In addition, the LPA has met the program activities that were approved in the fiscal year (FY) 2016-2017 workplan. On October 17, 2017, the Division conducted an annual evaluation' of the LPA program for Butte County for FY 2016-2017. The Division representatives conducting the evaluation were Jlaclyn Rowell -- Environmental Scientist and Dan Cikuth - Associate. Sanitary Engineer and the LPA representatives were Amanda Aguiar — Senior REIHS. The purpose of the evaluation is to determine the LPA program's compliance status with respect to the activities set forth in the LPA workplan for FY 2016-2017, LPA Delegation Agreement and California Code of Regulations (CCR) Title 22, sections 64253 through 64260. The findings of this evaluation are detailed in Attachment A and B. Upon completion of the evaluation, Division representatives find that the items listed below are required to be addressed or considered by Butte County LPA program. Please submit a written response demonstrating willingness to comply with the items below by February 26, 2016. California Health&:Safety, section 1116330(d)requires the Board to evaluate the drinking water program of each local primacy agency at least annually. Ms. Elaine McSpadden - 2 - February 5, 2018 DIRECTIVES 1. Beginning February 1, 2018, the LPA shall start using SDWIS-State to report all data elements currently being implemented by the Division on or before 30 days after the last day of each calendar quarter. 2. By March 1, 2018, the LPA shall ensure that all water systems that provide treatment have an operations plan on file with the county. 3. Beginning March 1, 2018, the LPA shall ensure that all water systems receive a completed detailed sanitary survey report, including the review of the mandatory 8 elements within 90 days of the completion of the sanitary survey and provide the water system a corrective action schedule for any deficiencies found within 60 days of the completion of the sanitary survey. 4. By March 1, 2018, the LPA shall submit the revised Total Coliform Rule (rTCR) Level 1 & 2 Tracking Form to the Division for Level 1 and 2 Assessments conducted during FY 16-17 and continue to submit the completion of all Level 1 & 2 assessments using the form that can be found on the Division's FTP website. 5. By March 1, 2018, the LPA shall send a letter to amend the FY 2017-2018 work plan by adding the following system that did not receive a water supply permit in the FY 16-17 workplan: • Gran Mutual (PWS No. 0400008) 6. By March 1, 2018, the LPA shall send a letter to amend the FY 2017-2018 work plan by adding the following systems that did not receive a sanitary survey as originally noted in the FY 2016-2017 work plan: • Humboldt Highlands (PWS No. 0400123) • Hartley Mutual ( PWS No. 0400003) 7, By April 1., 2018, the LPA shall evaluate all community and non-transient non- community (NTNC) water systems to determine whether a volatile organic chemical (VOC) waiver is applicable for each source. The LPA shall use the criteria as stated in CCR Title 22, 64445 (d)(1) & (2) to determine if each source can be designated as nonvulnerable or not susceptible, respectively. Example waivers may be obtained from the Division's District Office. All VOC waivers are Ms. Elaine McSpadden - 3 - February 5, 2018 valid for a maximum of six years as stated in the CCR Title 22, section 64445 (d)(3) and may be renewed if there have been no changes. NEW REQUIREMENTS 1. The LPA shall complete a quarterly Directive and Recommendation Progress Report and submit it to the Division no later than the loth day following a calendar quarter. This requirement will be deemed complete when all directives have been satisfied. 2. The LPA shall include the required reconsideration (i.e. appeal) language in all cover letters for citations and compliance orders issued by the LPA. The language is not to be included in the citation or compliance order, rather, it is only to be added to the cover letter. The language can be found on the FTP site. (LPDA, section 2.05 (h)). RECOMMENDATIONS 1. Continue to track and follow-up with water systems sanitary survey deficiencies to ensure that they are corrected in a timely manner based on their priority to correct. 2. Continue to review and update technical reports, bacteriological sample site plans, and emergency notification plans as necessary when information is developed or as inspections are conducted. The Division looks forward to our continued partnership as we share the oversight of small public water systems in Butte County. Beginning March 1, 2017, the LPA shall begin submitting to the Division in PDF format a copy of each citation, compliance order, and any court filings issued by the LPA. The LPA will also submit all enforcement actions issued as of July 1, 2016 to the Division's IT department for posting on the Divisions website. Beginning March 1, 2017 the LPA shall begin issuing formal enforcement actions (i.e. compliance orders and citations) for all MCL failures, including TCR MCLs in a manner consistent with the policies and procedures specified in the Staff Guide to Compliance and Enforcement document located on the Enforcement website (https:Hdrinc.ca.gov/tqs/Login.aspx?ReturnUrl=Contact.aspx) and SDWIS entry procedure documents provided on the SDWIS FTP site (https://drinc.ca.gov/tgs/Login.aspx?ReturnUrl=Contact.aspx — logon