The representatives conducting the evaluation were Dan Cikuth- Associate Sanitary Engineer and Wendy Killou-Senior Environmental Scientist (Supervisor) Representing. the LPA were Mike Huerta-Program Manager and Amanda Aguiar-Senior REHS. The evaluation and report are mandated by California Health and Safety Code (CHSC) Section 116339(d). The purpose of the evaluation is to determine the P'rogram's status with respect to the objectives set forth in the Butte County LPA Work Plan for FY 2014- 2015 and compliance with the requirements set forth in the LPA Delegation Agreement (LPDA) and California Code of Regulations (CCR) Title 22, Sections 64263 through 64260. Theis report summarizes the fundings, directives, and recommendations of the Division as it relates to requirements of the LPA Program. The Division finds that Butte County is in compliance withal[ requirements of the current LPA Delegation Agreement. In addition, the LPA has substantially met the Program objectives that were outlined in the approved FY 2014-2615 work plan and the LPA Program requirements set forth in CCR Title 22, Sections 64253 through 64260. The findings of this evaluation are detailed in the enclosed Attachment A. Upon completion of the evaluation, Division representatives find the items listed below are required to be addressed by the Butte County LPA Program. By May 2, 2016, the LPA shall require groundwater systems that provide treatment to submit monthly operation reports.' The LPAshall review and track the operation reports to ensure that the treated water meets all primary and secondary drinking water standards. 2. Starting May 2, 2016, the LPA shall require that all SWTR systems send mgnth.[y reports of the filtration and disinfection compliance data to the LPA. The LPA must review, track, and follow-up on monthly SWTR reports to determine compliance with filtration and disinfection requirements. For<water system'ahat are in noncompliance with the SWTR, an add ressing'enforcement action-shall be issued. 3. By May 2, 2016, the LPA shall amend the FY 2016-2017 work plan by adding the following systems that did not receive a Permit in FY 2014-2015 work plan: • Concow School (PWS No. 0400064) • Paradise.Adventist Church (PMIS No. 0409190) 4. 'By December 31; 2016, the LPA shall evaluate all community and nontransient non community (NTNC)Water systems to`determine whether an SOC waiver is applicable far each source. The LPA shall use the criteria as stated in CCR Title 22, 64445 (d)(1) &(2)"'to determine if each`source can be designated as nonvulnerable. All SOC waivers are valid for a maximum of three years as stated in CCR Title.22,. Section 64.445 (d}(4}• NEW"REQUIll,EMENT 1. Beginning July 1, 2016, the LPA shall begin submitting to the Division in PDF format a copy of each citation, compliance order, and any court,filings issued by the LPA. Further guidance will be provided to the LPA from.the Division. (LPDA- Section 2.05 (a)(iii)) Brad Banner - 3 - March 22, 2016 RECOMMENDATIONS 1 The Division recommends that the LPA review water systems' water quality sampling data within their regulatory jurisdiction by either the LPA accessing the water quality sampling history via the DRINIC portal-Water Quality Inquiry database at ht.tr)ml/drinc.ca.,(iov/'dnri/,Ap u a..51 p icafions/WaterQ uali I _spj or logging directly into the Division Water Quality Inquiry database (request for logon credentials required). We suggest that this be completed during the file review, prior to conducting a sanitary survey, to ensure that a water system's contracted certified environmental health laboratory is successfully transmitting the water quality data electronically to the Division as required in CCR Title 22, Section 64469 (c). 2. Continue to comply with the electronic annual report (eAR) requirements as stated in the LPDA-Section 2.06. For the 2015 eAR, the Division will be evaluating compliance with this section based on submittals from community and non-transient non-community (NTNC) water systems 3. Continue to update the water quality monitoring and reporting requirement notices to water systems to include the following: contaminant name, storet code, frequency of sampling, and any other sampling and reporting requirements applicable to a water system. Provide the updated notices at a minimum frequency of three (3) years for community water systems and five (5) years for non-community water systems, for example, send with the annual fees., (LPDA- Section 2.04 (a)) 4. The LPA should create a tracking system to track and follow-up with water systems sanitary survey deficiencies to ensure that they are corrected in a timely manner, based on their priority. 5. Continue to review water system files to ensure that there is a current emergency notification plan (ENP) on file. The County should use the State approved format. This form should be updated annually or when there is a change in the contact information/emergency plan. In order to fulfill the annual evaluation requirement, we are requesting the LPA complete this forme to assist the Division in evaluating whether or not the LPA is in compliance with the requirements of the LPDA and has met the workplan goals. Please complete this form for the period from July 1, 2014— June 30, 2015 and email or mail it back to your District field office prior to the annual evaluation meeting. EVALUATION 1. Previous Year's Evaluation Directives - Check the directives- that have been completed or resolved. Section 116525 (c) of the CHSC grants the LPA authority to renew, reissue, revise, or amend any domestic water supply permit whenever the LPA deems it to be necessary for the protection of public health whether or not an application has been filed. The Department recommends the following prioritization scheme when issuing new permits for water systems: L Systems adding new facilities (wells, treatment, etc.) ii. Surface water systems iii. Systems treating for a primary MCL violation (Nitrates are of the highest priority of MCL violations) iv. Systems that are changing ownership. By April 1, 2014, the LPA is recommended to send a letter notifying all public water systems within their regulatory jurisdiction of the requirement to complete the electronic Annual Report (eAR) for calendar year 2013. Prior to a sanitary survey, the LPA is recommended to request a Water Quality Monitoring Report from CDPH to ensure that a water system's registered environmental health lab is successfully transmitting the water quality data electronically to CDPH, as stated in 22 CCR 64469(c). Continue to file and retain bacteriological water quality results for minimum of five (5) and chemical water quality results for minimum of ten (110) years in each water system file. Continue to file all correspondences, including enforcement letters, memoranda, or any other written records for a minimum of three (3) years. The County should utilize the CDPH Lead and Copper Rule database for tracking compliance with monitoring action level exceedances and monitoring and reporting of sampling for lead and copper.
