Please find attached the revisions per the motion of Notice of Intent to modify and add conditions to the submitted Staff Report for the Hunter Use Permit (UP 03-06) Mark Michelena Associate Planner Butte County Development Services Department Planning Division 1 ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Adopt a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project, as well as the conditions added to the project will mitigate such effects to a level of insignificance; and B. The Planning Commission has independently reviewed, analyzed, and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration reflects the independent judgment of the County of Butte; and II. Adopt a "de minimis" exemption regarding impact to fish and wildlife or their habitat. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat. The collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required. The project site is not known to contain any species identified as a candidate, sensitive, or special status species in local or regional plans, policies, or regulations, or by the California Department of Fish and Game or U. S. Fish and Wildlife Service. The project will not have a substantial adverse effect on any riparian habitat; have a substantial adverse effect on federally protected wetlands as defined by Section 404 of the Clean Water Act; interfere substantially with the movement of any native resident or migratory fish or wildlife species; conflict with any local policies or ordinances protecting biological resources; or conflict with the provisions of an adopted Habitat Conservation Plan. III. Approve the Use Permit for Greg Hunter for a charter school (quasi -public use), UP 03- 06, on APN 021-100-047, subject to the following findings and the conditions found in Exhibit "A": A. The proposed charter school will not create a need for new public facilities, services, and utilities because telephone and electrical services, and water and sewer already extend to the project parcel. B. The proposed use, even though not similar in character, would not have deleterious impacts on the surrounding neighborhood character because the proposed charter school would be small in scale and service up to no more than 60 students at any given time. C. The proposed charter school will not significantly increase vehicle traffic in the area. Due to the current Level of Service A, and the potential increase of 294 ■ Butte County Planning Commission Agenda Report 0 Page 6 ■ average daily trips, the project is expected to only generate a modest increase in traffic. D. The site is suited for the project with the respect to the Butte County General Plan designation (Low Density Residential), and Zoning (SR -5). E. The Planning Division has circulated the proposed use permit application for the charter school (quasi -public) to County and State Agencies and has received no evidence that the use, with appropriate conditions, would cause any other relevant impact. F. The project does not require the removal of any trees or riparian vegetation. The project will -not impact any vernal pools. G. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. k:\projects\upc\hunter\Hunter PC Agenda Report. doc 0 Butte County Planning Commission Agenda Report 0 Page 7 0 EXHIBIT A USE PERMIT BUTTE COUNTY PLANNING COMMISSION DATE: (Certified Mail Rec.) UP 03-06 PERMIT NO. 021-100-047 ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Greg Hunter is hereby granted a Use Permit for a charter school on APN 021-100-047. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 0 Butte County Planning Commission Agenda Report ■ Page 8 0 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. Light or glare generated by the use shall be contained on-site. (Mitigation Measure) Plan Requirements: All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered throughout the proposed use of the parcel. Monitoring: The Planning Division shall ensure that the mitigation measure is complied with by inspection in response to nuisance complaints. 2. Dust generated by the development activities shall be kept to a minimum with a goal of retaining dust on the site. Following the dust control measures listed below: a. During clearing, grading, earth moving, excavation, or transportation of cut or fill materials, water trucks or sprinkler systems are to be used to prevent dust from leaving the site and to create a crust after each day's activities cease. b. During construction, water trucks or sprinkler systems shall be used to keep all areas of vehicle movement damp enough to prevent dust from leaving the site. At a minimum, this would include wetting down such areas in the later morning and after work is completed for the day and whenever wind exceeds 15 miles per hour. C. Soil stockpiled for more than two days shall be covered, kept moist, or treated with soil binders to prevent dust generation." (Mitigation Measure) Plan Requirements: All requirements shall be shown on building plans. Monitoring: Building inspectors shall spot check and shall ensure compliance on-site. Butte County Air Pollution Control District inspectors shall respond to nuisance complaints. 