If you wish to address the Town Council or the Board of Supervisors on any matter on the Agenda, it is requested that you complete a "Request to Address Council" card and give it to the Town Clerk prior to the beginning of the Council Meeting. 1. Rough, Jr. Town Manager of the Town of Paradise 2 Presentation concerning the proposed Joint Powers Authority Agreement By Butte County Public Works Department 3. PUBLIC COMMENTS This is the time for members of the public to address on items on the agenda. It is requested that anyone who wishes to address the Town Council and/or the Board Members fill out a speaker card and present it to the Town Clerk at the beginning of the meeting. Comments should be limited to a maximum of three minutes. (Speaker cards will be made available at the meeting location in the lobby or can be requested from the Town Clerk.) 4. COUNCIL/BOARD CONSIDERATION Board of Supervisors: Action on the Joint Powers Authority Agreement. a. Consideration of Joint Powers Agreement (JPA) for Solid Waste Collection and Recycling Services in the Paradise Urban Area (Town of Paradise/County of Butte) and Introduction of an Ordinance Adding Chapter 31 C to Butte County Code -previously staff reported to the Board the need to develop a JPA between the Town and County for the administration of a proposed solid waste and recycling franchise for the Paradise Urban area. The franchise area encompasses all of the Town and portions of unincorporated areas contiguous to the Town. The Town approved the JPA on July 10, 2006. When this issue was previously reported to the Board, Board Members requested this action be postponed until a combined meeting with the Town Council took place - action requested - APPROVE JOINT POWERS AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN; WAIVE READING OF THE ORDINANCE. (BOARD OF SUPERVISORS ROLL CALL VOTE) Town Council: Action on the Award of Franchise (If Butte County approves JPA) b. Consider (1) Approving the award of franchise to a specified company(ies) (Atlas Disposal Industries; Norcal Waste Systems of Butte County; Northern Recycling & Waste Services; or Waste Management, Incorporated) for refuse collection, recycling and vegetative waste diversion services for the Paradise Urban Area as shown by Exhibit A attached to the Joint Powers Agreement and generally described as follows: All lands within the Town of Paradise; lands within the upper Paradise ridge primarily consisting of the Paradise Pines, Magalia, and the Fir Haven Subdivision Area; and, lands within a geographical corridor situated along lower Pentz Road between the south Paradise Town limits and the Pentz Road intersection at Highway 70; and, (2) Directing staff to prepare a resolution authorizing the execution of a franchise agreement relating to such franchise for adoption at a future Town Council meeting. (TOWN COUNCIL ROLL CALL VOTE) or, (If Butte County does not approve JPA) c. Consider (1) Approving the award of franchise to a specified company(ies) (Atlas Disposal Industries; Norcal Waste Systems of Butte County; Northern Recycling & Waste Services; or Waste Management, Incorporated) for services for the area defined as the Town of Paradise; and, (2) Directing staff to prepare a resolution authorizing the execution of a franchise agreement relating to such franchise for adoption at a future Town Council meeting.