credentials required). For the 2016 eAR, the Division will be evaluating compliance with this section based on submittals from community and non-community non-transient (NTNG) water systems. The Division has data that concludes the LPA's acceptance of submitted 2015 eAR's was 76% for community and non-community non-transient water systems and highly encourages the LPA to accept a higher percentage of the 2016 eAR's. The Division recommends that the LPA review water systems' water quality sampling data within their regulatory jurisdiction by either the LPA accessing the water quality sampling history via the SDWIS-State database at https:Hsdwis.waterboards.ca.gov/PDWW/ or logging directly into the Division Water Quality Inquiry database (request for logon credentials required). We suggest that this be completed during the file review, prior to conducting a sanitary survey, to ensure that a water system's contracted certified environmental health laboratory is successfully transmitting the water quality data electronically to the Division as required in CCR Title 22, Section 64469 (c). 2. Continue to update the water quality monitoring and reporting requirements notices to water systems to include the following: contaminant name, storet code, frequency of sampling, and any other sampling and reporting requirements applicable a water system. Provide the updated notices on an annual basis, for example sent with the annual permit bills, or when the LPA conducts a sanitary survey. 3. Continue to review and update technical reports, bacteriological sample site plans, and emergency notification plans as necessary when information is developed or as inspections are conducted. 4. Continue to conduct sanitary surveys of all community water systems at a minimum of every three (3) years and all non-community water systems at a minimum of every five (5) years; unless the LPA's current work plan specifies that these surveys will be completed at a greater frequency. 5. Each Directive and Recommendation Progress Report will include a narrative stating the progress toward the completion of all directives identified in the evaluation report. This report will also summarizes the progress towards meeting any new requirements and if appropriate recommendations have been implemented. Directive and Recommendation Progress Report submittal for the FY (36117) evaluation is as follows: 1 Directive LPA Response to Directive Beginning February 1, 2018,the LPA shall start using SDWIS-State to report all data elements currently being implemented by the Division on or before 30 days after the last day of each calendar quarter. Progress Status: 2 Directive LPA Response to Directive By March 1, 2018,the LPA shall ensure that all water systems that provide treatment have an operations plan on file with the county. Progress Status: Attachment C 3 Directive LPA Response to Directive Beginning March 1, 2018, the LPA shall ensure that all water systems receive a completed detailed sanitary survey report, including the review of the mandatory 8 elements within 90 days of the completion of the sanitary survey and provide the water system a corrective action schedule for any deficiencies found within 60 days of the completion of the sanitary survey. Progress Status: 4 Directive LPA Response to Directive By March 1, 2018,the LPA shall submit the revised Total Coliform Rule (rTCR) Level 1 & 2 Tracking Form to the Division for Level 1 and 2 Assessments conducted during FY 16-17 and continue to submit the completion of all Level 1 & 2 assessments using the form that can be found on the Division's FTP website. Progress Status: 5 Directive LPA Response to Directive By March 1, 2018, the LPA shall send a letter to amend the FY 2017-2018 work plan by adding the following system that did not receive a water supply permit in the FY 16-17 workplan: Gran Mutual (PWS No. 0400008) Progress Status: Attachment C Directive LPA Response to Directive By March 1, 2018,the LPA shall send a letter to amend the FY 2017-2018 work plan by adding the following systems that did not receive a sanitary survey as originally noted in the FY 2016-2017 work plan: Humboldt Highlands (PWS No. 0400123) Hartley Mutual ( PWS No. 0400003) Progress Status: 7 Directive LPA Response to Directive By April 1, 2018,the LPA shall evaluate all community and non-transient non- community(NTNG) water systems to determine whether a volatile organic chemical (VOC) waiver is applicable for each source. The LPA shall use the criteria as stated in CCR Title 22, 64445 (d)(1) & (2)to determine if each source can be designated as nonvulnerable or not susceptible, respectively. Example waivers may be obtained from the Division's District Office. All VOC waivers are valid for a maximum of six years as stated in the CCR Title 22, section 64445 (d)(3) and may be renewed if there have been no changes. Progress Status: 1 Recommendation LPA Response to Recommendation Continue to track and follow-up with water systems sanitary survey deficiencies to ensure that they are corrected in a timely manner based on their priority to correct. Progress Status: Attachment C 2 Recommendation LPA Response to Recommendation Continue to review and update technical reports, bacteriological sample site pians, and emergency notification plans as necessary when information is developed or as inspections are conducted.