3. Construction activities, including the arrival or departure of trucks, shall be limited to the hours of 7:00a.m. to 6:00p.m. on Monday through Friday and 9:00a.m. to S:OOp.m. on Saturdays. (Mitigation Measure) Plan Requirements: All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: The Planning Division and the Public Works Department shall ensure that the condition is adhered to. 4. To the extent practical, playground activities shall be located so as to create the maximum separation of those activities from the nearest residential property lines. (Mitigation Measure) Plan Requirements: All requirements shall be shown on the site plan. Timing: Requirements of the condition shall be adhered to throughout the operation of the Use Permit. Monitoring: The Planning Division shall ensure that the condition is adhered to. 5. HVAC equipment shall be designed, operated or located so as not to exceed a steady- state level of 50 dB at any nearby residential property lines. (Mitigation Measure) Plan Requirements: All requirements shall be shown on site and building plans. Timing: Requirements of the condition shall be adhered to throughout the operation of the Use Permit. Monitoring: The Planning Division shall ensure that the condition is adhered to. 6. The school shall provide for adequate on-site stacking of cars when students are dropped - off and picked -up during peak AM and PM hours to eliminate the number of off-site drop-off and pick-up of students. (Mitigation Measure) Plan Requirements: All requirements shall be shown on building plans. The school shall provide for twenty (20) on-site parking spaces to eliminate off-site parking by staff or students. (Mitigation Measure) Plan Requirements: All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: The Planning Division and the Public Works Department shall ensure that the condition is adhered to. 8. Maximum school capacity during scheduled hours shall be 60 students. 9. The California Charter Academy School located at 1446 Oregon Street, Gridley, shall be a closed campus. 10. Student drop-off and pick-up shall be on the property and not on the Oregon Street Frontage. 11. Fencing around the easterly portion of the property shall be solid wall or state approved chain link with landscaping for screening to be approved by the Butte County Department of Development Services. 12. The drainage ditch at the east end of the property shall be cleaned up of all dumped materials. 13. Fence proposed for the eastern property boundary shall either be located on the west side of the existing drainage ditch, or on the east side of the drainage ditch, which would then be filled and graded for the play area. 14. Three trash receptacles shall be installed at the pedestrian entries into the school. 15. Volunteers/Staff shall be on-site during drop-off and pick-up periods (roughly 7:45 to 8:30 a.m. and 2:30 to 4:00 p.m.). 16. Signs shall be provided stating that no parking between the hours of 7:30am to 3:30pm in the designated parking spots in the drop-off/pick-up stacking lane. 17. Upon approval from the City of Gridley, the applicant, at his expense, shall post signs designating the Oregon Street frontage as a no parking zone. 18. Upon approval from the City of Gridley, the applicant, at his expense, shall construct curb, gutter, and sidewalk from the north property line to the existing drop inlet on Yew Street. ❑ BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 11 ❑ 19. Upon approval from the City of Gridley, the applicant, at his expense, shall work with City of Gridley Public Works to install and maintain crosswalks at three locations: 1) across Sycamore Street at Oregon Steet; 2) across Oregon Street at Sycamore Street Intersection; and 3) across Yew Street at Oregon Street. 20. Upon approval from the City of Gridley, the applicant, at his expense, shall work with City of Gridley Public Works to install and maintain school zone signs. 21. All outstanding application processing fees shall be paid prior to issuance of the Use Permit. 22. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. California Deuartment of Fores / 23. /shall Construction, installation or development of structures or facilities on the parcels/lots �.� comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 24. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. Public Wnrkq 25 Prior to the issuance of building permits submit road and drainage improvement plans for the installation and construction of the street frontage improvements on Oregon Street to RS -2A standard, including, but not limited to, P.C.C. curb, gutter and sidewalk and the required street section in accordance with City of Gridley Standards. Construct or install the requirements. 26. Prior to the recordation of the issuance of building permits a plan for a permanent solution to drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Environmental Health 27. If meals will be prepared or served, then a commercial kitchen will be required. Such kitchen shall meet all applicable requirements of the California Uniform Food Facilities Law. