HomeMy WebLinkAboutS072914 BCBS SAJ29,2014 500,%-%.4!, '%.$! 5,9 544% /5.49 /!2$ /& UPERVISORS Supplemental Agenda 3.00 CA ONSENT GENDA C-3.55* Durham Irrigation District Requests Consolidation of Measure on Ballot - The Board of LERK R Directors of the Durham Irrigation District (District) adopted Amended Resolution No. 14- ECORDER 07-1, calling for a special election to be held on November 4, 2014. The district is requesting the Butte County Board of Supervisors to consolidate this election with the statewide general election to be held on November 4, 2014, for the purpose of submitting a measure to the voters changing the method of electing the Board of Directors. In addition, the District is requesting the Butte County Clerk-Recorder to perform all duties necessary to conduct this election for which the District agrees to reimburse the County action requested - APPROVE CONSOLIDATION. 4.00 RA EGULAR GENDA 4.01* Boards, Commissions and Committees A 2. Consideration of Butte County Forest Advisory Committee (FAC) Public Members MENDED 7-25-14 - AppointmentsThe Board of Supervisors recently established the FAC to facilitate public involvement and assist the County in its quest to meet the guiding principles of the Butte General Plan 2030 as it pertains to utilization and management of public lands. The FAC will be comprised of 5 public members and 5 alternates representing the following areas of interest: 1) Agriculture/Timber Management; 2) Recreation Motorized; 3) Recreation Non-Motorized; 4) Environmental & Watershed Management; and 5) Economic/Tourism. A recruitment was conducted recruitment for the FAC, and to date, the County has received requests for appointment/letters of interest from the following eleven thirteen individuals: Jim Shary, Pete Moak, Frank Stewart, Vance Severin, Douglas Carpenter, Daniel Taverner, Nani Teves, Fred G. Thorne, Teri Faulkner, Charlotte Hilgeman, Owen R. Hansen, Patricia Puterbaugh, and BK Brooks. The letters of request and the FAC Bylaws, which contain additional detail regarding the membership of the FAC, are included in the staff report action requested MAKE APPOINTMENTS. SA 0 ¦¤ 1 ®¥ 2 *´«¸ ΑΘ, 2014 500,%-%.4!, GENDA BCBS SAJ29,2014 500,%-%.4!, '%.$! 5,9 544% /5.49 /!2$ /& UPERVISORS 5.00 PHTI UBLIC EARINGS AND IMED TEMS 10:45.. 5.05* Timed Item - Proposed Initiative Measure to Ban Hydraulic Fracturing in Butte County - AM California Elections Code section 9101 requires that the Board of Supervisors consider proposed ordinances when an initiative petition is filed with the county elections official, signed by not less than the number of voters specified in the article for county initiatives. To be valid, an initiative petition must be signed by 10% of the entire votes cast within the county for all candidates for Governor at the last gubernatorial election (November 12, 2010). On June 5, 2014, a proposed county-wide initiative titled "Ordinance Imposing A Ban On Hydraulic Fracturing Within Butte County" was filed in the Butte County Elections Office. The County Clerk-Recorder/Registrar of Voters is currently verifying that there are sufficient valid signatures on this petition. Pending the County Clerk Recorder/Registrar of voters finding the petition sufficient, and pursuant to Elections Code section 9118, the Board is required to take one of the following actions: (a) Adopt the ordinance without alteration at the regular meeting at which the certification of the petition is presented, or within 10 days after it is presented; (b) Submit the ordinance, without alteration, to the voters pursuant to subdivision 1405(b), at the next statewide election occurring not less than 88 days after the date of the Board of Supervisor's order to call election; or (c) Order a report pursuant to section 9111. When the report is presented, the Board must either adopt the ordinance within 10 days or order an election. A copy of the signature certification will be available by July 29, 2014. The petition, ballot title and summary, notice of intention, proposed ordinance, and copy of elections code section 9111 is attached. A resolution calling for the election will be available at the time this item is considered action requested - 1) ACCEPT THE CERTIFICATION OF SUFFICIENCY; AND 2) PASS THE ORDINANCE, WITHOUT ALTERATION; OR 3) ADOPT RESOLUTION PLACING THE PROPOSED ORDINANCE ON THE NOVEMBER 4, 2014 GENERAL ELECTION BALLOT; OR 4) REQUEST A REPORT PURSUANT TO SECTION 9111 OF THE CALIFORNIA ELECTIONS CODE.
