HomeMy WebLinkAbout19-273RESOLUTION TO TRANSFER AD -VALOREM PROPERTY TAX FROM THE DURHAM MOSQUITO ABATEMENT DISTRICT TO THE BUTTE COUNTY MOSQUITO AND VECTOR CONTROL DISTRICT WHEREAS, Section 99, Subdivision (b), Paragraph (5) of the Revenue and Taxation Code provides as follows: In the event that ajurisdictional change would affect the service area or service responsibility of one or more special districts, the board of supervisors of the county or counties in which the districts are located shall, on behalf of the district or districts, negotiate any exchange of property tax revenues; and WHEREAS, on June 7, 2018, the Butte Local Agency Formation Commission adopted Resolution No. 13 2017/18 approving LAFCO File No. 18-05 - Butte County Mosquito and Vector Control District - the Rice Lands Annexation/Detachment No. 1, which detached approximately 15,000 acres of service territory from the Durham Mosquito Abatement District and annexed this same territory to the Butte County Mosquito and Vector Control District thus transferring the responsibility for mosquito abatement services in this area to the Butte County Mosquito and Vector Control District; and WHEREAS, the Butte Local Agency Formation Commission determined this transfer of mosquito abatement services, from the Durham Mosquito Abatement District (DMAD) to the Butte County Mosquito and Vector Control District (BCMVCD) should include the following: "A Master Property Tax Shoring Agreement is in affect with Butte County that does not transfer any County shore of property tax to the District. DMAD's ad-volorem property tax revenue collected from the parcels within the territory shall be reassigned to BCMVCD", and WHEREAS, the Butte County Board of Supervisors has written a letter to the District Board Members and Executive Officers of DMAD and BCMVCD that notifies them of the Board's role in the process, identifies how the Board intends to proceed including the proposed resolution the Board may adopt, and requests, any comments the districts may have; and WHEREAS, the Butte County Board of Supervisors has considered all the information provided to it. NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby agrees that the ad -valorem, property tax assigned to the Durham Mosquito Abatement District will be transferred/reassigned to the Butte County Mosquito and Vector Control District because BCVMCD will assume responsibility for mosquito abatement services in the territory being annexed to it. vote PASSED AND ADOPTED by the Butte County Board of Supervisors this 22nd day of October, 2019, by the•' following AYES: Supervisors ILucero, Ritter, Teeter, and Chair Lambert NOES: ABSENT: Supervisor Connelly NOT VOTING: ATTEST: Shari McCracken, Chief Administrative Officer and Clerk of the Board of Supervisors Deputy Steve Lamb hair Butte County Board of Supervisors