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. City of Gridley 29. The proposed connection to the City of Gridley storm drainage collection system will require the use of stormwater detention facilities in accordance with Section 13.20.015 of the Gridley Municipal Code and the Gridley of Public Works Construction Standards. The Stormwater detention facilities shall be located on a public easement or right-of-way, or the property owner shall enter into an agreement with the City of Gridley (acceptable to the City Attorney) that requires the property owner to maintain the detention facilities in perpetuity. Said agreement shall be recorded, and shall run with the land. Pacific Gas & Electric 30. Any relocation or rearrangement of any existing facilities to accommodate this project will be at the expense of the developer. There shall be no building of structures, or the storage of any materials allowed over or under any existing PG&E facilities, or inside any easements that exists. I hereby declare under penalty of perjury I have read the foregoing conditions, they are in fact the conditions which were imposed upon the granting of this use permit, and that I agree to abide fully by said conditions. Oregon Street a public ublic two-lane road which directly serves six residences between Locust Street and Little Avenue. There are many streets and lots that are serviced by Oregon Street. The property is currently zoned SR -5 (Suburban Residential — 5 acre minimum) and the Butte County General Plan designation is Low Density Residential. Zoning on the adjacent parcels to the south, and east is SR -5. Parcels to the north and west are in the City of Gridley. Parcels in the area range in size from 0.14 to 8.7 acres with the predominant size being in the 0.25 to 1.0 g p on the surroundin parcels, are dwellings mostly at urban densities, with a acre range. TheJroject site is not within a 100 -year flood zone or airport area of influence. p ANALYSIS: The proposed charter school is being requested under section (c)(2) of the Suburban Residential zoning district (Butte County Code section 24-135), which states that quasi -public uses are allowed with a Use Permit. As a non-profit organization, the school meets the definition of a quasi -public use. Vehicle traffic generated by the development of the charter school would have minimal impacts during the peak am hours (7:30am. to 8:30am) during the drop-off of students and the afternoon pickup (2:30pm to 3:30pm). The school is proposed to have up to 60 students from kindergarten to twelfth grade. There is also an adult education proposed for afternoon and evening classes with up to 30 students each. The project is not expected to have a significant impact to vehicle traffic on Oregon Street. The project site is designated by the Butte County General Plan Land Use Element Map as Low Density Residential. The primary use under the Low Density Residential Designation is detached single-family residential dwellings at urban densities. The Charter School falls under the secondary use of quasi -public. The proposed use is, therefore, consistent with the uses envisioned for this area by the General Plan based on the site design criteria for the Low Density Residential designation that includes: 1. Needed for urban residential development within 20 years. The parcel has the potential for two residential dwellings. The proposed use would not have a significant effect on future residential development. 2. Adequate water supply. The site is served by public water through the City of Gridley. 3. Sewers available or natural conditions suitable for septic tanks. The site is served by public sewer through the City of Gridley. 4. Adjacent or near existing utilities, roads and single-family residential development. ■ Butte County Planning Commission Agenda Report ■ Page 2 ■ The site is in an urban area with existing roads, currently at Level of Service A, and utilities are available. 5. Good accessibility to commercial services, schools, fire protection and other community facilities. The site is located in an urban area that is located close to . fire protection services. The charter school will service the needs of the local community by providing an alternative school for those kids who need it. TheJroject site also falls within the Gridley Urban Reserve which developed policies to p designate areas that allow for future urban expansion. There are two policies that are applicable to this proposed project: 1. An residential lot which is now less than 5 acres which was legally created, pre- existing, and nonconforming may be developed according to its zoning and Any the provisions of Butte County Code 24-35. The zoning allows the proposed use, quasi public, with a Use Permit. 