P 3.27* Amendment to Memorandum of Agreement (MOA) with the Mooretown Rancheria for Road
UBLIC
W
Improvements - On June 19, 2012, Butte County and the Mooretown Rancheria entered into
ORKS
an MOA to repair a portion of Lower Wyandotte Road fronting the Rancheria and casino
property. The funding for the project came primarily from the American Recovery and
Reinvestment Act (ARRA) funds, which the Tribe received through the Bureau of Indian Affairs
(BIA). Since June 2012, Public Works staff has been working to get the project out to bid, but
the work must be completed by October 1, 2012, when the Tribe must return any unspent
ARRA funds to the BIA. Public Works staff has been meeting with the Tribe to identify an
alternate plan for the project. The new proposal is to expand the work to include all of Lower
Wyandotte Road as well as a portion of Foothill Blvd., which is approximately 7.4 miles in
length. County crews will prepare and chip seal the roadways. Public Works staff believe that
this is the only way the project can be completed before October 1, 2012. The County has
existing contracts for the chip seal materials. The Tribe has the ARRA funds in their possession
and can use it to pay the County to complete the work action requested - AUTHORIZE
PUBLIC WORKS DIRECTOR TO ENTER INTO THE AMENDED MEMORANDUM OF AGREEMENT
SUBJECT TO COUNTY COUNSEL AND AUDITOR APPROVAL.
