I strongly support and respectfully request your affirmative vote for passage and adoption of
the new draft of the Marijuana Cultivation Ordinance, Ch34A with one change indicated
below.
There are several reasons that I oppose the allowance of marijuana cultivation in Butte
County, least of which I believe California law is violation with Federal Law.

Nevertheless, if marijuana cultivation is going to be permitted, I believe the tighter the
regulations and ordinances the better. This new draft ordinance allows for the "legitimate"
cultivators more security and control of their plants. It also allows an "out of sight -out of
mind", situation where the criminal element may not be aware of the grows of medical
marijuana. Keeping the grows inside with air filtration helps keep the peace between
neighbors and communities.
This draft ordinance also helps inhibit the "commercial grows for sale", by the reasonable
restrictions it will have in place.
If I was to change anything in this ordinance, I would change any violations from an code
violation to a criminal misdemeanor enforceable by any State of California sworn Peace
Officer. This would not mean that the Sheriff s Deputies would have to go out and seek the
violations but that if a violation is reported they are authorized to respond and if needed
issue a misdemeanor citation. This would allow for a more streamline and swift mitigation of
the situation. Sothis change in the violation category would be my request for a change in
the ordinance.
Again, I ask for your support of the draft ordinance at the least and the change to a
misdemeanor violation at best.
