3.30Land Conservation (Williamson) Act Compatibility Determination and Contract Amendments
The applicant, John M. Bianchi, has applied for a Lot Line Adjustment (LLA15-0016) to
reconfigure two existing lots currently in use as walnut orchards. Existing Parcel 1 is
approximately 952 acres before and 575 acres after the lot line adjustment, and Existing Parcel
2 is approximately 212 acres before and 575 acres after the adjustment. Consistent with
Government Code section 51257(a) and Rule 7.B of the Butte County Williamson Act program,
the Board of Supervisors is asked to determine the compatibility of the lot line adjustment with
the Williamson Act program, and to consider amendment of the applicable Williamson Act
contract to reflect the adjusted parcel boundaries (LCA15-0006). On March 7, 2016, the
Williamson Act Advisory Committee recommended to the Board of Supervisors that LLA15-0016
meets the required findings and is consistent with the Williamson Act with the following
conditions: 1) the property owner shall be required to either obtain proper permitting for the
second dwelling on existing APN 038-210-019, or shall be required to obtain a demolition permit
and demolish the second dwelling on the parcel prior to recordation of the lot line adjustment;
2) the lot line adjustment shall be recorded concurrently with the updated contract(s); and, 3)
the applicant shall pay any outstanding fees prior to recordation of the lot line adjustment. On
March 9, 2016, the Zoning Administrator approved LLA15-0016 subject to conditions including
the rescission and amendment of the Williamson Act contract, the determination of consistency
with the Williamson Act by the Board of Supervisors, and the demolition of the second dwelling
on APN 038-210-019 prior to recordation action requested 1) MAKE THE REQUIRED
FINDINGS DETERMINING THAT LLA15-0016 IS COMPATIBLE WITH THE WILLIAMSON ACT AS
DISCUSSED IN THE MARCH 7, 2016, AGENDA REPORT TO THE WILLIAMSON ACT ADVISORY
COMMITTEE; AND, 2) APPROVE THE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN.
