HomeMy WebLinkAbout19-282WHEREAS, the Board of Supervisors of Butte County has investigated options to provide electric services to
customers within the incorporated and unincorporated areas of the County; and
WHEREAS, the County of Butte has prepared in consultation with the City of Chico, a Feasibility Study for a
community choice aggregation ("CCA"), also known a!s Community Choice Energy program in Butte County and in the City
of Chico under the provisions ofthe Public Utilities, Code Section 366.2. The Feasibility Study shows that implementing a
CCA program has the potential toprovide multiple benefits, including:
a) Rate savings on participant's electrical bills;
b) Local control over power supply choice;
c) Local control over programs that further increase economic development;
dl Local control over energy related projects; and
WHEREAS, the County wishes to be a community choice aggregator and has adopted Ordinance 4166 as required
by Public Utilities Code Section 366.2 in order to, do so; a nid
WHEREAS, the City of Chico also wishes to be a community choice aggregator and has adopted Ordinance 2537
as required by Public Utilities, Code Section 3,66l.2 in order to, do so, and
WHEREAS, pursuant to Section 366.2, two or more entities authorized to be a community choice aggregator,
may participate asa group in a community choice aggregation program through a joint powers agency established
pursuant to Chapter 5 (commencing with, Section 6500) of Division 7 of Title I of the Government Code, ifeach entity
adopts the aforementioned ordinance; and
WHEREAS, the Board of Supervisors have considered the proposed Joint Powers Agreement, attached hereto,
under which Butte County and the City of Chico will form the Butte Choice Energy Authority ("BCEA") and both agencies
will become the initial members VfBCEAtand
WHEREAS, the Joint Powers Agreement will create and establish BCEA, and Butte County,the City ofChico, and
other cities orcounties that later choose to participate in BCEA aind the CCA program will have membership on the
Board ofDirectors ofBCEA as provided in, the Joint Powers Agreement if they execute the agreement and adopt the
ordinance required bythe Public Utilities Code; and
WHEREAS, BCE4mi|| enter into agreements with electric plower suppliers and other service providers, and based
upon those agreements, BCEA will be able to provide power to residents and business. once the California Public
Utilities Commission approves the implementation plan created by B[EA^ BCE8 will provide service to customers within
Butte County and within, the jurisdiction ofthe City mf Chico and those other cities and counties that choose 10 jmimBLEA
andtmparticipate inthe CCA program; and
WHEREAS, under Public Utilities Code section 866.2, customers have the right to opt -nut of the CCA program
and continue to receive service from the incumbent utility. Customers who wish to continue to receive service from the
incumbent utility will be able to do so.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Butte County hereby approves the Joint
Powers Agreement with the City of Chico to form the Butte Choice Energy Authority; and
BE IT FURTHER RESOLVED that the Chairman of the Board of Supervisors is hereby authorized and directed to
execute the Joint Powers Agreement on behalf of Butte County, which will establish BCEA with Butte County as an initial
member; and
BE IT FURTHER RESOLVED that the Board of Supervisors shall, at a future meeting, appoint two (2) Directors to
sit on the Board of Directors of BCEA; and
BE IT FURTHER RESOLVED that the Board of Supervisors shalll, at a future meeting, appoint up to two (2)
alternates to serve as (Directors of BCEA; and
BE IT FURTHER RESOLVED that the Chairman of the Board of Supervisors is hereby authorized to execute any
and all other necessary documents to enter into the Joint Powers Agreement to form BCEA..
