CALIFORNIA MATT,urw RRODRIOl1E], Water Boards El;:ll,:•))IA,I,,;ia, State Water Resources Control Board NOTICE OF OPPORTUNITY FOR PUBLIC COMMENT DRAFT CLEANUP AND ABATEMENT ACCOUNT FUNDING PROGRAM GUIDELINES NOTICE IS HEREBY GIVEN that the State Water Resources Control Board (State Water Board) will receive public comments on the Draft Cleanup and Abatement(CAA) Funding Program Guidelines (Guidelines), dated October 2018. NOTICE IS ADDITIONALLY HEREBY GIVEN that the State Water Board will consider adoption of the Guidelines as early as the Tuesday, December 11, 2018 State Water Board Meeting. BACKGROUND The CAA is established by Water Code sections 13440 to 13443. The CM is funded by various monies including those: appropriated by the Legislature; collected as part of criminal penalties or civil proceedings brought pursuant to Division 7 of the Water Code; collected or recovered by the State Water Board or a Regional Water Quality Control Board (Regional Water Board) under Chapter 6.7 of Division 20 of the Health and Safety Code; and repaid by loan recipients, including principal, interest, and fees. In some instances, a court judgment or settlement agreement specifies how collected funds are to be spent(e.g., a specific cleanup, investigation, or supplemental environmental project [SEP]). Those funds are typically set aside in the CAA for that identified purpose, consistent with statutes governing uses of the CAA. After accounting for these needs and other prior encumbrances, remaining CAA funds may be utilized to fund: (1) projects that clean up and/or abate the effects of a waste on waters of the State, or(2) projects that address urgent drinking water needs. The Division of Financial Assistance (DFA) has developed Draft Guidelines which describe the process for soliciting applications, prioritizing and evaluating project proposals, and awarding CM funding to these types of projects. To submit written comments, please use the subject line: "Comment Letter—Cleanup and Abatement Funding Program Guidelines". BOARD CONSIDERATION OF ADOPTION Staff intend to present the Draft Guidelines to the State Water Board for consideration of adoption at the December 11, 2018 Board Meeting. After reviewing public comments submitted by the November 9, 2018 deadline, an updated version of the Guidelines will be posted for public review and comment prior to consideration of adoption. This will occur as part of the regular State Water Board Meeting Agenda process, at: http://www.waterboards.ca.gov/board info/calendar. PROCEDURAL MATTERS At the Board Meeting, participants will be given the opportunity to make oral comments or to summarize and supplement their written materials with oral presentations. To ensure a productive and efficient Board Meeting, the Board may limit the time for oral comments.