2. Development standards compatible with the City of Gridley shall be utilized for urban development projects with the city's established sphere of influence. Improvement standards are meeting, or exceeding the requirements of the City of Gridley. Asap art of the Use Permit request, the applicant is required to present information, including plans or other information that is substantial enough to enable decision makers to make an informed decision regarding the compatibility of the proposed project with existing zoning, g General Plan designation, and surrounding properties. The following finding is necessary for the Planning Commission to grant a Use Permit: "the proposed uses of property will not impair the integrity and character of the zone in p p p p which the land lies, and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and p g g safety of the residents of the county (Butte County Code, Section 24-45.10). To make the findings that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working n ithe neighborhood, the Commission should examine the existing uses in the g surrounding area. The character of the surrounding area is generally urban residential with p parcel arcel sizes within 1,000 feet of the subject property of approximately 0.2 acres. Thero osed charter school in not common to the area, but schools tend to be located within p p urban residential areas close to those who use the school. Thus, it appears that while the school is not consistent with the character of the area, it is a use that is complimentary to the area. As previously reviousl stated, the issue of a school (quasi -public) is an allowed use in the SR -5 zone. Pursuant to Butte Count Code section 24-45.15 the Planning Commission may impose County conditions upon the issuance of the Use Permit which are reasonably related to the use of the 0 Butte County Planning Commission Agenda Report ■ Page 3 ■ so property for which the Use Permit is requested. In addition the Planning Commission may at its p Y own discretion establish a date for either the termination of the use or review of the Use Permit. j Implementation of Project Conditions imposed by the Planning Commission will ensure p � compliance with all land use plans and policies and that the proposed project would not impair the health, welfare, or safety of Butte County residents. The proposed charter school and its activities have the potential to impact the environment and change the character of the area. The major compatibility issues with this project are traffic and noise. The fog llowin discusses the issues of all potential impacts as contained in the attached initial study. Traffic Oregon Street is a local collector road that provides access to the project site as well as many reside p Y residential parcels either directly or indirectly. In, addition to providing local access, Oregon a north -south connector, along Street is used as g with other streets, between Sycamore Street and The road surface is paved, with curb, gutter and sidewalk on the west side, and Little Avenue. on Y the east side directly north of the project site. To the south of the project site, there are no curb, gutter or sidewalks. The road does not carry a large traffic volume as evidenced by recent traffic count performed on Little Avenue; the average traffic count for a 24-hour period was 1701 daily trips. This q i equates to a Level of Service (LOS) A. Assuming the potential increase of 294 daily trips generated proposed nerated b the charter school, the future traffic would not exceed LOS A (9,600 trips for a 2 -lane surface street). Itxsep expected that most traffic would arrive at a scattered pattern in the morning, between • and 8:30a.m and in the afternoon between 2:45p.m and 3:30p.m. Impacts to Oregon 7.45a.m. , Street dropping will be due to the dro in off and picking up of students. Based upon this information, the vehicle traffic generated dropping off/picking p p p by the school use is not expected to cause any significant impacts to vehicle circulation in the proj ect area. It 1s recommended to the school that it initiate a program to use volunteers, and or staff, to assist children in exiting/entering car /enterin the quickly and safely with their school bags, in order to expedite q Y the drop-off/pick-up process. The off-street parking requirements, Butte County Code Section 24-240 (b), for elementary and intermediate schools are one (1) space for each classroom or office, and one (1) space for each employee and faculty member, but in no case less than three (3) spaces. For High School and Adult Education, one (1) space for each classroom or office, plus one (1) space for each ten (10) students attending class on the premises at any time during any twenty-four (24) hour period, plus one (1) space for each faculty member. The total number required is sixteen (16) spaces. 0 Butte County Planning Commission Agenda Report 0 Page 4 0 An additional four spaces were required to accommodate a potential higher driving usage by the adult education students. The County believes that this will more than cover the needed spaces for the average daily use of the school. On special events, the school is looking into using the open space play area as extra parking, to reduce on -street parking. Noise The noise issue related to the proposed project will be in three areas. The first is during construction, second is traffic, and third will be the outside play area and on-site equipment. The construction phase activities would add to the noise environment in the immediate vicinity of the school site. Activities involved in construction have the potential to generate maximum noise levels ranging from 85 to 90 dB(decibels) at a distance of 50 feet. Although construction activities would be temporary in nature and are anticipated to occur during normal daytime working hours, they will nonetheless, result in short-term periods of elevated noise