you signed, this condition was amended to read as follows: 26(a) Place a note on an additional map sheet stating the following: "A temporary gate is required across the road section between the new and old sections of Spyglass Road, prohibiting the passage of all traffic. The gate shall be removed and traffic shall be allowed to flow between the two sections of Spyglass Road after the end of September 2012. The gate shall be of a break-away design to ensure circulation during times of emergency. This condition is intended to provide time for the financing of additional infrastructure in the North Chico Specific Plan area prior to the allowance of traffic flow between the two sections of Spyglass Road." The developer is required to install the gate and construct the road connecting the two road segments to County standards (an RS-8-LD-1 County road standard is permitted during the time the road is gated)prior to Final Map recording for Phase. The developer shall be responsible for removal of the gate at the conclusion of the closure period. We cannot arbitrarily amend conditions that are part of a Court settlement, however your letter clearly points out that your gate is not in conformance with your conditions of approval because it is not "of a breakaway design to ensure circulation during times of emergency." In the interest of public safety please provide us with a design, for review and approval that complies with your conditions of approval. We would like to note that several of our gated communities have siren activated openers.
