The latest Use Permit we have in our files is UP 02-16, a 24 month permit which has not been established; thereby, declaring it null and void. Has the UP been updated? Use Permit 02-16 is for a 3,495 sq. ft. church. The plans state the building is 3,561 sq. ft. The minor upgrade in square footage is not a problem with the Fire Department— does it affect the Use Permit? 2. UP 02-16 requires: "Water for fire protection is required. The preferable system is a hydrant system capable of meeting the fire flow requirements. If this is not feasible, a system involving independent pumps, static water storage and dry standpipes may be substituted. Such a system is subject to the approval of the fire department. The available water flow from such a system must meet the general flow requirement. The minimum volume of water in storage must equal the fire flow for the type of project times 20 minutes. Provisions must be made to ensure the system is maintained to its design capacity. The above requirement per UP -02-16 was to be shown on all building plans. It is not shown on any plans. The fire flow for this project is: 1,500 gallons per minute (GPM) = 30,000 gallons of water storage (tank or well.) Fire Department Access: California Code of Regulations Title 19, Public Safety, Div. 1 State Fire Marshal, Chapter. 1 General Fire and Panic Safety Standards, Subchapter 1 Administration, Article 3 General Provisions, Section 3.05. Fire Department Access and Egress. (a) Roads. Required access roads from every building to a public street shall be all- weather hard -surfaced (suitable for use by fire apparatus) right-of-way not less than 20 feet in width. Such right-of-way shall be unobstructed and maintained only as access to the public street. County Road Standard 8 as noted on plan sheet C-1 will not suffice. Per Title 19 and Public Resources Code 4290 (SRA) the access road shall be hard -surfaced and capable of supporting 40,000 lbs. The parking area should also be capable of supporting the aforementioned weight. 4. Plan sheet "CS" failed to note that the project shall also comply with the latest edition of the California State Fire Marshal adopted 2001 California Fire Code. 5. In addition, Title 19 requires posting the assembly room's occupant load capacity. "Any room having an occupant load. of 50 or more persons where fixed seats are not installed, and which is used for assembly, classroom, and dining, drinking, or similar purposes, shall have the capacity of the room posted in a conspicuous place near the main exit from the room. Posting shall be by means of a durable sign having a contrasting color from the background to which it is attached. Signs shall be of an approved type and shall be maintained in a legible manner by the owner or his authorized agent and shall indicate the number of occupants permitted for each room use. No person shall deface or remove such signs except as authorized by the enforcing agency. ` Since no permanent seating is noted on the floor plan the following occupant loads shall be stated on the occupant load sign: Seating: 206 Dining: 96 6. All fire extinguishers shall be 2A: IOBC. 7. The following information is provided from Title 19 to further insure that the applicants have life safety guidelines at hand: s 3.08. Decorative Materials@ In every Group .A, E, I, R-1, R-2 and R-6 Occupancies all drapes, hangings, curtains, drops, and all other decorative material, including Christmas trees, that would tend to increase the fire and panic hazard shall be made from a nonflammable material, or shall be treated and maintained in a flame-retardant condition by means of a flame- retardant solution or process approved by the State Fire Marshal, as set forth in Subchapter 8, Chapter 1, Title 19, CAC. Exits, exit lights, fire alarm sending stations, wet standpipe hose cabinets, and fire extinguisher locations shall not be concealed, in whole or in part, by any decorative material. s 3.13. Fire Drills. (a) Group E Occupancies. (1) General. Every person and public officer managing, controlling, or in charge of any public, private, or parochial school shall cause the fire alarm signal to be sounded upon the discovery of fire. Every person and public officer managing, controlling, or in charge of any public, private, or parochial school, other than a two-year community college, shall cause the fire alarm signal to be sounded not less than once every calendar month at the elementary and intermediate levels, and not less than twice yearly at the secondary level, in the manner prescribed in Section 2-809, Part 2, Title 24, CAC, except that when a fire alarm system having a distinctive tone, and which is used for no other purpose, is installed, the manner of sounding such alarm shall not be subject to the provisions of Section 2-809 (c), Part 2, Title 24, CAC. A fire drill shall be held at the secondary level not less than twice every school year. (2) Emergency Pre -Fire Planning. Each school principal, district superintendent or day nursery manager shall, in cooperation with the enforcing agency, prepare procedures to be followed in case of fire or other emergency. They should include the following: (A) Posting of the telephone number of the fire department in the office and/or at the main switchboard. (B) Assignment of a responsible person to call the fire department upon notification of any fire or activation of the alarm system for any reason other than fire drills. Maintaining of order during evacuation. 2. Removal of roll call book and calling of roll when designated evacuation area is reached. USE PERMIT BUTTE COUNTY PLANNING COMMISSION DATE(Certified Mail Rec.) UP 02-16 USE PERMIT NO. 36-330-043 PARCEL NOs. Pursuant to the.provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below, the Church of God, Mennonite is hereby granted a Use Permit, in accordance with the application filed, to develop a 3,495 -square foot church building. This building shall be used as a church and includes a main sanctuary, three, 400 square foot classrooms, an office, and two restrooms. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental detennination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Prior to use of the site for the proposed use the applicant shall contact the Planning Division for a field inspection to verify that all conditions and ordinance requirements have been met. Conditions of Approval: Planning_ Division All new outdoor lights shall be fully shielded. Lights shall be directed downward and contained on-site. Direct light shall not be allowed on adjoining properties and roads. Plan Requirements: The condition shall be placed on the Use Permit. All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to while installing outdoor lighting and during all use of outdoor lighting. Monitoring: The Planning Division shall ensure that the conditions are placed on the Use Permit. The Planning Division shall ensure compliance through routine inspection. (Mitigation Measure # 1) 2. All outdoor trash containers shall be enclosed within a solid masonry wall or view - obstructing fence at least one (1) foot higher than the trash container. Plan Requirements: The condition shall be placed on the Use Permit. All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to during the installation of any outdoor trash