levels. Therefore, this impact is considered potentially significant and in need of a mitigation measure. Increase in traffic noise due to the dropping off and picking up of students will be concentrated in the morning (7:45 to 8:30) and the afternoon (2:30 to 4:00). There will also be a small increase in traffic in the evening (6:00 to 9:00) due to the proposed night class Monday through Thursday). On average automobiles can create noise levels of 60 to 70 dB. The increase in noise levels related to the proposed project will not have a significant effect due to the small amount of additional traffic to the area and the times that the increase in traffic will occur. The ambient noise environment in the immediate vicinity of the school site will vary depending on whether or not the school is in session. When the school is not in session, the noise environment in the immediate vicinities is lower, consisting primarily of local and background traffic noise. When the school is in session the noise environment is higher, defined by increased local traffic (particularly gduring school arrival and departure hours), outdoor equipment, and outdoor activities on the school playground. Outdoor noise levels would increase as a result of having more people on the site. Outdoor school activities would be the main contributor to the increase. The increase would occur primarily rimaril when students are out of the classroom, which is a minor portion of the day. Community noise levels u to 65 dB CNEL are considered normally compatible with residential Co y p g uses. Children playing la in outside on the school grounds in relatively close proximity to the school lines could result in elevated noise levels at the nearest residences, generating maximum property . noise levels of up to 75 dB or more at those residential areas, depending on their proximity to the property line. But the noise CNEL level is averaged over a 24-hour period which would reduce p Y the noise level average below the normal 65 dB CNEL level which is compatible with residential tl g uses. Based on actual levels, the State -recommended maximum noise level standard could be exceeded at the nearest residential uses when children are playing loudly near those uses. The exceedingof the State -recommended noise standards would be due to the anticipated round activities and not due to the proposed school alone. A possible staggered playground playground 0 Butte County Planning Conin2ission Agenda Report ■ Page 5 0 ka time could possibly reduce the noise levels, but would also create more time that a slightly lower noise level is heard. It was determined that it would be better to have less total playground time at a higher noise level. Therefore, the impact of the school playground noise levels received at the nearest residences is considered to be potentially significant. Noise impacts associated with air conditioning systems tend to operate at a level of 55dB, which is below normal levels that would have a significant impact. But the introduction of air conditioning systems would result in new noise exposure to nearby residences. Therefore, the impact is considered potentially significant, requiring mitigation. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Adopt a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project, as well as the conditions added to the project will mitigate such effects to a level of insignificance; and B. The Planning Commission has independently reviewed, analyzed, and considered thep roposed Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration reflects the independent judgment of the County of Butte; and C. This project will not have an impact to fish and wildlife or their habitat, and a "de minimus" exemption regarding impact to fish and wildlife or their habitat is recommended. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5 is not recommended. II. Approve the Use Permit for Greg Hunter for a charter school (quasi -public use), UP 03- 05, on APN 021-100-047, subject to the following findings and the conditions found in Exhibit "A": A. The proposed charter school will not create a need for new public facilities, services, and utilities because telephone and electrical services, and water and sewer already extend to the project parcel. B. The proposed use, even though not similar in character, would not have deleterious impacts on the surrounding neighborhood character because the proposed charter school would be small in scale and service up to no more than 60 students at any given time. 0 Butte County Planning Commission Agenda Report 0 Page 6 0 C. The proposed charter school will not significantly increase vehicle traffic in the area. Due to the current Level of Service A, and the potential increase of 294 average daily trips, the project is expected to only generate a modest increase in traffic. D. The Planning Division has circulated the proposed use permit application for the charter school (quasi -public) to County and State Agencies and has received no evidence that the use, with appropriate conditions, would cause any other relevant impact. F. TheJ roject does not require the removal of any trees or riparian vegetation. The p project will not impact any vernal pools. G.