receptacles. Monitoring: The Planning Division shall ensure that the conditions are placed on the Use Permit. The Planning Division shall ensure compliance through routine inspection. (Mitigation Measure #2) 3. Measures shall be taken to control fugitive dust emissions from all civil construction associated with development of the site. Standard Mitigation Measures to prevent or reduce fugitive dust emissions can be obtained from the Butte County Air Quality Management District. Plan Requirements: The conditions shall be placed on the Use Permit. All requirements shall be shown on building plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: The Planning Division and the Public Works Department shall ensure that the conditions are placed on the Use Permit. Building inspectors shall spot check and shall ensure compliance on-site. Butte County Air Pollution Control District inspectors shall respond to nuisance complaints. (Mitigation Measure # 3) 4. Prior to Use Permit issuance, a tree plan prepared by a certified arborist, botanist, or landscape architect shall be provided to the Planning Division. The Plan shall be prepared in accordance with the following 2 • Site improvements shall be made in coordination with the tree plan to ensure that development occurs in areas that would provide a minimum amount of disturbance with native oak trees and result in fewer trees being removed. • The applicant shall minimize the removal of trees deemed suitable for retention. The plan shall show the location of trees deemed suitable for retention, and trees to be removed. • Factors used to assess suitability of trees shall include health, location, and size of the tree. The plan shall encourage the retention of larger, healthier trees over smaller or diseased trees. • Each tree to be preserved in the vicinity of construction activities shall be surrounded by a tree zone identified by the drip line of the tree. An orange plastic fence or other suitable type of fence shall be used to identify the tree zone during construction activities to ensure that construction equipment does not compact the soil surrounding the tree. No vegetation removal, soil disturbance, or other development activities shall occur within the tree zone in order to protect root systems and minimize compaction of the soil. Plan Requirements: No vegetation removal, grading, road construction, or other earthwork shall be permitted until the tree plan is submitted and approved. Timing: The tree plan shall be submitted to the Planning Division prior to site development and Use Permit issuance. Monitoring: The Planning Division shall ensure compliance through routine inspection and review. (Mitigation Measure #4) Perform the following requirements to minimize soil erosion: (a) All graded slopes, over 5 feet in height shall be seeded, planted, mulched/hydroseeded, or otherwise protected to prevent soil erosion. (b) Structures, dumping, fill material, vegetation removal, and/or excavation shall not be allowed in areas having a slope of 30% or greater unless an Erosion Control Plan prepared by a registered civil engineer or other qualified professional is submitted to and approved by the Department of Public Works. Plan Requirements: The erosion protection measures shall be implemented during all times of construction where graded slopes are created over 5 feet in height or where development is proposed in areas of 30% slope or greater. Timing: This measure shall be implemented during site preparation and construction. Monitoring: The Planning Division shall coordinate with the developer and perform routine inspections to ensure compliance. (Mitigation Measure #5) 6. All development activity shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday, and 10 a.m. to 6 p.m., Saturday, Sunday, and holidays. Plan Requirements: The mitigation shall be placed on the Use Permit as a condition and shown on all building plans. Timing: The mitigation shall be applicable during all construction activity. Monitoring: The Department of Development Services shall be responsible for ensuring compliance with this mitigation. (Mitigation Measure #8) 7. The applicant or developer shall be required to submit a development impact fee for Sheriffs facilities to be paid pursuant to the provisions of Chapter 3, Article II of the Butte County Code, prior to issuance of building permits. The fee amount would be determined and calculated as of the date of application for the building permit. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The mitigation shall be required prior to the issuance of building permits. Monitoring: The Butte County Planning Division and Building Division shall ensure compliance. (Mitigation Measure #9) 8. Thirty -Two (32) parking stalls shall be provided, two of which shall be disabled parking stalls. In accordance with Butte County Code Section 24-240.10 (e), an additional 5 percent of the gross lot area (approximately 850 square feet) shall be devoted to landscaping. Each planter area shall be surrounded by a six-inch raised concrete curbing or equivalent. An irrigation system shall be installed in each separate planter area. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. Timing: The mitigation shall be required prior to the issuance of building permits. Monitoring: The Butte County Planning Division and Building Division shall ensure compliance. (Mitigation Measure #10) Public Works 9. Prior to site development and building permit issuance, a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how stormwater drainage shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no net increase in the peak flow runoff to said channel or facility. Plan Requirements: The mitigation shall be placed on the Use Permit and shown on all building plans. 4 Timing: The drainage plan shall be required prior to the issuance of building permits. Monitoring: The Department of Public Works shall be responsible for ensuring compliance with this mitigation. (Mitigation Measure #7) 10. Prior to issuance of Building Permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in the County Improvement Standards. 11. Prior to issuance of Building Permits deed to Butte County, in fee simple, 40 feet of right-of- way from the centerline of Foothill Boulevard. The right-of-way shall be sufficient for the installation of a standard No. S-5 sign at all street intersections. California Department of Forestry/Butte County Fire 12. Perform the following to the satisfaction of the Butte County Fire/California Department of Forestry: (a) Construction, installation or development of structures or facilities within this development shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulation in effect at the time of application for improvement permits. (b) Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. (c) Water for fire protection is required. The preferable system is a hydrant system capable of meeting the fire flow requirements. If this Use Permit or any finding, action or condition of this Use Permit is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. I hereby declare under penalty of perjury that I have read the foregoing conditions, that they are in fact the conditions which were imposed upon the granting of this use permit, and that I agree to abide fully by said conditions.
